No work shall be undertaken until the Order has become final and then has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of the registered land, the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is done. The recording information shall be submitted to the Conservation Commission on the form at the end of this Order, which form must be stamped by the Registry of Deeds, prior to the commencement of work. 10. A sign shall be displayed at the site not less then two square feet or more than three square feet in size bearing the words, "Massachusetts Department of Environmental Protection" [or, "MassDEP"] "File Number 64-556 " 11. Where the Department of Environmental Protection is requested to issue a Superseding Order, the Conservation Commission shall be a party to all agency proceedings and hearings before MassDEP. 12. Upon completion of the work described herein, the applicant shall submit a Request for Certificate of Compliance (WPA Form 8A) to the Conservation Commission. 13, The work shall conform to the plans and special conditions referenced in this order. 14, Any change to the plans identified in Condition #13 above shall require the applicant to inquire of the Conservation Commission in writing whether the change is significant enough to require the filing of a new Notice of Intent. 15. The Agent or members of the Conservation Commission and the Department of Environmental Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours to evaluate compliance with the conditions stated in this Order, and may require the submittal of any data deemed necessary by the Conservation Commission or Department for that evaluation. 16. This Order of Conditions shall apply to any successor in interest or successor in control of the property subject to this Order and to any contractor or other person performing work conditioned by this Order. 17. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated Wetland, the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden stakes or flagging. General Conditions Under Massachusetts Wetlands Protection Act (cont.) 18. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or water body. During construction, the applicant or his/her designee shall inspect the erosion controls on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission, which reserves the right to require additional erosion and/or damage prevention controls it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of work line has been approved by this Order. NOTICE OF STORMWATER CONTROL AND MAINTENANCE REQUIREMENTS 19. The work associated with this Order(the "Project') is (t) ❑ is not(2) ® subject to the Massachusetts Stormwater Standards. If the work is subject to the Stormwater Standards, then the project is subject to the following conditions: a) All work, including site preparation, land disturbance, construction and redevelopment, shall be implemented in accordance with the construction period pollution prevention and erosion and sedimentation control plan and, if applicable, the Stormwater Pollution Prevention Plan required by the National Pollution Discharge Elimination System Construction General Permit as required by Stormwater Condition 8. Construction period erosion, sedimentation and pollution control measures and best management practices (BMPs) shall remain in place until the site is fully stabilized. b) No stormwater runoff may be discharged to the post-construction stormwater BMPs unless and until a Registered Professional Engineer provides a Certification that: i. all construction period BMPs have been removed or will be removed by a date certain specified in the Certification. For any construction period BMPs intended to be converted to post construction operation for stormwater attenuation, recharge, and/or treatment, the conversion is allowed by the MassDEP Stormwater Handbook BMP specifications and that the BMP has been properly cleaned or prepared for post construction operation, including removal of all construction period sediment trapped in inlet and outlet control structures; ii. as-built final construction BMP plans are included, signed and stamped by a Registered Professional Engineer, certifying the site is fully stabilized; iii. any illicit discharges to the stormwater management system have been removed, as per the requirements of Stormwater Standard 10; iv. all post-construction stormwater BMPs are installed in accordance with the plans (including all planting plans) approved by the issuing authority, and have been inspected to ensure that they are not damaged and that they are in proper working condition; v. any vegetation associated with post-construction BMPs is suitably established to withstand erosion. opatonn5.doc- rev.05119/2010 Page 7 of 12 J Massachusetts Department of Environmental Protection Provided by MassDEP: Bureau of Resource Protection - Wetlands 64-556 WPA Form 5 — Order of Conditions MassDEPFile# Massachusetts Wetlands Protection Act M.G.L. c. 131, §40 eDEPTransntion# Salem City/Town C. General Conditions Under Massachusetts Wetlands Protection Act (cont.) c) The landowner