INTRODUCTION ' On October 29, 2010, the Fortunate Son Realty Trust was issued a positive Determination of Applicability and an Enforcement Order by the Salem Conservation Commission for working in an Area Subject to Protection Under the Wetlands Protection Act(MGL ' Chapter 131, Section 40). The work included the removal of two small buildings, one shed, one trailer, boat debris from a former boat yard and spreading of 2-inches of gravel at 8-10 Franklin Street in Salem (see Figure 1 - Locus Map). The Fortunate Son Realty Trust is submitting this Notice of Intent in response to the Determination of Applicability and an Enforcement Order ' B. PROJECT BACKGROUND The Fortunate Son Realty Trust purchased the property at 8 — 10 Franklin Street early this year. The property had been used as a boat yard for decades and was covered with ' dilapidated boats, floats and other related debris. The property also had two small buildings, a shed and a trailer that were in distressed condition. After purchasing the ' property the applicant proceeded to have all of debris removed including the buildings, shed and trailer. In total (30) 30-cubic yards trailers of debris were removed for disposal and recycling. After removing the debris the applicant spread 2-inches of crushed stone ' over the existing gravel from Franklin Street to approximately 75 feet from the existing bulkhead. ' C. RESOURCE AREAS Resource areas defined under the Wetlands Protection Act that are affected by this project include Riverfront Area and Land Subject to Costal Storm Flowage. The total ' area of Riverfront Area is al9,034-square feet with 10,422 between mean high water and the 100-foot buffer and 8,612 square feet between the 100-foot buffer and the 200-foot buffer. The Bordering Land Subject to Flooding includes the entire property of ' approximately 21, 401 square feet. In this case the flooding is Coastal Storm Flowage. D. PROJECT DESCRIPTION t After purchasing the subject property the applicant removed all of the boats and debris left by the former owner and the distressed buildings, shed and trailer. A total of(30) 30- cubic yards trailers of debris were removed for disposal and recycling. The majority of ' the property was covered with gravel and broken up bituminous pavement. After removing the debris the applicant spread approximately 100 tons of crushed stone from Franklin Street to approximately 75-feet from the existing bulkhead. The stone layer is ' approximately 2-inches thick. A chain-link fence was then erected on three sides of the property with an access gate on Franklin Street. There has been no net loss of flood storage capacity or change in impervious surfaces at the property as a result of the applicant actions. E. PERMITING This project is located in Resource Areas defined and protected under the Wetlands Protection Act. The applicant should have submitted an NOI prior to implementing any work at the property. F. CONCLUSIONS The work performed by the applicant required an Order-of-Conditions. ' As noted in the Checklist, the Stormwater Management Report shall document compliance with each of the Stormwater Management Standards as provided in the Massachusetts Stormwater Handbook. The soils evaluation and calculations shall be done using the methodologies set forth in Volume 3 of the ' Massachusetts Stormwater Handbook. To ensure that the Stormwater Report is complete, applicants are required to fill in the Stormwater Report Checklist by checking the box to indicate that the specified information has been included in the ' Stormwater Report. INTRODUCTION On October 29, 2010,the Fortunate Son Realty Trust was issued a positive Determination of Applicability and an Enforcement Order by the Salem Conservation Commission for working in an Area Subject to Protection Under the Wetlands Protection Act(MGL ' Chapter 131, Section 40). The work included the removal of two small buildings, one shed, one trailer, boat debris from a former boat yard and spreading of 2-inches of gravel ' at 8-10 Franklin Street in Salem (see Figure 1 - Locus Map). The Fortunate Son Realty Trust is Stormwater Report in support of the Notice of Intent submitted in response to the Determination of Applicability and an Enforcement Order ' B. PROJECT BACKGROUND The Fortunate Son Realty Trust purchased the property at 8 — 10 Franklin Street early this ' year. The property had been used as a boat yard for decades and was covered with dilapidated boats, floats and other related debris. The property also had two small buildings, a shed and a trailer that were in distressed condition. After purchasing the ' property the applicant proceeded to have all of debris removed including the buildings, shed and trailer. In total (30) 30-cubic yards trailers of debris were removed for disposal and recycling. After removing the debris the applicant spread 2-inches of crushed stone ' over the existing gravel from Franklin Street to approximately 75 feet from the existing bulkhead. ' C. RESOURCE AREAS Resource areas defined under the Wetlands Protection Act that are affected by this project include Riverfront Area and Land Subject to Costal Storm Flowage. The total ' area of Riverfront Area is al9,034-square feet with 10,422 between mean high water and the 100-foot buffer and 8,612 square feet between the 100-foot buffer and the 200-foot buffer. The