A public hearing on the above Petition was opened on August 17, 2016 pursuant to M.G.L Ch. 40A, � 11. The hearing was closed on that date with the following Salem Board of Appeals members present: Peter A. Copelas (Vice- Chair),Tom Watkins,Jimmy Tsitsinos, and Paul Viccica (alternate). The Petitioner seeks and amendment to a previously approved Special Permit in accordance with Sec. 3.0 Table of Prindpal and Accessory Use Regulations of the Salem Zoning Ordinance, in order to expand the hours of operation. Statements of fact: 1. In the petition date-stamped July 26, 2016, the Petitioner requested to expand the hours of operation for public days to 12pm to 8pm seven (7) days a week to accommodate private functions and additional public retail hours at select times of the year. 2. The Zoning Board of Appeals approved a special permit date stamped on October 29, 2014. All conditions of the October 29, 2014 special pennit apply unless otherwise specified in this amended decision. 3. Since opening on October 20, 2015, the business Deacon Guiles, has declined to hold private functions at the facility,including birthday parties,rehearsal dinners, and corporate meetings. 4. Additionally, the business has received a number of requests for tours of the facility particularly on Federal and State holidays. 5. The current hours of public operation, as limited by the October 29, 2014 decision. The current permitted of hours of public operation are Friday and Saturday from 12pm -5pm OR 1pm to 6pm with the possibility of expanding hours dependent upon Board of Appeals approval. 6. The petitioner stated that Deacon Guiles will be applying to the Licensing Board for a pouring license. 7. The Board stated that the nature of the business use will change with the addition of a pouring license,if granted. Therefore, the Board requested that the petitioner reduce the request to expand the proposed hours of operation from 12pm-8pm seven (7) days a week to Thursday through Sunday 12pm (noon) to 8pm, federal and state holidays,and private events as scheduled until Spm. 8. The Board also requested that the expansion of the hours of operation shall be for a six (6) month trial period and automatically extended if there are no complaints filed with the Building Inspector. This expansion of hours of operation shall be for a six (6) month trial period and automatically extended after six (6) months if there are no complaints filed with the Building Inspector. 1. Special Condition #6 of the October 29, 2014 special permit shall be replaced with the following condition: "All retail sales at 75 Canal Street will be limited to the public hours. At the public hearing, one (1) member of the public spoke in favor and no (0) members of the public spoke in opposition to the amended decision. Distillery Description The Deacon Giles Distillery is planning a new distilling area and tasting'room.at,75 Canal Street in Salem; MA.'The space will contain three separate rooms: a.public tasting.room, the distilling room, and a storage room. , The proposed distillery is intended to.occupy approximately 5,500 sq. ft. within an existing- industrial building, which is currently divided into multiple, separate tenant spaces. The stated plan for this distillery is to produce quantities of a number of alcoholic beverages (spirits). To produce these various beverages, a still is being installed in the space, which will be used to produce the various liquids; a variety of alcoholic beverages with alcoholic contents ranging . from 40%to 60%by volume. Based on discussions with you,the grains are milled for use in the still for the creation of spirits. The mill takes the grains and."cracks"the.kemels_for_fermenting,Themill_being used_creates particles approximately 1 millimeter in size.. The milled grain is•depositeddrito a hopper,:which is immediately transported via auger to the Mash Tun to create the wort. .Although there might be combustible dust smaller than 420 microns, it is not likely that a dust explosion hazard exists. There is no ignition source within the piece of equipment and all of the dust is confined. In addition,the mill, hopper, and auger are cleaned regularly to prevent cross contamination of batches. The wort is then fermented within the fermenter which creates a solution with approximately 10% alcohol by volume. This solution is then distilled through the use of the steam jacketed boilers. The alcohol that condenses is approximately at 40%ABV. The spirit can be distilled a second time to obtain alcohol at 60%-70% ABV. The distillation process is considered a closed system. The vapor from the boilers condenses directly into the collection containers. No alcohol vapor is released into the distillery room or warehouse. Therefore, as the alcohol is being collected, vapor is assumed to be emitted during the process. After the spirits are in their finished states (40%to 60%by volume),they are either bottled or stored within wooden (oak) barrels for aging before bottling. An exact quantity that is likely to be stored in this facility at any one time is not specifically known at this time. It is intended that those products that will not require aging may be temporarily stored prior to being transferred into glass (750 ml) containers, which will ultimately be stored within cardboard cases until shipped from the facility. Once transferred to the smaller glass containers, the product will only be stored on site for relatively short periods of time prior to being shipped to clients. It is anticipated that the maximum quantities would not exceed that permitted within the building code would result in a High Hazard Building Classification. Based on the parameters outlined in the International Building Code (IBC), the occupancy classification that best"fits"this distillery operation would be that of a"Factory Industrial, F-1, Moderate-hazard"occupancy. The distillery