Construction Contract

This agreement made this y of 2014 by and between Nicholas
Mosher of 462 Lafayette treet, Salem, Therein referred to as "Owner", and D & H
Construction Company, Inc., of 33 Central Street, Peabody, Massachusetts,01960,Mass_
Contractor Registration No. 102798, herein referred to as "Contractor". Owner and
Contractor in consideration of the mutual covenants hereinafter set forth agree as follows:
Contractor shall fiunish all labor and materials necessary to perform and complete the
work described below upon the following described property,which owner warrants he
owns, free and clear of liens and encumbrances: 462 Lafayette Street, Salem,MA. -
The work,which shall include all of the labor and materials necessary for the completion
thereof, shall consist of the following:
Construct roof deck as specified over existing garage.
Remove and discard existing garage roof as specified.
Install plywood deck and fully adhered .060 rubber membrane over'/2" insulation secured
with locking plates and screws.
Install 3"x 3"edge metal to perimeters.
Frame new 2"x 8"pressure treated frame approx. 10'6"x 28'
20' over garage and extend approx. 8' additional to meet front comer of house.
Install joist hangers and bolt frame to house.
Remove existing vinyl siding as needed for flashing at house.
Construct new landing at rear of deck with stairs to grade as specified.
Install 6"premium Azek solid P.V.C. deck with color matched fasteners.
Install 4"x 4"pressure treated posts and cover with white vinyl post sleeves with
decorative white vinyl caps.
Install white premium vinyl railings.
Install Azek decking to stair treads and Azek trim boards to risers.
Install Azek trim boards to skirt of deck and stairs.
Install cement footings with sono tubes to front outside corner at overhang and rear for
stairs to code.
Install 6"x 6"post brackets at new footings and 6"x 6"posts to support outside corners
of deck.
NOTE: Alternate price if all pressure treated decking and 'Is g$15,7;90.00 )Acs
Contractor shall perform the work in conformance with such plans and specifications,if
any, as have been provided by the owner or the contractor,which plans and specifications
shall be deemed incorporated into this contract by reference, and will do so in a
workmanlike manner. Contractor is not responsible for performinx any work not
specifically referred to in this contract.
Owner shall pay contractor the sum of Fifteen thousand seven hundred ninety dollars,
cj ($15,790.00), in installments as follows:
($5,264.00),upon signing this contract.
($5,263.00),upon 501/o completion
($5,263.00),upon completion of the remainder of the work called for under this contract.
In the event any installment is not paid when due,contractor may stop work without
breach until payment is made and for five (5) days thereafter. In the event any installment
is not paid within ten(10) days after it is due, Contractor may,at its option deem this
contract terminated by the owner and may take such action as may be necessary,
including initiating legal proceedings,to enforce its rights hereunder.
At all times during construction, Owner shall provide and maintain free and unobstructed -
access to all areas of the site where the work will be performed and shall provide, at
Owner's sole expense, water and electrical service.
Due to the nature of construction there may be some damage to the landscaping.
Dumpsters and heavy equipment may be necessary and may cause damage to the
driveway blacktop and lawn.As long as Contractor shall exercise reasonable care, it shall
not be liable for any damage to the above-mentioned landscaping,lawn, or driveway.
NOTE:Hammering to walls,roofing, and around windows may cause dust in attics,
plaster cracks,and things falling.
Contractor shall not be responsible for claims for damages to persons or property
occasioned by Owner or his agents,third parties, acts of God or other causes beyond
contractor's control. Owner shall hold contractor completely harmless from, and shall
indemnify contractor for, all costs, damages, losses,and expenses,including judgments
and attorneys fees,resulting from claims arising from causes enumerated in this
paragraph-
1.All work shall be completed in a workmanlike manner and in compliance with all building codes and
other applicable laws.
2.To the extent required by law all work shall be performed by individuals duly licensed and authorized by
law to perform said work.
3.Contractor may at its discretion engage subcontractors to perform work hereunder,provided Contractor
shall fully pay said subcontractor and in all instances remain responsible for the proper completion of this
Contract.
4. All change orders shall be in writing and signed by both Owner and Contractor. Contractor shall be
responsible to provide only the work described in this contract and in such change orders as may from time
to time be agreed to between Contractor and Owner. All change orders shall specify in detail any
additional work called for and the price for such labor and materials as shall be necessary to complete such
additional work.
5.Contractor warrants it is adequately insured for injury to its employees and any others incurring loss or
injury as a result of the acts of Contractor or its employees and subcontractors.
6.Contractor shall at Owner's xpense obtain all permits necessary for the work to be performed.
Contractor shall not,however,be responsible for obtaining any variances or other zoning relief;or for the
cost thereof,as may be required to enable the Contractor to obtain a building permit.
7. Contractor shall not be liable for removal,recalibration,or replacement of alarm systems,satellite
dishes,wall or window air conditioning units or faulty cable,electrical,and telephone connections.
8. Contractor shall not be liable for any delay due to circumstances beyond its control including strikes,
casualty or general unavailability of materials or the discovery of the conditions or defects upon the site or
in the structure(s)thereon not known to the Contractor at the time of execution of this contract and which
may be discovered during the course of the Contractor's completion of the work. in addition,the Owner
acknowledges and agrees that in certain remodeling work the demolition of portions of the pre-existing
structure may reveal additional defects,conditions or the need for additional work which must be repaired,
altered or carried out in order to commence or complete the work called for in this contract. In such case,
the Owner agrees that the duration of the work and any scheduled date of completion may vary from that
which has may be set forth herein and Owner agrees execute a change order detailing the cost and scope of
the additional work necessary to repair,correct or alter such additional defects and conditions.
9. Contractor warrants all work for a period of 36 months following completion.This warranty is void if
payments have not been made to Company Agent or Foreman when due and in the full amount specified
10. Owner agrees that in the event it becomes necessary for Contractor to collect any payments called for
hereunder or to enforce any provision of this agreement,Owner shall be responsible for the costs of such
collection or enforcement,including reasonable attorney's fees.
You-may cancel this agreement if it has been signed by a party thereto at a place
other than an address of the seller,which may be his main office or branch thereof,
provided you notify the seller in writing at his main office or branch by ordinary
mail posted,by telegram sent or by delivery,not later than midnight of the third
business day following the signing of this agreement.

