In my opinion,the above referenced site was constructed in accordance With the record documentation and plan with the following small differences. 1.The proposed chain link fence between the bituminous and the detention area was eliminated. A second chain link fence was constructed along the northerly property line.The area was gated. 2.A security camera pole was added. 3.The new roof drain drainage system was tied into the existing roof drain system eliminating the proposed 10"ADS pipe to the existing catch basin. At no time shall sediments be deposited in a wetland or water body. During construction, the applicant or his/her designee shall inspect the erosion controls on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission, which reserves the right to require additional erosion and/or damage prevention controls it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of work line has been approved by this Order. NOTICE OF STORMWATER CONTROL AND MAINTENANCE REQUIREMENTS 19. General Conditions Under Massachusetts Wetlands Protection Act (cont.) c) The landowner is responsible for BMP maintenance until the issuing authority is notified that another party has legally assumed responsibility for BMP maintenance. Prior to requesting a Certificate of Compliance, or Partial Certificate of Compliance, the responsible party (defined in General Condition 18(e)) shall execute and submit to the issuing authority an Operation and Maintenance Compliance Statement ("O&M Statement) for the Stormwater BMPs identifying the party responsible for implementing the stormwater BMP Operation and Maintenance Plan ("O&M Plan") and certifying the following: i.) the O&M Plan is complete and will be implemented upon receipt of the Certificate of Compliance, and ii.) the future responsible parties shall be notified in writing of their ongoing legal responsibility to operate and maintain the stormwater management BMPs and implement the Stormwater Pollution Prevention Plan. d) Post-construction pollution prevention and source control shall be implemented in accordance with the long-term pollution prevention plan section of the approved Stormwater Report and, if applicable, the Stormwater Pollution Prevention Plan required by the National Pollution Discharge Elimination System Multi-Sector General Permit. e) Unless and until another party accepts responsibility, the landowner, or owner of any drainage easement, assumes responsibility for maintaining each BMP. To overcome this presumption, the landowner of the property must submit to the issuing authority a legally binding agreement of record, acceptable to the issuing authority, evidencing that another entity has accepted responsibility for maintaining the BMP, and that the proposed responsible party shall be treated as a permittee for purposes of implementing the requirements of Conditions 18(f) through 18(k)with respect to that BMP. Any failure of the proposed responsible party to implement the requirements of Conditions 18(f)through 18(k)with respect to that BMP shall be a violation of the Order of Conditions or Certificate of Compliance. In the case of stormwater BMPs that are serving more than one lot, the legally binding agreement shall also identify the lots that will be serviced by the stormwater BMPs. Introduction • This Notice of Intent is submitted to the City of Salem Conservation Commission on behalf of • Robert Dunham of RTD Nominee Realty Trust (the "Applicant") for the proposed work within the 100-foot buffer of a bordering vegetated wetland .and 200 foot of Riverfront Area in • conjunction with the new addition to the existing commercial/industrial building at 63 '/2 • Jefferson Avenue in Salem, MA. 2. Project Site • The site encompasses approximately 58,500sf of land depicted as Lot 227 and 229 on the City • of Salem's Assessor's Map 24, located at No. 63 '/2 Jefferson Avenue in Salem, Massachusetts • (see Figure 1 — Site Locus). The parcel is bounded by Jefferson Avenue to the West, commercial/industrial lots to the North and South and a resource area associated with an • unnamed brook to the East. The site is currently fully developed, containing a • commercial/industrial building,parking, loading and storage areas. • 3. Resource Areas ` The edge of the BVW has been delineated by Wetlands and Land Management, Inc. on August 6, 2012 and subsequently located by Eaglebrook Engineering and Survey. See Site Plan in • Appendix E for the location of the BVW and Appendix A for the description and the • methodology of the delineation of the BVW. • There are no Priority Habitats of Rare Species, Estimated Habitats of Rare Wildlife or Certified • Vernal Pools in the vicinity of the site (see Appendix A-Wetlands and Land Management, • Inc. report). The Northerly,undeveloped portion of the site lies within flood Zone X as depicted ' on Figure 2 in Appendix B. • 4. Proposed Project The Proposed Project includes the demolition of the roof overhang along the easterly side of the existing building, the removal of storage containers along the northeasterly side of the parcel and the construction of a building addition to the existing single building to the East. • The Proposed Project will take place entirely within the 200-foot Riverfront Area and partially • within the buffer zone to bordering vegetated wetlands. The entire area is currently paved and is • used as parking area, storage and driveway for commercial activities. No work will take place in previously undisturbed areas. • A total of approximately 9,800 sf of area will be temporarily disturbed, out of which 4,684 sf will remain as the permanent building and the rest will be restored as paved parking or driveway/yard. • • • Notice of Intent Page 1 Proposed Addition • 63%Jefferson Avenue • Salem, MA • • • • • 4.1 Proposed building addition • • The proposed addition is a commercial single story building, which will increase the • footprint