Dear Mr. Gattineri:
In response to your letter received by this office on March 21, 2002, I will try to clarify
the building code issue.
Any use group A-1, A-3, A-4,B,E, M , S-1 or F-1 that exceed 12, 000 square feet
requires the addition of a sprinkler system. The use you had proposed was a S-1 use.
Any change of use which would create a "mixed use" building would also trigger a full
sprinkler system.
Any use in Section 402 through 426 will require a sprinkler system.
The only use that would avoid the addition of sprinklers would be a S-2 use group low
hazard storage. See Table 331.3 enclosed
Regardless of whether the building is sprinkled or not, an updated fire alarm system must
be installed Section 917 State Building Code.
If further information is needed please contact this office.
If you wish to appeal an order of the building department yout appeal is to the Board of
Building Regulations and Standards located in the Department of Public Safety, One
Ashburton Place, Boston, Ma. 02108.

Dear Thomas,
Thank you for your letter dated 3/5/02 which we received 3/8/02. We
will notify our tenant of this decision. Due to the fact there may have
been some misinformation as to this tenants ability to lease this space,
we are requesting enough time for this tenant to relocate to a facility that
is more appropriate.
Regarding the change of use issue. The property has not been leased
since purchased and has been emptied to accommodate a potential
tenant for what ever use may be acceptable. Since the boat storage is
unacceptable and some miscommunication may have occurred here,
we are requesting a legal statement defining the change of use.
Regarding a code analysis, thank you for any information. We are not
asking or intending on the city to provide any drawings and or
professional architect services. We are looking for as many examples of

what is permitted in a type 2-c construction that does not have
sprinklers. Please clarify, if the landscapers occupy less then 12,000 sq.
ft in the building which has 15,625 sq. ft and a tenant separation of 2
hour rating is installed if that is acceptable. This is important for our
correct understanding. If the case is that the building is 3,625 sq. ft to
large then we need to know if a decision has to be made to remove this
amount of sq. ft to allow the use or is there a more reasonable solution
or discretion that may be applied.

Dear Mr. Gattinei::
Last week, this Department along with the representatives of Salem Fire Department,
Chief Turner,Fire Marshall Latulippe and John Flock, from the State Fire Marshall's
Office inspected your building at 18 Broadway. We were responding to a complaint
regarding boats being stored in your building.
We found 4 boats being stored inside the building. N.F.P.A. regulations require any
building used for boat storage that exceeds 5000 sq. ft must have fire suppression system
"sprinklers".
Your building is 15, 625 sq. ft. Please have the boats removed within 15 days.
In response to your inquiry on Friday, it is not possible to prepare a code analysis until a
specific use is defined. Also, we are not allowed to prepare your drawings or
specifications. A professional architect should be retained.
I will offer the following information about your building.
The building is type 2-C construction. Any change of use will trigger full code
compliance.
To use the building for landscapers would place the building into a S-1 "Moderate
Storage" use group.
In use group S-1 and F-1 an area of more than 12,000 sq ft would require a sprinkler
system. Additionally, tenant separation walls would be required to be 2 hour rating.
