Petition of LEE DEARBORN, seeking an amendment to a previously issued decision, dated March 1, 2017,
to include a third floor dormer and a few minor changes at 32 BUFFUM STREET (Map 25, Lot 255)(82
Zoning District).
A public hearing on the above Petition was opened on April 19, 2017 pursuant to M.G.L Ch. 40A, § 11 and
closed on that date with the following Salem Board of Appeals members present Mr. Copelas (Acting Chair),
Mr. Duffy,Mr. Tsitsinos,Mr. Watkins,and Mr.Viccica (alternate).
The Petitioner seeks an amendment to a previously issued decision, dated March 1, 2017, to include a third
floor dormer and a few minor changes.
Statements of fact:
1. Lee Dearborn,petitioner,presents the petition.
2. In the petition date-stamped March 28, 2017, the petitioner requested an amendment to a previously
issued decision,dated March 1,2017, to include a third floor dormer and a few minor changes.
3. The petitioner is also requesting that the previously issued special permit include the shed dormer as
previously proposed. In the February 15, 2017 public hearing, the petitioner's plans showed a shed
dormer,but the relief was not directly requested by the petitioner or directly discussed by the Board at
February 15, 2017 public hearing. The Building Inspector denied a building permit after the issuance
of the March 1,2017 Zoning Board of Appeal decision due to this discrepancy.
4. In the original plans and petition, the petitioner did not correctly indicate the number of stories
proposed. The petitioner is actually proposing three (3) stories where 2.5 stories was indicated on the
plans.
5. The petitioner is also proposing to add a rear door on the lower right side elevation where there was a
window previously proposed.
6. The petitioner is no longer proposing the three dormers on the right elevation.
7. At the public hearing no (0) members of the public spoke in favor of, and none (0) in opposition to
the proposed amendments to the petition.
On the basis of the above statements of facts and findings, the Salem Board of Appeals voted five (5)in favor
Mr. Copelas (Acting Chair), Mr. Duffy, Mr. Tsitsinos, Mr. Watkins, and Mr. Viccica (alternate) and none (0)
opposed,to grant an amendment to a previously issued decision, dated March 1, 2017, to include a third floor
dormer and a few minor changes, subject to the following terms,conditions and safeguards:

Standard Conditions:
1. Petitioner shall comply with all city and state statues, ordinances,codes and regulations.
2. All construction shall be done as per the plans and dimensions submitted to and approved by the
Building Commissioner.
3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly
adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. Exterior finished of the new construction shall be in harmony with the existing structure.
6. A Certificate of Occupancy is to be obtained.
7. A Certificate of Inspection is to be obtained.
8. Petitioner shall obtain street numbering from the City of Salem Assessor's Office and shall display
said number so as to be visible from the street,if needed.
9. Petitioner is to obtain approval from any City Board or Commission having jurisdiction including,but
not limited to the Planning Board.

Required Parking Spaces to allow parking within five (5D feet of the street line.
3. The property is located within an R-2 Zoning District.
4. The existing non-conforming structure is a two (2) family dwelling. The petitioner is proposing to
change the two-family home into two (2) townhome style units and expand the rear of the property.
5. The petitioner is proposing to construct a 12'x 18'addition onto an existing non-conforming
structure that is within the side yard setback. The existing structure is currently within 6.7' feet from
the required 10'foot setback to provide additional living space.
6. The petitioner is proposing to preserve the existing historical features of the home and use materials
that are in keeping with the character of the existing structure.
7. There are currently two (2) existing curbcuts at the property. The petitioner is proposing to use one of
the curbcuts and create a parking area within five (5) feet of the street line in lieu of using the second
curbcut and existing side yard space for parking,which could be done by right. The petitioner
requested the variance to preserve the existing historic features of the property including the existing
sideyard landscape that serves as the front yard to the orientation of the existing historic structure.

8. The petitioner is also requesting a Variance to construct a parking space within the front yard setback.
Currently, there is a driveway that provides two (2) tandem parking spaces.The petitioner is
proposing to carve out a 23'x 18' section of existing front yard space to provide a parking space.
9. The requested relief,if granted,would allow the petitioner to reconstruct,extend, or structurally
change the existing structure and allow parking within five (5� feet of the street line.
10. At the public hearing two (2) members of the public spoke in favor of, and none (0) in opposition to,
the petition.
The Salem Board of Appeals, after careful consideration of the evidence presented at the public hearing, and
after thorough review of the petition, including the application narrative and plans, and the Petitioner's
presentation and public testimony, makes the following findings that the proposed project meets the
provisions of the City of Salem Zoning Ordinance:
Findings for Special Permit:
The Board finds that the reconstruction, extension or structural changes are not substantially more
detrimental that the existing nonconforming structure to the neighborhood.
1. Social, economic and community needs served by the proposal.
2. Traffic flow and safety,including parking and loading is adequate.
3. Adequacy of utilities and other public services will not be negatively impacted.
4. Impacts on the natural environment,including drainage will remain the same.
5. The proposal fits with the character of the neighborhood.
6. Potential fiscal impact,including the impact on City tax base and employment is positive.
Findings for Variance:
1. Special conditions and circumstances that especially affect the land, building, or structure involved,
generally not affecting other lands, buildings, and structures in the same district as the orientation of
the historic building is such that the side yard serves as the front yard. The petitioner is proposing to
preserve the look and historic character of this facade and associated landscaping.
2. Literal enforcement of the provisions of the Ordinance would involve substantial hardship to the
applicant. Inserting a driveway into the side yard would be a detriment to the unique historic character
of the front entry and associated landscaping.
3. Desirable relief may be granted without substantial detriment to the public good, and without
nullifying or substantially derogating from the intent of the district or the purpose of the ordinance.
On the basis of the above statements of facts and findings, the Salem Board of Appeals voted five (5) in favor