of the existing building by 47 feet by 99 feet 8 inches and by an area of approximately 4,684 sf. The closest point of the proposed addition is approximately 57 • feet to the wetland line. 4.2 Erosion and Sedimentation Control • Haybales will be placed along the disturbance areas to prevent erosion and sedimentation • from impacting the wetland resources as depicted on the enclosed Site Plan in Appendix • E. Disturbed areas beyond the proposed structures will be restored by re-grading and re- paving the parking and driveway areas. The Site Plan also specifies erosion control • practices to be utilized by the contractor along all onsite disturbance areas to prevent • erosion and sedimentation from impacting wetland resources and abutting properties. • 4.3 Stormwater Management The proposed building addition and re-paving will take place in currently impervious (paved) areas. Since the roof runoff coefficient is the same as the pavement runoff • coefficient no additional stormwater runoff will be generated as a result of the proposed • activities. The site currently contains a stormwater detention area, which was constructed in accordance with an Order of Conditions issued by the Salem Conservation Commission, dated May 14, 1998. Roof runoff from the proposed addition will be • discharged into the existing detention area. Since roof runoff is free of sediments and • contaminants,the proposed project will improve water quality at the site. • 5. Summary • • The Proposed Project, as discussed in this Notice of Intent, will not alter or impact the interests • of the Massachusetts Wetlands Protection Act for the following reasons: • . Wetlands on the site were evaluated using delineation methodology established in the Wetlands Protection Act and the Department of Environmental Protection "Delineating • Bordering Vegetated Wetlands Handbook"dated 1995, and the US Army Corps of • Engineers Manual (1987). These regulations and methodology incorporate the evaluation of hydric soils,predominance of wetland vegetation and wetland hydrology to evaluate • the upper limit of vegetated wetlands. These methods are appropriate to evaluate the • limits of wetlands in the City of Salem. • On site,the property is fully developed with a commercial building and parking lot. To • the east is an unnamed flowing water body with a thickly vegetated wetland and adjacent • buffer zone. The near side of bordering vegetated wetlands affecting this site was • identified with sequentially numbered blue surveyors flagging labeled Al to A16. Flag • Al begins at the southeast comer of the lot and is located at the toe of a well defined slope- The flags trend north/northeasterly continuing along the toe of a moderate slope • at all the wetland flags. A 100-foot buffer zone extends out from the limit of wetlands. • The vegetation in this wetland was comprised almost entirely of common reed(also • known as Phragmites). The adjacent buffer area between the developed portion of the • site and the wetland was overgrown and dominated by Japanese knotweed and staghom • sumac. I prepared one set of wetland data sheets to document the typical transition between the wetlands and the adjacent buffer zone at this site. • • Riverfront Area • The Wetlands Protection Act establishes a two hundred foot riverfront area extending • parallel to the mean high tide line of tidal rivers. The unnamed water body is shown as • being part of a riverine system on the USGS map. The portion of the river adjacent to • this site was identified as a perennial stream on the USGS map. By regulation,a river shown as perennial on the USGS map is presumed to be perennial and would have a 200- • foot riverfront area extending from mean annual high water limit of the river. • • • • • • At this site,the mean annual high water line and the limit of wetlands are essentially coincident. I suggest showing the 200-foot riverfront area limit offset from the wetland • boundary. The parcel is bounded by Jefferson Avenue to the West, commercial/industrial lots to the North and South and a resource area associated with an unnamed • brook to the East. The proposal is limited to the replacement • of an existing asphalt storage area and building overhang with an enclosed building structure. The entire 4,684 sf building addition sits over currently paved surface. While the addition creates no • new impervious area,the enclosure better protects the Owner's stored materials, and reduces risk • of spills, debris, or other contamination of the resource area. • A survey of existing conditions, including resource area delineation,was prepared by Eaglebrook • Engineering and Survey,LLC and is dated August 24,2012. • Stormwater runoff from paved surfaces flows overland to a catch basin with hood and is conveyed • by perforated pipe to a vegetated swale and stormwater detention area,which was constructed in • accordance with an Order of Conditions issued by the Salem Conservation Commission, dated May • 14, 1998. Roof runoff is collected into 6-inch perforated PVC pipes connected to the same catch basin.Roof drainage from the addition will be collected into 6-inch perforated PVC pipe and tied • in to the existing drain system. Under the proposed plan, existing drainage patterns will be • maintained, and stormwater continues to be conveyed via pipe to the existing vegetated swale and • detention basin,where it outlets to the South Mill Pond resource area via 4-inch perforated pipe underdrain systems. • • As no new impervious areas are proposed, additional recharge and treatment are not required,and • have not been provided. • As a redevelopment project,all stormwater management systems have been designed in accordance • with the MADEP's Stormwater Handbook to the maximum extent practicable. • 2.0 LID Measures • • There are two Low Impact Design(LID)techniques utilized as part of this project. While the • techniques