The Application was prepared and submitted to MassDEP on behalf of the City of Salem(the City) by Tighe &Bond, Inc. of Portsmouth,New Hampshire. DISCUSSION In 2015,waste handling operations at the Salem Transfer Station ceased,with the exception of a temporary drop-off area for residential yard waste. The Salem Ash Landfill(the Landfill)is also located at the site (the transfer station and the landfill are collectively referred to as the Site). The Application proposes the temporary storage of approximately 500 cubic yards (cy) of street sweepings at the Site. As discussed in the Application,the street sweepings were generated by the City of Salem Department of Public Works (DPW) during 2018 and are currently stored at the DPW yard at 5 Jefferson Avenue in Salem,MA(DPW Yard). A site plan showing the proposed stockpile location is included as Appendix A of the Application. The Application states the City will install hay bales on the downgradient side of the temporary stockpile to control storm water runoff. On November 29, 2018, Tighe&Bond submitted a completed application certification signed by the Engineer of Record and the Town in response to MassDEP's November 23, 2018 request for additional information regarding the Application. DECISION MassDEP has reviewed the Application pursuant to 310 CMR 19.000,the Solid Waste Management Regulations and approves the Application subject to the City's compliance with the conditions of this decision imposed by MassDEP pursuant to 310 CMR 19.043(1),Items Subject to Conditions. This decision is issued by MassDEP pursuant to M.G.L. Chapter 111, § 150A and the implementing regulations thereunder at 310 CMR 19.000. In the event this approval conflicts with all or parts of prior plans or approvals issued pursuant to Chapter 111, § 150A,the terms and conditions of this approval shall supersede the conflicting provisions of the prior approvals. This decision does not relieve the City, or any other person, of the responsibility to comply with all other applicable federal, state and local statutes,regulations and requirements. This decision allows the temporary storage of street sweepings as shown on the site plan included with the Application. In issuing this decision,MassDEP is not approving the reuse of street sweepings or any other material at the Site, and is not authorizing any disturbance or modification of the Landfill. CONDITIONS 1. By no later than December 31, 2018,the City may relocate up to 500 cubic yards of street sweepings from the DPW Yard to the Site. The City may not bring in any other street sweepings to the Site. 2. The City shall not store more than 500 cubic yards of street sweepings at the Site: 3. All street sweepings stored at the Site shall be stored as proposed in the Application and shall only be stored at the location shown on the site plan included with the Application. 4. Storm water controls(e.g., hay bales) shall be installed and maintained around the downgradient side of the temporary street sweepings stockpile to prevent erosion and sedimentation of wetland resource areas. 11130118 SALEM—Salem Transfer Station Page 3 of 5 Temporary Storage of Street Sweepings(BWP SW45/Authorization Number: SW45-0000013) 5. All street sweepings stored pursuant to this decision shall be removed from the Site no later than May 31, 2019. 6. All street sweepings removed from the Site shall be managed pursuant to applicable state and federal regulations including,but not limited to,the management of solid waste in accordance with 310 CMR 19.000 and shall be either disposed of off-site at a disposal facility permitted for the disposal of solid waste, or reused in accordance with an approval issued pursuant to the requirements of 310 CMR 19.060. 7. Within fifteen(15) days of the removal of the street sweepings,from the Site,the City shall submit to MassDEP a written report documenting the removal of the street sweepings and identifying any off-site disposal location and any reuse of the street sweepings. 8. The City shall comply with 310 CMR 19.000, the Solid Waste Management Regulations, including, but not limited to,the requirements established at 310 CMR 19.043(5), Standard Conditions. 9. The City shall comply with 310 CMR 40.0000,the Massachusetts Contingency Plan including, but not limited to, section 310 CMR 40.0114:Solid Waste Management Facilities. 10. The City shall ensure persons conducting activities at the Site are familiar with the applicable provisions of this permit and the approved plans, and that all work performed at the Site complies with 310-CMR 19.000 and the applicable requirements of this decision. 11. The City shall not cause or allow nuisance conditions to exist as a result of the activities subject to this decision. In the event any nuisance conditions occur,the City shall take the necessary measures to abate and eliminate said nuisance conditions,including,but not limited to, ceasing or reducing the storage and separation activities, and taking the necessary actions to prevent the conditions from re-occurring. 12. The City shall,without limitation, implement Best Management Practices to prevent the occurrence of nuisance conditions. This shall include, without limitation,measures to prevent wind-blown dust and litter, fugitive dust emissions, odors,noise, and potential public health issues associated with the activities subject to this decision. Water shall not be used for dust control in amounts that produce excessive infiltration,ponding,runoff or erosion. 13. The City shall notify the Chief of the Solid Waste Section in MassDEP's Northeast Regional Office or other individual designated by MassDEP in writing,within twenty- four(24)hours of receiving a nuisance complaint regarding the activities subject to this decision. This written notification shall be made by FAX to MassDEP's Solid Waste Management Section,Northeast Regional Office at(978) 694-3499 or by email to mark.fairbrothcrra?mass.jzov. Any additional activities or modifications not described in the Application(Number: 18-SW45-000018-APP)may require notification of MassDEP, and the preparation and submittal of a separate application for permit modification. 15. MassDEP reserves the right to rescind, suspend or modify this approval based upon a determination that the project causes or contributes to the development of nuisance conditions, is not being operated safely or in accordance with this approval, or results in a threat to the public health, safety or the environment. NOTICE OF RIGHT TO.APPEAL The City of Salem(the City) is hereby notified that it may within twenty-one (21) days file a request that this decision be deemed a provisional decision under 310 CMR 19.033(4)(b),by submitting a written statement of the basis on which the City believes it is aggrieved,together with any supporting materials. Upon timely filing of such a request, the decision shall be deemed a provisional decision with an effective date twenty-one (21) days after the Department's receipt of the request. Such a request shall reopen the administrative record, and the Department may rescind, supplement, modify, or reaffirm its decision. Failure by the City to exercise the right provided in this section shall constitute a waiver of the City's right to appeal. Appeal. Any person aggrieved by the issuance of this decision, except as provided for under 310 CMR 19.033(4)(b), may file an appeal for judicial review of said decision in accordance with the provisions of M.G:L. c. 111, s. 150A, and M.G.L. c. 30A,not later than thirty(30) days following the receipt of the final decision. The standing of a person to file an appeal and the procedures for filing such appeal shall be governed by the provisions of M.G.L. c. 30A. Unless the person requesting an appeal requests and is granted a stay of the terms and conditions of the decision by a court of competent jurisdiction,the decision shall remain effective. Notice of Action. Any aggrieved person intending to appeal this decision to the Superior Court shall first provide notice to the Department of their intention to commence such action. Said notice of intention shall include the Department file number and shall identify with particularity the issues and reasons why it is believed the decision was not proper. Such notice shall be provided to the Office of General Counsel of the Department and the Regional Director for the regional office which processed the application.
