Enclosed please find a copy of the survey done at subject location by
Carter and Tower Engineering Corp.
Please note that the building is located exactly where we had planned.
However, the islands are slightly off from where we had originally
planned. The change came about as a result of a number of factors.
The original plans done by Ayoub Engineering of Rhode Island had four (4)
51x12 ' islands.
Ayoub's plans were then sent to a design company, Jim Mitchell Associates
in Texas. Mr. Mitchell is a nationally known consultant for C-stores and
gas stations. Mr. Mitchell reduced the size of the islands and slightly
changed their angle for traffic flow and safety reasons. He did this with
his Computer Aid Design (CAD) System which flows vehicles through a
location. Northeast Fire and Safety Equipment recommended a smaller
fire suppression system. The Fire Department and State Fire Marshall
approved the smaller islands and the Northeast letter from a safety
standpoint and stamped my 8-17-89 letter attached hereto.
As you may know, we transported over 1, 000 tons of soil to Maine. The
removal of the soil necessitated us to use tractor trailers similar in
length to the transports that would be delivering gasoline to our site.
As a result of on site discussions with the transport drivers, we felt
that it would be safer to slightly angle the island to facilitate the
transports entering and exiting the property.
Our vendor inadvertently shipped us 10' islands instead of 9' islands but
the change approved by the fire officials was to protect islands under
12 ' .

Pursuant to the authority of C.L. c. 131, s. 40, the Salem
Conservation Commission has reviewed your Notice of Intent
and plans identified above, and has determined that the area on which
the proposed work is to be done is significant to one or more of the
interests listed in G.L. c. 131, s. 40. The Salam Conservation Commission
hereby orders that the following conditions are necessary to protect
said interests and all work shall be performed in strict accordance
with them and with the Notice of Intent and plans identified above
except where such plans are modified by said conditions.

CONDITIONS
1. Failure to comply with all conditions stated herein, and with
all related statutes and other regulatory measures, shall be
deemed cause to revoke or modify this order.

2. This order does not grant any property rights or any exclu-
sive privileges; it does not authorize any injury to private
property or invasion of private rights.
3. This order does not relieve the permittee or any other per-
son of the necessity of complying with all other applicable
federal, state or local statutea; .ordinances, by-laws and/
or regulations.
4. The work authorized hereunder shall be completed within one
(1) year from the date of this order unless it is for a
maintenance dredging project subject to Section 5(9). The
e order may he extended by the issuing authority for one or
more additional one-year periods upon application.to the
said issuing authority at least thirty (30) days prior to
the expiration date of the order or its extension.
5. Any fill used in connection with this project shall be clean
fill, containing no trash, refuse, rubbish or debris, includ-
ing, without limiting the generality of the foregoing, lumber,
'bricks, plaster, wire, lath, paper, cardboard, pipe, tires,
ashes, refrigerators, motor vehicles or parts of any of the
foregoing.
6. No work may be commenced untill all appeal periods have f
elapsed from the -order of the Conservation Commission or from a
a final order by the Department of Environmental Quality
Engineering.
7. No work shall be undertaken until the final order, with
respect to the proposed project, has been recorded in the _
Registry of Deeds for the district in which the land is
located within the chain of title of the affected property.
The Document number indicating such recording shall be sub-
mitted on the form at the end of this order to the issuer
of this order prior to commencement of work.
8. A sign shall be displayed at the site not less than two
square feet or more than three square feet bearing the
words, "Massachusetts Department of Environmental Quality
Engineering, Number C4_61 "
9. Where the Department of Environmental Quality Engineering
is requested to make a determination and to issue a super—
seding order, the Conservation Commission shall be a party
to all agency proceedings and hearings before the Depart—
ment.