Bordering Land Subject to Flooding includes the entire property of approximately 21, 401 square feet. In this case the flooding is Coastal Storm Flowage. D. PROJECT DESCRIPTION ' After purchasing the subject property the applicant removed all of the boats and debris left by the former owner and the distressed buildings, shed and trailer. A total of(30) 30- cubic yards trailers of debris were removed for disposal and recycling. The majority of ' the property was covered with gravel and broken up bituminous pavement. After removing the debris the applicant spread approximately 100 tons of crushed stone from Franklin Street to approximately 75-feet from the existing bulkhead. The stone layer is ' approximately 2-inches thick. A chain-link fence was then erected on three sides of the property with an access gate on Franklin Street. ' There has been no net loss of flood storage capacity or change in impervious surfaces at the property as a result of the applicant actions. II 1 ' E. STORMWATER This project did not involve any soil excavation, dewatering, or creation of impervious surfaces. There have been no changes to the property's stormwater runoff characteristics or creation of any point source discharges. F. No work shall be undertaken until the Order has become final and then has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of the registered land, the Final Order' shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is done. The recording information shall be submitted to the Conservation Commission on the form at the end of this Order, which form must be stamped by the Registry of Deeds, prior to the commencement of work. 10. The work shall conform to the plans and special conditions referenced in this order. 14. Any change to the plans identified in Condition #13 above shall require the applicant to inquire of the Conservation Commission in writing whether the change is significant enough to require the filing of a new Notice of Intent. 15. The Agent or members of the Conservation Commission and the Department of Environmental Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours to evaluate compliance with the conditions stated in this Order, and may require the submittal of any data deemed necessary by the Conservation Commission or Department for that evaluation. 16. This Order of Conditions shall apply to any successor in interest or successor in control of the property subject to this Order and to any contractor or other person performing work conditioned by this Order. 17. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated Wetland, the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden stakes or flagging. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or water body. During construction, the applicant or his/her designee shall inspect the erosion controls on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission, which reserves the right to require additional erosion and/or damage prevention controls it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of work line has been approved by this Order. NOTICE OF STORMWATER CONTROL AND MAINTENANCE REQUIREMENTS 19. The work associated with this Order (the "Project') is (1)® is not (2)❑ subject to the Massachusetts Stormwater Standards. If the work is subject to the Stormwater Standards, then the project is subject to the following conditions: a) All work, including site preparation, land disturbance, construction and redevelopment, shall be implemented in accordance with the construction period pollution prevention and erosion and sedimentation control plan and, if applicable, the Stormwater Pollution Prevention Plan required by the National Pollution Discharge Elimination System Construction General Permit as required by Stormwater Condition 8. Construction period erosion, sedimentation and pollution control measures and best management practices (BMPs) shall remain in place until the site is fully stabilized. b) No stormwater runoff may be discharged to the post-construction stormwater BMPs unless and until a Registered Professional Engineer provides a Certification that: i. all construction period BMPs have been removed or will be removed by a date certain specified in the Certification. Prior to requesting a Certificate of Compliance, or Partial Certificate of Compliance, the responsible party(defined in General Condition 18(e)) shall execute and submit to the issuing authority an Operation and Maintenance Compliance Statement("O&M Statement) for the Stormwater 8MPs identifying the party responsible for implementing the stormwater BMP Operation and Maintenance Plan ("O&M Plan") and certifying the following: i.) the O&M Plan is complete and will be implemented upon receipt of the Certificate of Compliance, and ii.) the future responsible parties shall be notified in writing of their ongoing legal responsibility to operate and maintain the stormwater management BMPs and implement the Stormwater Pollution Prevention Plan. d) Post-construction pollution prevention and source control shall be implemented in accordance with the long-term pollution prevention plan section of the approved Stormwater Report and, if applicable, the Stormwater Pollution Prevention Plan required by the National Pollution Discharge Elimination System Multi-Sector General Permit. e) Unless and until another party