A hearing on this petition was held October 20, 1999 with the following Board Members
present: Nina Cohen, Chairman, Michael Ward, Stephen Buczko, Stephen Harris, and
Richard Dionne. Notice of the hearing was sent to abutters and others and notices of
the hearing were properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
Petitioner requests a Special Permit to allow use of the pre,Wises for boat storage and
maintenance for the property located at-266 Canal Street B-2.
The provision of the Salem Zoning Ordinance which is applicable to this request for a
Special Permit is section 5-3 Q), which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance, the Board of
Appeal may, in accordance with the procedure and conditions set forth in Section 8-6
and 9-4, grant Special Permits for alterations and reconstruction of nonconforming
structures, and for changes, enlargement, extension of expansion of nonconforming lots,
land, structures, and uses, provided, however, that such change, extension,
enlargement or expansion shall not be substantially more detrimental than the existing
nonconforming use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests, guided by
the rule that a Special Permit request may be granted upon a finding by the Board that
the grant of the Special Permit will promote the public health, safety, convenience and
welfare of the City's inhabitants.
A. Special conditions and circumstances exist which especially affect the land, building
or structure involved and which are not generally affecting other lands, buildings or
stuctures in the same district.
B. Literal enforcement of the provisions of the Zoning Ordinance would involve
Substantial hardship, financial or otherwise, to the petitioner.
C. Desirable relief may be granted without substantial detriment to the public good and
Without nullifying or substantially derogating from the intent of the district or the
purpose of the ordinance.
The Board of Appeal, after careful consideration of the evidence presented, and
after viewing the plans, makes the following findings of fact:

1. The petitioner, Fred J. Dion Yacht Yard Inc. was represented by Attorney George
W. Atkins III, of 59 Federal Street, Salem
2. The petitioner requests a Special Permit to allow use of the premises for boat
storage and maintenance in accordance with Section 5-3 (f) (2) and Section 9-4
of the Salem Zoning Ordinance.
3. The subject property is owned by 266 Canal Street Trust of which John Bertini is
a Trustee. Fred J. Dion Yacht Yard, Inc. plans on leasing the property from 266
Canal Street Trust.
4. A zoning district boundary divides the subject property; the property is located in
both the B-2 District and I District. The proposed use is an allowed in the I District
and special permit use in the B-2 District.
5. No changes to the structure are planned. Minor construction including the
installation of a ramp and expanding access doors will be performed. Also, a
sprinkler system will be installed as per the request of the Salem Fire Department.
6. Approximately 60 boats will be stored on site with half being stored outside and
half inside.
7. Boat maintenance to be performed includes simple maintenance,
waxing/polishing, winterizing engines, replacement of parts, equipment
installation, bottom sanding and painting. The sanding and painting operation will
be performed inside the existing building. Major work will be performed at Fred J.
Dion Yacht Yard, Inc.'s Glendale Street facility.
8. Only incidental sales will be performed at the site.
9. No opposition to the requested Special Permit was presented.
On the basis of the above findings of fact, and on the evidence presented at the hearing,
the Board of Appeal concludes as follows;
1. Literal enforcement of the provisions of the ordinance would involve substantial
hardship on the petitioner.
2. The relief requested can be granted without substantial detriment to the public good
and without nullifying or substantially derogating from the intent of the district or the
purpose of the ordinance.

Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the relief
requested, subject to the following conditions:
1. Petitioner shall comply with all city and state statues, codes ordinances and

2. All construction shall be done per the plans anddimensionssubmitted and approved
by the Zoning Enforcement Officer.
3. All requirements of the Salem Fire Department relative to smoke and fire safety
shall be strictly adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. A Certificate of Inspection shall be obtained.
6. Petitioner shall obtain proper street numbering form the City of Salem Assessors
office and shall display said number so as to be visible from the street.
7. Petitioner is to obtain approval from any City Board or Commission having
jurisdiction including, but not limited to, the Planning Board and Conservation
Commission.

