Northeast.Wetland Restoration would be happy to provide you with a plan to reclaim the
wetland resource impacted during the site development project on Laurier Road in Salem
Ma:_From the information and descriptions you have provided me the resource
reclamation should be fairly straight forward,however, as with every resource impact,we
will need to formulate a longterm invasive species management plan for,the resource
area;
Wetland impacts in all but the most pristine settings are prone to the establishment of a
-handful of invasive wetland species. Once established in an area they have a tendency to
spread throughout the resource degrading the wetland functions and wildlife values.
`-Some of these invasive species are more impacting than others, and considering that the
resource we are focusing on is located in the mid point of a riparian resource there is a
high probability that these invasive species already exist in the resource and possibly
even in the existing seed bed of the impacted area. In situations like these if the resource
recovery plan does not consider the longterm trajectory of the impact area one of the
three main invasive species will establish a mono culture in the disturbance area and hold
the site in a suspended trajectory of lower than desirable wetland and wildlife values.
One of the ways that Northeast Wetland Restoration prefers to handle situations like
these is to look beyond the here and now and develop a longterm trajectory plan for the
site that is based on site specific growing conditions that will prevent the invasive species
from becoming the dominant plant community. As the site evolves native species will
prevent the'invasive species from overtaking the site.
During this time of the season it is difficult to establish the precise growing conditions at
a site. It is possible to determine the resource type and the dominant vegetation
community but often times the minor plant communities and grass species that define the
precise site.hydrology are not identifiable during the winter season. For instance a-red
maple swamp can have a number of different plant communities established in the under
story of e primary plant community. Each different secondary plant community is
sustained by a dynamic equilibrium based on the precise growing conditions for that
location in the resource area. By using these site specific growing conditions to the
advantage of the native species best suited for these conditions we will be able to develop
an invasive species control plan that will ensure that the longterm site trajectory will be a
self sustaining resource that is not dominated an invasive species. Because the majority
of these secondary species are herbaceous or as in the case of grasses, are difficult to
identify during the winter, it is best to develop a recovery plan during the spring when we
are able to define the site specific growing conditions.
By defining the site specific or precise growing conditions in the spring we will be able to
identify a number of secondary wetland species as they immerge in the spring and we
will be able to observe the spring high water growing conditions. The next most common
variable will be the flashyness of the system which will be identifiable by the primary
plant community.
The majority of the reclamation plan is defined by the preexisting elevations prior to the
disturbance. Reclaiming these elevations will not be difficult because the site was not
tilled prior to filling and the filling process was completed less than one year ago.
Because wetlands are anaerobic environments the existing vegetation layer does not
decompose and will be intact under the fill. We will use this plant material layer to
define the excavation efforts. We have successfully used this technique on salt marsh
sites that were filled more than 60 years prior to our restoration efforts. Once that the site
specific conditions can be determined we have that ability to determine a nursery stock
list and define planting areas.

Re: Denial of Request to Issue a Certificate of Compliance—DEP#64-360-7 Laurier
Road, Salem, Massachusetts
Dear Mr. Tremblay:
On the December 9, 2005 regularly scheduled Salem Conservation Commission Meeting, the
Salem Conservation Commission reviewed the Request for Certificate of Compliance submitted
by Griffin Engineering on November 21, 2005 for the above referenced property.
The As-Build Plans dated November 16, 2005 and the cover letter from your hired engineer lists
a number of deviations from the approved Site Plan and Order of Conditions. After review and
inspection of the site, the Commission has determined that these deviations are considered
significant changes, and in one instance a deliberate violation of the Massachusetts Wetland
Protection Act. In order for the Commission to issue a full Certificate of Compliance you must
comply with your Order of Conditions and the approved site plans titled Conservation Plan for
Street Extension and Single-Family Residence 7 Laurier Road, dated December 16, 2003.
Following are each significant change and/or violation and the corresponding action required to
comply:
• Cleaning of 24-inch drain line—The approved site plans specifically state in Note #8 that
"the 24-inch drain line shall be cleaned after the establishment of vegetation and prior to the
Conservation Commission issuing a Certificate of Completion". As of this time the
Commission does not have proof that this has been completed. Proof must come in the
form of a CCTV color video, 360 pan/tilt recording of the drain line from the catch basin
on your property south to the catch basin on Laurier Road.
• Catch Basin on Laurier Road—The approved plans show that the catch basin must
include a 4-foot sump and hood. The as-built plans confirm that the catch basin was
installed in the right location but without the 4-foot sump and hood. You must replace the
existing catch basin with the approved 4-foot deep sump
catch basin w/hood. Prior to
replacement you are required to obtain a street opening permit from the City of Salem
Department of Public Works (DPW).
• Deck and stone patio in the rear of the house—Condition #49 of the Order of
Conditions states that "the area between the rear property line of 31 Wilson Street and the
propose paved drive way shall be maintained as a lawn area.....any changes to this area
requires the homeowner to seek approval from the Conservation Commission prior to any

modifications". You must remove the deck and stone patio or file a Notice of Intent with
the Conservation Commission to seek approval of the after-the-fact deck and stone patio.
• Fence on top of Concrete Headwall—The original chain link fence installed on top of the
concrete headwall that was damaged was replaced with a wooden picket fence. The
Easement Agreement between you and City of Salem DPW states that the City is
responsible for maintaining the culvert and headwall. Neither the Conservation Commission
nor the DWP permitted you to replace that fence. This fence must be replaced with the
same size,height, and gage chain link fence as was pre-existing.
• Curbing along Castle Hill Playground—The Commission required you to locate granite
curbing along the southern portion of Laurier Road fronting Castle Hill Playground-to —
ensure that no vehicles would park on parkland. The granite curbing must be installed
according to the approved site plans.
■ Illegal Filling of Wetlands— The as-build plans show that the lawn area on the west side
of the garage was expanded approximately 1,350 square feet. As you are aware, the
Commission met with you when you filed a Request for a Determination of Applicability to
install a fence along the western property line and the request to clean the brook and culvert,
which was eventually withdrawn. At that site visit the commission expressed their concerns
with the conditions of the erosion control measures relative to your DEP #64-360 project.
At that time the side yard was not learned and seeded as of yet and stockpiled soil was
located roughly 10-feet from the dilapidated hay bales and siltation fencing. At that time,
you agreed to remove the fill, replace the dilapidated hay bales, and stabilize your lawn area
inside the approved hay bale line by loaming and seeding. Following the request submitted,
the Commission members had a follow-up site visit to your property and noticed a
discrepancy with the amount of lawn in said area. The Commission members noticed that
the hay bales you agreed to replace had been restored, but moved some 15-20 feet
encroaching into direct Boarding Vegetated Wetland (BVW). The As-Built Plans affirm the
Commission's belief that there was illegal filling and has issued you the enclosed
Enforcement Order to restore the wetlands that you filled. A Wetland Scientist must submit
a Planting and Replication Plan on your behalf on or before the Conservation Commission's
Meeting on February 23 s or we will begin assessing fines of $200 a day against you until
such plan has submitted for review and approval.
These deviations are significant and must be resolved prior to requesting another Request for a
Certificate of Compliance. The wetland filling issue must be addressed prior to the allotted time
frame or the Commission will levy fines against you.