is responsible for BMP maintenance until the issuing authority is notified that another party has legally assumed responsibility for BMP maintenance. Prior to requesting a Certificate of Compliance, or Partial Certificate of Compliance, the responsible party (defined in General Condition 18(e)) shall execute and submit to the issuing authority an Operation and Maintenance Compliance Statement("O&M Statement) for the Stormwater BMPs identifying the party responsible for implementing the stormwater BMP Operation and Maintenance Plan ("O&M Plan") and certifying the following: i.) the O&M Plan is complete and will be implemented upon receipt of the Certificate of Compliance, and ii.) the future responsible parties shall be notified in writing of their ongoing legal responsibility to operate and maintain the stormwater management BMPs and implement the Stormwater Pollution Prevention Plan. d) Post-construction pollution prevention and source control shall be implemented in accordance with the long-term pollution prevention plan section of the approved Stormwater Report and, if applicable, the Stormwater Pollution Prevention Plan required by the National Pollution Discharge Elimination System Multi-Sector General Permit. e) Unless and until another party accepts responsibility, the landowner, or owner of any drainage easement, assumes responsibility for maintaining each BMP. To overcome this presumption, the landowner of the property must submit to the issuing authority a legally binding agreement of record, acceptable to the issuing authority, evidencing that another entity has accepted responsibility for maintaining the BMP, and that the proposed responsible party shall be treated as a permittee for purposes of implementing the requirements of Conditions 18(f) through 18(k)with respect to that BMP. Any failure of the proposed responsible party to implement the requirements of Conditions 18(f) through 18(k) with respect to that BMP shall be a violation of the Order of Conditions or Certificate of Compliance. In the case of stormwater BMPs that are serving more than one lot, the legally binding agreement shall also identify the lots that will be serviced by the stormwater BMPs. All debris, fill and excavated material shall be stockpiled a location far enough away from the wetland resource areas to prevent sediment from entering wetland resource areas. Material stockpiles shall be protected from contact with stormwater using a temporary perimeter sediment barrier such as fiber roll, compost filter tube or silt fence. Stockpiles shall be covered or appropriate temporary erosion control stabilization method applied to minimize sediment discharge. 24. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or replaced as necessary. Disturbed areas shall remain in a stable condition at the close of each construction day. 26. Within fourteen (14) days of completion of construction on any given portion of the project, all disturbed areas in the completed portion of the site shall be temporarily or permanently stabilized with rapidly growing vegetative cover,using sufficient top soil to assure long-term stabilization of disturbed areas. 28. If soils are to be disturbed for longer than fourteen (14) days, a temporary cover of rye or other grass should be established to prevent erosion and sedimentation. If the season is not appropriate for plant growth, exposed surface shall be stabilized by other appropriate erosion control measures, firmly anchored, to prevent soils from being washed by rain or flooding. DURING CONSTRUCTION 29. A copy of this Order of Conditions and the plan(s) approved in this Order shall be available on site at all times when work is in progress. 30. No alteration or activity shall occur beyond the limit of work as defined by the sediment barriers shown on the approved plan(s). 31. All waste products,including construction materials, etc. shall be deposited in waste containers of sufficient size to contain waste. 32. Building products shall be stored either under cover to prevent products from coming into contact with rainwater or similar effective means to prevent the discharge of pollutants. Diesel fuel,oil and hydraulic fluids,and other petroleum products shall be stored in water-tight containers and under cover(plastic sheeting or temporary roof) to prevent products from coming into contact with rainwater or provide secondary containment. 33. Hazardous wastes (paints, solvents,curing compounds,acids) shall be separated from construction waste and stored in sealed containers suitable to prevent leakage and corrosion and labeled in accordance with applicable federal and state requirements. Outside storage of containers shall contain secondary containment or similar effective means to prevent discharge of pollutants. 34. Concrete trucks shall not be washed out in any wetland resource or buffer zone area,nor into any drainage system. Concrete washwater shall be directed to a leak-proof container or pit. Any deposit of cement,concrete or masonry products into a buffer zone or wedand resource area shall be immediately removed. 