A hearing on this petition was held December 16, 1998 with the
following Board Members present: Nina Cohen;Chairman, Richard Dionne,
Michael Ward, Stephen Buczko and Stephen Harris. Notice of the
hearing was sent to abutters and others and notices of the hearing
were properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
Petitioner is requesting a Special Permit to allow a mixed use with a
maximum 8 car capacity for rental, leasing and sale of cars for the
property 290 Canal Street.
The provision of the Salem Zoning Ordinance which is applicable to
this request for a Special Permit is Section 5-3(j ) , which provides
as follows:
Notwithstanding anything to the contrary appearing in this Ordinance,
the Board of Appeal may, in accordance with the procedure and
conditions set forth in Sections 8-6 and 9-4, grant Special Permits
for alterations and reconstruction of nonconforming structures, and
for changes , enlargement, extension or expansion of nonconforming
- lots, land, structures, and uses, provided, however, that such
change, extension, enlargement or expansion shall not be
substantially more detrimental than the existing nonconforming use to
the neighborhood.
in more general terms, this Board is, when reviewing Special Permit
requests, guided by the rule that a Special Permit request may be
granted upon a finding by the Board that the grant of the Special
Permit will promote the public health, safety, convenience and
welfare of the City's inhabitants .
The Board of Appeal, after careful consideration of the evidence
presented at the hearing and after viewing the plans, makes the
following findings of fact:
1 . Petitioner was represented by Steven Bornstein, Trustee for the
JEDS Realty Trust of Peabody.
2 . Petitioner sought a special permit to allow the property to be
used for the purpose of selling no more than 6 used cars.
Presently he operates a gas station\mini mart with a car wash and
a car rental and leasing business on the site. The car rental and
leasing business was permitted by this Board under a decision
issued in March 19998.
3. Petitioner stated that he has applied to the Licensing Board for
a used car lot permit, but was told that the permit could not be
considered until the Zoning Board issued a special permit for a
used car business on the site.

4 . The Variance was withdrawn without prejudice.
5. There was no opposition to the special permit.
On the basis of the above findings of fact, and the evidence
presented, the Board of Appeal concludes as follows:
1 . The Special Permit requested can be granted without substantial
detriment to the public good or without nullifying and substantially
derogating from the intent of the district or the purpose of the
ordinance.
2. The granting of the Special Permit requested will promote the
public health, safety, convenience and welfare of the City's
inhabitants and may be granted in harmony with the neighborhood.
Therefore, the Zoning Board of Appeal voted unanimously, 5-0 to
grant the Special Permit requested, subject to the following
conditions;
1 . Petitioner shall comply with all city and state statutes,
ordinances, codes and regulations.
2 . All requirements of the Salem Fire Department relative to smoke
and fire safety shall be strictly adhered to.
3 . A Certificate of Inspection shall be obtained.
4. Petitioner is to obtain approval from any City Board or Commission
having jurisdiction including, but not limited to, the Licensing
Board.
5 . Hours of operation shall not extend oast 9:00 p .m.

the release of diesel fuel at the University Fuel facility at 290 Canal Street in Salem,
Massachusetts (the "Site") in accordance with the Massachusetts Contingency Plan,

The Permanent Solution Statement documents that a Permanent Solution has been achieved

SUMMARY OF FINDINGS
Permanent Solution Statement
290 Canal Street, Salem, MA
RTN 3-35673
Site Description
The Site (University Fuel, 290 Canal Street) is located on the west side of Canal Street just south
of Kimball Road. The Site generally is situated in a commercial area of Salem in the vicinity of
Salem State University. A large, paved, University parking lot is present opposite the Site on the
west side of Canal Street.
A wetland area, that is associated with the Forest River and is located at the edge of a large
area of pavement southwest of the Site. The edge of the wetland area is approximately 150
feet southwest of the release location.
The area is entirely paved except for the wetland associated with the Forest River and a small
green area south of the residential building, as shown on Figure 2. The topography slopes from
a high point at the end of Bertini Lane. Surface runoff flows easterly toward Canal Street and
northerly toward the Forest River. The is served by municipal water and sewer.
According to the Massachusetts Geographic Information System (MassGIS) and information
available from various municipal offices, the Site is not located within a designated
groundwater supply or potential supply area. Wetlands associated with the Forest River are
present to the north of the Site. There are no other natural or public resource areas, as listed in
the MCP requirements under 310 CMR 40.0483 (1a), located within 500 feet of the Site.
Catch basins are not present in the release area of nearby. Catch basins are present in Canal
Street but they either are upgradient of the release area or beyond the limits of the affected
area.
Description of Release
At about 4:30 pm, on June 13, 2019 an attendant at University Fuel was dispensing diesel fuel
into the fuel tank of a box truck. The attendant left the dispenser unattended to perform other
activities. When the attendant returned, he observed that the fuel was overfilling the fuel tank
as the nozzle failed to stop the fuel flow and fuel and water were flowing across the adjacent
parking lot.to the north. Precipitation had been occurring during day. He pavement was wet
and isolated, small puddles were present. In addition, a larger puddle was present at the edge
of the pavement adjacent to the wetland vegetation in the northwest portion of the affected
area approximately 200 feet from the fuel dispenser.