is not separated from the warehouse area by fire rated construction. It is assumed that there is a 1-hour fire separation between the distillery and the adjacent tenant. Also, the building is assumed to be provided with a wet sprinkler system as well as a fire alarm system. A ventilation system is to be provided within the distillery and warehouse to remove any vapors that may have been emitted from the distilling process. The ventilation system is required to meet NFPA 30 (minimum of 1 CFM/ square foot of floor area). NFPA 70 classifies locations based on their hazard. Areas containing flammable gas, flammable liquid-produced vapor, and combustible liquid-produced vapor in:quantities'sufficient to produce explosive or ignitable mixtures are considered Class I locations. NEC—Class I—Combustible/Flammable Liquids/Vapors/Gas Class I locations are further broken into two divisions, Division 1 and 2. Conclusion Based on the definitions of Class I (Divisions 1 and 2), both the still and the collection containers by the still and within 3 feet of the still could be classified as Class 1, Division 1. Due to the open collection of alcohol and the temperature of the distillery, it is assumed that alcohol vapors would be present during the process. The ventilation within the Distillery area will limit the amount of vapors. Areas 3 to 5 feet from the still and the collection container and along the floor within 10 feet of the container would be classified as Class 1, Division 2. DistiIIery Description The Deacon Giles Distillery is planning a new distilling area and tasting room at 75 Canal Street in Salem,MA. The space will contain three separate rooms: a public tasting room,the distilling room,and a storage room. The.proposed distillery is intended to occupy approximately 5,500 sq. ft.within an existing. industrial building,which is currently divided into multiple,separate tenant spaces. The stated plan for this distillery is to produce quantitiesbf a number of alcoholic beverages(spirits). To produce these various beverages, a still is being installed in the space,which will be used to produce the various liquids;a variety of alcoholic beverages with alcoholic contents ranging from 40%to 60%by volume. Based on discussions with you,the grains are milled for use in the still for the creation of spirits. The milt takes thegrains.and.`c,ra_cks'._'Ac-.kernels;for_fermenting_-Thexull_being,uscd,.croates.. _.. . particles approximately 1 millimeter in size. The milled grain is deposited into a hopper,which is immediately transported via auger to the.Mash Tun to create the wort. Although there might be combustible dust smaller than 420 microns, it is not likely that a dust explosion hazard.exists. There is no ignition source within the piece of equipment and all of the dust is confined. In addition,the mill,hopper, and auger are cleaned regularly to prevent cross contamination of batches. The wort is then fermented within the fermenter which creates a solution with approximately 10%alcohol by volume. This solution is then distilled through the use of the steam jacketed boilers. The alcohol that condenses is approximately at 40%ABV. The spirit can be distilled a second time to obtain alcohol at 60%-70%ABV. The distillation process is considered a closed system. The vapor from the boilers condenses directly into the collection containers. No alcohol vapor is released into the distillery room or warehouse. After the spirits are in their finished states(40%to 60%by volume), they are either bottled or stored within wooden (oak) barrels for aging before bottling. An exact quantity that is likely to be stored in this facility at any one time is not specifically known at this time. It is intended that those products that will not require aging may be temporarily stored prior to being transferred into glass(750 in])containers,which will ultimately be stored within cardboard cases until shipped from the facility. Once transferred to the smaller glass containers, the product will only be stored on site for relatively short periods of time prior to being shipped to clients. It is anticipated that the maximum quantities would not exceed that permitted within the building code would result in a High Hazard Building Classification. Based on the parameters outlined in the International Building Code(113C), the occupancy classification that best"fits"this distillery operation would be that of a"Factory Industrial,F-1, Moderate-hazard" occupancy. The distillery is not separated from the warehouse area by fire rated construction. It Is assumed that there is a 1-hour fire separation between the distillery and the adjacent tenant: Also,the building is assumed to be provided with a wet sprinkler system as well as a fire alarm system. A ventilation system is to be provided within the distillery and warehouse to remove any vapors that may have been emitted from the distilling process. Based upon information provided by you and others,the following parameters are the basis for this summary: Building Construction Type= IIIB Previous occupancy of tenant space = Group S-1 Other tenants: Transmission Shop= Group S-1 (motor vehicle repair) Day Care Center=Group E & I-4 Auto Body Shop = Group S-I (motor vehicle repair) Fire Protection=Building equipped with automatic sprinklers The proposed tenant has been identified as a Group F-1 occupancy (distillery - production of beverages exceeding 16% alcohol content - Sec. 306.1) Per Sec. 912 of Chapter 34, the existing buildings code (2009 International Existing Buildings Code plus MA amendments), changes in occupancy are evaluated on the basis of whether or not they constitute increases in the relative hazard of the previously existing versus proposed new occupancy relative to means of egress(IEBC Table 912.4),heights and areas(IEBC Table 912.5), and exterior walls (IEBC Table 912.6). In all cases. there is no