As a result of the recent inspection conducted by this office it has been
determined that an illegal dwelling unit exists on the third floor of 36 Cabot
Street in violation of the State Building, Electrical and Plumbing Codes for
insufficient means of egress and performing work without permits.
The illegal unit needs to be vacated and the violations must begin to be
corrected, repaired, and/or brought into compliance within 15 days of your
receipt of this notice. Failure to do so may result in further actions being
brought against you, up to and including the filing of criminal complaints at
District Court.
You have the right to appeal this order to the State Board of Building
Regulations at One Ashburton Place, Boston, Ma.

FEE SCHEDULE
I. The filing fee is $75.00 for an application for Special Permit or Variance, or for an
appeal of the decision of the Building Commissioner. The check should be made
payable to City of Salem Board of Appeal. Fees may be waived if the City of Salem is the
petitioner.
a. /f the application for a special permit or variance involves new construction of
dwelling units, a fee of$50 will added to the tiling fee for each dwelling unit on the
property up to a maximum of$500. This additional fee will be refunded if the request is
denied.
b. /f the application for a special permit or variance will increase the namber of dwelling

Legal Remedies for Tenants of
Residential Housing
The following is a brief summary of some of the legal remedies tenants may use In order to get housing code violations
corrected:
1. Rent Withholding,(Massachusetts General laws,Chapter 239,section 8A): If Code Violations Are Not Being Corrected you
may be entitled to hold back your rent payments.You can do this without being evicted if:
A. You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger
or materially impair your health or safety and that your landlord knew about the violations before you were behind in-.
your rent-
B. You did not cause the violations and they can be repaired while you continue to live in the building.
C. You are prepared to pay any portion of the rent Into court if a judge orders you to pay it (For this,it is best to put the,
rent money aside in a safe place) _
2. Repair and D n r i(Massachusetts General Laws,Chapter I11,section 127L):The law sometimes allows you to use your rent ,
money to make the repairs yourself.If your local code enforcement agency certifies that there are code violations which
endanger or materially impair your health,safety,or well-being,and your landlord has received written notice of the violations;
you may be able to use this remedy.If the owner fails to begin necessary repairs(or to enter into a written contract to have their
made)within five days after notice or to complete repairs within 14 days after notice,you can use up to four months'rent inany
year to make the repairs.
3. Retaliatory R nt Increaus or vi ions Pmbibited(Massachusetts General Laws,Chapter 186,section 18,and Cbapta239„
section 2A):The owner may not increase your rent or evict you in retaliation for making a complaint to your local code
enforcement agency about code violations.If the owner raises your rent to tries to evict within six months'after you have made
the complaint, he or she.will:have toshow-a good reason for the increase or eviction which is unrelated to your complaint.You
may be able to sue the landlord for damages of he or she tries this.
4. Rent R ccivershin(Massachusetts General Laws,Chapter 11,section 127 C-H):The occupants and/or the Board of Health may
petition the District or Superior Court to allow rent to be paid into court rather than to the owner.The court may then appoint a
"receiver" who may spend as much of the rent money as is needed to correct the violation.The receiver is not subject to a
spending limitation of four months'rent-
5. Breach of Warranty of Nabi ahilorrv:You may be entitled to sue your landlord to have all or some of your rent returned if your.:
dwelling unit does not meet minimum standards of habitability.
6. Unfair and Deceo iv� ra i es(Massachusetts General Laws,Chapter 93A): Renting an apartment with code violations is a
violation of the consumer protection act and regulations,for which you may sue an owner.

Please be advised that at 36 Cabot Street, Salem, Massachusetts,
there are various activities which I understand are in contra-
vention to the zoning and occupancy codes of the city of Salem.
A recent observation made by Reverend Lloyd W. Jewett, the
direct abutter, noted that the following vehicles were parked
on or adjacent to the property:
1 . trailer for payloader;
2. two-and-one-half-ton body truck;
3. four three-quarter ton trucks;
4. two five-ton trucks with sand blasting and staging
equipment.
Reverend Jewett has also observed that various residents of the
property at 36 Cabot Street are carrying on businesses from the
house including earth removal business , plowing business, sand
blasting and painting. It is Father Jewett' s understanding that
all of these uses are in violation of current zoning. Would you
please direct that these uses cease and that the vehicles
associated with these uses be removed from the premises.

The Massachusetts Department of Public Health State Sanitary Code, Chapter II, "Minimum Standards
of Fitness for Human Habitation," Section 410.354 Metering of Electricti and Gas and Section 410.254
Light in Passageway, Hallways and Stairs states:
(A) The owner shall provide the electricity and gas used in each dwelling unit unless
(1) Such gas or electricity is metered through a meter which serves only the dwelling unit
and
(2)The owner shall install and maintain wiring and piping so that any such electricity or
gas used in the dwelling unit is metered through meters which serve only such
dwelling unit and
(3) The rental agreement provides for payment by the occupant.
(B) If the owner is required by this code or rental agreement to pay for the electricity or gas
used in a dwelling unit,then such electricity or gas may be metered through meters which
serve more than one dwelling unit.
(C) In a dwelling containing only three or fewer dwelling units,the light fixtures used to
illuminate a common hallway may be wired to'the electricity service serving a dwelling unit
on the same floor provided that if the occupant of such dwelling unit is responsible for
paying for the electric service to such dwelling unit,then the rental agreement shall
state that the occupant is responsible for paying for light in the common hallway and the
owner shall notify the occupants of the other dwelling units.
Cross metering has been reported by the occupant of 36 Cabot Street Apt#1 Left
This occupant(s) pay the electric bill for that unit.
You are hereby ordered to present certification to this office within 14 days that a licensed electrician has
determined that no cross metering exists or that any cross metering has been remedied.