Dear Chairman,
In accordance with the approved wetland replication plan Hancock Associates has conducted the
second mid-growing season inspection to determine the overall health of the replication area.
The property owner installed 6 highbush blueberry shrubs (Vaccinium corymbosum) in a
staggered row along the base of the wall. The plants are thriving and display fruit,and all of the
plants appear to be surviving the stress of the summer's heat at this time.The property owner has
also installed 2 chokeberry shrubs (Aronia arbutifolialmelanocarpa) and 2 winterberry shrubs
(Ilex verticillata) along the edge of the restoration area.These shrubs are healthy and appear to be
standing up to the summer weather. No additional plantings are needed at this time.
The herbaceous layer is densely vegetated with healthy plants,with the exception being a small
area in the southern end of the replication area that has patches of brown grass.The homeowner
has been instructed to keep an eye on this area and plant addition seed if necessary. The area is
stabile and it is recommend that the homeowner remove the haybales and silt fence at this time.
The density of the herbaceous layer has aided in preventing invasive species from encroaching on
the replication area and the homeowner has been removing the occasional invasive plant by hand.
It is not recommended that any further maintenance activities occur at this time.

Dear Chairman,
The purpose of this letter is to inform you that Hancock Associates has been retained by the
property owner,Mark Tremblay,to supervise the construction of the wetland replication area and
to provide any future monitoring reports that may be required by the Commission.
It is anticipated that the construction of the wetland replication area shall be complete by the end
of the day on November 3, 2006.The proposed replication shall adhere to the Wetland
Restoration Program provided by Wetlands Preservation Inc(dated 6/8/06)and the following
construction sequence plan:
November 2— Grade replication area to match existing wetland grades and establish a proper
hydrologic connection to the wetland.
Remove concrete,asphalt,and other debris from wetland by hand.No
mechanized equipment shall enter the wetland.
Construct small wall separating upland area from wetland replication area.
November 3 — Install wetland plants. Disperse wetland seed mix and cover disturbed area with
hay to stabilize soil.
Seed and stabilize adjacent disturbed upland area.
The Wetland Restoration Program provided by Wetlands Preservation Inc. requires the property
owner to install approximately 6 highbush blueberry shrubs (vaceinium corymbosum)along the
base of the proposed wall. The property owner proposes to install and addition 3 shrubs along the
border of the existing wetland in order to protect the area from invasive species. The additional
shrubs shall be a chokeberry species (Aronia arbutifolia or melanocarpa).

Dear Chairman,
The wetland replication efforts have been completed in substantial compliance with the
Wetland Restoration Program prepared by Wetlands Preservation Inc., and Construction
Sequencing plan submitted by Hancock Associates. The wetland plants were not installed
on November 3`d as anticipated due to the length of time it took to construct the wall. The
plants were installed on the morning of November 6 h.
The applicant has graded the restoration area to match the grades of the adjoining
wetland. An erosion control barrier consisting of a silt fence has been installed along the
edge of the restoration area abutting the existing wetland. An erosion control barrier
consisting of silt fence and haybales has been installed along the edge of the restoration
area that abuts the stream. The property owner placed several haybales around the catch
basin located at the end of Laurier Road during the construction process, and these
haybales were removed on the morning of November 6d'after all of the disturbed areas
had been stabilized.
The property owner installed 6 highbush blueberry shrubs (Vaccinium corymbosum) in a
staggered row along the base of the wall. The property owner has also installed 2
chokebery shrubs (Aronia arbutifolia/melanocarpa) and 2 winterberry shrubs (Ilex
verticillata) along the edge of the restoration area. The additional shrub species were
selected to provide a variety of habitat niches,nesting cover and food sources for birds
and small mammals. The density of planting in the restoration area will also contribute to
a long-term improvement of wildlife habitat by inhibiting the growth of invasive species.
Once the shrub component had been installed the area was seeded as specified in the
Restoration Plan. The amount of seed placed in the wetland restoration area far exceeds
the required amount, and thus should provide a dense herbaceous cover and help prevent
the spread of invasive species. The area was then covered with hay to stabilize the
disturbed soils.
A monitoring report shall be submitted to the Commission in July 2007. The report shall
detail the survival rate of the shrubs, density of plant growth in the herbaceous layer, and

needed, in regards to invasive species removal or additional plantings to ensure the long-
term health of the restoration area.
The property owner is requesting the Commission grant permission to remove the portion
of the silt fence that abuts the existing wetland. The will allow for a proper hydraulic
connection to be made.

Failure to comply with this Order may constitute grounds for additional legal action. Massachusetts
General Laws Chapter 131, Section 40 provides: 'Whoever violates any provision of this section(a)
shall be punished by a fine of not more than twenty-five thousand dollars or by imprisonment for not
more than two years, or boar, such fine and imprisonment; or(b)shall be subject to a civil penalty not
to exceed twenty-five thousand dollars for each violation". Each day portion thereof of continuing

Following the review of the above-referenced Notice of Intent and based on the information provided
in this application and presented at the public hearing, this Commission finds that the areas in which

C. General Conditions Under Massachusetts Wetlands Protection Act
(only applicable to approved projects)
1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory
measures, shall be deemed cause to revoke or modify this Order.
2. The Order does not grant any property rights or any exclusive privileges; it does not authorize any
injury to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying with all
other applicable federal, state, or local statutes, ordinances, bylaws, or regulations.
4. The work authorized hereunder shall be completed within three years from the date of this Order
unless either of the following apply:
a. the work is a maintenance dredging project as provided for in the Act; or
b, the time for completion has been extended to a specified date more than three years, but less
than five years, from the date of issuance. If this Order is intended to be valid for more than three
years, the extension date and the special circumstances warranting the extended time period are
set forth as a special condition in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill.Any fill shall contain no trash, refuse,
rubbish, or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard,
pipe, tires, ashes, refrigerators, motor vehicles, or parts of any of the foregoing.
7. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such
an appeal has been taken, until all proceedings before the Department have been completed.
8. No work shall be undertaken until the Order has become final and then has been recorded in the
Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title
of the affected property. In the case of recorded land, the Final Order shall also be noted in the
Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to
be done. In the case of the registered land, the Final Order shall also be noted on the Land Court
Certificate of Title of the owner of the land upon which the proposed work is done. The recording
information shall be submitted to this Conservation Commission on the form at the end of this Order,
which form must be stamped by the Registry of Deeds, prior to the commencement of work.

10. Where the Department of Environmental Protection is requested to issue a Superseding Order, the
Conservation Commission shall be a party to all agency proceedings and hearings before DEP.
11. Upon completion of the work described herein, the applicant shall submit a Request for Certificate of
Compliance (WPA Form 8A) to the Conservation Commission.
12. The work shall conform to the plans and special conditions referenced in this order.
13. Any change to the plans identified in Condition #12 above shall require the applicant to inquire of the
Conservation Commission in writing whether the change is significant enough to require the filing of a
new Notice of Intent.
14. The Agent or members of the Conservation Commission and the Department of Environmental
Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours
to evaluate compliance with the conditions stated in this Order, and may require the submittal of any
data deemed necessary by the Conservation Commission or Department for that evaluation.
15. This Order of Conditions shall apply to any successor in interest or successor in control of the
property subject to this Order and to any contractor or other person performing work conditioned by
this Order.
16. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated Wetland,
the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden
stakes or flagging. Once in place, the wetland boundary markers shall be maintained until a Certificate
of Compliance has been issued by the Conservation Commission.
17. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully
stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or
water body. During construction, the applicant or his/her designee shall inspect the erosion controls
on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately
control any erosion problems that occur at the site and shall also immediately notify the Conservation
Commission, which reserves the right to require additional erosion and/or damage prevention controls
it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of
work line has been approved by this Order.
18. All work associated with this Order is required to comply with the Massachusetts Stormwater Policy
Standards.

F. Appeals
The applicant, the owner, any person aggrieved by this Order, any owner of land abutting the land subject
to this Order, or any ten residents of the city or town in which such land is located, are hereby notified of
their right to request the appropriate DEP Regional Office to issue a Superseding Order of Conditions.

