The petitioner is requesting a Variance for relief for from rear yard setback to construct an addition (a bath) on the existing building for the property located at 10 Calibrese Street located in an R-1 zone. The Variances, which have been requested, upon a finding Board that: a. Special conditions and circumstances exist which especially affect the land, building Or structure involved and which are not generally affecting other lands, buildings, and structure involve. b. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioners.. c. Desirable relief may be granted without substantial detriment to the public good and Without nullifying or substantially derogating from the intent of this district of the purpose of the Ordinance The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1. His contractor,Mr. Don Carter, represented the petitioner. 2. Plans were submitted showing the addition to the property. 3. There was no opposition to the petition. Therefore,the Zoning Board of Appeal voted 5-0,to grant the Variances requested, subject to the following conditions; 1. Petitioner shall comply with all city and state statures, ordinances, codes and regulations. 2. All construction shall be done as per the plans and dimensions submitted. 3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 4. Petitioner shall obtain building permit prior to beginning any construction. 5. Exterior finishes of the new construction shall be in harmony with the existing structure. 6. A Certificate of Occupancy must be obtained. Petitioner appeared before the Board to request a front setback of 12 feet to allow construction of a raised front porch to enclose the existing door and extend 20feet along the front of the existing structure. 2. Tremblay Director of Public Property One Salem Green Salem, MA 01970 Dear Mr. Tremblay: I am responding to your letter dated 2/15/94 sent to my mother, Mrs. Dorothy E. Dallaire, concerning the unshoveled sidewalk at 10 Calabrese Street. Attached you will find a copy of a letter regarding my concerns about inadequate plowing, sent to Mayor Harrington on March 18, 1993, as well as his response to me. As a taxpayer in the City of Salem, I do believe that the tax money is used to pay the plowing contractors. The plowing at 10 Calabrese Street is still being done in a less than satisfactory manner, requiring my mother to pay a person to shovel between 10 and 16 feet of the street, which is the responsibility of the City to be cleared by the plowing contractor. My mother is elderly and quite ill with a heart condition. Taxes are already paid by us to cover the clearing of the street by the City in front of 10 Calabrese Street, and in addition to paying the taxes we have to again pay a person to clear the street. To clear the street takes at least 1 hour before even reaching the sidewalk into the driveway which is, as your letter states, 'bur responsibility." Because of this added burden placed upon the person shoveling the street and the added cost to my mother, the sidewalk in front of the house remains unshoveled. My mother lives on a very limited income. Why should she have to pay a person to shovel the street which is the responsibility of the City, when she has already payed taxes for this service which is not being done. The time and money that could be put toward a person shoveling the sidewalk is being used to shovel the street because the contractor insists on not plowing along the curve. This problem also affects the residents of 6 Calabrese Street. There is no reason why the person doing the plowing does not do it properly. Because of my many phone calls to the Public Works Department last winter, during one storm the plow driver did cut into the curb, leaving a very small section of street needing to be shoveled -- this was understandable -- so, this proves that if done right, there is no need to leave 10-16 feet of the street unplowed needing to be shoveled. If this problem persists, I suggest the Public Works Department send someone to shovel the sidewalk at no extra cost to us, since we are doing the work of the Public Works Department by shoveling the street. I intend to, again, contact the Mayor's Office and the Public Works Department. As soon as I receive a response from them on how they intend to correct this ongoing problem, I will contact you with our "plan of action" for a problem caused by the lack of commitment on the part of the plowing contractor who is getting paid extremely well with taxpayers money for a job he obviously chooses not to do correctly.