are not specific structural Best Management Practices (BMP's),they are a key • component of any LID project. The proposed roof drain system will connect to an existing drainage system on the site, therefore no new discharges are created. • • 4.0 Standard 2: Peak Rate Attenuation • • Standard 2 requires that peak rates of flow be attenuated for the proposed development condition. • As no new impervious surfaces are being created,peak flows will be at or below existing condition rates. • 5.0 Standard 3: Recharge • • Standard 3 requires that the loss of annual recharge to groundwater be eliminated or minimized through the use of infiltration measures including environmentally sensitive site design, low impact • development techniques, stormwater best management practices, and good operation and • maintenance. As no new impervious surfaces are proposed that prevent natural recharge,there will • be no change to the annual recharge to groundwater and therefore Standard 3 is met. • 6.0 Standard 4: Water Quality • • The Stormwater Management Standards require that systems be designed to remove 80% of the • average annual post-construction load of Total Suspended Solids(TSS)from impervious surfaces. • As no new impervious surfaces are proposed, Standard 4 is met. • Additionally,a minimum requirement of redevelopment projects is to create a Long Term Pollution • Prevention Plan(LTPPP). The general contractor for the project will be responsible for • implementation of the construction period controls. • 10.1 EROSION AND SEDIMENT CONTROL MEASURES • The project will not disturb more than one acre of land during the construction process and so will • not require a NPDES Construction General Permit issued by the Environmental Protection Agency. • Due to the site location within Resource Areas, erosion and sedimentation controls will be • employed to prevent the erosion and transport of sediment into resource areas during the construction of the project. Erosion and sedimentation control measures will be installed prior to • site excavation or disturbance and will be maintained throughout the construction period. Below is a description of some of the erosion and sediment control measures recommended for project site. The barrier will be placed to trap sediment transported • by runoff before it reaches the drainage system or leaves the construction site. The silt fence is a • semi-permeable barrier made of a synthetic porous fabric which provides additional protection when used with straw bale barriers. When necessary,additional straw bale and silt fence barriers • will be installed immediately down gradient of erosion-prone areas, such as the base of steep • exposed slopes and around the base of stockpiles,throughout the construction phase of the project. • The barriers will be entrenched into the substrate to prevent underElow. • The erosion control barriers will be inspected weekly and after every storm event.Any sediment • that collects behind the barriers will be removed and will be either reused at the site or disposed of • at a suitable offsite location.Any damaged sections of silt fence or hay bales will be repaired or replaced. The underside of straw bales will be kept in close contact with the earth and reset as • necessary. Straw bale barriers and silt fences will be maintained and cleaned until slopes have L • healthy stands of grass. • Catch Basin Inlet Protection The inlets of proposed catch basins will be protected from sediment inflow during the work period through the installation of SiltsacksTM, or by surrounding them with a barrier of staked straw bales. • In the latter case, a layer of filter fabric will be installed beneath the grates of the catch basins. • These protection measures will be inspected after every storm event and will be routinely • maintained until the drainage area tributary to each inlet has been stabilized with vegetation and/or covered by pavement.Any sediment that collects behind the barrier or in the sacks will be removed and will be either reused onsite or disposed of at a suitable off-site location. • Dust Control • • Fugitive dust from large areas of unstabilized soil can be a problem during construction. On dry • and windy days when dust generation is a concern, a water truck will traverse the site and spray water as necessary to prevent dust from forming. Calcium chloride may also be applied to the • ground in granular form to attract atmospheric moisture, dampening the ground and preventing • fugitive dust. • Slope Stabilization • • A temporary vegetative cover will be established on areas of exposed soils(including stockpiles) that remain inactive and unstabilized for a period of more than 30 days for slopes, and weather • permitting. On slopes 4:1 and • greater,loamed and seeded areas will be mulched with hay to prevent erosion prior to germination of the seed. After disturbed areas have been stabilized,the temporary erosion control measures • will be removed and accumulated sediment will be removed and disposed of in an appropriate • location. • Stabilized Construction Entrance • • Temporary stabilized construction entrances will be installed at the site. The purpose of the construction entrance is to remove sediment attached to vehicle tires and to minimize sediment • transport and deposition onto public road surfaces. The construction entrances will be composed of beds of crushed stone which will be replenished as necessary to maintain their proper function. • The stone will be placed over a layer of non-woven filter fabric. The stabilized construction • entrances will remain in place until a binder coat of pavement has been established in areas to be paved. • Diversion Channels • If required,temporary diversion channels will also be used to collect runoff from construction areas • and convey it to a temporary sediment basin or trap.Diversion Channels will be constructed • properly with