AMENDED SPECIAL CONDITIONS—DEP FILE#64-360

Based on the Estimated Habitats or Rare Wildlife and Certified Vernal Pools Map(June 1, 2003)from
Natural Heritage&Endangered Species Program(NHESP)of the Massachusetts Division of Fisheries
and Wildlife, it has been determined that this project does not occur near any habitat of state-listed rare
wildlife species nor contains any vernal pools.
This Order is issued under the Massachusetts Wetlands Protection Act, M.G.L. Chapter 131, Section 40 and
the City of Salem Wetlands Protection Ordinance, Salem Code Chapter 34, Section 34-1 —34-13.
This Amended Order of Conditions permits the restoration of approximately 550 square feet of wetlands
located on the southeastern portion of the applicant's property located at 7 Laurier Road. The
Commission approved this work although it had commenced prior to the Commission voting on the item,
because the applicant wanted to plant the vegetation prior to the first frost of the season. The filled lawn
was removed, the area re-graded, debris and material pulled from the wetlands were properly disposed of
off site, and the restored wetlands were planted with wetland plant seed mix and a mix of blueberry and
choke berry bushes. A wetland scientist hired by the applicant oversaw the process described above and
will be overseeing the project during the next two growing seasons. A field stone wall was constructed
by the applicant along the boundary of the wetlands and the lawn area. The erosion control measures
were in place during construction and will be removed to allow for the newly planted wetland area to
establish a hydrolic connection with the established wetlands. Additional conditions have been added to
the existing Order of Conditions to include wetland restoration/replication procedures the applicant shall
follow.
1. The Conservation Agent will be notified 48 hours prior to commencement of construction activities(978-745-
9595 ext. 311). Members and agents of the Salem Conservation Commission(Commission)shall have the right
to enter and inspect the premises to evaluate and ensure compliance with the conditions and performance
standards stated in this Order,the Notice of Intent,the referenced plans,the Act,and 310 CMR 10.00, and may
require any information,measurements,photographs,observation and/or materials or may require the submittal
of any data or information deemed necessary by the Commission,agent,or DEP determines that any of the
work is not in compliance with this Order of Conditions. Work shall not resume until the Commission is
satisfied that the work will comply,and has so notified the applicant in writing.
2. Approval of this application does not constitute compliance with any law or regulation other than MGL Chapter
131,Section 40, and Wetlands Regulations 310 CMR 10.00.
3. This Order shall apply to any successor in control or successor in interest of the property described in the Notice
of Intent and accompanying plans. These obligations shall be expressed in covenants in all deeds to succeeding
owners or portions of the property.
4. The form provided at the end of this Order shall be completed and stamped at the Registry of Deeds after the
expiration of the 10-day appeal period and within 30 days of the issuance if no request for appeal has been filed
with the Department of Environmental Protection. This form shall be returned to the Commission within 21
days of recording accordance and prior to commencement of any activities subject to the Order of Conditions.
5. Prior to any work commencing,a sign shall be displayed showing DEP file#64-360,and not placed on a
living tree.
6. The term"Applicant"as used in this Order of Conditions shall refer to the owner,any successor in interest or
successor in control of the property referenced in the Notice of Intent,supporting documents and this Order of
Conditions. The Commission shall be notified in writing within 30 days of all transfers of title of any portion of
the property that takes place prior to issuance of the Certificate of Compliance.
7. It is the responsibility of the applicant to procure all other applicable federal,state and local permits and
approvals associated with this project. These permits may include but are not necessarily limited to the
following:
(1) Section 404 of the Federal Water Pollution Control Act(P.L. 92-500,86 star. 816),U.S. Army Corp of
Engineers.
(2) Water Quality Certification in accordance with the Federal Water Pollution Control under authority of sec.
27 (5)of Chapter 21 of the Massachusetts General Laws as codified
(3) Flood Plain
(4) Grading Ordinance
S. If there are conflicting conditions within this Order,the stricter condition(s) shall rule.
9. All work shall be performed so as to ensure that there will be no sedimentation into wetlands and surface waters
during construction or after completion of the project.
10. The Commission and its Administrator shall have the discretion to modify the erosion/siltation control methods
and boundary during construction if necessary.
11. All work shall be performed in accordance with this Order of Conditions and approved site plans(s). No
alteration of wetland resource areas or associated buffer zone,other than that approved in this Order shall occur
on this property without prior approval from the Commission.
12. If any changes are made in the above-described plan(s)which may or will alter an area subject to protection
under the Wetlands Protection Act,or any changes in activity subject to regulations under G.L. Ch. 131,Section
40,the applicant shall inquire from this Commission in writing,prior to their implementation in the field,
whether the change(s) is significant enough to require the filing of a new Notice of Intent. Any error in the
plans or information submitted by the applicant shall be considered changes and the above procedures shall be
followed. A copy of such request shall at the same time be sent to the Department of Environmental Protection.
13. In conjunction with the sale of this property or any portion thereof before a Certificate of Compliance has been
issued,the applicant or current landowner shall submit to the Commission a signed statement by the buyer that
he/she is aware of an outstanding Order of Conditions on the property and has received a copy of the Order of
Conditions.
14. Conditions number 49&50 as indicated shall continue in force beyond the Certificate of Compliance,in
perpetuity,and shall be referred to in all future deeds to this property.
PRIOR TO CONSTRUCTION
15. Prior to commencement of any activity on this site,there shall be a PRECONSTRUCTION MEETING
between the project supervision;the contractor responsible for the work or its administrator to and phone
numbers of all responsible parties shall be registered with the Commission at the pre-construction meeting.
16. Prior to the pre-construction meeting and commencement of any activity on this site,sedimentation and erosion
control barriers shall be installed as shown on the approval plan(s)and detail drawings. The Commission and/or
its Administrator shall inspect and approve such installation at the pre-construction meeting.
17. Prior to the commencement of any activity on this site,the applicant or current landowner shall submit to the
Commission in writing a construction schedule/sequence of work to complete this project.
18. Prior to any work on site,the proposed limits of work shall be clearly marked with stakes or flags and shall be
confirmed by the Commission or its Administrator. Such markers shall be checked and replaced as necessary
and shall be maintained until all construction is complete. Workers shall be informed that no use of machinery,
i
storage of machinery or materials,stockpiling of soil or construction activity is to occur beyond this line at
anytime.
19. Prior to commencement of construction on site,the limits of wetland resource areas closest to construction
activity shall be flagged with surveyor's tape and shall remain in place during construction. The limits of areas
to be impacted and the limits of work in the replication area(s)shall be clearly flagged.
20. There shall be 20 hay bales and wooden staked stored under cover on the site to be used only for emergency
erosion control.
EROSION CONTROL
21. Appropriate erosion control devices shall be in place prior to the beginning of any phases of construction,and
shall be maintained during construction in the wetland areas and buffer zones. The erosion control specification
provided in the Notice of Intent and the erosion control provision in the Order will be the minimum standards
for this project;additional measures may be required by the Commission.
22. All debris,fill and excavated material shall be stockpiled a location far enough away from the wetland resource
areas to prevent sediment from entering wetland resource areas.
23. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or replaced as
necessary. Any accumulated silt adjacent to the barriers shall be removed.
24. The areas of construction shall remain in a stable condition at the close of each construction day.
25. Any de-watering of trenches or other excavations required during construction shall be conducted so as to
prevent siltation of wetland resource areas. All discharges from de-watering activities shall be filtered through
haybale sediment traps,silt filter bags or other means approved by the Commission or its Administrator.
26. Within thirty days of completion of construction on any given portion of the project,all disturbed areas in the
completed portion of the site shall be permanently stabilized with rapidly growing vegetative cover,using
sufficient top soil to assure long-term stabilization of disturbed areas.
27. If soils are to be disturbed for longer than two months,a temporary cover of rye or other grass should be
established to prevent erosion and sedimentation. If the season is not appropriate for plant growth,exposed