City of Salem Board of Appeals
Petition of NICK MOSHER, requesting a special permit per Sec. 3.3.5 Nonconfotming Single-and
Two-Family Residential Structures of the Salem Zoning Ordinance, to allow the addition of a second
floor deck onto an existing nonconforming single-family residence, at the property located at 462
LAFAYETTE ST (RI Zoning District).
A public hearing on the above Petition was opened on July 16, 2014 pursuant to M.G.L Ch. 40A, § 11. The
hearing was closed on that date with the following Salem Board of Appeals members present: Ms. Curran
(Chair), Mr. Duffy, Mr. Watkins, and Mr. Copelas (Alternate).
The Petitioner seeks a Special Permit per Section 3.3.3 Nonconforming Structures of the Salem Zoning
Ordinance.
Statements of fact:
4. In the petition date-stamped June 19, 2014, the Petitioner requested a Special Permit in order, to
construct a deck over the existing one-car garage on the property.
2. Mr. Micbael Shapiro, D&H Construction, Peabody, MA presented the petition on behalf of the
applicant.
3. The existing building is nonconforming, so the addition of the proposed deck requires a Special
Permit.
4. The deck would be placed over the existing garage, with an overhang at the front of the garage, and
stairs providing egress from the deck to the rear yard would be added to the back of the garage. The
front edge of the deck would be even with the front facade of the house.
5. Due to the angle of the structure relative to the side lot line, the extension of the deck toward the
street would result in an additional six inches of encroachment on the required side yard width. The
front corner of the deck would be approximately 2.5 feet from the side lot line, while the rear comer
of the existing garage is three (3) feet from the side lot line.
6. An existing second-story side window would become the door to the deck. This window is located
above the front edge of the existing garage, necessitating the extension of the deck beyond the front
edge of the garage in order to facilitate access to the deck.
7. The requested relief, if granted, would allow the Petitioner to construct a deck over the existing
attached one-car garage,with rear stairs and a front overhang.
8. At the public hearing, no members of the public spoke in favor of, or in opposition to, the petition.
The Salem Board of Appeals, after careful consideration of the evidence presented at the public hearing, and
after thorough review of the petitions, including the application narrative and plans, and the Petitioner's

presentation and public testimony, makes the following findings that the proposed project meets the
provisions of the City of Salem Zoning Ordinance:
Findings:
1. The impact of the proposal on the community's needs is no different than what currently exists.
2. The proposal does not impact parking or loading in the area.
3. The proposal does not impact the adequacy of utilities or other public services.
4. The proposal is in keeping with the character of the neighborhood.
5. The proposal does not impact the natural environment.
6. The proposal does not have an economic or fiscal impact.
On the basis of the above statements of facts and findings, the Salem Board of Appeals voted four (4) in
favor (Mr. Watkins, Ms. Curran, Mr. Copelas and Mr. Duffy in favor) and none (0) opposed, to grant the
requested Special Permit to allow the expansion of an existing nonconforming structure, subject to the
following terms, conditions, and safeguards:
1. The Petitioner shall comply with all city and state statutes, ordinances, codes and regulations.
2. All construction shall be done as per the plans and dimensions submitted to and approved by the
Building Commissioner
3. All requirements of the Salem Fire Department relative to smoke, and fire safety shall be strictly
adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. Exterior finishes of new construction shall be in harmony with the existing structure.
6. A Certificate of Inspection is to be obtained.
7. Petitioner is to obtain approval from any City Board or Commission having jurisdiction including,but
not limited to; the Planning Board. T C