35. All exposed sub-sods shall be covered by a minimum of three(3) inches of quality screened loam topsoil prior to seeding and final stabilization. 36. Immediately following drainage structure installation all inlets shall be protected by inlet protection to remove sediment from the discharge before it enters the drainage system. Inlet protection measures may include woven filter fabric, concrete blocks with clean washed stone. Inlet protection measures may be removed in the event that the measure floods. 37. There shall be no pumping of water from wetland resource areas. 38. All equipment shall be inspected regularly for leaks. Any leaking hydraulic lines,cylinders or any other components shall be fixed immediately. 39. During construction, all drainage structures shall be inspected regularly and cleaned as necessary. 40. INTRODUCTION This Notice of Intent (NOI) is being submitted by the Fortunate Son Realty Trust for the repair and modification of an existing wooden bulkhead and railway ramp and pier previously use for launching boats. All three structures are permitted under Chapter 91. Because of the requested modification to the railway ramp and pier a new Chapter 91 License will be sought in addition to this filing. The property subject to this NOI is located at 8-10 Franklin Street in Salem. The location of the property is shown on Figure 1 —MassDEP Priority Resource Map and Figure 2 Oliver MassGIS's Online Mapping Tool. Photographs of the existing structures are presented in the Photo Log. B. PROJECT BACKGROUND The Fortunate Son Realty Trust purchased the property at 8-10 Franklin Street early in 2010. The property had been used as a boat yard for decades and was covered with dilapidated boats, floats and other related debris. The property had two small buildings, a shed and a trailer that were in distressed condition. After purchasing the property the applicant proceeded to have all of debris removed including the buildings, shed and trailer. In total(30) 30-cubic yards trailers of debris were removed for disposal and recycling. After removing the debris the applicant spread 2-inches of crushed stone over the existing gravel from Franklin Street to approximately 75 feet from the existing bulkhead. On October 29, 2010, the Fortunate Son Realty Trust was issued a positive Determination of Applicability and an Enforcement Order by the Salem Conservation Commission for working in an Area Subject to Protection Under the Wetlands Protection Act(MGL Chapter 131, Section 40) without an Order of Conditions (Order). The work had included the removal of two small buildings, one shed, one trailer,boat debris from the former boat yard and spreading of 2-inches of gravel. Fortunate Son Realty Trust filed an NOI a received an Order. The Order was recorded and a request for a Certificate of j Completion was filed for. The Certificate of Completion was recorded on August 3, 2012, at the Southern Essex Registry of Deeds on Page 1 of Book 31588. This NOI is being submitted for the repair and modification of the existing wooden bulkhead and railway ramp and pier previously use by the former boat yard for launching boats. Both existing structures are permitted under Chapter 91. A copy of the license is presented in Appendix A C. PROJECT DESCRIPTION The proposed project consists of removing an existing wooden bulkhead, railway and pier that were permitted in 1997 under Chapter 91 license 4980 and replacing them with a steel-sheeting bulkhead held in place with a buried four-foot high, nine-inch thick reinforced concrete anchor wall and tie-backs. A copy of the 1997 Chapter 91 plan is attached as Appendix A and plans for the proposed project are presented as Appendix B. Plans for the Chapter 91 application to be filed with the Department of Environmental Protection are presented in Appendix C. The existing bulkhead is 131 feet long including the sidewall of the existing railroad ramp. The proposed bulkhead is 116 feet long. It is shorter because it extends across the railroad ramp instead of forming the sidewall. The proposed bulkhead would close off the existing railway ramp and pier. The concrete anchor wall will be set 35-feet back from the bulkhead and approximately 18 inches below existing grade. Excess fill displaced by the concrete anchor wall will be used as backfill in the railroad ramp area. The top of the bulkhead will be 12.6 feet, above MHW (9.0' NAVD88)) and below FEMA Zone AE Elevation of 13.7' (MLW). The proposed top of the bulkhead elevation was the permitted elevation in 1997 before the existing wall failed. The railway ramp and pier area and volume to be filled is a total of 455 square feet and 60 cubic yards of which 226 square feet and 9 cubic yards are located between MHW and the proposed bulkhead. Prior to removing the existing structure, a floating boom with silt curtain will be installed in an arch from one end of the proposed bulkhead to the other and anchored in place. The silt curtain will be 10 feet long so that it touches the bottom at high tide. Next the existing bulkhead, railway, and pier will be removed