surfaces shall be stabilized by other appropriate erosion control measures,firmly anchored,to prevent soils
from being washed by rain or flooding.
DURING CONSTRUCTION
28. A copy of the Order of Conditions,construction plans,and copies of the documents and reports cited in
Condition# 11,shall be on the site upon commencement and during any site work for contractors to view and
adhere to.
29. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or replaced as
necessary. Any accumulated silt adjacent to the barriers shall be removed.
30. Only clean fill, free of masonry,stumps,asphalt,and any other kind of waste material shall be used on the site.
31. All waste products,grubbed stumps, slash;construction materials,etc.shall be deposited at least 100 feet from
wetland resource areas and 200 feet from rivers.
32. All filling or removal of waste material from the site shall be done in accordance with the regulations of the
City of Salem Health Department.
33. Cement trucks shall not be washed out in any wetland resource or buffer zone area. Any deposit of cement or
concrete products into a buffer zone or wetland resource area shall be removed by hand.
34. No fuel,oil,or other pollutants shall be stored in any resource area or the buffer zone thereto,unless specified
in this Order of Conditions.
35. There shall be no pumping of water from wetland resource areas.
36. During construction,all drainage structures shall be inspected regularly and cleaned as necessary.
37. Immediately following drainage structure installation,all inlets shall be protected by silt fence,hayblae barriers
and/or silt bags to filter silt from stormwater before it enters the drainage system.
38. The project shall not cause an increase in run-off onto adjacent properties,either during construction or when
completed.
39. The applicant is hereby notified that failure to comply with all requirements herein may result in the issuance of
enforcement actions by the Conservation Commission including,but not limited to,civil administrative
penalties under M.G.L. Chapter 21A,section 16.
POST CONSTRUCTION
40. All disturbed areas,slopes and proposed landscape areas shall be loamed and seeded or stabilized through the
use of erosion control blankets or other approved means. All disturbed areas will be graded,loamed,and
seeded prior to November 1 of each year, if possible. No disturbed areas or stockpiled material will be left
unprotected or without erosion controls during the winter.
41. Upon completion of construction,the applicant or current landowner shall submit the following to the
Commission to request a Certificate of Compliance:
(1) A letter requesting a Certificate including the following information:
a. Name and address of current landowner;
b. Name and address of the individual/trust or other entity to whom the Certificate is to be issued:
c. Street address and lot number for the project;and
d. DEP file number
(2) A letter from a Registered Professional Engineering or Land Surveyor certifying compliance of the
property with this Order of Conditions
(3) An"As-Built"plan signed and stamped by a Registered Professional Engineer showing post-construction
conditions and:
a. As-built elevations of all drainage ways constructed within 100 feet of any wetland resource area;
b. As-built elevations and grades of all filled or altered wetland resource areas,buffer zones and
replicated areas;and
c. Distances to all structures within 100 feet of any wetland resource area.
Registry
42. When issued,the Certificate of Compliance must be recorded at the Essex County of Deeds.
43. If the completed work differs from that in the original plans and conditions,the report must specify how the
work differs; at which time the applicant shall first request a modification to the Order. Only upon review and
approval by the Commission,may the applicant request in writing a Certificate of Compliance as described
above.
44. Erosion control devices shall remain in place and properly functioning until all exposed soils have been
stabilized with final vegetative cover and the Commission and/or its Administrator has authorized their
removal.
45. The following condition(s) shall extend beyond the Certificate of Compliance,in perpetuity,and shall
be recorded as such on the Certificate of Compliance and in all future deeds to this property:
PERPETUAL CONDITIONS
46. There shall be no dumping of leaves, grass clippings,trash or any kind of refuse in the resource area.
47. Herbicides shall not be applied within 100 feet of the wetland.
48. No sodium-based products shall be used for control of ice or snow within 100 feet or the wetland.
ADDITIONAL CONDITIONS
49. The area between the rear property line of 31 Willson Street and the proposed paved driveway shall be
maintained as a lawn area as depicted on the plan entitled"Conservation Plan for Street Extension and Single-
Family Residence Laurier Road"Revised 3/16/04.Any changes to this area shall require the homeowner to
seek approval from the Conservation Commission prior to any modifications.
50. There shall be no outside storage of commercial construction equipment or supplies associate with the
applicant's private business within the 100-foot buffer zone to the Bordering Vegetated Wetland(BVW).
AMENDED CONDITIONS
51. Applicant shall install a hood on the catch basin located to the southwest of the driveway of the property at 7
Laurier Road, as indicated on the approved site plans.
52. Applicant shall clean the 24-inch drain line as stated in Note#8 on the approved site plans: "the 24-inch drain
line shall be cleaned after the establishment of vegetation and prior to the Conservation Commission issuing a
Certificate of Completion." Proof must come in the form of a CCTV color video,360 pan/tilt recording of the
drain line from the catch basin located on the northwestern portion of the property at 7 Laurier Road,south to
the catch basin on Laurier Road.
ALTERATION AND REPLICATION OF VEGETATED WETLAND
53. Prior to the Pre-Activity Meeting and commencement of any activity on this site,the applicant or current
landowner shall provide the Commission with the name of a qualified"Wetlands Specialist"
(qualifications subject to approval of the Commission)experienced in wetland replication who shall be
present on site to direct and supervise the replication work.
54. Prior to the Pre-Activity Meeting and commencement of any activity on this site,the borders of both the
wetland resource area(s)to be altered and the replication area(s)shall be clearly delineated by grade
stakes set in place by field survey.
55. Prior to any alteration of wetland resource area,the wetland replication area(s)shall be constructed per
the approved wetland replication site plan and wetland replication methodology(included as attachment
to this Order titled"Wetland Restoration Program 7 Laurier Road Salem,Massachusetts"dated June 8,2006).
The wetland replication area shall be excavated in the location and to the size and elevation indicated on
the approved wetland replication site plan.
56. Following construction of the wetland alteration and replication areas and prior to any other work on site,
the Wetlands Specialist shall certify in writing to the Commission that both the wetland alteration and
replication work has been performed in compliance with the Order of Conditions. An"As-built"plan of
both the alteration and replication areas,signed and stamped by a Registered Professional Engineer or
Registered Professional Land Surveyor,shall be submitted to the Commission along with the written
certification. Said plan shall show the location and size calculated in square feet for the alteration area;as
well as the subsurface and finish grade elevations for the replication area. No other work may proceed
on this site until the wetland alteration and replication certification and as-built plan have been
submitted and approved by the Conservation Commission.
57. If the wetland replication area does not exhibit at least fifty(50)percent coverage of indigenous wetland
indicator species by the end of the first growing season,the applicant shall supplement the plantings with
indigenous wetland indicator species obtained via transplantation from adjacent wetland areas or from a
nursery specializing in the propagation of wetland plants.
58. The Wetland Specialist shall monitor the soil horizons and depths,plant community composition and
structure,and hydrology of the wetland replication area. Monitoring inspections shall occur in June and
September for two complete growing seasons following completion of construction. Monitoring shall
continue beyond that date if the wetland replication area does not exhibit at least seventy-five(75)
percent coverage of indigenous wetland indicator species at the end of the second complete growing
season.
59. During each monitoring inspection,the Wetland Specialist shall perform a vegetation analysis at each
plot location. The analysis shall document all vegetation species within each plot by common and
scientific name,wetland indicator status,and percent coverage. Total percent coverage of all
INDIGENOUS wetland indicator species within the plot area shall also be documented. Copies of the
documentation for each monitoring inspection shall be submitted to the Commission immediately
following each inspection.
60. In the event that the wetland replication area does not meet the Performance Standard for wetland
replication as set forth in Section 10.55(4)(b)(1-7)of the Massachusetts Wetlands Protection Act
Regulations,the Wetland Specialist shall submit a wetland replication Contingency Plan in writing to the
Commission. The Contingency Plan shall describe proposed measures(such as additional plantings
and/or changes in grading)designed to bring the replication area into compliance with said regulations.
The Contingency Plan shall not be implemented until it has been reviewed and approved by the
Commission or its Administrator.

Dear Mr. Tremblay:
Per our phone conversation this afternoon, I wanted to follow-up on the next steps in regards to
your two outstanding Orders of Conditions #64-360 and#64-433.
Project #64-360 was for the restoration of approximately 550 square feet of wetlands at the
above referenced property. Tom Keough, from Hancock Associates, was hired to oversee the
planting of high bush blueberry and chokeberry bushes as described in the Order of Conditions.
The Conservation Commission received two monitoring reports (dated July 16, 2007 and July
15, 2008) describing the condition of the wetland replication. Based on the reports the wetland
replication appears to have successfully survived two growing seasons. In order to confirm that
they are established the Salem Conservation Commission requires a written certification from the
Wetlands Specialist certifying that both the wetland alteration and replication work has been
performed in compliance with the Order of Conditions and an "as-built" plan of both the
alteration and replication areas signed and stamped by a Registered Professional Engineer or
Registered Professional land Surveyor (See Order of Conditions Special Condition #56 for
additional details). In order to receive a full Certificate of Compliance please review all
Conditions and confirm that they have been met.
As we discussed this Order of Conditions was extended until March 11, 2009. 1f you are not
able to request a Certificate of Compliance by March 11, 2009 due to weather conditions that
make surveying difficult or for other reasons please contact me.
A second project that you have an open Order of Conditions for at 7 Laurier Road is #64-433.
This project permitted the after-the-fact installation of a 14'X 22' stone patio, a 4'X 12' side
deck and a 4'X 8' front deck. The order also permitted the installation of a wooden picket fence
with posts that were hand dug and located along the northeastern corner of the property abutting
29 Willson Street as well as the installation of an above ground pool (see the Order for more
details). This Order expires on October 19, 2009. As stated above prior to requesting a

Certificate of Compliance please review all conditions and ensure they have been met. In order
to receive a full Certificate of Compliance all conditions will have to be fulfilled.

injury to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying with all
other applicable federal, state, or local statutes, ordinances, bylaws, or regulations.

4. The work authorized hereunder shall be completed within three years from the date of this Order
unless either of the following apply:
a. the work is a maintenance dredging project as provided for in the Act; or
b. the time for completion has been extended to a specified date more than three years, but less
than five years,from the date of issuance. If this Order is intended to be valid for more than three
years,the extension date and the special circumstances warranting the extended time period are
set forth as a special condition in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill.Any fill shall contain no trash,refuse,
rubbish, or debris, including but not limited to lumber, bricks, plaster,wire, lath, paper, cardboard,
pipe, tires, ashes, refrigerators, motor vehicles,or parts of any of the foregoing.
7. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such
an appeal has been taken, until all proceedings before the Department have been completed.
8. No work shall be undertaken until the Order has become final and then has been recorded in the
Registry of Deeds or the Land Court for the district in which the land is located,within the chain of title
of the affected property. In the case of recorded land, the Final Order shall also be noted in the
Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to
be done. In the case of the registered land, the Final Order shall also be noted on the Land Court
Certificate of Title of the owner of the land upon which the proposed work is done. The recording
information shall be submitted to this Conservation Commission on the form at the end of this Order,
which form must be stamped by the Registry of Deeds,prior to the commencement of work.
9. A sign shall be displayed at the site not less then two square feet or more than three square feet in
size bearing the words,
"Massachusetts Department of Environmental Protection" [or, "MA DEPI
"File Number 64-360 "
10. Where the Department of Environmental Protection is requested to issue a Superseding Order, the
Conservation Commission shall be a party to all agency proceedings and hearings before DEP.
11. Upon completion of the work described herein, the applicant shall submit a Request for Certificate of
Compliance(WPA Form 8A)to the Conservation Commission.
12. The work shall conform to the plans and special conditions referenced in this order.
13. Any change to the plans identified in Condition#12 above shall require the applicant to inquire of the
Conservation Commission in writing whether the change is significant enough to require the filing of a
new Notice of Intent.
14. The Agent or members of the Conservation Commission and the Department of Environmental
Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours
to evaluate compliance with the conditions stated in this Order, and may require the submittal of any
data deemed necessary by the Conservation Commission or Department for that evaluation.

15. This Order of Conditions shall apply to any successor in interest or successor in control of the
property subject to this Order and to any contractor or other person performing work conditioned by
this Order.
16. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated Wetland,
the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden
stakes or flagging. Once in place, the wetland boundary markers shall be maintained until a
Certificate of Compliance has been issued by the Conservation Commission.
17. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully
stabilized with vegetation or other means.At no time shall sediments be deposited in a wetland or
water body. During construction, the applicant or his/her designee shall inspect the erosion controls
on a daily basis and shall remove accumulated sediments as needed.The applicant shall immediately
control any erosion.problems that occur at the site and shall also immediately notify the Conservation
Commission,which reserves the right to require additional erosion and/or damage prevention controls

C. Appeals
The applicant,the owner, any person aggrieved by this Order, any owner of land abutting the land subject
to this Order, or any ten residents of the city or town in which such land is located, are hereby notified of
their right to request the appropriate DEP Regional Office to issue a Superseding Order of Conditions.
The request must be made by certified mail or hand delivery to the Department,with the appropriate filing
fee and a completed Appendix E: Request of Departmental Action Fee Transmittal Form, as provided in
310 CMR 10.03(7)within ten business days from the date of issuance of this Order.A copy of the request