increase in the relative hazard with regard to any of these three categories of hazard. As a result, this partial change in occupancy does not require that the existing means of egress and exterior walls must comply with new construction requirements,nor is compliance required with the height and area limits of the code for new construction. A 1 hour fire separation assembly is required by Table 508.4 to separate this new occupancy from the other existing building occupancies. For the altered space,compliance is required with IEBC Chapters 6, 7 and 8 for the altered space. This will require compliance with the code for new construction for altered elements of the new tenant space. The tenant space has an approximate total area of 6,000 gross square feet,with 431 net square feet used as a tasting room, and approximately 200 square feet used as office space. The tasting room and office spaces are sufficiently small so as to qualify as accessory areas for purposes of occupancy classification, but are evaluated separately for purposes of determining occupant loads. The main distillery spaces are determined to have 27 occupants,using a floor area allowance of 1 person per Mr. Edward O. Nilsson Page 2 December 23, 2014 200 gross square feet from Table 1004.1.1. The tasting room is determined to have an occupant load of 29 occupants, using a floor area allowance of 1 person per 15 net square feet(assembly-tables and chairs)from Table 1004.1.1. The office is determined to have an occupant load of 2 occupants, using a floor area allowance of 1 person per 100 gross square feet from'fable 1004.1.1. This yields a total occupant load of 58 persons for the tenant space. In my opinion,the capacity and arrangement of the means of egress for the proposed occupancy complies with applicable building code requirements. The existing fire suppression sprinkler system should be evaluated to ensure that it is adequate for the hazard represented by the new occupancy. Also, the relocation of individual sprinklers will likely be required to accommodate the construction associated with the tenant fit-out. Portable fire extinguishers are also required for the new occupancy. A public hearing on the above Petition was opened on October 15th, 2014 pursuant to M.G.L Ch. 40A, § 11. The heating was dosed on that date with the following Salem Board of Appeals members present: Ms. Curran (Chair),Mr. Dionne,Mr.Watkins,Mr. Duffy,and Mr. Copelas. The Petitioner seeks a Special Permit from the provisions of Section 3.0 Table of Principal and Accessory Use Regulations of the Salem Zoning Ordinance. Statements of fact: 1. In the petition date-stamped September 24th, 2014, the Petitioner requested a Special Permit per Section 3.0 Table of Principal and Accessory Use Re ulakonr of the Salem Zoning Ordinance, in order to allow a brewery, distillery or winery with a tasting room. 2. The Petitioner,Mr. Ian Hunter and co-founder Mr. Brenneman,presented the petition. 3. The proposed brewery, distillery, winery is approximately 6,000 square feet with a 800 square foot tasting room. The proposed tasting room is no larger than 33%of the main building's square footage. 4. The requested relief, if granted, would allow the Petitioner to operate a brewery, distillery or winery with a tasting room. 5. The distillery will provide tours, sell commercial goods branded by the brewery, distillery, winery and sell beverages by the bottle to consumers for consumption off the brewery premises during designated public hours. 6. The tasting room will only provide samples at no charge and will be limited in size as set forth in M.G.L. c. 138. All staff will have a TIPS certification (Training and Intervention Procedures for Servers of Alcohol). 7. No additional parking is needed because it is an existing building. 8. The permitted hours of operation for the tasting room are Friday and Saturday from 12-5pm or 1- 6pm with the possibility of expanding hours into Thursday and Sunday seasonally dependent on Planning Board approval. 9. Deliveries to the facility will be made during regular business hours of operation Monday through Friday from 8am-4pm. The applicant will not have deliveries during drop-off and pick-up times of the daycare facility located within 75 Canal Street. 10. At the public hearing, three (3) members of the public spoke in opposition to the petition. Two (2) members of the public spoke in favor of the petition. The distillery and tasting room will have minimal impact on parking, traffic flow and safety as this is a small business with few deliveries and limited public hours of operation. 2. There are many uses that could be allowed as of right in this building that would have a greater impact on parking. There will be three full-time employees that will be on-site during regular non-public business hours and the public will be limited to visiting the distillery to Friday and Saturday afternoons from 12-5pm or 1-6pm. 3. The distillery and tasting room will not impact the adequacy of utilities and other public services will not be changed. 4. The impact on the environment including drainage will not be impacted. 5. The neighborhood character will remain the same as there are no significant changes proposed to the exterior of the building. 6. The potential fiscal impact on the City's tax base is positive. On the basis of the above statements of facts and findings, the Salem Board of Appeals voted four (4) in favor (Ms. Curran, Mr. Watkins, Mr. Copelas and Mr. Duffy) and one (1) opposed (Mr. Dionne), to approve the requested Special permit to allow the addition of a tasting room to an existing brewery, distillery,winery subject to the following terms, conditions and safeguards: Standard Conditions: 1. The Petitioner shall comply with all city and state statutes,ordinances,codes and regulations. 2. All construction shall be done as per the plans and dimensions submitted to and approved by the Building Commissioner. 