Decision
Petition of Mario Zepaj requesting a Variance
for the property at 17 Canal Street
City of Salem Zoning Board of Appeals
A public hearing on the above petition was opened on October 19, 2006 pursuant to
Massachusetts General Law Ch. 40A, Sec. 11. The following Zoning Board members
were present: Nina Cohen, Robin Stein, Steve Pinto, Richard Dionne, Elizabeth Debski.
The petitioner, Mario Zepaj, sought a variance from the requirements of the City of
Salem Sign Ordinance to allow the existing sign to be altered for the property located at
17 Canal Street, Salem, in the Wholesale and Automotive (B-4) zoning district.
The Board of Appeals, after careful consideration of the evidence presented at the public
hearing, and after thorough review of the Petition submitted, makes the following
findings of fact:
1. The property at 17 Canal Street is within the B-4 zoning district.
2. The petitioner is requesting a variance to alter an existing non-conforming
sign at 17 Canal Street. Specifically petitioner undertook to alter a roof sign
by changing the wording to "Sammy's Roast Beef' from "Big Fred's Roast
Beef."
3. The petitioner received a violation letter regarding the alterations from the
Building Inspector dated August 30, 2006.
4. Ward 3 City Councilor Jean Pelletier spoke in favor of the variance.
5. No other members of the public wished to speak on this petition.
On the basis of the above findings of fact, including all evidence presented at the public
hearing, including, but not limited to, the Petition the Zoning Board of Appeals concludes
as follows:
1. The petitioner's request for a Variance to the existing nonconforming sign do
not constitute substantial detriment to the public good.

2. The requested relief does not nullify or substantially derogate from the intent
or purpose of the zoning ordinance.
3. A literal enforcement of the zoning ordinance would create a substantial
hardship to the petitioner, both financial and otherwise.
4. In permitting such change,the Board of Appeals requires certain appropriate
conditions and safeguards as noted below.
In consideration of the above, the Salem Board of Appeals voted, five (5) in favor

3. The sign shall remain at the same size as it is currently.

Based on our site visit on 6/4/03, the Gateways of Peace interior handicapped ramp
project, 47 Canal Street, Salem, MA has been reviewed, and to the best of my knowledge
and ability, the project has proceeded according to the drawings prepared by HHM(dated
4/0/2003). The ramp construction appears to comply with applicable provisions of the
Massachusetts State Building Code and Architectural Access Board- 521 CMR. As per
our telephone call on 6/2/03 the following specific issue was reviewed at above mentioned
site visit
1. Under Handrail Installation- Upper handrail installed at required height
as per 521 CMR at each ramp location.
Further, to the best of my knowledge and ability, the Gateways of Peace HCP ramp
construction project is complete and ready for a permanent occupancy.

1. No chairs, musical equipment will be present in the construction area until a
Certificate of Occupancy is given.
2. No childcare or public of any king until a Certificate of Occupancy is issued.
3. All life safety issues of the project will be finished before a Certificate of
Occupancy is issued.
4. All issues regarding 521 CMR will be inspected and sanctioned before a
Certificate is issued.

Dear Mr. St. Pierre:
We have been asked to provide documentation that there does not exist any underground
fuel storage tank(s) at 47 Canal Street. We purchased the property in October of 2001
and thoroughly researched this issue to our satisfaction that there are no underground fuel
tanks on the property.
This conclusion was based on our satisfactory review of the following materials.
Letter dated September 5, 1997 from REW Environmental Consultants to Heritage
Co-operative Bank(first mortgagor) that essentially narrowed down any environmental
issues to the possibility of one tank being present on site.
Letter dated September 8, 1997 from REW Environmental Consultants to Heritage
Co-operative Bank which confirms the presence of one underground fuel tank.
Documentation that on September 25, 1997 the tank was pumped dry by Dependable
Environmental Services, Inc. and then the tank was properly removed and disposed of by
T. Mackey and Sons of Salem.

Enclosed herewith is our report entitled "Environmental Property Screed' for the property located at 47
Canal Street, Salem, Massachusetts. We have prepared this report based on a modified version of the
American Society for Testing and Materials (ASTM) Standard Practice for Environmental Transaction
Screens (E 1528-93). In addition to ASTM guidance, REW incorporates industry standards and practices
of the National Groundwater Association as well as the regulatory guidelines of the Massachusetts
Department of Environmental Protection.
Based on the information that we evaluated and discussed in our report, we recommend the following:
During our reconnaissance of the Site, we found no evidence of an existing underground
storage tank. Mr. Paul Lyons stated that he had no knowledge of a tank nor any
knowledge of removing or abandoning a tank. However,-since-the-GMRC_indicated-an
existing storage tank-at-the-time-of-their_1986=assessment3REW-is-recommending.an3

Dear Mr. Millerick:
Pursuant to your request, REW Environmental Consultants, Inc. (REW) has reviewed Salem Fire
Prevention records for information relative to underground storage tank(s) potentially existing at the
property located at 47 Canal Street in Salem, Massachusetts. These-records-indicacaied-a=1946-iinstallationr
of1500-gallon-capacity-underground-storage-taak_for_No:2=fuel-`oil. The-records=additionally-indicate�-an�
4nspeetion--by-the_Fife-Departmenf-m-Decembe�LLl 953-and-subsequent=abandonment-in--Apri 1=1=980--wh em
-the-site=building converted to gas--for_hea�g. There were no records of removal and/or the proper
abandonment of the tank.
KEW retumed to the Site for a second attempt to locate the tank. We conducted an evaluation along the
exterior face of the building for evidence of bolts, brackets, concrete patches and ground disturbances that
may suggest the potential existence or the former existence of an underground tank. By permission of Mr.
Paul Lyons, REW removed a small portion of concrete using a five pound hammer. Upon removal, we
observed a single section of vertical pipe filled with concrete. Further investigation of the parking area
approximately 40 feet from the building facade, we found an obscured, five inch diameter, protective
casing covering a smaller diameter pipe.
REW removed the cover on a subsequent visit using channel locks. After inserting a dip-stick down the
pipe, we measured four feet of a clear fluid remaining.in the tank that we presume is the fuel-oil tank on
record. We noted however,that the fluid in the tank had a similar odor to that of gasoline.
