Sec. 12-66. - Purpose.
It is the intent of this division to foster the protection and preservation of public safety and health of
occupants, abutters, and neighborhoods and prevent blight and dangerous conditions caused by poorly
maintained and unsecured real property by: (i) requiring each owner of an abandoned real property or
real property in foreclosure to register that real property with the inspectional services department and (ii)
encouraging and authorizing maintenance of such real property. This division is in addition to the exiting
authority of various municipal officials, boards and commissions, including the director of inspectional
services and the board of health, to address problems caused by unsecured and poorly maintained real
properties and nothing set forth herein shall be construed to limit that authority.
The director of the inspectional services department has enforcement authority hereunder pursuant
to, inter alia, M.G.L c. 143. § 3, the State Building Code, and the City of Salem Zoning Ordinance.

Sec. 12-67. - Definitions.
When used in this division, unless a contrary intention clearly appears, the following terms shall have
the following meanings:
Abandoned means any property, residential and commercial, that is unoccupied for more than 45
days excluding, however, real property used exclusively for seasonal occupancy or to which improvements
are being made pursuant to a building permit.
City means City of Salem.
Days mean consecutive calendar days.
Director means director of inspectional services department.
Evidence of abandonment means any condition that would lead a reasonable person to believe that the
property is abandoned.
Forc/osure process means when, as to that real property, (1) an action for possession has been brought
or possession has been taken by a mortgagee pursuant to M.G.L. c. 244, § 1 or(ii) publication of the first
foreclosure notice has been made pursuant to M.G.L. c. 244, § 14.
Mortgagee means the creditor, including but not limited to, service companies and lenders, in a
mortgage agreement.

Mortgagee in possession means a mortgagee that has taken over control and/or occupancy of a
property upon default of the borrower to collect from the property and/or prepare for foreclosure.
Occupied means a property that is not abandoned.
Owner means each person or entity who alone or severally with others:
(1) Holds legal or equitable title to any real property:
(2) Has care, charge or control of any real property in any capacity including but not limited to agent,
personal representative, executor, executrix, administrator, administratix, trustee or guardian of
the estate of the holder of legal title;
(3) Is a mortgagee in possession of any real property;
(4) Is an agent, trustee, receiver or other person appointed by a court and vested with possession or
control of any real property; or
(5) That has initiated the foreclosure process.
Real property means any parcel of land, with improvements thereof, if any, residential or commercial,
or portion thereof, including a condominium unit located in the City of Salem.
Secure means making real property inaccessible to unauthorized persons.

Sec. 12-68. - Registration.
Each owner of an abandoned real property or real property for which the foreclosure process has
begun shall register that property as required herein with the director on forms provided by the director.
All registrations forms must be complete and be received by the director within seven days of
abandonment or the initiation of the foreclosure process as defined in section 12-87.
An annual registration fee of$300.00 must accompany the registration form. The fee and registration
are valid for the calendar year, or remaining portion of the calendar year, in which the registration was
initially required. Registration fees shall be prorated on a monthly basis. Each such real property must be
re-registered until it is occupied or the foreclosure is complete or otherwise resolved. Subsequent
registrations and fees are due January 15th of each year and must include a complete registration form.

Sec. 12-69. - Maintenance requirements.
Real property subject to this division must be maintained in accordance with all applicable sanitary
codes, building codes, and federal, state and local laws, rules and regulations. For so long as real property
is subject to this division, each owner of the property shall make at least monthly inspections thereof.

Sec. 12-70. - Inspections.
The inspectional services department shall have the authority and to inspect properties subject to this
division for compliance and to issue citations for any violations hereof. The inspectional services
department shall have the discretion to determine when and how such inspections are to be made,

provided that their policies are reasonably calculated to ensure that this division is enforced. The director
may request that an owner of real property subject to this division take action to secure, maintain or
otherwise improve that property.

Sec. 12-71. - Enforcement and penalties.
Failure to register, including the submission of a complete registration form, with the director is
punishable by a fine of$300.00, each day being a separate offense.

Sec. 12-72. -Appeal.
Any person aggrieved by the requirements of this division or by a decision issued under this division
by the director may seek relief pursuant to M.G.L. c. 40, § 21 D.

If any provision of this division imposes greater restrictions or obligations than those imposed by any
other general law, special law regulation, rule ordinance by-law order, or policy then the provisions of this
division control.

The director has the authority to promulgate rules and regulations necessary to implement and
enforce this division.