10. Upon completion of the work described herein, the applicant
shall forthwith request, in writing, that a Certificate of
Compliance be issued stating that the work has been satis-

work is significant to storm damage prevention and therefore
issues the following order:

On Thursday, June 5, 1980, the Planning Board of the City of Salem held
a publichearing regarding the appli`cation`of-Mr: Richard Salinsky, for
a special permit under section P, Wetlands and Flood Hazard Districts, of
the Salem Zoning_Ordinance, with respect to the installation of new oil
tanks at 45 Canal Stree, Salem.
At a regularly schedualed meeting of the Planning Board on July 2, 1980,
the Board 'voted, by a vote of eight in favor, none opposed, to approve
the application as complying with the requirements for the issuance of
the permit with the following conditions:
1. The work shall be done in accordance with the plans submitted entitled
"New Oil Tanks Installation for BP Gas Station, Salem, Mass. dated 3/25/80
and signed by Robert M. Rumpf ".
I hereby certify that a copy of this decision has been filed with the
City Clerk and a copy is on file with the Planning Board.
This Special Permit shall not take effect until a copy of the decision
bearing the certification of the City Clerk that twenty days have elapsed
and no appeal has been filed or. that if such appeal has been filed, and
it has been dismissed or denied, is recorded in the Essex County Registry
of Deeds and is indexed in the grantor index under the name of the owner
of record or is recorded and noted on the owner's certificate of title.
The fee for recording or registering shall be paid by the owner or

PERMIT AT 145 CANAL STREET (B-4)
A hearing on this petition was held on January 25 , 1989 with the
following Board Members present: James M. Fleming, Chairman;
Messrs . Bencal , Strout , LaBrecque and Nutting. Notice of the
hearing was sent to abutters and others and notices of the
hearing were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A.
Petitioner , owner of the property, is requesting a special permit
to reconstruct nonconforming structures on the premises located
in _a B-4 zone. During the hearing Petitioner requested
withdrawal of its request for a sign variance and the request was
allowed by the Board.
The provision of the Salem Zoning Ordinance which is applicable
to this request for a Special Permit is Section V B 10 , which
provides as follows :
Notwithstanding anything to the contrary appearing in this
Ordinance , the Board of Appeal may, in accordance with the
procedure and conditions set forth in Section VIII F and IX D ,
grant Special Permits for alterations and reconstruction of
nonconforming structures and for changes , enlargement , extension
or expansion of nonconforming lots , land, structures , and uses ,
provided however , that such change , extension, enlargement or
expansion shall not be substantially more detrimental than the
existing nonconforming use to the neighborhood.
In more general terms , this Board is , when reviewing Special
Permit requests , guided by the rule that a Special Permit request
may be granted upon a finding by the Board that the grant of the
Special Permit will promote the public health, safety,
convenience and welfare of the city' s inhabitants .
The Board of Appeal , after careful consideration of the evidence
presented at the hearing, and after viewing the plans , makes the
following findings :
1 . There was no opposition to the petition and the ward
councillor for the district appeared and spoke in
favor.

2 . The proposed reconstruction will improve public safety,
traffic flow and the general appearance of the site .
3 . The existing and proposed uses are allowed uses in the
district.
4 . The plans provided for parking as required by the
Ordinance.
On the basis of the above findings of fact, and on the evidence
presented at the hearing, the Board of Appeal concludes as
follows :
1 . The proposed reconstruction of the nonconforming
structures will promote public safety and convenience .
2 . The Special Permit requested can be granted without
more substantial detriment to the public good than the
existing nonconforming structures and without
nullifying or substantially derogating from the intent
of the district or the purpose of the Ordinance .
Therefore , the Zoning Board of Appeal voted unanimously, 5 - 0 to
grant the Special Permit requested, subject to the following
conditions :
1 . All exterior lighting be directed away from residential
abutters .
2 . Hours of operation shall be 6 A.M. to 11 P .M. Monday
through Friday and 7 A.M. to 11 P .M. Saturday and
Sunday.
3 . Roof drains shall collect and dispense storm water to a
municipal storm drain should such drain be accessible
within a reasonable distance.
4 . A compressed air facility shall be available for public
use during operating hours .
5. Two employees shall be employed at the site during
operating hours .
6 . All requirements of the Salem Fire Department shall be
adhered to.
7 . Construction shall be completed in accordance with the
plans submitted except as any changes may be directed
by the Salem Fire Department and State Fire Marshall .
