STATEMENT OF GROUNDS (1)STATEMENT OF GROUNDS
The property that is the subject of this petition is located at 49 Essex Street (the “Property”) in the R-2
Zoning District. There is one four-family dwelling situated on the Property. The petitioner is proposing to
replace the existing narrow and winding unit way of egresses with new exterior egresses. The 2nd floor
units would include a raised landing and stairs totalling 178 square feet area. The 1st floor unit "1L" will
have a 6.5'x3' raised landing built leading down to ground level. The 1st floor unit "1R'' will have a 3'x4'
raised landing also leading down to ground level.
The existing structure on the Property is legally non-conforming under Section 3.3.1 of the
Zoning Ordinance and may be altered by a Special Permit issued under Sections 3.3.3 and 3.3.5 upon a
finding that the alteration is not substantially more detrimental to the neighborhood than the existing
nonconforming structure.
Based on the criteria set forth in Section 9.4.2 of the Ordinance authorizing the issuance of
Special Permits, the benefits of the proposed change to the building will outweigh any adverse
effects for the following reasons:
A.The improvements to the egresses will create units that are easier to move furniture in/out of
and subsequently a more desirable housing unit which is much needed in the city. This will also allow for
improved emergency exit access without winding stairs and overly narrow doors/hallways;
B.There will be no changes to parking or traffic flow as a result of the proposed alteration;
C.Adequate public utilities and services already exist to serve the Property and demand on
those services will not be impacted by the proposed changes.
D.There should be no significant impact on the natural environment, including drainage;
E.The proposed second egress doors would be located in the rear of the building which would not be in
eyesight from Essex Street nor Bentley Street and would conform with the neighborhoods character,
similar to 47,48,52,53 and 54 Essex Street;
F.The proposed improvements to the Property will cause its assessed value to increase and
result in a positive fiscal impact on the City.
For these reasons, I feel there is adequate grounds for the Board to grant the requested relief.
