Dear Ms. Morin,
I am writing to you with regard to Section VI1 C.4 a of the Salem
Zoning Ordinance, and a complaint reviewed by this office concerning
your alleged violation of the Ordinance through the parking of a
commercial vehicle in your driveway.
I would respectfully request that this practice be halted. If not,
further action will necessarily be taken.

Dear Councillor O'Leary:
There is presently no city ordinance or state law in
effect that prohibits the parking of commercially registered
vehicles in residential areas of the city.
To my knowledge no such law or ordinance exists in any
of the surrounding communities . Any attempt to enact such
legislation would, in my opinion, pose a hardship to numerous .
working people and business owners in the city.
With regards to the parking of The_Salem Trolley, a com-
mercially registered vehicle at C6 Cauldron Cour£; no-.violation
of any existing law, ordinance or zoning-reguiat-ion-has occurred.

Dear Councillor O'Leary:
Last night you made a statement concerning your recent
efforts to have the Salem Trolley prohibited from parking on
Caldron Ct. In particular you made a remark that your efforts
in this regard were somehow "sandbagged" by myself or this
department. In support of that remark you made reference to an
opinion rendered by the City Solicitor on March 7, 1985 , concern-
ing the parking of a ten wheel tractor-trailer truck. Enclosed
is a copy of that opinion for your review.
If you had read that opinion carefully, you would have noted
that the offending vehicle in this case was parked on private
property, which is a violation of the zoning ordinance. In the
case of the Salem Trolley the vehicle is parked on a public way,
.and as I stated in an earlier communication to you, no present
city ordinance or state statute is being violated by the parking
of a commercial vehicle (The Salem Trolley) on a public way.
I would, therefore, ask that you refrain from making state-
ments that cast. unfavorable aspersions on myself and the Salem
Police Department with regards to this matter .

Dear Mr . McIntosh:
You have requested my opinion as to whether or not the
use of a ten-wheel truck tractor to arrive, park overnight,
and leave an owner' s property in a residentially-zoned dis-
trict constitutes a permitted use under the Zoning Ordinance .
Section V of the Zoning Ordinance clearly states that
the use you make reference to is not a permitted use in a
residential zone . Accordingly, such a use is a clear viola-
tion of Section V of the Zoning Ordinance .
