Just as background information, opening access to my front hallway from your unit is not really a possibility for me since it would give whoever bought your unit complete access to mine. I looked into this quite deeply in the 1980s, when I turned the house into condominium units, and was in conversation with the fire department about it. At that time, they determined that the first floor had adequate emergency exits from many windows and a - . door (plus'basemen4—They did approve our curreAt floor-plan (shown in the r architectural drawings I had created as part of the official condominium documents), which does not show my;front door as one of your exits. If you would like to create a second exit by door, or find that the current rules have changed and now require two doors for a first floor, we can talk about where that might be and how best to do it. 1,am sure we can work something out. I understand that you do not want to talk now about the door situation, so I will put in writing what I have learned and would like you to know. On the advice of Joseph Barbeau I spoke to the architect, David Jaquith, who has acknowledged that there may be mistakes in the 1987 plan and will come to visit anytime we wish, to discuss possible changes. In order to be in compliance,the plans will at some point have to be redone and structures in some way altered. Everyone I speak to agrees that egresses are not supposed to be in bedrooms, or to open into other units' living spaces(like my front hallway/stairway - in fact, there is a clause in the Purchase and Sale Agreement that gives exclusive right to Unit 2,to use the first floor entrance to Unit 2). I take responsibility for not reading the 1987 plans closely, and therefore not knowing that an egress was noted through what has been a plaster wall on my side since the early 1980s, at least. Apparently the Fire Department largely bases their approval on the architect's plans. It had been my sincere belief from 1986, when I began the conversion of the first floor(which had been a separate apartment I rented to several different tenants) until last week's Violation Notice,that your unit, Unit 1, was completely in compliance with Code, based upon the Fire Department's 1987 approval. I will go on with what I have learned from different people in a minute, but would first like to say earnestly here that I am very very concerned with your safety and do not wish you to have another minute's worry about this. I was extremely agitated and distressed for weeks after your visit to me, when you expressed concern at not being able to find your way to a door from your bedroom, in case of fire at night. I have been concerned about it ever since, and did not know how to resolve this! I had been told by someone years ago that to open the door at the end of the hallway would set a precedent that would therefore create future danger for me. I did not know how to grant what was clearly so important to you,when it was clearly so dangerous for me. However, it seems(I will continue to do research) from talking to people now that I was mistaken in that assumption. If so, we might be able to open that door solely for the time you own your unit,just to give you this safety and peace of mind. I am sure some agreement could be made that would work for both of us until you are able to sell your unit and to move. If we were to do that, we would also have to create a second, legal egress for your unit from some other place so that the unit would be in compliance. One of the reasons I was concerned about this,when I spoke last week with David and Steve Whittier, a local contractor who has worked on many historic structures, was that any new doorway, since �1 it should not come from your bedroom, would most logically be created at the back of the house in order to meet the standards of the Historic District. Possibilities, according to them, would be from Neil's studio (marked"Den") or your kitchen. Obviously, these would not help you in case of fire. Conceivably a second door could be created on the driveway side of your living room, but this would not be much of an improvement for you, from your bedroom. (The Code simply states that a second egress be"as far as possible" from the first.) This is why I particularly asked about the hallway door, for you. The other people I've talked to are four real estate specialists and legal professionals, whom I consulted to try to understand what had happened—not to create threat or animosity between us. Several have offered to serve as mediators for us, should we need their services. Joseph Barbeau said we could certainly go this route,but he and others urged strongly that we resolve this ourselves. It is difficult in the instance of a two-unit condominium association dispute, they say,because there is no one to break a tie. We do, however,have an"arbitration" clause in our Agreement, in case we cannot resolve this ourselves. In that case we would need to pay someone to mediate or arbitrate. If I have in any way seemed difficult to talk to about these things, or have offended you in some other way, I sincerely apologize. While we may have a conflicting interest in this matter, our larger interests as owners and human beings do not need to be in conflict. Besides our friendship, there are other pressing needs, such as the leaking roof,the condo fees and exterior house painting,that we must address together. It seems there are several separate issues in the egress situation: your personal safety, compliance with Fire Codes, creating Unit 1 desirable for resale, and finding a solution that works for me,too. I want to cooperate with you in any way I can to create the outcomes you want and need. I hope you can see that I have wants and needs too. I need privacy and security in my living space,just as you do in yours. I need to protect the value of my property,just as you do yours. This house has been my home since 1983, and I raised my children here. The garden I created from a macadam truck parking lot; your pillared entry from a run-down shed. I am very proud of my work here, and have always operated with integrity. So, again,I truly hope you and Neil will discuss this with me. If we cannot work it out by ourselves, perhaps you have a religious leader who could serve to be a concerned third party for us. Otherwise, we'll have to hire a mediator. If that does not work Joseph Barbeau and his Department will eventually cite us in Civil Court and we will both have to hire lawyers. Jane, I know neither one of us is interested in this! Once Monday came I was able to go in person to Tom St. Pierre,the Building Inspector, to acknowledge a beginning to address the violation. He now has copies of our plans. Joseph Barbeau, who wrote the letter to us of September 21, reached me by phone on Wednesday. We had a good conversation and he answered many of my questions. He let me know that his department considers cases like these to be civil matters, and, aside from registering violations, does not take sides between the parties involved. According to Joseph, it is up to us to straighten out the violation that was revealed by their recent inspection. In their eyes we, as joint owners of the property, are equally responsible for the violation. They don't even, as a rule,make suggestions, although he did talk to me about architectural possibilities based on our plans. He explained that we have quite a long time to resolve this, and can do so ourselves or use a professional mediator of some kind. But I'm sure you've spoken with him yourselves, and this information is not new to you. I would like you both to know that it has been hard to witness our relationship go from friendship to something adversarial,as well as to try to live with the present animosity between us. Maybe most difficult for me is to be accused of being someone who threatens other people's safety. If you have felt frightened or threatened by this situation, so have I. However, it is my commitment to let go of my personal concerns in favor of reaching a larger space of accord and possibility for us both The present confrontation is giving me the gift of an opportunity to straighten out my mistake of long ago: not reviewing the architect's plans adequately. I continue to hold every belief and expectation that we can find a solution among ourselves. I certainly know a lot more than I did a week ago, and am able to make a more informed contribution to our negotiations. I hope we can meet soon and exchange thoughts and ideas, as a beginning.