accepts responsibility, the landowner, or owner of any drainage easement, assumes responsibility for maintaining each BMP. To overcome this presumption, the landowner of the property must submit to the issuing authority a legally binding agreement of record, acceptable to the issuing authority, evidencing that another entity has accepted responsibility for maintaining the BMP, and that the proposed responsible party shall be treated as a permittee for purposes of implementing the requirements of Conditions 18(f) through 18(k)with respect to that BMP. Any failure of the proposed responsible party to implement the requirements of Conditions 18(f) through 18(k)with respect to that 8MP shall be a violation of the Order of Conditions or Certificate of Compliance. In the case of stormwater BMPs that are serving more than one lot, the legally binding agreement shall also identify the lots that will be serviced by the stormwater 8MPs. Plans are .�> required to show existing and proposed conditions, identify all wetland resource areas, NRCS soil types, critical areas, Land Uses with Higher Potential Pollutant Loads (LUHPPL), and any areas on the site where infiltration rate is greater than 2.4 inches per hour. The Plans shall identify the drainage areas for both existing and proposed conditions at a scale that enables verification of supporting calculations. As noted in the Checklist, the Stormwater Management Report shall document compliance with each of the Stormwater Management Standards as provided in the Massachusetts Stormwater Handbook. The soils evaluation and calculations shall be done using the methodologies set forth in Volume 3 of the Massachusetts Stormwater Handbook. To ensure that the Stormwater Report is complete, applicants are required to fill in the Stormwater Report Checklist by checking the box to indicate that the specified information has been included in the Stormwater Report. If any of the information specified in the checklist has not been submitted, the applicant must provide an explanation. The completed Stormwater Report Checklist and Certification must be submitted with the Stormwater Report. w 'The Stormwater Report may also include the Illicit Discharge Compliance Statement required by Standard 10. If not included in the Stormwater Report,the Illicit Discharge Compliance Statement must be submitted prior to the discharge of stormwater runoff to the post-construction best management practices. INTRODUCTION On October 29, 2010,the Fortunate Son Realty Trust(the"Applicant') received a positive Determination of Applicability and Enforcement Order from the Salem Conservation Commission for work at 8— 10 Franklin Street in an Area Subject to Protection Under the Wetlands Protection Act(MGL Chapter 131, Section 40; see Figure I —Locus Map). The work included removal of two small buildings, a shed, a trailer, and boat debris from former boat yard uses at the site. The work also included spreading a thin layer of crushed stone to control erosion. This Stormwater Report has been prepared to support a Notice of Intent prepared by Geological Field Services of Salem,submitted in response to the aforementioned Determination of Applicability and Enforcement Order. j a B. PROJECT BACKGROUND The Applicant purchased the property at 8 — 10 Franklin Street in 2010. Previously,the property had been used for decades as a boat yard and was covered with dilapidated boats, floats and other related debris. The property also had two small buildings, a shed and a trailer that were in distressed condition. The majority of the property was covered with gravel and bituminous pavement: After purchasing the property,the Applicant razed the buildings and shed and removed the trailer and boat yard debris. Approximately 900 cubic yards(cy) of debris were hauled off-site for disposal and recycling. The Applicant then top-dressed with crushed stone the portion of the site from Franklin Street to approximately 65-feet west of the existing bulkhead to control erosion. C. RESOURCE AREAS Resource areas defined under the Wetlands Protection Act within the project locus include Riverfront Area(to the North River) and Land Subject to Coastal Storm Flowage. The total area of Riverfront Area on the parcel is approximately 19,034-square feet(so. Of this amount approximately 10,422 sf is within the Inner Riparian Area (less than 100- ft from MHW) and approximately 8,612-square feet is within the Outer Riparian Area ' (between 100-ft and 200-ft from MHW). The FEMA Flood Insurance Rate Map indicates that the entire parcel (21,401 square feet)is located within Zone A2,which is an area of 100-year flooding with a determined base flood elevation of 10-feet (NGVD 1929 Datum). D. PROJECT DESCRIPTION After purchasing the property, the Applicant removed all of the boats and boat yard debris and the distressed buildings,shed and trailer. A total of thirty 30-cy trailers were Page 1 of 5 used to haul debris offsite for disposal and recycling. After removing the debris, the Applicant spread approximately 100-tons of crushed stone from Franklin Street to approximately 65-feet west of the existing bulkhead. The crushed stone minimizes erosion and is up to approximately two-inches thick. To improve security, a chain-link fence was erected on three sides of the property. An access gate was provided along Franklin