DECISION ON THE PETITION OF WILLIAM HORTON BEEBE-CENTER REQUESTING
A VARIANCE FOR THE PROPERTY LOCATED AT(72__BUFFUM-, TREET,. (R-2)
A hearing on this petition was held September 11, 1996 with the
following Board Members present: Gary Barrett, Chairman; Nina Cohen,
Joseph Ywu, Richard Dionne and Paul Valaskatgis. Notice of the
hearing was sent to abutters and others and notices of the hearing
were properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
Petitioner requests a Variance to create a third (studio) unit in an
existing 2 family dwelling by adding a kitchenette to third floor for
the property located at 22 Buffum Street.
The Variance which has been requested may be granted upon a finding
of the Board that:
a. Special conditions and circumstances exist which especially
affect the land, building or structure involved and which are not
generally affecting other lands, buildings or structures in the same
district.
b. Literal enforcement of the provisions of the Zoning Ordinance
would involve substantial hardship,financial or otherwise, to the
petitioner.
c. Desirable relief may be granted without substantial detriment to
the public good and without nullifying or substantially derogating
from the intent of the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence
presented at the hearing, makes the following findings of facts:
1. Petitioner was not present for the hearing of this petition.
2. A petition was submitted with 13 names of neighbors in opposition
to this petition.
3. A letter was submitted from Robert Peterson of 26 Buffum Street
in opposition.
4. Ward 6 Councillor, Sarah Hayes appeared in opposition to this
petition.
5. Shirley Cervoni, 28 A Buffum Street appeared in opposition to the
petition.
On the basic of the above findings of fact, and on the evidence
presented at the hearings, the Board of Appeal concludes as follows:
1. No special conditions exist which especially affect the
subject property as opposed to the district in general.
2. Literal enforcement of the Zoning Ordinance would not involve
substantial hardship to the petitioner.

In August of 1996 , you applied and received a curb
cut to enable to park an additional vehicle on the left
hand side of the property . You have illegally extended
the driveway, and made accommodations to park three
additional vehicles . This driveway is illegal and must
have City of Salem Board of Appeals approval in order to
be used . Please file appropriate application to the Board
of Appeals or cease and desist the use of the driveway and
rear parking spaces .

Dear Mr. Tremblay:
Thank you for your guidance in explaining what needs to be done
in order for Salem to change the designation of the house at 22
Buffum Street from a 1 -family house to a 2-family house. This
letter and the attachments give you evidence that 22 Buffum
Street was a 2-family house prior to 1965 and has continued to be
used as a 2-family house since then.
The house at 22 Buffum Street was built in 1850 for my great
grandparents, Nathaniel and Martha Horton. They moved into the
1st-floor apartment where they stayed for decades, and their son
and daughter-in-law, Nathaniel and Harriet Horton moved into the
2nd-floor apartment. It was in the 2nd-floor apartment in 1860
that Harriet gave birth to William Horton, who is my father, and
I know these things because of the stories my father has told me
about living there. My father, William Horton, continued to live
in the 2nd-floor apartment until he was a grown man - from 1860
to the 1880s. A notorized statement about these facts is
attached.
My sister, Mary Horton, remembers the day in 1914 , when she was 7
years old, that our great Aunt Elmira Maguire ' s house burned down
in the great Salem fire. Our father, William Horton, was then
the owner of 22 Buffum Street. At that time, the 2nd-floor
apartment was occupied by Mary Boardman, and the 1st-floor
apartment was occupied by another family who moved out shortly
thereafter. Then, with our father' s help, Elmira Maguire moved
into the 1st-floor apartment. Elmira lived there for the rest of
'her life, from 1914 to about the early 1930s. Mary Boardman
continued living in the 2nd-floor apartment for the rest of her
life, also, probably till around the early 1930s. A notorized
statement about these facts is attached.
In 1939, Lloyd and Florence Moss and their toddler children,
Gaylord and Kathleen, moved into the 1st-floor apartment at
22 Buffum Street. The children lived there until they grew up.
The parents continued to stay in the 1st floor-apartment until
1961 . A notorized statement about these facts is attached.
In 1946 , I inherited the house at 22 Buffum Street from my
father, William Horton. A family was living in the 2nd-floor

apartment at that time, but we asked the family to leave, and
then my husband, Lowell Nicholson and I and our 4 children moved
into the 2nd-floor apartment. Our children stayed there until
they grew up. My husband and I stayed in the 2nd-floor apartment
until 1961 when the Moss family moved out of the 1st-floor
apartment . Then in 1962, Lowell and I moved downstairs to the
1st-floor apartment and stayed there. My husband, Lowell, died
in 1992 , and I stayed on in the 1st-floor apartment until
entering Blair House Assisted Living Facility a few months ago in
the fall of 1995. A notorized statement about these facts is
attached.
From 1962 through 1995, the 2nd-floor apartment has been lived in
successively by a number of different individuals or families,
including: Lois Wilson and her 4 children, Sondra Allphin,
Suzanne and Jonathan Hart and their son, Ruth and Bill Milne,
Lowell Beebe-Center, Eric Pelletier, Horton Beebe-Center, Nancy
and Max Sorensen, Marion Cass and her daughter, and ending with
Beth and Neil Doherty and their daughter who moved out in
November 1995.
In summary, known occupants at 22 Buffum Street, 1850-1995, are:

Also from stories that have been passed down from my grandfather,
William Horton, to my mother, Anna Horton Nicholson, to me, I
know that the 1st-floor apartment at 22 Buffum Street , Salem, MA,
is the place where my grandfather' s grandparents, Nathaniel and
Martha Horton, lived from 1850 to the 1880s, and that my
grandfather enjoyed many visits with his grandparents who were
right downstairs from his own apartment.

To the best of my knowledge, from my own memory, and from what
I 've been told by my parents, William and Annie Horton, I know
that in 1914 when I was 7 years old, my great aunt , Elmira
Maguire, came to our Dearborn Street house in Salem and told us
her house had just burned down. It was during the great Salem
fire of 1914 . My father, William Horton, owned a house at 22
Buffum Street in Salem, but both the 1st and 2nd floor apartments
were already rented. However, shortly thereafter, the 1st-floor
renters moved out. So my father helped Aunt Elmira Maguire move
into the 1st-floor apartment at 22 Buffum Street. She lived
there for the rest of her life, from 1914 to around the early
1930s.
Also to the best of my knowledge, from my own memory, and from
what I 've been told by my parents, the person who rented the 2nd-
floor apartment at the time of the great Salem fire in 1914 was
Mary Boardman. Mary continued to live in the 2nd-floor apartment
for the rest of her life, from 1914 to around the early 1930s.

In 1946, I moved into the 2nd-floor apartment at 22 Buffum
Street , Salem, MA, along with my parents, Anna and Lowell
Nicholson, and my 3 sisters, Nancy, Ruth, and Lois. My sisters
and I lived there until we grew up. Our parents, Anna and Lowell
Nicholson, continued to live in the 2nd-floor apartment through
1961 . Then the 1st-floor renters, Lloyd and Florence Moss, moved
. out . At that point, my parents, Anna and Lowell Nicholson moved
from the 2nd-floor apartment at 22 Buffum Street , into the
1st-floor apartment. They remained in the 1st-floor apartment
until my father died in 1992, and until my mother moved into an
assisted living facility a few months ago, during the autumn of
1995.