Laurier Road
1. The Conservation Agent will be notified 48 hours prior to commencement of construction activities(978-745-
9595 ext.311). Members and agents of the Salem Conservation Commission(Commission)shall have the right
to enter and inspect the premises to evaluate and ensure compliance with the conditions and performance
standards stated in this Order,the Notice of Intent,the referenced plans,the Act,and 310 CMR 10.00,and may
require any information,measurements,photographs,observation and/or materials or may require the submittal
of any data or information deemed necessary by the Commission,agent,or DEP determines that any of the
work is not in compliance with this Order of Conditions. Work shall not resume until the Commission is
satisfied that the work will comply,and has so notified the applicant in writing.
2. Approval of this application does not constitute compliance with any law or regulation other than MGL Chapter
131,Section 40,and Wetlands Regulations 310 CMR 10.00.
3. This Order shall apply to any successor in control or successor in interest of the property described in the Notice
of Intent and accompanying plans. These obligations shall be expressed in covenants in all deeds to succeeding
owners or portions of the property.
4. The form provided at the end of this Order shall be completed and stamped at the Registry of Deeds after the
expiration of the 10-day appeal period and within 30 days of the issuance if no request for appeal has been filed
with the Department of Environmental Protection. This form shall be returned to the Commission within 21
days of recording accordance and prior to commencement of any activities subject to the Order of Conditions.
5. Prior to any work commencing,a sign shall be displayed showing DEP file#64-360,and not placed on a
living tree.
6. The term"Applicant"as used in this Order of Conditions shall refer to the owner,any successor in interest or
successor in control of the property referenced in the Notice of Intent,supporting documents and this Order of
Conditions. The Commission shall be notified in writing within 30 days of all transfers of title of any portion of
the property that takes place prior to issuance of the Certificate of Compliance.
7. It is the responsibility of the applicant to procure all other applicable federal,state and local permits and
approvals associated with this project. These permits may include but are not necessarily limited to the
following:
(1) Section 404 of the Federal Water Pollution Control Act(P.L.92-500,86 star. 816),U.S.Army Corp of
Engineers.
(2) Water Quality Certification in accordance with the Federal Water Pollution Control under authority of sec.
27 (5)of Chapter 21 of the Massachusetts General Laws as codified
(3) Flood Plain
(4) Grading Ordinance
8. If there are conflicting conditions within this Order,the stricter condition(s)shall rule.
9. All work shall be performed so as to ensure that there will be no sedimentation into wetlands and surface waters
during construction or after completion of the project.
10. The Commission and its Administrator shall have the discretion to modify the erosion/siltation control methods
and boundary during construction if necessary.
11. All work shall be performed in accordance with this Order of Conditions and approved site plans(s). No
alteration of wetland resource areas or associated buffer zone,other than that approved in this Order shall occur
on this property without prior approval from the Commission.
12. If any changes are made in the above-described plan(s)which may or will alter an area subject to protection
under the Wetlands Protection Act,or any changes in activity subject to regulations under G.L.Ch. 131,Section
40,the applicant shall inquire from this Commission in writing,prior to their implementation in the field,
whether the change(s)is significant enough to require the filing of a new Notice of Intent. Any error in the
plans or information submitted by the applicant shall be considered changes and the above procedures shall be
followed. A copy of such request shall at the same time be sent to the Department of Environmental Protection.
13. In conjunction with the sale of this property or any portion thereof before a Certificate of Compliance has been
issued,the applicant or current landowner shall submit to the Commission a signed statement by the buyer that
he/she is aware of an outstanding Order of Conditions on the property and has received a copy of the Order of
Conditions.
14. Conditions number 49&50 as indicated shall continue in force beyond the Certificate of y Compliance,in
perpetuity,and shall be referred to in all future deeds to this property.
PRIOR TO CONSTRUCTION
15. Prior to commencement of any activity on this site,there shall be a PRECONSTRUCTTON MEETING
between the project supervision;the contractor responsible for the work or its administrator to and phone
numbers of all responsible parties shall be registered with the Commission at the pre-construction meeting.
16. Prior to the pre-construction meeting and commencement of any activity on this site, sedimentation and erosion
control barriers shall be installed as shown on the approval plan(s)and detail drawings. The Commssion and/or
its Administrator shall inspect and approve such installation at the pre-construction meeting.
17. Prior to the commencement of any activity on this site,the applicant or current landowner shall submit to the
Commission in writing a construction schedule/sequence of work to complete this project.
18. Prior to any work on site,the proposed limits of work shall be clearly marked with stakes or flags and shall be
confirmed by the Commission or its Administrator. Such markers shall be checked and replaced as necessary
and shall be maintained until all construction is complete. Workers shall be informed that no use of machinery,
storage of machinery or materials,stockpiling of soil or construction activity is to occur beyond this line at
anytime.
19. Prior to commencement of construction on site,the limits of wetland resource areas closest to construction
activity shall be flagged with surveyor's tape and shall remain in place during construction. The limits of areas
to be impacted and the limits of work in the replication area(s)shall be clearly flagged.
20. There shall be 20 hay bales and wooden staked stored under cover on the site to be used only for emergency
erosion control
EROSION CONTROL
21. Appropriate erosion control devices shall be in place prior to the beginning of any phases of construction, and
shall be maintained during construction in the wetland areas and buffer zones. The erosion control specification
provided in the Notice of Intent and the erosion control provision in the Order will be the minimum standards
for this project;additional measures may be required by the Commission.
22. All debris, fill and excavated material shall be stockpiled a location far enough away from the wetland resource
areas to prevent sediment from entering wetland resource areas.
23. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or replaced as
necessary. Any accumulated silt adjacent to the barriers shall be removed.
24. The areas of construction shall remain in a stable condition at the close of each construction day.
25. Any de-watering of trenches or other excavations required during construction shall be conducted so as to
i prevent siltation of wetland resource areas. All discharges from de-watering activities shall be filtered through
haybale sediment traps,silt filter bags or other means approved by the Commission or its Administrator.
26. Within thirty days of completion of construction on any given portion of the project,all disturbed areas in the
completed portion of the site shall be permanently stabilized with rapidly growing vegetative cover,using
sufficient top soil to assure long-term stabilization of disturbed areas.
27. If soils are to be disturbed for longer than two months,a temporary cover of rye or other grass should be
established to prevent erosion and sedimentation. If the season is not appropriate for plant growth,exposed
surfaces shall be stabilized by other appropriate erosion control measures,firmly anchored,to prevent soils
from being washed by rain or flooding.
DURING CONSTRUCTION
28. A copy of the Order of Conditions,construction plans,and copies of the documents and reports cited in
Condition# 11,shall be on the site upon commencement and during any site work for contractors to view and
adhere to.
29. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or replaced as
necessary. Any accumulated silt adjacent to the barriers shall be removed.
30. Only clean fill,free of masonry,stumps,asphalt,and any other kind of waste material shall be used on the site.
31. All waste products,grubbed stumps,slash;construction materials,etc.shall be deposited at least 100 feet from
wetland resource areas and 200 feet from rivers.
32. All filling or removal of waste material from the site shall be done in accordance with the regulations of the
City of Salem Health Department.
33. Cement trucks shall not be washed out in any wetland resource or buffer zone area. Any deposit of cement or
concrete products into a buffer zone or wetland resource area shall be removed by hand.
34. No fuel,oil,or other pollutants shall be stored in any resource area or the buffer zone thereto,unless specified
in this Order of Conditions.
35. There shall be no pumping of water from wetland resource areas.
36. During construction,all drainage structures shall be inspected regularly and cleaned as necessary.
37. Immediately following drainage structure installation, all inlets shall be protected by silt fence,hayblae barriers
and/or silt bags to filter silt from stormwater before it enters the drainage system.
38. The project shall not cause an increase in run-off onto adjacent properties,either during construction or when
completed.
39. The applicant is hereby notified that failure to comply with all requirements herein may result in the issuance of
enforcement actions by the Conservation Commission including,but not limited to,civil administrative
penalties under M.G.L. Chapter 21A,section 16.
POST CONSTRUCTION
40. All disturbed areas,slopes and proposed landscape areas shall be loamed and seeded or stabilized through the
use of erosion control blankets or other approved means. All disturbed areas will be graded,loamed,and
seeded prior to November 1 of each year,if possible. No disturbed areas or stockpiled material will be left
unprotected or without erosion controls during the winter.
41. Upon completion of construction,the applicant or current landowner shall submit the following to the
Commission to request a Certificate of Compliance:
(1) A letter requesting a Certificate including the following information:
a. Name and address of current landowner;
b. Name and address of the individual/trost or other entity to whom the Certificate is to be issued:
c. Street address and lot number for the project;and
d. DEP file number
(2) A letter from a Registered Professional Engineering or Land Surveyor certifying compliance of the
property with this Order of Conditions
(3) An"As-Built"plan signed and stamped by a Registered Professional Engineer showing post-construction
conditions and:
a. As-built elevations of all drainage ways constructed within 100 feet of any wetland resource area;
b. As-built elevations and grades of all filled or altered wetland resource areas,buffer zones and
replicated areas;and
c. Distances to all structures within 100 feet of any wetland resource area.
42. When issued,the Certificate of Compliance must be recorded at the Essex County Registry of Deeds.
43. If the completed work differs from that in the original plans and conditions,the report must specify how the
work differs;at which time the applicant shall first request a modification to the Order. Only upon review and
approval by the Commission,may the applicant request in writing a Certificate of Compliance as described
above.
44. Erosion control devices shall remain in place and properly functioning until all exposed soils have been
stabilized with final vegetative cover and the Commission and/or its Administrator has authorized their
removal.
45. The following condition(s) shall extend beyond the Certificate of Compliance,in perpetuity,and shall
be recorded as such on the Certificate of Compliance and in all future deeds to this property:
PERPETUAL CONDITIONS
46. There shall be no dumping of leaves,grass clippings,trash or any kind of refuse in the resource area.
47. Herbicides shall not be applied within 100 feet of the wetland.
48. No sodium-based products shall be used for control of ice or snow within 100 feet or the wetland.
ADDITIONAL CONDITIONS
49. The area between the rear property line of 31 Willson Street and the proposed paved driveway shall be
maintained as a lawn area as depicted on the plan entitled"Conservation Plan for Street Extension and Single-
Family Residence Laurier Road"Revised 3/16/04.Any changes to this area shall require the homeowner to
seek approval from the Conservation Commission prior to any modifications.
50. There shall be no outside storage of commercial construction equipment or supplies associate with the
applicant's private business within the 100-foot buffer zone to the Bordering Vegetated Wetland(BV W).