3. Notice of this hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. The petitioner is requesting a Special Permit per Section 5-2& 94 to add a Family Dollar Store to an existing multi use building and Variance from the off-street parking requirements for the property located at 75 Canal Street located in a B4 zone. The Variance which has been requested may be granted upon a finding of the Board that: a. Special conditions and circumstances exist which especially affect the land, building,or structure involved and which are not generally affecting other lands, buildings or structures in the same district. b. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship,financial or otherwise,to the petitioner. c. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing and after viewing the plans,makes the following findings of fact: 1. The property is located in the B4 zone where retail is an allowed use. 2. The Petitioner proposed to occupy 9,253 square feet of space of which, 7,994 would be dedicated as retail area. 3. Section 7-3 of the Bylaws requires one parking space for every 150 square feet of retail space. Therefore, Petitioner needs 54 parking spaces. 4. Petitioner can only provide 17 parking spaces on site. 5. The Petitioner did not provide the Board with figures regarding the estimated number of trips per day or customer activity. The Petitioner represented that six to eight employees may also use the provided parking spaces at any given time. 7. Numerous neighbors spoke in opposition to the proposal. Most raised concerns that the project would exacerbate existing traffic and parking problems. 8. Additionally,the serious safety concerns for people routinely crossing Canal Street to access the property cause the Board to conclude that granting the requested variance would cause substantial detriment to the public good. 9. The Board did not find that due to any special and unique circumstance (s)of this land and/or building a literal enforcement of the Bylaws would result in a substantial hardship to the Petitioner. On the basis of the above findings of fact, and on the evidence presented at the hearing,the Board of Appeal concludes as follows. 1. Special conditions do not exist which especially affect the subject property and not the district in general. 2. Literal enforcement of the provisions of the Zoning Ordinance would not result in unnecessary hardship to the petitioner. 3. The relief requested cannot be granted without substantial detriment to the public good or without nullifying and substantially hardship derogating from the intent of the district or purpose of the Ordinance. Therefore,the Zoning Board of Appeal voted 0 in favor and 5 in opposition to grant the requested variances. Having failed to garner the four affirmative votes required to pass, the motion is defeated and the petition is denied. In one it states that I have been on the property and verbally abused the employees. Obviously this is not true I have never been beyond the sidewalk and have only asked them to not work before 8:00 AM. In fact I have been sworn at by the employees who are quite rude in the best of times. Also I am faxing these pictures of the yard and the fact that the way they park the trucks forces people to enter Canal Street from Hancock Street from the wrong side of the street causing a traffic hazard and a possible head on collision. Also note that they are using city property to work on. One picture shows them building on the trucks which are parked on Hancock Street. Anything you can do would be greatly appreciated. Noise pollution: Salem Glass continues to work before 8:00 AM and after 5:00 PM. During the spring, summer and into fall they use lower Hancock, Canal and lower Gardner Streets as their work area, including the sidewalk and streets. They move the cutting machinery as close to the open overhead doors due to the lack of any type of air conditioning system. This increases the noise level considerably. 2. Traffic Hazard: The parking of Salem Glass trucks against the curb and then next to these the tractor trailer trucks park causing there to be a very narrow single lane forcing residents to enter Canal Street from the wrong side of the street. The possibility of a head on collision is greatly increased. Many of the residents of Hancock street find this of great concern. 3. Yazd condition: When I moved to Hancock Street approx. 7 years ago this lot was primarily used for employee parking. Some storage but very little. This lot is now a trash site containing rusted barrels full of scrap metal, a dumpster, a storage container and mounds of trash related to their business. Along with this they no longer have parking available to employees thus they park along Hancock and Gardner Streets making parking for residents difficult. The condition of the yard also significantly impacts the property values in a negative manner. Hoyt & Jay A. lerardi, Ph.D., P.E., LEED AP DATE: May 20, 2011 SUBJECT: 75 Canal Street— Code Review This memo summarizes the code issues identified in our review of the Salem Glass Company located at 75 Canal Street in Salem, MA. It is our understanding that the building currently contains manufacturing and storage areas (Use Groups F-1 and S-1). The proposed work involves renovations to the interior of the building to include a church. Therefore, there will be a change in use as part of this renovation, to include Use Group A-3. This code review is based on architectural drawings dated February 11, 1998 and a site visit conducted on May 17, 2011. International Existing Building Code The 2009 International Existing Building Code with Massachusetts amendments allows for 3 separate compliance methods, the Prescriptive Method (in general, altered areas must comply with the code for new construction), Work Area Method (level of compliance is based on the classification of work), and Compliance Alternative Method (numerical method that allows tradeoffs for deficiencies). This report is based on the Work Area Method. Work Area and Classification of Work: The proposed work includes a change in use and alterations to the interior of the existing building. For the purposes of this report, it has been conservatively assumed that the renovations in the existing building will be classified as Level 2 alterations, which includes the reconfiguration of spaces, the addition or elimination of doors and windows, the reconfiguration or extension of systems, and/or the installation of additional equipment in less than 50% of the aggregate area of the building. Therefore, the work must comply with IEBC Chapters 6, 7, & 9. Occupancy Classification: Separated Uses: • A-3 (Church) • F-1 (Manufacturing) • S-1 (Moderate-hazard Storage) It is assumed that the proposed renovations to the existing building will maintain any hazardous materials below the exempt amounts permitted in 760 CMR Tables 307.1(1) & (2) therefore the building will not contain Use Group H. 75 Canal Street—Code Review May 20, 2011 — Page 2 Construction Type: The existing building was observed to have a wooden roof, heavy timber girders and exposed steel columns with brick masonry exterior walls. Therefore, the building construction type was assumed to be Type 111B. Height and Area Limitations: Since there is a change in use to a higher height and area hazard category planned as part of this renovation, the building is required to comply with the height and area limitations for the construction type of the existing building (IEBC 912.5.1). Fire Resistance Ratings: New fire walls, fire barriers, fire partitions, smoke barriers, and smoke partitions, or any other wall required to have protected openings or penetrations must be identified with signs or stenciling within concealed spaces (i.e. floor-ceiling, attic spaces) at 30 ft intervals (780 CMR 703.6). The existing building is provided with use group separation walls constructed of CMU blocks affording at least a 2 hour rating. The Use Group A-3 space must be separated from Use Group F-1, S-1, and M by 2 hour rated construction (780 75 Canal Street—Code Review May 20, 2011 -- Page 3 CMR Table 508.4). Use Groups F-1, S-1 and M are not required to have a rated separation between occupancies. Exterior Wall Rating: Since the renovation includes a change in use, the exterior walls of the building are required to comply with the exterior wall rating and allowable opening requirements for new construction (IEBC 912.6.1). The exterior wall rating requirements and opening limitations are based on the fire separation distance for each wall. The fire separation distance is measured perpendicular to the exterior wall to the centerline of a public street, an interior lot line, or an imaginary lot line between two buildings on the same lot (780 CMR 702.0). If the fire separation distance is more than 30 feet the wall is not required to be rated (780 CMR Table 602). The allowable area of exterior wall openings is not limited when the fire separation distance is greater than 20 feet (780 CMR Table 704.8). It should be noted that openings are not permitted when the fire separation distance is less than 3 feet in accordance with 780 CMR Table 704.8. For the purposes of this code review, it was assumed that the eastern section of the building is considered a separate structure. The fire separation distance between the two buildings on the lot are 0 ft along the shared wall and >30 ft along the open wall. Where the FSD is 0 ft, no openings are permitted. Interior Finish: The existing interior finish of walls and ceilings in the work area and in all exits and corridors serving the work area must comply with the code requirements for new construction (IEBC 703.4 & 912.3). All newly installed wall and ceiling finishes, floor finishes including carpet, and interior trim materials must also comply with 780 CMR Table 803.9 (IEBC 602.1, 602.2, 602.3). Means of Egress: The means of egress including the number of exits and egress capacity must be sufficient for the number of occupants on all floors (IEBC MA Amendment Section 102.2.2.1). For the purposes of this code review, it was assumed that the church fit-out would have an occupant load of approximately 141 people. This calculation is based on an assumed 630 SF platform (calculated at 50 gross SF per occ.) and 1,920 SF of seating area (calculated at 15 net SF per occ.). During the site visit, it was observed that the main entrance to the church is comprised of a set of existing double doors measuring 70", affording an egress capacity of 466 people. The second means of egress from the space is via an existing stairway leading to the existing warehouse space and exiting the building through a set of 70"double doors. The stairway is assumed to be at least 60"in width. The stairway affords an egress capacity of 300 people, and the egress doors permit an egress capacity of 466 people. Therefore the egress capacity of the church is 766 people which is sufficient for the calculated occupant load of the space. 75 Canal Street—Code Review May 20, 2011 Page 4 All new construction must comply with the requirements of 780 CMR 10.00. Also, all means of egress lighting and exit signs throughout the building must be provided with,an emergency power supply to assure continued illumination for not less than 1.5 hours in case of primary power loss (780 CMR 1006.1 & 1011.1). Required Fire Protection Systems: The following fire protection systems are required in the areas noted: • Automatic sprinkler system throughout the church work area (IEBC 704.2.2 & 912.2.1) • Fire extinguishers unless building is equipped with quick response sprinklers (780 CMR 906.1) M.G.L. Chapter 148 Section 26G Since the building is over 7,500 gross square feet in area, it is subject to the requirements of M.G.L. Chapter 148 Section 26G. These amendments require the entire building to be provided with sprinkler protection if the renovations are considered "major". Renovations are considered major depending on the type of work and the scope/cost of work. The following are general guidelines established by the board to be used to determine if the scope or the cost of the planned alterations are major. 