Street. There has been no net loss of flood storage capacity at the property due to the work. The amount of impervious surfaces at the site was reduced by approximately 1,800-square feet due to removal of two buildings. E. STORMWATER Standards The project is a redevelopment project and is subject to the applicable portions of the DEP Stormwater Management Standards. Of the 10 DEP Stormwater standards, redevelopment projects must meet Standard nos. 1, 8, 9, and 10 in their entirety;Standard nos. 2, 3,4, 5, 6, and 7 must be met to the maximum extent practicable. i The project did not involve any excavation, dewatering, or creation of impervious surfaces. There have been no changes to stormwater runoff characteristics at the site nor the creation of any point source discharges. The amount of impervious surfaces at the site has been reduced by approximately 1,800-square feet due to the removal of two buildings. The 10 stormwater standards, and the manner in which the project meets those standards, are reviewed below. Standard 1: No new Untreated Discharges. The project did not create any new untreated discharges or drainage patterns at the site. Prior to and following the work, stormwater flowed off the property only as sheet flow, flowing in the direction of the North River. The project did not involve installation of a stormwater collection system. No crushed stone was placed over the last 55 to 75 feet of land along the North River. For these reasons, Standard no. 1 is satisfied. Standard 2: Peak Rate Attenuation The site is specifically exempt under the regulations from Standard no. 2, which applies only to discharges to non-tidal waterbodies. This site is along the tidal portion of the North River and has no point-source discharges. Therefore, Standard no. 2 is satisfied. Standard 3: Recharge The Stormwater Management Guidelines require that the annual recharge from the site following redevelopment approximate the annual recharge from the site prior to the work. Since the project has reduced impervious surfaces at the site by approximately 1,800 sf, and improved the ability of the ground surface to Page 2 of 5 infiltrate stormwater(due to the top-dressing of crushed stone), the annual recharge at the site has increased. Therefore, Standard no. 3 has been satisfied. Standard 4: Water Quality This standard requires that the amount of stormwater captured at the site for water quality treatment equal the volume derived by multiplying one-inch times the amount of new impervious area created at the site. Since the project has reduced impervious surfaces at the site, this product is zero, and no water quality volume capture or treatment is required. This standard also requires that a Long Term Pollution Prevention Plan be prepared for the site. Such a plan has been prepared and is attached to this report. In short, the plan identifies suitable practices for source control and pollution prevention throughout the life of the site operation. I For these reasons,Standard no. 4 is satisfied. Standard 5: Land Uses with Higher Potential Pollutant Loads (LUHPPL) This standard requires that certain stormwater management practices and technologies be used to control stormwater captured at sites with land uses that are of increased concern with regard to stormwater pollution. At this site,prior to the Applicant purchasing the property, the site was used as a boat yard. Boat yard activities are defined in the DEP Stormwater Management guidelines as LUHPPL. The boat yard spanned the entire property from Franklin Street to the North River. The Applicant plans to use the property to store construction equipment which is also a LUHPPL. The storage use will be located on the new crushed stone surface which is at least 55-feet from the North River. The Applicant has improved pre- development conditions at the site by moving the LUHPPL activity further away from the North River. Since there are no facilities or systems constructed at the site to capture stormwater runoff,there is no requirement at this site to include a specific stormwater management technology or practice as part of a captured stormwater management treatment process. The Applicant's improvements to the site meet Standard 5 to the maximum extent practicable. The 55-ft strip of land between the North River and the storage area will not be disturbed. The post-development site does not create any new impervious surfaces and does not create any point source discharges. Standard 6: Critical Areas Similar to Standard no. 5,this Standard no. 6 requires that captured runoff from sites that are located in environmentally-sensitive areas be treated with specific technologies or practices prior to discharge. At this site, the tidal flats along the j Page 3 of 5 North River are designated by the Massachusetts Division of Marine Fisheries as a shellfish growing area where shellfishing is prohibited. Shellfish growing areas, whether or not shellfishing is allowed, are considered Critical Areas under the Stormwater Management Guidelines. The Applicant's work, as noted above, improves stormwater runoff conditions at the site. The strip of land created between the North River and the storage area, the cleanup of the site, and the reduction in impervious surfaces at the site all reduce pollution generation and increase opportunities for sediment