On behalf of the property owner, Mark Tremblay, this letter requests that the
Commission grant a Certificate of Compliance for the subject work under the
Wetlands Protection Act (WPA) regulations and the City of Salem Wetlands
Protection Ordinance. Please find enclosed seven (7) copies of the Record
Plan for Certificate of Compliance drawing (C-4) and Massachusetts Wetland
Protection Act Form 8A.
Based on our post-construction inspection, this letter certifies that the work has
been completed in substantial compliance with the approved plan with the
following noted deviations, as shown on the attached Record Plan:
The 4-foot diameter catch basin located in Laurier Road was
constructed without a 4-foot sump and pipe hood.
c2* A 300 s.f. stone patio, not indicated on the approved plan, was
installed on the north-east side of the 3-story dwelling. The
approximately 300 s.f patio was installed partially within the 100-
foot buffer zone.
The dwelling footprint was built slightly larger than the approved
plan (approximately 85 s.f. more).
,4 The approved extension of the existing water main with a 6-inch
class 52 ductile iron pipe, hydrant, and 1-inch diameter type K
copper water service was not installed. Instead a potable well
was installed out side the 100-foot buffer zone on the west side
of the lot approximately 11-feet from the property line.
(5Y The lawn was expanded approximately 1,350 s.f. on the west
side of the garage.

Dear Mr. Cefalo:
In response to the City's comments on the subject plan please find enclosed
seven copies of the revised site plan. The revisions are as follows:
• The drain line size is 24-inches instead of 12-inches.
• The drain line alignment has been shifted further into the existing
drain easement.
• The proposed catchbasin at the end of the Laurier Road has been
relocated to the existing 24-inch drain. There have been minor
grading changes associated with this.
• The discharge from the proposed sewage pump chamber to the
existing sewer manhole has been modified as requested by the
City Engineering department (see note 9 on plan).
In response to comments by the City Engineering office, we note the following:
• The existing 24-inch drain runs parallel to the stream channel,
discharging to that channel approximately 450 feet from the site.
The existing drain was visible at the catchbasin on the subject site
and through a manhole in the ballfield (the cover is incorrectly
labeled as a "sewer' manhole). The pipe was in good condition at
these locations with little debris or silt therein. The applicant has
committed to re-inspecting the pipeline following the work and
cleaning it as required after vegetation has been established.
(See note 8 on plan).
At the discharge into the stream channel the embankment has

eroded and the last two lengths of the existing 24" RCP pipe have
settled. However, due to the free discharge condition at the end
of the drain line the settlement does not appear to have
significantly affected the discharge capacity.
• The top of the existing 60" RCP at the proposed driveway
crossing is at approximately elevation 23.6. Twenty-four inches of
cover are proposed over the pipe, which we believe will provide
sufficient protection from potential wheel loads.
The circa 1975 design drawing for this pipe (Camp Dresser
McKee) does not indicate the type of RCP required. However, it
does indicate that 18" of cover would be provided over the pipe at
the Willson Street crossing. Thus our proposed cover will be
greater than the minimum cover required during design of the
pipeline.
Additionally, we have attached an excerpt from the
Massachusetts Highway Design Manual that indicates the
minimum design cover for Type III RCP pipe is 18-inches. Given
the large size of the storm drain and typical pipe manufacturing
practices, it is more likely that Type V RCP was installed, which
would have less minimum design cover.

1. The Engineer of record (Griffin) needs to document the downsizing of the drain from
24" to 12". What storm basis was used?
2. The owner can pave over the drain easement but the city reserves all rights of access
and maintenance. If the pavement has to be ripped up, it will be at the owner's expense.
Further more the engineer(Griffin) needs to provide details of proper support for the pipe
from heavy surface loads. (eg.. Truck, other.)
3. The engineer(Griffin) needs to show/add more survey regarding connection to the
existing drain and where it discharges and what capacity is available now and after the
proponents work is completed.
4. Construction activity must address sediments and clean the drain post construction.

On behalf of the property owner, Mark Tremblay, we are pleased to provide seven (7)
copies of a Notice of Intent (NOI)for the subject property.
The project involves the extension of Laurier Road and the construction of a single-
family residences on an existing undeveloped residential lot (Map 23, Lot 0050)
located at the east end of Laurier Road in Salem. This NOI addresses the extension
of Laurier Road approximately 100 feet, site preparation, including site grading and
' utility installation, and the construction of a single-family residence.
Wetland resource areas, including an Intermittent Stream and BVW, are located on
the eastern portion of the property; and construction on the site is constrained by a 40-
' foot wide drainage easement which crosses the property. As shown, no alteration of
the wetland resource areas is proposed with impacts only to the Buffer Zone to the
resource areas.

' PROJECT DESCRIPTION

1.0 INTRODUCTION
The project site is an approximately 23,458 square foot undeveloped lot (Map 23, Lot 0050)
located at the eastern end of Laurier Road in Salem, Massachusetts. Figure 1 - United States
' Geological Survey (USGS) Locus Map depicts the general location of the proposed project.
The property is abutted by residential properties to the north, east, and west, and by Castle Hill
' Playground to the south. Undeveloped portions of Laurier Road and St. Anne's Park are
located on the south and east sides of the property. A 40-foot wide drainage easement,
containing a 60-inch diameter concrete subsurface culvert, runs across the property from
i ' northwest to southeast. The culvert discharges at a concrete headwall on the southeastern
portion of the property. The resultant stream is indicated on USGS topographic maps (Figure
1) as an unnamed intermittent stream. The unnamed stream continues to flow to the southeast
within the easement, which narrows to 30 feet downstream of the headwall. The remainder of
the site is relatively level with a slight slope to the southeast.
Wetland resource areas have been identified on the eastern portion of the site. These include:
' the intermittent stream; inland bank to the stream; bordering vegetated wetlands (BVW) along
the stream; an additional BVW on the eastern portion of the lot; and an area of isolated wetland
on an adjacent 29 Willson Street property.
This Notice of Intent is for the construction of the extension of Laurier Road approximately 100
feet within the existing right-of-way; and for development of the property with a single-family
' residence, including associated utility installation and site grading. Such work will take place
within the Buffer Zone to the wetland resource areas identified above. No alteration of resource
areas is proposed, and no resource area impacts are anticipated. The reader is referred to
' Attachment B for a site plan showing the proposed work. Mitigation of potential adverse
impacts associated with the proposed work is described below in Section 4.0.
2.0 WETLAND RESOURCE AREAS
GEG conducted an assessment of the Laurier Road property to determine resource areas
regulated under the Massachusetts Wetlands Protection Act (310 CMR 10.00) and the Salem
Wetlands Protection Ordinance present on the property in the vicinity of the proposed work.
The investigation included an on-site inspection, conducted by a wetlands scientist in August
' 2003; and a review of pertinent published information regarding the site area. Information
reviewed, included:

FEMA Flood Insurance Rate Maps, Salem, (Comm. Panel 250102 0005 B), Aug. 1985
Massachusetts Natural Heritage Atlas, July 2003 Edition, Salem, MA