1. Major alterations are reasonably considered major in scope when such work over a 5 year period affects 33% or more of the total gross square footage of the building (measured from the outside walls, regardless of firewalls). 2. Major alterations are reasonably considered major in scope or expenditure, when the total cost of the work over a 5 year period, excluding costs relating to sprinkler installation, is equal to or greater than 33% of the assessed value of the building, as of the date of permit application. Major alterations would include work such as the demolition or reconstruction of existing ceilings, sub flooring, walls, stairways, doors, or the removal or relocation of a significant portion of the building's HVAC, plumbing, or electrical systems. Cosmetic work such as painting or installing / replacing carpeting would be considered minor and would not trigger compliance with this law. Since these are just general guidelines and not specific thresholds, it is up to the head of the fire department to determine if the renovation work triggers compliance with M.G.L. Chapter 148 Section 26G. Based on the scope of the proposed renovations to the existing building, the alterations are not be considered major in our opinion since the work area does not exceed 33% or more of the total gross square footage of the building 75 Canal Street-Code Review May 20, 2011 Page 5 (4,326 sf / 15,487 sf = 28%). The cost of work relative to assessed building value should be confirmed. The 33% cost threshold is $199,610 (based on an assessed building value of $598,832 from the Salem Assessor's online database with consideration given to Salem's 96% assessment rate for commercial properties from the MA Dept of Revenue online records). Energy Code Provisions for Existing Buildings: The building must comply with the 2009 International Energy Conservation Code (IECC) including the amendments contained in 780 CMR Chapter 13. Alternatively, the provisions of ASHRAE 90.1-2007 can be met in lieu of the IECC. The IECC 101.4.3 also requires all new or altered systems or portions thereof within the existing building to comply with the code requirements applicable to new construction without requiring the unaltered portions to be upgraded. Structural Provisions for Existing Buildings: Alterations to buildings must be evaluated by a registered structural engineer to determine compliance with the IEBC. Massachusetts Architectural Access Board Regulations Alterations to the building must comply with the requirements of the Massachusetts Architectural Access Board Regulations (521 CMR). For existing building alterations the requirements of 521 CMR are based on the cost of the proposed work: A. If the cost of the proposed work is less than $100,000, only the new work must comply. B. If the cost of the proposed work is greater than $100,000 then all new work must comply and the existing building must include an accessible public entrance, toilet room, telephone and drinking fountain (if public phones and drinking fountains are provided) (521 CMR Section 3.3.1(b)). Exempt work when calculating the cost of work includes roof repair or replacement, window repair or replacement, and repointing and masonry repair work. C. If the cost of the proposed work is greater than 30% of the full and fair cash value of the existing building, the entire building is required to fully comply with 521 CMR (521 CMR Section 3.3.2). There is no exempt work, i.e. the entire project costs apply to determining the 30% criteria. The cost of all work performed on a building in any 36 month period must be added together in determining the applicability of 521 CMR (521 CMR Section 3.5). The full and fair cash value of the existing building is determined by using the 100% equalized assessed value of the building on record with the city assessor's office. Based on the City of Salem Assessor's office, the building value is listed as $698,832.00 ($575,800.00 * Assessment Ratio of 0.96). The 75 Canal Street—Code Review May 20, 2011 Page 6 certified appraised,value must be submitted to the Massachusetts Architectural Access Board for approval. If the renovation triggers the 30% threshold, all portions of the building open to the general public must be upgraded to comply in full with the current requirements of 521 CMR. Major upgrades required to meet full compliance with the provisions of 521 CMR will likely include the following building features: • All public entrances must be accessible (521 CMR 25.1) • Accessible routes throughout the building (521 CMR 20.1) • Vertical access to all floor levels (521 CMR 28.1) • Accessible toilet rooms (521 CMR 30) • Accessible drinking fountains, where drinking fountains are provided (521 CMR 36.1) • Accessible telephones (where public telephones are provided) (521 CMR 37.1) If full compliance with 521 CMR is required throughout, all areas open to the general public must fully comply. Any employee-only areas such as staff lounges, staff bathrooms, and staff work areas are not required to comply with 521 CMR, as long as public access is not permitted. It should be noted that the Access Board is in the process of including employee-areas within their regulations. For the church fit-out, all new construction must comply with 521 CMR including, but not limited to, accessible toilet rooms (521 CMR 30.0), accessible seating (521 CMR 14.2), an accessible route to the platform (521 CMR 14.6), and assisted listening