Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner, is requesting a Variance from side and rear setbacks to allow the second and third floor porches to be closed in and to enlarge the second and third floor apartments for the property located at 143 Canal Street. The apartments are to be enlarged as follows: Second Floor will be reconstructed into two (2) , one (1) bedroom apartments and two (2) , two (2) bedroom apartments; Third Floor will be reconstructed into Three (3) , one (1) bedroom apartments. The second and third floor porches will be enclosed to accommodate the enlargement the apartments. The Variances which have been requested may be granted upon a finding by this Board that: 1 . Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures involved. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioners. 3. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district of the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1 . There was no opposition in this matter. On the basis of the above findings of fact, and on the evidence presented at the hearing, the Zoning Board of Appeal voted unanimously, 5-0 to grant the variance requested, subject to the following conditions: 1 . Petitioner shall .comply with all city and state statues, ordinances, codes and regulations. 2. Wire Inspector SUBJECT: 143 Canal Street - Inspection conducted on August 28 , 1993 Please be advised , I was called to investigate any electrical problems that may have resulted from a water leak on the second floor. The area of concern was isolated electrically , however, there were a lot of unsafe areas in the building , please note the following : 1 . In the basement, a hot water tank with open wiring to the persons touch. 2. Numerous splice boxes were found to be open and wiring exposed; ;i ^ 3, Th.e oil burner wiring is hap-hazard . 4. At the top of the stairs , in one unit , wiring was exposed out of 2 light fixtures . 5, Th-e same unit had a kitchen fixture that was all rusted out . 6 , There were extension chords coming from the apartment units , plug- ged into the common hall light circuit. 7. Th.e fire alarm panel was found open , when I arrived at the scene . This building is unsafe and my recommendation at this time , is that the code enforcement team visit the site . Salem, mass. 01970 Sirs: As a result of complaints received this date, I have made an inspection of the premises for overcrowded conditions. The following conditions were found to exist at the time of inspection. Inspection Date: Friday Lay 8, 1981 Inspection Time : 1600 hrs 1. Upon arrival I found the occupancy was excessively crowded , and a waiting line out the front entrance door and on the sidewalk. 2. After considerable problem making entrance to the inner hallway and observing the excessive overcrowding within the assembly area, I stepped outside and called for assistance from the Salem Police Department. 3. Upon arrival of Police Officers Emelian and kichaud , we made our way into the assembly area ( Lounge ) ,removinr standing patrons as we entered. Once inside, I ordered the sale of liquor and beer to cease, until furthur notice. The police officers and myself continued to order the patrons who were standing (packed solid , body to body) , to leave the premises. I checked the Certificate of Occupancy, which Lists 128 paersons as the maximum occu nncy. The actual occupancy was in the vicinity of 350 occupants. 4. Encountering some difficulty in removal of the occupants, I requested the response of Engine Co. #5 and Deputy Chief Joseph ',Sullivan to the scene. This is recorded as Incident # 1109, at 1612 hrs. Upon arrival of Engine Co. r5, we set un an orderly pattern of patron dispersal, with the police officers, using both Canal St. egress doors. 5. Upon reaching a point where the occupancy was approximately the 128 persons allowed by the Certificate of Occupancy, we informed the person in char8;e , to initiate a guard at the door and to permit only one person in for each person leaving, r then permitted the bar to re-open. R nrR WYiihholdiu(Massachusetts General laws,Chapter 239,section 8A): If Code Violations Are Not Beteg Corrected you may be entitled to hold back your rent payments.You can do this without being evicted if: A. You can prove that your dwelling unit or common areas contain code violations which are seriornsmough to endanger or materially impair your health or safety and that your landlord knew about the violations before you were behind in- your rent B. You did not cause the violations and they can be repaired while you continue to live in the buildiing C. You are prepared to pay any portion of the rent into court if a judge orders you to pay it (For this.it is best to put the rent money aside in a safe place.) 2.
