Of fICF DECISION OF THE PETITION OF GARN'DER MATTRESS, INC.REQUESTING A VARIANCE FOR THE PROPERTY LOCATED AT 254 CANAL STREET (I) A hearing on this petition was held May 20, 1998 with the following Board members present: Nina Cohen, Paul Valaskagis, Michael Ward, Ronald Harrison « and Stephen Buczko. Notice of the hearing was sent `to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner requests a Variances on rear setback to allow new enclosure of a loading dock for the property located at 254 Canal Street. The Variance which has been requested may be granted upon a finding of this Board that: 1 . Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other land, buildings , or structures in the same district. 2 Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner. 3. Desirable relief may be granted without substantialdetrimentto the public good and without nullifying or substantially derogation from the intent of the district or the purpose of the Ordinance. -ha Board of Appeal , after careful considerations the eviden: presented at the hearing, makes the following findings' of fact: 1 . The petitioner was represented by John R. Kielty, Esq. . 2 . A plan for the enclosed loading dock, which is to join''te older, established Gardner Mattress Co. building with a newly, constructed building, was presented. 3 . it was noted that a prior variance dated October 25 996, allowed for a 6 foot rear setback for the new building. The 3 foot rear setback that is requested by the petitioner would jut into an unused railroad spur which is currently being prepared as part of the city's new bike path. 5. There was no opposition to the petition. Cn the basis of the above findings of fact, and on the evidence presented at the hearings, the Board of Appeal concludes as follows: 1 . Special conditions exist which especially affect the subject property and not the district in general . 2 . Literal enforcement of the provisions of the Zoning Ordinance would involve substation hardship to the petitioner. DECISION ON THE PETITION OF GARNDER MATTRESS, INC REQUESTING A VARIANCE FOR THE PROPERTY LOCATED AT 254 CANAL STREET (I) page two 3. Desirable relief can be granted without substantial detriment to public good and without nullifying and substantially derogating from the intent of the district or purpose of the Ordinance. On the basis of the above findings of fact, and on the evidence presented at the hearing, the Zoning Board of Appeal voted unanimously, 5-0 to grant the variance requested, subject to the following conditions: 1 . Petitioner shall comply with all city and state statures, ordinances, codes and regulations. 2 . All construction shall be done as per the plans and dimensions submitted. 3. All requirements of the Salem Fire Department relative to smoke and safety shall be strictly adhered to. A Certificate of Occupancy is to be obtained. S. Petitioner shall obtain a building permit prior to beginning any construction. 6. Exterior finishes of the new construction shall be in harmony with the existing structure. 7 . A Certificate of Inspection is to be obtained. S . Petitioner is to obtain approval from any City Board of Commission having jurisdiction including, but not limited to, the Planning Board and Historic Commission. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner, requests a Variance from lot ares, front yard, side yard and rear yard setbacks to allow construction of a new warehousing/manufacturing facility for the property located at 254 Canal Street (I) . The Variance which has been requested may be granted upon a finding of this Board that: 1 . Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other land, buildings, or structures in the same district. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner. 3. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogation from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful considerations the evidence presented at the hearing, makes the following findings of fact: 1. Petitioner sought variances to undertake a substantial modernization of a mixed industrial and retail property on Canal Street that has been a mattress assembly plant for three generations. 2. Petitioner's plans include the erection of a new mattress assembly plant to replace 3 trailers, the renovation of an existing building for mixed retail and office use, and a re-engineered traffic pattern among the buildings on the 20,000 sq. foot site. 3. Petitioner's representative stated that the proposed plans were necessarily tentative, as the site work required SRA approval, Site Plan review, and approvals by the Conservation Commission. 4. There was no opposition the proposed plans. On the basis of the above findings of fact, and on the evidence presented at the hearings, the Board of Appeal concludes as follows: 1. Special conditions exist which especially affect the subject property and not the district in general. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substation hardship to the petitioner. Gar�ner NIA lA( � Mattress - 25.0-254 Canal Streetf On Thursday, December 5, 1996, the Planning Board of the City of Salem opened a public hearing regarding the application of Gardner Mattress, Inc., under Section 7-18, Site Plan Review of the Salem Zoning Ordinance, with respect to the construction of a 60 x 80 warehouse building and the demolition of existing storage trailers at Gardner Mattress, located at 250-254 Canal Street. The public hearing was closed on December 19, 1996. At a regularly scheduled meeting of the Planning Board held on December 19, 1996, the Board voted by a vote of six(6) in favor, none opposed , to approve the application as complying with the requirements of Section 7-18, subject to the following conditions: 1. Conformance with Plan All work shall conform with set of plans entitled, "Site Plan in Salem, MA", prepared for Gardner Mattress, prepared by Coastal Survey, dated July 8, 1996, revised October 23, 1996 and revised October 30, 1996. The first floor elevation of the proposed building shall be shown on the plan. 2. Amendments Any amendments to the above referenced plans or waiver of conditions contained herein may require the approval bfthe Planning Board. 3. Utilities A. Utility installation shall be reviewed and approved by the City Engineer prior to the issuance of a Building Permit. B. All utilities shall be installed underground. 4. Board of Health All Board of Health requirements shall be strictly adhered to. 5. Fire Department All requirements of the Salem Fire Department shall be strictly adhered to. 6. Building Inspector All requirements of the Salem Building Inspector shall be strictly adhered to. 7. Landscaping A. Clerk of Works The City's Clerk of Works shall be on site as deemed necessary by the City Planner. The cost for this service shall be borne by the applicant. 11. Maintenance A. The Applicant shall employ an acceptable method or means for the holding and disposal of trash after site development. A copy of this information shall be sent to the Planning Department and Health Department. B. Refuse removal, ground maintenance and snow removal shall be the responsibility of the applicant. C. Winter snow in excess of the snow storage areas on the site shall be removed off site. 12. Construction Practices All construction shall be performed in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all rules, regulations and ordinances of the City of Salem. 13. As-Built Plans As-built plans, stamped by a Registered Professional Engineer or Land Surveyor, shall be submitted to the Planning Department and the Engineering Department prior to the issuance of a Certificate of Occupancy. 14. Violations Violations of any condition contained herein may result in revocation of this permit by the Planning Board.