stabilized beds using crushed stone,plastic or other approved materials,crushed stone check dams or polymer treatments as necessary. •• Temporary diversion channels will remain in place until slopes are permanently stabilized or graded level. If vegetation of the diversion channel is required to avoid erosion of the channel,the channel will be temporarily stabilized to ensure viability of the grass seed. • • Dewatering Straw Bale Basins and Filter Bats • Dewatering basins will be established in the event that dewatering activities are required on the • site. The dewatering basin will consist of a ring of staked straw bales overlain by non-woven • geotextile filter fabric and crushed stone established on a stable surface. Discharge water will be pumped into the basin and allowed to drain through the fabric onto stabilized surfaces.Dewatering filter bags may be used in place of straw bale basins. To ensure proper installation, filter bags will • be placed on relatively flat terrain free of brush and stumps to avoid ruptures and punctures.Proper • installation requires cutting a small hole in the corner of the bag,inserting the pump discharge hose, and securing the discharge hose to the bag with a hose clamp. Filter bags are to be constructed of non-woven geotextile fabric.A maximum of one six inch discharge hose will be allowed per filter bag.To help prevent punctures, geotextile fabric will be placed beneath the filter • bag when used in wooded locations. Unattended filter bags will be encircled with a straw bale or silt fence barrier. The following good • housekeeping practices will be followed on-site during the construction period. • • An effort will be made to store only enough product required to do the job. • • All materials stored on-site will be stored in a neat,orderly manner in their appropriate • containers, and(if possible)under a roof or other enclosure. . • Products will be kept in their original containers with the original manufacturer's label. • • Substances will not be mixed with one another unless recommended by the manufacturer. • • Whenever possible, all of a product will be used before disposing of the container. Manufacturer's recommendations for proper use and disposal will be followed. • • The site superintendent will inspect the storage area daily to ensure proper use and disposal of • materials on-site. • The following practices will reduce the risks associated with hazardous materials (e.g.,petroleum • products, solvents): • • A copy of all Material Safety Data Sheets(MSDS) for materials or products used during • construction will be kept in the office trailer. • . Necessary sediment removal, earth repair and/or • reseeding shall be performed immediately upon identification. • Dispose and transport accumulated sediment and remove materials off-site in accordance with • applicable local, state,and federal guidelines and regulations. • • Dispose and transport accumulated sediment from catch basins and area drain off-site in accordance with applicable local,state and federal guidelines and regulations. • • Remove accumulated leaves and debris from catch basins and area drain openings. 11.0 Standard 9: Operation and Maintenance Plan • The goal of the operation and maintenance plan is not only to protect resources on-site or nearby, • but also to protect resources in the region that may be affected by the activities at the site. The stormwater management system will be owned by RTD Nominee Realty Trust, and they will • be responsible for operation and maintenance. • 11.1 STRUCTURAL POLLUTANT CONTROLS The proposed stormwater management system is designed to protect runoff water quality through the removal of sediment and pollutants. Structural pollutant controls used to separate and capture • stormwater pollutants are described below. • Catch Basins • • The existing catch basin will be replaced with a structure equipped with a deep sump and hooded • outlet to trap debris, sediments, and floating contaminants,which are the largest constituents of urban runoff. The proper removal of sediments and associated pollutants and trash occurs only • when catch basin inlets and sumps are cleaned out regularly. The more frequent the cleaning,the • less likely sediments will be re-suspended and subsequently discharged. In addition, frequent • cleaning also results in more volume available for future deposition and enhances overall performance. • • The catch basin will be inspected at least four times per year and cleaned a minimum of at least • once per year. Sediment(if more than six inches deep)and/or Bearable pollutants will be pumped from the basin and disposed of at an approved offsite facility in accordance with all applicable • regulations. Any structural damage or other indication of malfunction will be reported to the site • manager and repaired as necessary. During colder periods,the catch basin grates will be kept free • of snow and ice. During warmer periods,catch basin grates will be kept free of leaves,litter, sand, and debris. Regular maintenance and cleaning of catch basins will assure adequate performance of these structures. Stormwater Outfalls • The stormwater drainage system at the Project site has one existing outfall location. The outfall • location will be inspected monthly for the first three months after construction to ensure proper functioning and correct any areas that have settled or are not functioning correctly. The outfall will • be inspected annually after the initial three month period. Vegetation around the outfall will be • maintained to prevent blockages at the outfall. Rip-rap will be maintained,as necessary. The • owner shall remove and properly dispose of trash and debris at the outfall. Long-term,Weeds and invasive plant species will be removed by hand. However, the original detention basin has been Increased in size to accommodate the runoff volume and peak discharges.