A hearing on this petition was held on December 17, 1980 with the following
Board Members present: Douglas Hopper, Chairman; Messrs. Piemonte, LaBrecque,
Feeherry and Hacker. Notice of the hearing was sent to abutters and others and
a notice of the hearing was published in the Salem Evening News on December 3,
and December 10, 1980 in accordance with Massachusetts General Laws Chapter 40A.
The Petitioners have requested a Special Permit to allow the premises at
266 Canal Street to be used for a roller skating or ice skating rink.
The building at 266 Canal Street is in a B=2 and RC Zoning district.
However, by virtue of a prior variance, the building may be used for all purposes
permitted in a B-2 district. A special permit is now requested to allow use of
the premises for a recreational facility, a use permitted by special permit in
a B-2 zoning district. The Special Permit which has been requested may be granted
upon a finding by the Board of Appeals, that the grant of the. Special Permit will _
promote the public health, safety, convenience and welfare of the City's in-
habitants.
The Board of Appeals, after considering the evidence presented at the
hearing, and after viewing the property, makes the following findings of fact:
1. The proposed facility was unopposed by abutters.
2. The proposed use will result in an improvement -in the appearance of
the property.
3. The proposed facility will have adequate parking and will not adversely
affect the neighborhood.
On the basis of the above findings of fact and on the evidence presented
at the public hearing, the Board of Appeals concludes unanimously that the
proposed use will promote the health, safety, convenience, and welfare of the
City's inhabitants and that the proposed use is in harmony with the Zoning Ordinance.
Accordingly, the Board votes in favor of granting a Special Permit to the Petition-
ers.
The Special Permit is therefore granted in accordance with the following terms
and conditions:

1. There will be no filling or any other construction behind the existing
fence at the site.
2. The proposed facility will be confined to the existing fenced in area
at the site and the existing fence at the site will be maintained.
3. No alcohol will be served in the facility.
4. Hours of operation shall be limited to 11 P.M. on Monday, Tuesday,
Wednesday, Thursday and Sunday and 12 o'clock midnight on Friday.and Saturday. '
5. Lighting in the parking lot shall be constructed so as to shield the
light from the surrounding neighborhood. ,
6. One hundred and forty one parking spaces shall be maintained in the
existing fenced in area,
7. The configuration on the driveway entrance and exit shall be subject
to the approval of the City Engineer.

Dear Sir,
At your request an inspection of 266 Canal Street was performed
by this department in the company of Lt. David Goggin of the
Salem Fire Pervention Bureau.
It is my determination that the present building is of 2C construction
and is classified as a "Type A - High Hazard" use classification as
defined .in the Massachusetts State Building Code .
She building at present does not conform to the Massachusetts State
Code , in that the code requires a structure of that size
(appox. 23 ,800 sq. ft. ) be divided by a fire wall .
Any furthu.r expansion of the structure would require that the
entire building comply with the code requirements for a
"';ype A classified building." Among other requirements , this
would mean that all exterior walls , floors , ceilings and interior
partitions be of four hour rated materials.
It would appear that expansion of the present building would
entail a great deal of expense and not appear practical at this time .

A hearing on this Petition was held on October 29, 1980 with the following
Board Members present: Mr. Piemonte (Vice Chairman) , Acting Chairman; Messrs.
Feeherry, Hacker and Associate Member Luzinski. Notices of the hearing were
sent to abutters and others and a notice of the hearing was published in the
Salem Evening News on October 15, 1980 and October 22, 1980, in accordance
with Massachusetts General Laws, Chapter 40A.
The Petitioner has requested a variance for that portion of property
at 266 Canal Street which is in an R-C zoning district so as to permit that
portion of the land to be used in conjunction with the permitted B-2 uses
on another portion of the land in question.
The Board of Appeals, after consideration of the evidence presented at
the public hearing and after viewing the property makes the following findings
of fact:
1. Plans were submitted showing the premises at 266 Canal Street
consisting of approximately 3 acres with an existing building structure
approximately 350 feet long and 70 feet wide.
2. The plan submitted to the Board also showed that the zoning line
divided the building as well ,as the land into a B-2 and R-C zone.
3. The. Petitioner advised the Board that the premises in question had
been used for a variety of manufacturing and industrial purposes as well as a
warehouse prior to a 1969 zoning change. The zoning change in 1969 resulted in
a portion of the land and building being zoned for business purposes and
designated B-2 and the balance of the land and building being designated R-C.
4. The division of the building into B-2 and R-C zoning districts makes
it virtually impossible to use the existing building as a whole and imposes
a hardship on the petitioner.
5. The Planning Board of the City of Salem has recommended approval of
the requested variance for the existing building.
The Board of Appeals, after consideration of the evidence presented at
the public hearing and after viewing the property makes the following findings
of fact: _.
1. The particular condition affecting the petitioner's property (i.e..
divided by a zoning line) presents a unique and onerous condition for the
owner of the property.