devices(521 CMR 14.5). Americans with Disabilities Act Guidelines The ADA Guidelines are not enforced by the Commonwealth of Massachusetts, they can only be enforced through a civil lawsuit or complaint filed with the U.S. Department of Justice. Compliance with the ADA Guidelines is triggered by renovations to the existing building. All renovations to the building must be made to ensure that, to the maximum extent feasible, the altered portions of the facility are readily accessible to and usable by individuals with disabilities (28 CFR Part 36 Section 36.402(a)). Alterations made to provide an accessible path of travel to altered areas and accessible facilities (i.e. provide accessible toilet facilities) are not required if the cost exceeds 20% of the total cost of the alteration (28 CFR Part 36 Section 36.403(f)). However, if the cost to meet these accessibility requirements does exceed 20%, alterations are still required to the maximum extent that the area can be made accessible without exceeding the 20% criteria (28 CFR Part 36 Section 36.403(g)). The ADA also contains less stringent dimensional requirements for some building elements in an existing building where it is infeasible to meet the requirements for new construction (ADA Section 4.1.6). In general, the majority of the dimensional requirements in the ADA are equivalent to those in the 521 CMR. 75 Canal Street—Code Review May 20, 2011 -- Page 7 It should be noted that the 2010 ADA standards were published September 15, 2010. There is currently a 1.5 year concurrency period where the project can comply with either the 2010 standards or the 1991 ADA standards. Mandatory compliance is required after March 15, 2012. 248 CMR: The Massachusetts State Plumbing Code The Massachusetts Plumbing Code (248 CMR) regulates the number of plumbing fixtures required throughout buildings. The minimum number of plumbing fixtures is established by 248 CMR 10.10(18) Table 1 based on the building use and the expected population as determined by the local Plumbing Inspector per 248 CMR 10.10 (18)(2). The Plumbing Inspector must approve the building population, however, the building population can generally be based on the designer's determination of the actual number of people expected within the building. The Plumbing Code expects that the building population will be divided evenly between male and female for the purpose of determining fixture counts. Any distribution other than 50/50 must be justified to the Plumbing Inspector. Section 3 —Design Responsibility for Fire Protection Systems AHA Consulting Engineers, as the Professional Engineer (PE) will provide a partial (preliminary) design including design criteria and drawings, and calculations to be used by the installing subcontractor. The installing subcontractor will produce shop drawings and calculations of the proposed system installation as well as manufacturer's data sheets on products that will be installed. The PE will review and approve the installing contractor's final layout and equipment selection. The wet pipe sprinkler system in reception, lobbies, vestibules, toilet rooms, conference rooms, corridors, the future build-out space, and similar spaces will be designed for Light Hazard occupancy with a 0.10 gpm/sf over 1,500 sf design density with a 100 gpm hose allowance. Maximum sprinkler coverage will be 225sq. ft. The wet pipe sprinkler system in mechanical and similar spaces will be designed to Ordinary Hazard Group 1 Occupancy requirements and will be capable of providing 0.15 gpm/sf over the hydraulically most remote 1,500sf with 250 gpm hose allowance and 130sf maximum sprinkler spacing. The new sprinkler system will be sized to accommodate the extension of the sprinkler system into the adjoining tenant spaces in the future. Water is supplied from municipal water mains. A hydrant flow test was conducted on 09/20/2011 by AHA and the Salem Water Department. A 4" Storz fire department connection will be installed on the exterior wall outside of the fire sprinkler room. The building will be equipped with a single 6" fire service and a 6" double check valve type backflow preventer. All sprinkler control valves will be provided with tamper switches and flow switches will be provided for each floor to be monitored by the base building fire alarm system. All sprinkler heads shall be quick response type. Sprinklers will be installed under exposed ductwork greater than 4 feet in width. FIRE ALARM SYSTEM System Description: The building fire alarm system will operate in conjunction with the building's fire protection system(s) in accordance with all-applicable codes and standards including NFPA 13, 72, 90A and the 8`h Edition of the Massachusetts State Building Code, and Town of Salem. 2 TENANT FIT-UP September 30,2011 75 CANAL STREET Salem,Massachusetts The building will be provided with a new addressable fire alarm system with municipal notification via a digital alarm communication transmitter (i.e. telephone dialer). The fire alarm system will be a microprocessor-based multiplex, analog/addressable system with complete audio and visual occupant notification, and municipal reporting via the master box and central station monitoring service. Each initiating point (water flow switch, tamper switch, smoke detector, duct- mounted smoke detector, heat detector or manual pull station) will be individually addressable. Upon activation, the specific device address, type, status and location will be presented at an LCD annunciator integral to the FACP and remote LCD annunciator. Occupant notification will consist of audio/visual signaling. Audible signaling will be a general temporal-3 pulse evacuation tone. Visual signaling will be by xenon strobes in accordance with NFPA 72 and the Americans with Disabilities Act. The new addressable fire alarm system will interface with the existing conventional fire alarm zones located in the repair garage tenant's space via monitor modules. The existing notification appliance circuits will also be controlled by the new addressable system via control modules. Wiring Styles: Signaling Line Circuits will be wired in a Class A, Style 6 manner. Related Systems Interface: The fire alarm systems will also interface to the fire protection system(s) by monitoring each individual water flow and tamper switch via dedicated addressable modules. Section 5 —Features Used in the Design Methodology N/A Section 6— Special Consideration and Description There is no intent to deviate from the prescriptive code requirements of regulatory codes and standards with alternative methods. 