As discussed, I spoke to Tom the other day and described what we are doing for this project, essentially, this is an existing commercial facility and we are not making any changes or doing any construction. However, we are moving in store equipment, movable shelving and movable counters. The facility is sprinkled and has all of the necessary fire annunciation equipment in place and existing. In my discussion with Tom, I noted that our plans are primarily indicating handicap circulation, equipment layout and egressing. Tom noted that I should submit the drawing for record and that it would not be necessary to submit for a building permit whereas there is no construction to take place. The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is Section 5-3(j ) , which provides as follows: Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeal may, in accordance with the procedure and conditions set forth in Section 8-6 and 9-4, grant Special Permits for alterations and reconstruction of nonconforming structures, and for changes, enlargement, extension or expansion of nonconforming lots, land, structures, and uses, provided, however, that such change, extension, enlargement or expansion shall not be substantially more detrimental than the existing nonconforming use to the neighborhood.