2. The condition described above especially affects the structure in
question but does not generally affect the zoning district in which the
building is located.
3. The conditions described above which affect the land in question, but
not the zoning district generally cause special hardship to the petitioner.
4. The desired variance may be granted without substantial detriment
to the public good.
Therefore, the Board of Zoning Appeals, unanimously voted in favor of
granting the requested relief. The Board grants a variance to the petitioner
on the following .terms and conditions:
A variance is granted so as to permit the portion of the existing build-
ing on this property not presently zoned B-2 to be used for permitted uses
in a B-2 zone, provided however, that the use of the property as a research
and development facility or as a laboratory facility will require prior approval
of the Board of Appeals.

rya As a result of an inspection conducted on R;arch 18, 1976 by
r this Bureau, of the premises owned and occupied by you at
266 Canal Street, Salem, Mass. ; the following items were noted
as requireing attention. These recommendations for correction
ofthe conditions found in violation of law, are made in the
interest of fire prevention and life safety. These conditions
" shall. be corrected within 14 days of receipt of this notice , but
, no later than April 15, 1976.
' If at the expiration of the time allowed these conditions have
"'e, not been remedied and no cause aforesaid be shown, such furthur
action will be taken as the law requires. `�
1. It .is recommended that no warehouse for the storage of high
hazard materials be in excess of 50, 000 sq . feet, per Standard
231B, Section 221 of the National Fire Code, which is the Standard
applicable under The Salem Fire Code.
The structure as built and approved on 6/6/72, while not fully
', t,}• in compliance with the current codes, will be permitted to
continue in operation, until such time as the law may require

and connections. The use of a plastic type nozzle is acceptable.

facility as a warehouse will be contingent on compliance with
the above recommendations.
10. No manufacturing process shall be permitted on this premises

As there is no City of Salem sewer line in the section
of Canal Street abutting our property, we are going forward
with plans to install a private sewage disposal system at
the earliest possible date.
The building in question is to be used for warehouse and
shipping purposes .
We do not anticipate any situation in the future which
would require the employment of more than fifteen people at
this facility.
It is hoped that the above gives you the information

In answer to your recent letter (not dated)., you are advised that the fold
action must be taken with alldna haste to provide a private sewage disposal
system or your warehouse at 2 anal Street in Salem.
(1) Plans and construction for the private sewage disposal system
must be done in accordance with Article xi of the Sanitary
Code of the Commonwealth of Massachusetts
(2) Person or firm designing the private sewage disposal system
must have percolation tests and observation pits dog in
the presence of a representative of the Salem Board of Health
(3) Installation of the system cannot be started until such time
as written approval is granted by the Salem Board of Health
(4) Person or firm installing the private sewage disposal syatem
must have a "Salem Disposal Works Installer's Permit".

Dear Kevin:
The above-referenced 3 . 04 acre parcel is located in a combined
Industrial/B/2/RC zone, and contains a 26 , 250 ± square foot
building previously used for manufacturing purposes and currently
used as a consignment sales market .
The owners of the property, 266 Canal Street Trust, has
received a proposal for lease of the property for use as a boat
storage or boat storage and service facility.
As we have discussed, the proposed use will require approval
of the zoning board of appeals, but my clients first need your
opinion as to whether the change of use will require installation
of a sprinkler system. Although the Building Code appears to allow
auto storage and service without a sprinkler system, there is no
category for boat storage or boat storage and service .
Please review whether a sprinkler system is required for this
building to be used for (a) boat storage, and (b) boat storage and
service .