3 TENANT FIT-UP September 30,2011 75 CANAL STREET Salem,Massachusetts (I.b) SEQUENCE OF OPERATION FIRE SPRINKLER SYSTEMS Wet Pipe Sprinkler System: Heat produced from a fire melts the fusible link or glass bulb on a single sprinkler head or group of sprinkler heads causing the sprinkler(s) to open. Water from the water filled pipe is discharged immediately from the sprinkler head(s) to control the fire. The fire department may pump the fire department connection to supplement the system. Sprinkler system water flow alarms activate upon system flow and indicate to the FACP an alarm condition which transmits the alarm signal to the Municipal Fire station. The sprinkler(s) continue to flow water until manually shut off. Upon any wet pipe sprinkler system waterflow switch activation, an "ALARM" signal will be received by the main building fire alarm system. Building fire alarm system will commence evacuation sequence and notify the Salem Fire Department. FIRE ALARM SYSTEM In accordance with the Town of Salem and the Massachusetts State Building Code, the operation of a manual station or activation of any automatic alarm initiating device (system smoke detector, or sprinkler system waterflow switch) will cause the following to occur: • Transmit the alarm signal to the Salem Fire Department via telephone dialer (DACT). • Sound a code 3 temporal general evacuation signal throughout the building. • Flash all visual signals throughout the building in a synchronized manner. • Flash an alarm LED and sound an audible signal at the FACP and remote annunciator located in the main entry lobby. • Upon Acknowledgment, the alarm LED will light steadily and the audible shall silence. Subsequent alarms will re-initiate this sequence. • Visually indicate the alarm initiating device type and location via the LCD display located at the FACP and remote LCD annunciator. • Activate the outside weatherproof beacon. • Activate outside 24 VDC electric alarm bell upon waterflow alarm only. Activation of the electric alarm bell is for sprinkler system waterflow only. 4 TENANT FIT-UP September 30,2011 75 CANAL STREET Salem,Massachusetts (1.0 TESTING CRITERIA Section 1 —General Testing Criteria The general contractor has overall responsibility for setting up and coordinating all acceptance testing with authorities having jurisdiction. All testing shall be in accordance with NFPA requirements, Salem Fire Department, the Massachusetts State Building Code (80' Edition), the IMC International Mechanical Code, the NFPA National Electrical Code, and the contract specifications. FIRE SPRINKLER SYSTEMS The sprinkler contractor is responsible for setting up and coordinating all sprinkler system acceptance testing. All testing shall be in accordance with NFPA 13, 14, 20, 25, the Massachusetts State Building Code, and contract specifications. FIRE ALARM SYSTEM Testing Criteria: The completed system shall be subject to the final test and acceptance, UL certification and periodic inspection, testing and maintenance, in accordance with the City of Salem, Massachusetts State Building Code and NFPA 72 as follows: • The test shall be conducted by a UL certified testing company. Each and every device shall be functionally tested. • Upon function test of each device, the corresponding programmed event sequences shall be verified. Subsequent events shall include occupant notification, system annunciation, and municipal reporting. • Proper visual notification shall be verified. • Audible sound pressure levels shall be measured and recorded. • Fault conditions shall be simulated and verified as to their proper reporting and system response. These shall include loss of AC power, battery standby operation, and wiring faults of each and every circuit. • A complete report demonstrating the activation and subsequent acknowledgement of each activation shall be generated. An annual test and inspection contract will be in evidence at the time of final testing. The final system acceptance test shall be conducted by the holder of the local authority having jurisdiction. In addition to device testing, maintenance (sensitivity) reports shall be generated directly from the system during each quarterly test. These reports shall include a complete listing of each analog device in the system, their corresponding programmed sensitivity setting, and their current sensitivity level, and the number of times each device has entered alarm verification mode. Section 2—Equipment and Tools - FIRE SPRINKLER SYSTEMS The sprinkler contractor shall be responsible for providing all required equipment and tools including but not limited to: hydrostatic testing equipment, pressure gauges, hoses, nozzles, manufacturer' s instructions, radios, etc. FIRE ALARM SYSTEM The Electrical Contractor shall provide all tools necessary to complete the successful testing of the Fire Alarm systems. Section 3 —Approval Requirements Obtain written approval of all acceptance testing from the Salem Fire Department. Report all system failures to the general contractor, Salem Fire Department, and design engineer. Provide the Salem Fire Department with copies of NFPA 13 and 72 testing certificates, instruction manuals and as-built drawings.