along with the debris that has spilled over and into the adjacent wetland resource area. The debris includes concrete, concrete block,wood beams, and previously used to stabilize the failing bulkhead. All solid waste will be place into dumpsters for off site disposal. Following the removal of the structure a new steel-sheeting bulkhead will be driven the width of the property as shown on the plan presented in Appendix B and C. Work on the bulkhead will be performed on the outgoing tide and will cease when the tide returns to the work area. Siltation fence will be place on the landside of the bulkhead while the tiebacks are being installed. All soil stockpiles will be surrounded with silt fence at the end of each workday. When work is complete the area will be dressed with crushed stone and returned to final grade. D. RESOURCE AREAS Resource areas defined under the Wetlands Protection Act that are affected by this project include Costal Bank,Land Subject to Costal Storm Flowage and tidal flats. Land Under The Ocean (310 CMR 10.25) Land Under the Ocean (LUO) is defined as "land extending from the mean low water line seaward to the boundary of the municipality's jurisdiction and includes land under estuaries. The project takes place entirely above mean low water and does include any Land Under Ocean. Designated Port Areas (310 CMR 10.26) Designated Port Areas means those areas designated in 301 CMR 25.00 of the Coastal Zone Management Regulations. There Project area is not a "Designated Port Area. " Coastal Beach (310 CMR 10.27) Coastal Beach means unconsolidated sediment subject to wave, tidal and coastal storm action which forms the gently sloping shore of a body of salt water and includes tidal flats. Coastal beaches extend from the mean low water line landward to the dune, coastal bank or the seaward edge of existing man-made structures,when these structures replace one of the above lines, whichever is closest to the ocean. This project takes places with the manmade structures and does not include any coastal beach. 1 Tidal Flats (310 CMR 10.27) Tidal Flat means any nearly level part of a coastal beach which usually extends from the mean low water line landward to the more steeply sloping face of the coastal beach or which may be separated from the beach by land under the ocean. Inside the railroad ramp area there are 226 square feet of tidal flats. The area was filed when the ramp was constructed and later permitted in 1997. This tidal area is shown to be outside of the shellfish habitat on Figure 2. ' Coastal Dune(310 CMR 10.28) Coastal Dune means any natural hill, mound or ridge of sediment landward of a coastal beach deposited by wind action or storm overwash. Coastal dune also means sediment deposited by artificial means and serving the purpose of storm damage prevention or flood control. There are no coastal dunes present at this Project. IBarrier Beaches (310 CMR 10.29) Barrier Beach means a narrow low-lying strip of land generally consisting of coastal beaches and coastal dunes extending roughly parallel to the trend of the coast. It is separated from the mainland by a narrow body of fresh, brackish or saline water or a marsh system. A barrier beach may be joined to the mainland at one or both ends. The Project area is not a Barrier Beach. i Costal Bank(310 CMR 10.30) Coastal Bank means the seaward face or side of any elevated landform, other than a coastal dune,which lies at the landward edge of a coastal beach, land subject to tidal action, or other wetland. The Costal Bank is the existing bulkhead the top of which was 12.6 feet according to the 1997 Chapter 91 license. A significant amount of the existing bulkhead has crumbled and fallen into the oceanside of the bulkhead. The existing bulkhead is 131 feet long including the sidewall of the existing railroad ramp. The proposed bulkhead is 116 feet long. It is shorter because it extends across the railroad ramp instead offorming the sidewall. When a proposed project involves the dredging, filling,removing or altering of a bank of a fish run, or land under the ocean, or under a pond, stream, river, lake or creek which is a fish run, the issuing authority shall presume that such bank or land is significant to the protection of marine fisheries. This presumption may be overcome only upon a clear showing that such bank or land does not play a role in the protection of marine fisheries, and if the issuing authority makes a written determination to that effect. MHW comes two feet up the existing bulkhead. The rest of the time the bulkhead is dry. Because it is manmade and out of the water most of the tide cycle the bulkhead is not considered significant to the protection of marine fisheries. We request the Commission to confirm this with a written determination to that effect. Rocky Intertidal Shores (310 CMR 10.31) Rocky Intertidal Shores means naturally occurring rocky areas, such as bedrock or boulder-strewn areas between the mean high water line and the mean low water line. There are no naturally occurring rocky areas associated with the project. The existing boulders