Based on this assessment, it was determined that the following wetland resource areas are
' present on the property, and/or within 100 feet of the work area. These include:
• Intermittent Stream

As such, the proposed work requires filing a Notice of Intent in accordance with the MA WPA
' and the Salem Wetlands Protection Ordinance. Locations of these resource areas and their
associated buffer zones are depicted on the Site Plan (Attachment B).
' 2.1 Intermittent Stream
As indicated above, an unnamed stream emerges from a 60" culvert at the concrete headwall
on the southeastern portion of the property. For this Notice, the date of installation of the drain
I ' pipe was not determined. However, the property easement to the City of Salem was granted in
1971. According to the plans, prepared by Camp, Dresser & McKee for the Salem Department
of Public Works, the installation involved the straightening of the stream channel and placement
of fill on the property upgradient of the headwall.
The USGS map of the area (Figure 1) indicates that the unnamed stream is an intermittent
stream. It is noted that the stream is not indicated as perennial on the USGS map until it
' emerges from an unnamed pond south of the St. Anne School. Based on analysis of the
USGS map, the drainage system watershed extends approximately 5,500 feet upgradient of the
site to an area southwest of the Witchcraft School; and has an average width of approximately
' 1,500 feet. Based on this analysis, the stream has a watershed area of approximately 0.3
square miles upgradient of the site. In accordance with the definitions of the Riverfront
regulations (310 CMR 10.58 (2)(a)1.c.), a stream that is shown as intermittent on the current
' USGS map, and has a watershed size of less than 0.50 square miles is to be considered
intermittent, regardless of soil strata type. Therefore, the site is not subject to the Riverfront
regulations.
' It is noted that alteration of the stream is not proposed.
' 2.2 Inland Bank
Inland bank is present adjacent to the intermittent stream downstream form the headwall. The
upland limits of the banks were marked by the B-series of wetland flags. As part of the drain
' installation, the stream appears to have been altered and channelized within linear banks. No
alteration of the Bank is proposed, nor anticipated. However in accordance with 310 CMR
10.02 (2)(b), a 100-foot buffer zone, subject to regulation in accordance with the WPA, is
established for this type of resource area. Work is proposed for this buffer zone.
' 2.3 Bordering Vegetated Wetland
The field investigation identified an area of Bordering Vegetated Wetland (310 CMR 10.55) to
' the north of the stream banks on the eastern portion of the property. The upland limit of the
BVW on the subject site was marked by flags A-1 through A-6 by the wetland scientist. Flag
locations were mapped by survey, and are shown on the Site Plan. Attachment C provides the
Wetland Delineation Data Forms completed for the on-site wetland identification performed.
No alteration of the BVW is proposed. However, land within 100 feet of the BVW is subject to
' the jurisdiction of the MA WPA and the Salem Wetlands Ordinance to ensure that the resource
area is not impacted. Work is proposed for this Buffer Zone.
' The location of the BVW, and the associated Buffer Zones within the project area, are depicted
on the Site Plans found in Attachment B.
2.4 Isolated Vegetated Wetland
An area of non-jurisdictional isolated vegetated wetland was identified on an adjacent parcel to
the north. This area was delineated by Flags 11 - 13. No alteration of this area is proposed, or
anticipated.

2.5 Additional Wetland Information
The Flood Insurance Rate Map for the City of Salem indicates that the Site and
surrounding area is considered an area of minimal flooding (Zone C).
• The portion of the National Wetland Inventory Map applicable to the project area does
not indicate the presenc@ of wetlands at the project site. The NW I maps indicate that
' the area downstream from the site as a partially drained, seasonally flooded, palustrine
wetland.
According to the Massachusetts Natural Heritage Atlas, July 2003 Edition, the project
area is not within an area mapped as having Estimated Habitat of Rare Wildlife.
' 3.0 PROPOSED PROJECT/WETLAND RESOURCE IMPACTS
The applicant proposes to construct a single-family residence with associated site grading and
utility installation on the subject site. In order to conform to Salem zoning frontage
requirements, the applicant must extend Laurier Road approximately 100 feet within the
existing right-of-way. Specific elements of the project include:
' extending Laurier Road approximately 100 feet within the existing right-of-way;
• constructing a single-family residence, and associated utility installation;
' constructing a detached garage;
realigning an existing 24" diameter drain pipe to within the easement; and
• grading the site to provide sufficient cover over the existing drain pipes.
The reader is referred to Attachment B for a site plan showing the proposed work.
' Potential locations for the house and garage are constrained by the presence of the 40-foot wide
drainage easement, zoning setback requirements, and on-site wetland resource areas. Also,
additional clean fill is required to grade the property to provide proper cover for the existing drain
' pipe within the easement. It is noted that the plans for the drain construction called for at least
2.5 feet of fill material to be place over the pipe.
All disturbed areas will be re-seeded , re-vegetated, or repaved. Significant soil and aggregate
' stockpiles are generally not expected to be needed. Should equipment logistics require
temporary stockpile creation, the stockpile will be protected from erosion for as long as it exists.
Erosion control measures are specified in Attachment E.
4.0 MITIGATION OF POTENTIAL ADVERSE IMPACTS
Proposed mitigation measures are described below. These elements will mitigate impacts to
potential buffer zone impacts and ensure protection of adjacent wetland resource areas.
' Short-term impacts to the resource areas may occur during construction. To minimize these
impacts, several construction mitigation steps are proposed as described below.
As the soils are removed during construction they will be set aside. It is anticipated that all
excavated soils will be used on site for grading purposes.

' Prior to work commencing on the Site, there will be a preconstruction conference with the
contractor. The purpose of this meeting will be to coordinate the best methods for erosion and
sedimentation control, protection of adjacent wetland resource areas, and other construction-
related issued. The implementation of a comprehensive soil and erosion control plan will occur
prior to and project construction activities within the project area. In general, the following
sequences of events will occur.
' Erosion and sedimentation control devices will be installed between the work area
and the wetland resource areas, as indicated on the Site Plan In addition to
providing for sedimentation deposition and reducing runoff during storm events,
this barrier will limit work areas for equipment operators.
' Erosion and sedimentation control devices will be inspected daily during periods
of active construction and bi-weekly during the remainder of the construction
period. Sediments will be removed from the barriers as soon as they reach a
depth of 6 inches.
tRunoff from the site will be directed through sedimentation control barriers.
• During construction, disturbed areas will be kept to a minimum and vegetative
stabilization of these areas will occur as soon as possible.
I ' Temporary seeding, mulching, or other suitable stabilization measures will be
used to protect exposed critical areas should unprotected soils remain exposed
for prolonged periods.
' The construction activities shall be monitored on-site by the construction supervisor to ensure
that the soil erosion and sediment control features are installed properly and maintained and to
evaluate the need for additional erosion control and/or stabilization measures. The inspector will
perform the following tasks:
• Supervise installation and maintenance of soil erosion and sediment control
features.
• Evaluate the need for additional soil erosion and sediment control features.
' Scheduled inspections of erosion control features, including construction
entrance, haybales, check dams, and dust control.
' Supervise and monitor temporary and permanent stabilization activities.
' 5.0 CONCLUSION
The extension of Laurier Road and construction of the single-family residence have been
' designed to avoid work within the wetland resource areas. Construction on the subject site is
constrained by the presence of a 40-foot drainage easement which runs diagonally across the
site. The proposed project will entail impacts only to the Buffer Zone to BVW and Inland Bank.
Permanent unavoidable impacts and temporary impacts have been minimized. Adequate
mitigating actions are proposed. The proposed project includes comprehensive construction
mitigation. These mitigation measures meet the performance standards to protect the interests
of the Massachusetts Wetlands Protection Act and the Salem Wetlands Protection By-Law. For
these reasons, approval of the project is requested.