This Department has continued to receive complaints regarding this property. A few months ago, I had to secure
the building and remove a section of gutter that was flapping in the breeze. We are aware of a foreclosure filing
on the building and understood that it was for sale.Now it appears that you are rehabbing the building without
permits in an attempt to reoccupy the Building
As of this point,the building is empty and I am removing the Occupancy permit for both units such time that
building permits are pulled by licensed contractors to do repairs and to replace the rear stair. You are also
required to have a plumber pull a permit to install a new meter as well as check the plumbing and gas
throughout the house.The same goes for Electrical . Also, because of the length of time that has gone by, new
certificates of Fitness need to be done by the Health Department as well as a smoke detector certificate from
Fire Prevention.If you feel you are aggrieved by this order,your Appeal is to the Board of Buildings,
Regulations and standards in Boston. If you have any other questions,please contact me directly.

Mr. Dominguez, enclosed, please find a new citation for three separate building code violations.
These violations are a result of you ignoring the letter of September 9" ,2016 outlining the steps
you needed to take before re-occupying your rental property.
#1 Failure to obtain Occupancy Permits : State Building code 780 CMR section RI 10
#2 Failure to secure a building permit and to use a licensed Contractor to repair the rear stairs
State Building Code 780 CMR section R-105
#3 Blue tarp on roof- is a non-approved roof covering and does not meet the waterproofing
standard of the State Building Code 780 CMR sections 904 and 905.
Each violation is $50 for the first offense and $150 and $300 for the second and third violations.
The first two items were clearly stated in my letter. I will also add that both chimneys are failing
with bricks falling from both.
You may appeal my Building Code interpretations to the Board of Buildings, Regulations and
Standards in Boston. Failure to address these violations will result in further enforcement actions
and additional fines

Sec. 12-66. - Purpose.
It is the intent of this division to foster the protection and preservation of public safety and health of
occupants, abutters, and neighborhoods and prevent blight and dangerous conditions caused by poorly
maintained and unsecured real property by: (i) requiring each owner of an abandoned real property or
real property in foreclosure to register that real property with the inspectional services department and (ii)
encouraging and authorizing maintenance of such real property. This division is in addition to the exiting
authority of various municipal officials, boards and commissions, including the director of inspectional
services and the board of health, to address problems caused by unsecured and poorly maintained real
properties and nothing set forth herein shall be construed to limit that authority.
The director of the inspectional services department has enforcement authority hereunder pursuant
to, inter alia, M.G.L c. 143. § 3, the State Building Code, and the City of Salem Zoning Ordinance.

Sec. 12-67. - Definitions.
When used in this division, unless a contrary intention clearly appears, the following terms shall have
the following meanings:
Abandoned means any property, residential and commercial, that is unoccupied for more than 45
days excluding, however, real property used exclusively for seasonal occupancy or to which improvements
are being made pursuant to a building permit.
City means City of Salem.
Days mean consecutive calendar days.
Director means director of inspectional services department.
Evidence of abandonment means any condition that would lead a reasonable person to believe that the
property is abandoned.
Forclosure process means when, as to that real property, (1) an action for possession has been brought
or possession has been taken by a mortgagee pursuant to M.G.L. c. 244, § 1 or(ii) publication of the first
foreclosure notice has been made pursuant to M.G.L. c. 244, § 14.
Mortgagee means the creditor, including but not limited to, service companies and lenders, in a
mortgage agreement.

Mortgagee in possession means a mortgagee that has taken over control and/or occupancy of a
property upon default of the borrower to collect from the property and/or prepare for foreclosure.
Occupied means a property that is not abandoned.
Owner means each person or entity who alone or severally with others:
(1) Holds legal or equitable title to any real property:
(2) Has care, charge or control of any real property in any capacity including but not limited to agent,
personal representative, executor, executrix, administrator, administratix, trustee or guardian of
the estate of the holder of legal title;
(3) Is a mortgagee in possession of any real property;
(4) Is an agent, trustee, receiver or other person appointed by a court and vested with possession or
control of any real property; or
(5) That has initiated the foreclosure process.
Real property means any parcel of land, with improvements thereof, if any, residential or commercial,
or portion thereof, including a condominium unit located in the City of Salem.
Secure means making real property inaccessible to unauthorized persons.

Sec. 12-68. - Registration.
Each owner of an abandoned real property or real property for which the foreclosure process has
begun shall register that property as required herein with the director on forms provided by the director.
All registrations forms must be complete and be received by the director within seven days of
abandonment or the initiation of the foreclosure process as defined in section 12-87.
An annual registration fee of$300.00 must accompany the registration form. The fee and registration
are valid for the calendar year, or remaining portion of the calendar year, in which the registration was
initially required. Registration fees shall be prorated on a monthly basis. Each such real property must be
re-registered until it is occupied or the foreclosure is complete or otherwise resolved. Subsequent
registrations and fees are due January 15th of each year and must include a complete registration form.