capture and stormwater infiltration. The improvements do not create any new impervious surfaces or point-source discharges, so there are no specific treatment technologies which need to be incorporated into the site stormwater management system. The project will not alter drainage patterns, sediment characteristics, water circulation,shellfish habit nor marine water quality in any way. For these reasons, Standard no. 6 is satisfied to the maximum extent practicable. Standard 7: Redevelopment Projects must meet Certain Standards only to the maximum extent practicable. Standard no.7 requires that redevelopment project meet Standards 1, 8, 9 and 10 in their entirety and meet Standard nos. 2, 3,4, 5, and 6 to the maximum extent practicable. As described herein,the standards are so satisfied. Therefore, Standard no. 7 is satisfied. Standard 8: Construction Period Pollution Prevention and Erosion and Sedimentation Plan. Standard no. 8 requires that Pollution Prevention and Erosion Control plans be prepared prior to construction and followed during the work. The Notice of Intent and this Stormwater Report are after-the-fact documents filed in response to an enforcement order issued by the Salem Conservation Commission. The work at the site has been completed and the site has been stabilized. Therefore, a Construction Period Pollution Prevention and Erosion and Sedimentation Plan is not necessary at this time. For this reason Standard no. 8 has been satisified. i Standard 9: Operation and Maintenance Plan Standard no. 9 requires that a Long-Term Operation and Maintenance Plan be prepared to ensure that stormwater management systems function as designed. For this property there are no engineered stormwater management systems. Therefore,no operation and maintenance plan is necessary. Should stormwater management systems be designed in the future then an operation and maintenance plan will be required. For these reasons, Standard no. 9 is satisified. Page 4 of 5 Standard 10: Prohibition of Illicit Discharges This standard requires that illicit discharges, such as the discharge of sewage to a drainage system,be prevented. The property is currently vacant and as noted above,there are no stormwater management pipes at the site. For these reasons, there are no illicit discharges on the property and Standard no. 10 is satisfied. The submitted Long Term Pollution Prevention Plan attached specifies measures to prevent illicit discharges in the future. F. CONCLUSIONS This project fully conforms to Standard nos. 1,2, 3, 4, 7, 8, 9 and 10 and conforms to Standard nos. 5 and 6 to the maximum extent practicable. The site was the subject of an Enforcement Order issued by the Salem Conservation Commission. The attached Long Term Pollution Prevention Plan has been prepared and will be instituted throughout the facilities' life. Changes in use of the site or future construction or development work involving the creation of impervious surfaces will require the submission of a Notice of Intent. The Applicant has been reminded of this requirement. i i Page 5 of 5 i Long Term Pollution Prevention Plan Good housekeeping practices-The property owners are required to keep the site in a neat and orderly condition so that unnecessary pollutants stay out of the North River. Some examples of good housekeeping practices are pavement cleaning, litter control, waste disposal, proper material storage, offsite equipment/vehicle cleaning, training and assigning responsibilities to personnel. Provisions for storing materials and waste products inside or under cover- No materials will be stored at the site. Requirements for routine inspections and maintenance of stormwater BMP's- No stormwater BMPs exist or are proposed at the site. Spill prevention and response plans -All vehicles and equipment stored on-site are to be checked for leaks on a daily basis and fixed immediately if required. Drip pans are required to contain leaks or spills during routine maintenance activities. No vehicles and equipment maintenance shall be conducted on-site. Provisions for maintenance of lawns, garden, and other landscaped areas -All landscaped areas are to be maintained with dense vegetative growth or a layer of mulch to minimize sediment transport. Litter and waste are to be picked up daily from the landscaped areas and adjoining gravel area and disposed of properly. Requirements for storage and use of fertilizer, herbicides, and pesticides- No fertilizers, herbicides, and pesticides will be stored on-site. Pet waste management provisions-Any pet waste at the site is to be scooped up, sealed in a plastic bag, and disposed of properly in the garbage for it contains high level of fecal coliform bacteria. Provisions for operation and management of septic systems- No on-site septic system exist at the site. Provisions for solid waste management- All solid waste is to be disposed of per applicable solid waste management guidelines. If a dumpster is needed on-site, the dumpster area is to be inspected periodically. Repairs to a leaky dumpster or container are to be made as necessary. The dumpster and other waste containers are to be covered to prevent waste from mixing with stormwater. Snow disposal and plowing plans relative to Wetland Resource Areas- Snow disposal is prohibited within 50-ft of the North River. Pollution-Prev-Planmpd 1121/11