Legal Remedies for Tenants of
Residential Housing
The following Is a brief summary of some of the legal remedies tenants may use In order to get housing code violations
corrected:
1.,Rent Withholding(Massachusetts General laws,Chapter 239,section 8A): If Code Violations Are Not Being Corrected you
may be entitled to hold back your rent payments.You can do this without being evicted if:
A. You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger
or materially impair your health or safety and that your landlord knew about the violations before you were behind im
your rent.
B. You did not cause the violations and they can be repaired while you continue to live in the building.
C.Tou are prepared to pay any portion of the rent into court if a judge orders you to pay it.(For this,it is best to put the,
rent money aside in a safe place)
2. &aairnd D A t it(Massachusetts General Laws,Chapter 111,section 127L):The law sometimes allows you to use your rent
money to make the repairs yourself.If your local code enforcement agency certifies that there are code violations which
endanger or materially impair your health,safety,or welt-being,and your landlord has received written notice of the violations;
you may be able to use this remedy.If the owner fails to begin necessary repairs(or to enter into a written contract to have thetfr
made)within five days after notice or to complete repairs within 14 days after notice,you can use up to four months'rent in anS;
year to make the repairs.
3: R .tom aiintory Rent Increases or Evictions Probihit (Massachusetts General Laws,Chapter 186,section 18,and Chapter 239„:_
section 2A):The owner may not increase your rent or evict you in retaliation for making a complaint to your local code
enforcement agency about code violations.If the owner raises your rent to tries to evict within six months after you have made
the complaint,he or she.wilLhave.to show.a good reason for the increase or eviction which is unrelated to your complaint.You
may be able to sue the landlord for damages of he or she tries this.
4. Rent Receivership(Massachusetts General Laws,Chapter 11, section 127 C-H):The occupants and/or the Board of Health may
petition the District or Superior Court to allow rent to be paid into-court rather than to the owner.The court may then appoint a
"receiver” who may spend as much of the rent money as is needed to correct the violation.The receiver is not subject to a
spending limitation of four months'rent.
5. Breach of Warranty of Habitability:You may be entitled to sue your landlord to have all or some of your rent returned if your.:
dwelling unit does not meet minimum standards of habitability.
6. Unfair and D=fiyc Practices(Massachusetts General Laws,Chapter 93A): Renting an apartment with code violations is a
violation of the consumer protection act and regulations,for which you may sue an owner.

Legal Remedies for Tenants of
Residential Housing
The following Is a brief summary of some of the legal remedies tenants may use In order to get housing code violations
corrected:
1..R nt Wi hholdin (Massachusetts General Laws,Chapter 239,section 8A):If Code Violations Are Not Being Corrected you
may be entitled to hold back your rent payments.You can do this without being evicted if-
A- You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger
or materially impair your health or safety and that your landlord knew about the violations before you were behind in-
your rent.
B. You did not cause the violations and they can be repaired while you continue to live in the building.
C. You are prepared to pay any portion of the rent'Lato court if a judge orders you to pay it(For this,it is best to put the,
rent money aside in a safe place.) _
2. Ro it and D n r s(Massachusetts General Laws,Chapter 111, section 127L):The law sometimes allows you to use your rent
money to snake the repairs yourself.If your local code enforcement agency certifies that there are code violations which
endanger or materially impair your health,safety,or welt-being,and your landlord has received written notice of the violations.;
you may be able to use this remedy.If the owner fails to begin necessary repairs(or to enter into a written contract to have the¢N
made)within five days after notice or to complete repairs within 14 days after notice,you can use up to four months'rent in fang;
year to make the repairs.
3. Re,aliatory Rent Increases or Evictions Prohibited(Massachusetts General Laws,Chapter 186,section 18,and Chapter 239„:. .
section 2A):The owner may not increase your rent or evict you in retaliation for making a complaint to your local code
enforcement agency about code violations.If the owner raises your rent to tries to evict within six months after you have made
the complaint,he or she.will:have to-show.a good-reason for the increase or eviction which is unrelated to your complaint.You
may be able to sue the landlord for damages of he or she tries this.
4. Rent Receivership(Massachusetts General Laws,Chapter 11, section 127 C-H):The occupants and/or the Board of Health may
petition the District or Superior Court to allow rent to be paid into court rather than to the owner.The court may then appoint a
"receiver" who may spend as much of the rent money as is needed to correct the violation.The receiver is not subject to a
spending limitation of four months'rent.
5. Breach of Warranty of Habitability You may be entitled to sue your landlord to have all or some of your rent returned if your
dwelling unit does not meet minimum standards of habitability.
6. Unfair and D=tive Practices(Massachusetts General Laws,Chapter 93A): Renting an apartment with code violations is a
violation of the consumer protection act and regulations,for which you may sue an owner. •