Sec. 12-69. - Maintenance requirements.
Real property subject to this division must be maintained in accordance with all applicable sanitary
codes, building codes, and federal, state and local laws, rules and regulations. For so long as real property
is subject to this division, each owner of the property shall make at least monthly inspections thereof.

Sec. 12-70. - Inspections.
The inspectional services department shall have the authority and to inspect properties subject to this
division for compliance and to issue citations for any violations hereof. The inspectional services
department shall have the discretion to determine when and how such inspections are to be made,

provided that their policies are reasonably calculated to ensure that this division is enforced. The director
may request that an owner of real property subject to this division take action to secure, maintain or
otherwise improve that property.

Sec. 12-71. - Enforcement and penalties.
Failure to register, including the submission of a complete registration form, with the director is
punishable by a fine of$300.00, each day being a separate offense.

Sec. 12-72. -Appeal.
Any person aggrieved by the requirements of this division or by a decision issued under this division
by the director may seek relief pursuant to M.G.L. c. 40, § 21 D.

Sec. 12-73. -Applicability.
If any provision of this division imposes greater restrictions or obligations than those imposed by any
other general law, special law regulation, rule ordinance by-law order, or policy then the provisions of this
division control.

Sec. 12-74. - Regulatory authority.
The director has the authority to promulgate rules and regulations necessary to implement and
enforce this division.

Sec. 12-75. - Severability.
If any provision of this division is held to be invalic[by a court of competent jurisdiction then such
provision shall be considered separately and apart from the remaining provisions, which shall remain in
full force and effect.

A report has been made to this office that there is an illegal apartment unit located in the attic of this permitted two
(2)- unit building in an R2 zoning district. For this reason an inspection must be conducted by our office to assure
compliance with the code and city ordinance.
The most concerning off these violations that has been received are the life safety and egress conditions at the property
for this alleged third floor unit, A Required Inspection must be conducted by our Department to assure compliance with
the State Building code and city ordinances.
Under the provisions of 780 CMR, Section 104.6—Right of Entry, of the State Building Code, access to this property
must be granted for the purposes of this inspection. Please call this office upon receipt of this letter, if this property has
rental units, these tenants must be notifaed in advance of this inspection, so that access to these spaces may also be
accomplished.
This Required Inspection shall be conducted by this office on Thursday, June 7, 2012 at 3:00 p.m.; failure to respond
to this notification will be construed as non- compliance,with issuance of Municipal tickets and as such an

I conducted an inspection at 49 Butler Street on January 8, 2001, along with Dennis Ross,
Plumbing Inspector and Paul Tuttle, the City Electrician. Their list of violations is
included with this report. My list of violations are as follows;
1. Broken window side entrance door.
2. Structural repair around window on Std floor—no header
3. Washer& dryer blocking 2nd means of egress 2°d floor
4. Hand rails of all stairs wells must be repaired.
5. 42" rail must be installed on 3I floor around stairway.
6. 2°d means of egress on first floor blocked by bureau.
7. Holes in ceiling exposing non vented sink and toilet.Vt floor
8. Mattress and lots of other debris covered with snow out back must be cleaned up.
9. New plumbing, new electric, must be removed from Std floor. The kitchen and bath
are illegal and must be removed. He has heating pipes going through his shower.
10. All locks to Std floor apartment must be removed.
All contractors must be licensed in the State of Massachusetts. Plumbing,Electrical, and
Builders. No homeowner exempt applies to this property because he doesn't live there.
Building permit must be taken out first with plumbing and electrical permits to follow.

Domingo Dominquez has had several trips from our Department to his residence at 49
Butler Street.
We originally had to put a stop work order, and a visit from the Salem Police to get him
to finally take out permits for his illegal 3`d floor apartment. His outside decks were built
without footing and encroaching the properties on both sides closer than the 5' allowed.
He was told no door on the 3`d floor. He must put the window back in. As of 10:45 a.m.
this day, there is now a door there. He constantly ignores letters and conversations we
have with him and just does as he pleases. He has broken Salem Zoning Ordinances and
Massachusetts Building Codes and won't comply with anything we tell him.
Section 1-7, Penalty for violation of code and ordinances "says" I suggest to Magistrate if
he does not comply within (14) days to the City of Salem, he be fines $25.00 a day.

The following Is a brief summary of some of the legal remedies tenants may use In order to get housing code violations
corrected:
1:,Rent V ilhholdinv(Massachusetts General Laws,Chapter 239,section 8A): If Code Violations Are Not Being Corrected you
may be entitled to hold back your rent payments.You can do this without being evicted if:
A_ You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger
or materially impair your health or safety and that your landlord knew about the violations before you were behind in-
your rent