Immediate Response Action
Commonwealth Tank was contracted to remediate the release. MassDEP orally approved an
Immediate Response Action (IRA)that included the recovery of all LNAPL and petroleum-
contaminated standing water on the parking lot, as well as to remediate the affected asphalt
surfaces with Speedi Dri.
Later on, June 13 2019,three Comm Tank technicians arrived on site to perform IRA activities.
Speedi Dri was spread across the entire affected area and absorbent pads were used to remove
the oil that was present on the surface of the puddles. A total of nine-55-alion drums were
filled with the spent Speedi Dri and absorbent pads. An inspection of the Site conducted by the
LSP on June 15, 2019 noted that the affected area had been cleaned very effectively. No sheen
was observed on the surface of the large puddle adjacent to the wetlands. There was no other
standing water observed in the vicinity. Approximately 20 pads remained on the surface of the
puddle.
Comm Tank spread Speedi Dri and absorbents pads as appropriate to collect the oil/water
mixture. Eight 55-gallon drums were used on the paved area that contained primarily spent
Speedi Dri. A separate drum was used to collect the absorbents pads used on the incidental
puddles and the larger puddle adjacent to the wetland. Five of the drums were collected by
Murphy's Waste Oil Service of Woburn, MA on July 1, 2019. These drums were transported,
along with materials from other clients, which accounts for the additional volume that is
indicated on the manifest. The remaining four drums were collected by Spring Grove Resource
Recovery, Inc. of Cincinnati, OH on August 8, 2019.
Risk Characterization
The Site conditions and Contaminants of Concern (COC) (diesel fuel oi), were evaluated to
determine risk to public safety pursuant to the MCP at 310 CMR 40.0960. There are no open,
rusted or corroded drums or containers of chemicals at the Disposal Site. No open pits or
lagoons are present at the Disposal Site, and there are no risks of fire or explosion of the COCs
at the Disposal Site. In addition, no uncontainerized materials which exhibit the characteristics
of corrosivity, reactivity or flammability as described in the MCP at 310 CMR 40.0347 are
present. Therefore, it is the opinion of the LSP that a condition of No Significant Risk to public
safety exists at the Disposal Site.
The Risk Characterization finds that a condition of No Significant Risk of harm to human health
exists within the Disposal Site Area with respect to the diesel fuel release and with respect to all
current and reasonably foreseeable future uses of the Disposal Site Area. The LSP also is of the
opinion that conditions within the Disposal Site Area with respect to the diesel fuel release
present to No Significant Risk of harm to public welfare, safety or to the environment.
Response actions conducted at the Site resulted in the elimination, or reduction to background
levels, of contamination associated with the release. Based on the observations of the LSP
made during the Site inspection, there are no catch basins in the area;therefore, there is no
evidence to indicate that diesel fuel migrated into the stormwater collection system, or

beneath or through the paved surface. Therefore, evaluation of the feasibility of restoration to
background is not required.
The performance of response actions resulted in the elimination of sources of contamination
and prevented the migration of contamination to subsurface soil and groundwater and surface
water. The response actions have achieved of a condition of No Significant Risk of harm to
human health, public welfare, safety and the environment. Therefore,the LSP is of the opinion
that a Permanent Solution with No Conditions has been achieved for the Disposal Site Area. An
Activity and Use Limitation (AUL) is not necessary to maintain a condition of No Significant Risk.