and concrete pieces were placed by the previous owner in an effort to stabilize the bulkhead. Salt Marshes (310 CMR 10.32) Salt Marsh means a coastal wetland that extends landward up to the highest high tide line, that is,the highest spring tide of the year, and is characterized by plants that are well adapted to or prefer living in, saline soils. Dominant plants within salt marshes are salt meadow cord grass (Spartina patens) and/or salt marsh cord grass (Spartina alterniflora). A salt marsh may contain tidal creeks, ditches and pools. There are no salt marshes associated with the Project. Land Under Salt Ponds (310 CMR 10.33) Salt Pond means a shallow enclosed or semi-enclosed body of saline water that may be partially or totally restricted by barrier beach formation. Salt ponds may receive freshwater from small streams emptying into their upper reaches and/or springs in the salt pond itself. i � There are no salt ponds associated with the Project. ILand Containing Shellfish (310 CMR 10.34) Land Containing Shellfish is defined as "land under the ocean,tidal flats,rocky intertidal shores, salt marshes and land under salt ponds when any such land contains shellfish." Land Containing Shellfish may exist within the intertidal and subtidal areas, which include LUO. Land Containing Shellfish shall be found significant when it has been determined and mapped as follows: by the Conservation Commission or the Department in consultation with DMF and based upon maps and designations of DMF; or by the Conservation Commission or the Department based on maps and written documentation of the shellfish constable or the Department. In making such identification and maps,the following factors shall be taken into account and documented: the density of shellfish, the size of the area and the historical and current importance of the area to recreational or commercial shellfishing. Currently, no maps exist that identify this intertidal area adjacent to and including the bulkhead as significant shellfish areas. DMF maps indicate that this area is and has been for many years closed to shell fishing due to high bacterial contamination. The Mass GIS shellfish suitability maps (Figure 2) do not indicate the project area as being potentially for suitable shellfish habitat. Banks of or Land Under The Ocean,Ponds, Streams,Rivers, Lakes, Or Creeks That Underlie Anadromous/Catadromos Fish Run (310 CMR 10.35) The land under the ocean, ponds, streams, rivers, lakes, or creeks that underlie anadromous/catadromous fish run is defined as "that area within...rivers...which is a spawning or feeding ground or passageway for anadromous or catadromous and which is ' identified by the DMF or has been mapped on the Coastal Atlas of the Costal Zone Management Program." The North River is known to contain river herring (alewife, Alosa pseudoharengus, and blueback herring Alosa aestivalis and smelt(Osmera mordax). MHW comes two feet up the existing bulkhead. The rest of the time the bulkhead is dry. Because it is manmade and out of the water most of the tide cycle the bulkhead and is therefore not considered significant to the protection of marine fisheries. This project will not adversely affect the fish run by impeding or obstructing the migration offish, changing the volume or rate of f ow water, or impairing the capacity of spawning or nursing habitats necessary to sustain the various life stages of the fish. Land Subject to Costal Storm Flowage The Land Subject to Costal Storm Flowage includes the entire property of approximately 20,687 square feet. The area of the railroad ramp is 455 square feet with 38 square feet outside the proposed bulkhead. The area inside the railway ramp between MHW and the proposed bulkhead is 226 square feet. Approximately 60 cubic yards of fill from the t concrete anchor wall will be used to fill the railroad ramp area. Nine cubic yards will be placed between MHW and the proposed bulkhead. The total volume is not significant and will have no measurable impact on the Land Subject to Costal Storm Flowage. E. PERMITING This project is located in Resource Areas defined and protected under the Wetlands Protection Act and is subject to the jurisdiction of Chapter 91. The applicant will be applying for a new Chapter 91 license pending the outcome of this NOI. F. PUBIC NOTICE An Affidavit of Service for notification of abutters an abutters list provide by the City are presented in Appendix D G. CONCLUSIONS The project area is in a state of disrepair as was the rest of the property when it was purchased. The applicant cleared the rest of the property of tons of solid waste that was the result of decades of accumulation. The existing bulkhead has failed and is allowing uncontrolled erosion the land to onto the tidal flats adjacent to the property. Under the existing Chapter 91 license the owner is required to repair and maintain the bulkhead, li railway ramp and pier. The owner has no desire for the continued use of the railway ramp and would like to fill it to grade. The area below MHW inside the ramp is 226 square feet and 9 cubic yards in volume.
