FIRST AMENDMENT OF MASTER DEED
ALTERATION OF EXISTING UNIT
WHEREAS, this is the First Amendment of the 17-19 Gardner Street Condominium, a
condominium created by Master Deed dated October 27, 1988, recorded with the Essex
Southern District Registry of Deeds in Book 9757, Page 94,
WHEREAS, it is provided in Section 12 of said Master Deed that the Master Deed may
not be amended without the unanimous written consent of all unit owners; and
WHEREAS, Matthew K. Rohnke is the owner of Unit 1;
Richard T. Walsh, Trustee of Brendon's Future Trust under Declaration of Trust dated
October 31, 1995 and recorded in the Essex Southern District Registry of Deeds in Book
13263, Page 466 is the owner of Unit 2;
Barbara D. Hawlena is the owner of Unit 3; and
Matthew J. Varley and Lauren J. Sykes (Varley/Sykes) are the owners of Unit 4; and
Said Units 1, 2, 3 and 4 constitute all of the units of the condominium; and
WHEREAS, Varley/Sykes desire to alter the square footage of Unit 4 by converting 517
square feet of common area located in the attic into an additional room and bath to be
made part of Unit 4 and acquire an exclusive use easement for storage in the remaining
common attic area all in accordance with the floor plan recorded herewith entitled,
"17-19 Gardner Street Condominium, Drawn By Timothy Burke, Architect— 142
Berkeley Street, Boston, Massachusetts, Drawing Title: Condominium Floor Plans,
Date: June 15, 2004, DWG. No. M-L"
NOW, THEREFORE, said Master Deed is hereby amended as follows:
Floor Plans U-1, U-2, U-3 and U-4 of said Master Deed are hereby deleted and replaced
by Floor Plan M-1 attached hereto;
Exhibit B of said Master Deed is hereby deleted and replaced by the following:
