WPA Form - 7 Extension Permit for Orders of Condition is attached. Our original plan was to complete the construction of Friendship during 1999 and to construct the permanent mooring piles and access ramps to accommodate the docking facility in late 1999. Issues involved with the construction of the ship have set the time frame for completion back to mid - 2001. We are now into the last phase of construction on the vessel and would like to begin construction of the mooring facility at Derby Wharf. We have requested a similar extension with the Army Corps of Engineers and look forward to working with the Salem Conservation Commission in obtaining the necessary time extension. All work shall conform to the above-referenced Notice of Intent, site plan and supporting documents and those final specifications which shall be filed with the Commission prior to construction. Any change made or intended to be made to the approved plans shall require the applicant to inquire of the Commission in writing whether the change is substantial enough to require the filing of a new Notice of Intent. 2. Members and agents of the Commission shall have the right to enter and inspect the premises at all reasonable times to evaluate compliance with the conditions in this Order. The Commission may require the applicant to submit additional data or information necessary for the Commission to conduct that evaluation. 3. Upon completion of the project,the applicant shall submit, with the request for a Certification of Compliance, an affidavit,prepared by a professional engineer or land surveyor registered in the Commonwealth of Massachusetts, stating that the site has been developed in accordance with the requirements of this Order of Conditions, the referenced site plan and supporting documents. 4. This Order shall apply to every successor in control or successor in interest of the property described int he Notice of Intent and accompanying plans or part thereof. In the event this land or any part thereof changes ownership before or during construction,the current owner shall notify the new owner, by registered mail, of this Order prior to the transfer of ownership and shall forward proof of this notification to the Commission. 5. Additional erosion and sedimentation control measures deemed necessary by the Commission shall be instituted by the applicant. Any siltation caused onto any wetland or waterway area shall be promptly reported to the Commission. Such areas shall be restored to the satisfaction of the Commission. 6. During construction, no debris, fill, or excavated material shall be stockpiled within 100 feet of the high tide line. Any other stockpile location will be protected sufficient to prevent sediment from surface runoff entering wetlands and be located only on the northwesterly corner of the Derby Wharf large lawn area(easterly of the light house path), be kept covered, with material removed weekly. Haybales shall be anchored with stakes and entrenched 4 to 6 inches in depth. Excavated material shall be stockpiled on the upgradient side of the haybale barrier. Haybales shall be inspected daily; those showing signs of deterioration shall be replaced immediately. The haybale barrier shall remain in proper functioning condition until all stockpiling has ceased and material removed. 1 A 7. Equipment servicing and overnight equipment storage must be conducted outside the buffer zone. Equipment must be maintained to prevent leakage or discharge of pollutants. 8. *No spill or discharge of petroleum products or other pollutants will occur within 100 feet of any wetland resource area. 9. Notice shall be given this Commission no more than 2 weeks nor less than 2 days prior to the commencement of construction activities. Said notice shall include, in writing, the names(s), address(es), and business and home telephone numbers of the project supervisor(s) responsible for insuring that operations are conducted in compliance with this Order. 10. All disturbed soils shall be immediately and similarly re-vegetated upon completion of construction activities or shall be mulched until the next growing season. Hydroseeding will be initiated no later than September 15. 11. *Fertilizers used for landscaping and lawn care shall contain a low nitrogen content and be used in moderation. Pesticides and herbicides shall not be used within 100 feet of the resource area. 12. A plan for landscaping and maintenance of vegetation for the buffer zone shall be developed and submitted for Conservation Commission approval prior to commencement of work. 13. An erosion control subsurface filter fabric shall be installed in a line running from Building 1 to Building 5 and installed in a vertical position in area between the existing northerly seawall and the proposed building foundations. 14. A full depth silt curtain shall be installed and maintained during all work associated with construction of the mooring facility. 15. All work shall be performed from wharf excluding installation of 2 piles for Friendship. 16. ' 1.0 INTRODUCTION The Salem Maritime National Historic Site is considered the best remaining representation of early maritime commerce activities in the United States. Spanning a period of approximately 300 years, the nine acre site is at the center of Salem Harbor and ' was significant in early American History. In the present Site Master Plan, which was approved in 1978, modifications were proposed for the area that would revitalize the site, stabilize and restore the deteriorating wharves, integrate the site into the city of Salem, and provide adequate maintenance facilities. The Site's regional location is illustrated in ' Figure 1 of 21. During the summer of 1990, Derby, Hatch's and Central wharves in the Salem Maritime National Historic Site were investigated to ascertain their existing conditions and to develop the means and methods for restoring their structural integrity. The feasibility of dredging the area between the wharves was also studied for both structural and environmental impacts. Based on the outcome of the feasibility studies, the design of park improvements was initiated and wharf rehabilitation work began in late 1992. She will also carry ' a ticket as a sailing school vessel capable of carrying 49 students and instructors on domestic ocean voyages. Construction associated with S/V Friendship mooring structures will take place in the tidal area between Derby and Central wharves, as well as on land. The fender pipe piles for floating fenders will be driven into the bottom of the berthing area. Anchoring deadmen, braces and cross-braces, and boarding aprons will be constructed on Derby ' Wharf itself. Mooring floats for visiting vessels including tour and educational vessels will also be constructed along Central Wharf. Also during this current phase of the project, a failing seawall on the northern edge of the beach near the end of Kosciusko Street, will be repaired. The NPS will repair the seawall and restore the granite blocks. Design details for this particular aspect of the project are not included in the Chapter 91 License portion of this application because as an already ' licensed structure, License No. 1095 for this seawall was issued in 1888, a license or permit under Chapter 91 is not required. The project schedule is as follows: Construct S/V Friendship (off-site) 1996 - mid-1997 Construct mooring and boarding structures mid-1997 ' S/V Friendship arrives in Salem mid-1997 Finishes to S/V Friendship late 1997 S/V Friendship Sea trials early 1998 ' Construct warehouses (pending available funding) post-1999 Construction of the permanently moored floating exhibit as well as the enclosed and "ghosted" warehouses on Derby Wharf are proposed within and adjacent to resource areas protected under the Massachusetts Wetlands Protection Act (MGL c. 131 §40). Resource areas which will be affected by the proposed construction activities include: (1) Land Under the Ocean; (2) Coastal Beach; (3) Coastal Bank; and (4) Land Containing Shellfish. In addition, portions of the site revitalization are proposed within the Buffer Zone. Figure 3 of 21 presents the boundaries of these resource areas on the site. The Notice of Intent associated with these activities, contained in Section 2.0 describes the work proposed within each of the above resource areas, the anticipated impact on the resource, and mitigation measures proposed to minimize impacts. In addition, installation of the mooring piles and docking facilities and construction of the warehouse exhibits require licensing under the state's Public Waterfront Act and its regulations at 310 CMR 9.00. A licence application (BRP WW 01) for these structures is included in Section 2.0. In accordance with 310 CMR 9.12(2)(a), the proposed mooring facilities and maritime exhibits are determined to be water-dependent uses. Section 5.2 describes the project's compliance with the DEP standards for water dependent projects. The U.S. Army Corps of Engineers, through the Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403) and Section 4040 of the Clean Water Act (33 USC 1344), also has regulatory jurisdiction over placement of the mooring piles, floating docks and bulkhead ' rehabilitation. In order to restrict the dispersion of turbidity and , limit impacts to water quality and marine resources, a silt curtain will enclose the area of construction and extend the full depth of the water column and will have windows cut into it to allow the exchange of tidal water. During land-side ' construction activities, a sedimentation and erosion control system will be installed prior to construction and maintained until the site is stabilized. The system will include requirements for staked hay bales and silt fencing around the , entire periphery of the construction area(s) . ' 3.0 SITE DESCRIPTION ' The Salem Maritime National Historic Site is approximately nine acres on and adjacent to Salem Harbor and abuts Pickering Wharf and the central business district of Salem. The Site consists of three historic wharves: (1) Derby, (2) Hatch's, and (3) Central Wharves, as well as a number of historic maritime structures. Derby, Hatch's, and parts of Central Wharves are grassed and Central Wharf contains a restroom and shower facility and Contact Station, and the foundation of the historic Forrester warehouse. There is a small beach to the east of Derby Wharf and most of the perimeter of Derby Wharf is intertidal. 1 A berthing basin with a -13 ft depth is present between Derby and Central wharves. There are no salt marshes on site and it is not near an Area of Critical Environmental Concern nor is it in an Ocean Sanctuary. During site planning activities that took place during the summer of 1990, investigations into the quality of landside soils on the wharves, marine sediments, and biological conditions in the inter- and subtidal zones were conducted by Jason M. Cortell and Associates Inc. The findings, which are summarized below, were documented in a report to the National Park Service, titled Volume 2, Environmental Site Investigation, dated September, 1990. Except as otherwise indicated in the text, the following discussions are 1 based on the Cortell field investigations. 3.1 NATURAL FEATURES 3.1.1 Soil Soil at the Salem Maritime National Historic Site affected by the project consist of landside soils to be excavated for anchoring deadmen for the fender pile braces and cross-braces, and parts of the boarding apron. Although dredging will not be conducted, the fender pipe piles will be jetted into the hard clay bottom of the berthing area. The following sections describe the physical and chemical characteristics of both the marine sediments and landside fill materials. 3.1.1.1 Marine Sediment 1 In support of permitting activities for the berthing area dredging, the then existing sediments were sampled and analyzed in 1990. The contaminated surface sediments were removed during the 1993-1994 dredging, dewatered and disposed at the GCR Landfill in Peabody. Therefore, the present bottom of the berthing area consists, for the most part of uncontaminated clay. Based on data collected by Cortell in 1990, the bottom can be characterized as Category I Type C, uncontaminated clay (see Table 1 of 2). 3.1.1.2 Landside Soil ' Landside soils were sampled from test pits that were excavated at the locations indicated in Figure 4 of 21. The soil horizons were logged and scanned with a HNu model PI-101 photoionization detector to test for the potential presence of volatile compounds. For the proposed construction, soil characterized at TP-4 and TP-5 is of greater interest. The test pit logs and descriptions for TP-4 and TP-5 are contained in Figures 5 and 6 of 21. The data indicate that the soils consist of fill materials including clay, silt, fine to coarse sand, gravel, cobbles, cinders (and ashes), coal, brick, glass, ceramic, and wood. Chemical testing was conducted for organic and inorganic compounds and elements in the , landside soils in the area where the warehouses are to be constructed. The results are contained in Table 2 of 2 and are compared with the Massachusetts Contingency Plan reporting concentrations for the S-1 soil category. In 1996 a Phase I Initial Site Investigation was conducted for the Park Service in response to earlier findings of lead contamination in the grassed area between Derby Wharf proper, the walkway to Derby Wharf, Derby Street and the east property line along Kosciusko Street. The findings indicated that soil contamination levels of lead and certain polynuclear aromatic hydrocarbons exceeded the Massachusetts Contingency Plan (310 CMR 40.0000) Reportable Concentration for S-1 soil. Lead levels in groundwater exceeded the GW-2 Reportable Concentrations. 3.1.2 Vegetation Portions of the site addressed under this application consist of open waters and wharves. Vegetation on the wharves predominantly consists of lawn. Additionally, there are areas , of landscaped vegetation within the general park area. There is no wetland vegetation at the Site. Observations made during the field sampling indicate that such species of marine algae as sea lettuce (Lava lactuca), rockweed Fucus sp), and Irish moss Chondrus crisousl grow on the bottom, rocks and piles around the site. No marine vascular plants have been reported on the site. 3.1.3 Topography The wharves and adjacent upland area are essentially level. A small beach area at the northeast corner of the site slopes gently into the Harbor. In general, water depths between Derby and Central Wharves range from +2.0' to -13.0' , referenced to Mean Low Water (MLW). 3.1.4 Surface and Groundwater Features 3.1.4.1 Surface Water Features Salem Harbor is classified as Class SB water. Class SB waters are to be suitable for primary and secondary contact recreation, as habitat for fish and other aquatic life and wildlife, and for shellfishing in designated areas. Historical water quality data indicate that Class SB water quality standards are met during dry weather. During wet weather conditions, however, fecal coliform bacteria concentrations in the Harbor exceed Class SB standards. During the 1990 feasibility study, wet weather effluent from a sewer drain between Hatch's and Derby wharves was found to be contaminated with fecal coliform and streptococcus bacteria. The Salem Board of Health investigated the sewer system and found an off-site sewer connection which was corrected to the sanitary sewer. There are no public or private surface water supplies on or within 100 feet of the site. 3.1.4.2 Groundwater Features r Based on inspections of test pits excavated onsite, groundwater elevations appear to be established by tidal influence. Groundwater elevations within the project area were found to be consistent with tide elevations. No marine vascular plants have been reported on the site and no salt marsh vegetation is present. Benthic macroinvertebrates were sampled and the data indicate that the community is dominated by pollution tolerant worms including Canitella canitata. The Shannon-Weiner diversity values are indicative of a shallow, polluted coastal estuary. Barnacles were , found to be growing on piles, rocks, and granite blocks. Intertidal flats are present around Derby Wharf and Hatch's Wharf. The Massachusetts Division of Marine Fisheries (MDMF) reported that a 2.7 acre intertidal flat located at the northeast corner of Derby Wharf (Figure 3 of 21) has contained 12 bushels of intermediate and 221 bushels of legal-sized clams (Jerome, Chesmore and Anderson; March 1967). Screening surveys conducted on the intertidal areas around Derby and Hatch's wharves during the summer of 1990 did not result in the finding of any soft-shell clams. Blue mussels were found to be located from approximately the mid-point of Derby Wharf to its southern end. The mussels are found to be growing on cobbles and pebble substrates, with limited growth on the granite seawalls and piles. These beds are outside of the proposed dredge area. Data from the MDMF indicates there are at least 30 species of fish inhabiting the , Beverly-Salem Harbor area. Lobstering also takes place off the end of Derby Wharf. 3.2 MAN-MADE FEATURES 3.2.1 Structures The project site consists of three parcels of land totalling approximately nine acres. , Parcel A (approximately 1.5 acres), located along Derby Street consists of the Custom House, the Hawkes House, the Derby House, the Narbonne Hale House, the West India Goods Store, and public restroom facilities. Parcel B (approximately 0.07 acres) consists of a structure known as the Polish Club. Parcel C (approximately 7.5 acres) consists primarily of the three wharves which were constructed and expanded between 1764 and 1896. Structures associated with the wharves include restroom and shower facility and Contact Station on Central Wharf and several piers and floats along the perimeter of the wharves. There is also a lighthouse at the seaward end of Derby Wharf. The wharves consist of various fill materials (see Section 3.1.1.1) contained by a combination of granite block, timber and sheet steel bulkheads. During 1992-1994, Derby Wharf was rehabilitated by the installation of a steel pile and reinforced concrete panel wall system that is design to serve as an earth support system along the length of the dredged berthing area. A new timber crib was installed along this section of Derby Wharf. Repairs were also made to various sections of the granite bulkhead for Derby Wharf where blocks were missing and/or large voids had opened. Two unsafe piers on the east side of the wharf were removed and a section of timber bulkhead was replaced. , 3-8 ' JASON M.CORTELL AND ASSOCIATES INC. rA new restroom and shower facility was constructed on Central Wharf at the location of the former parking lot. The failing timber bulkheads along the east and south sides of Central Wharf were replaced by a sheet pile wall with timber fascia and new cross ties. The turf area along Derby Street was also re-landscaped. 3.2.2 Drainage and Flood Control Facilities Stormwater runoff from the site is directed to Salem Harbor by overland flow and a sewer drain located between Hatch's and Derby Wharves. The entire portion of the site seaward of Derby Street is located within the 100 year floodplain. The entire perimeter of the wharves is contained by various bulkhead ' structures which serve to protect the site from flood and storm damage. 3.2.3 Underground Utilities ' All structures on the site are connected to the City's existing sanitary sewerage system. The site is also served with municipal water. r r r r � r r r r r r r 3-g ' JASON M.CORTELL AND ASSOCIATES INC. ' 4.0 PROJECT DESCRIPTION ' The following is a description of the proposed project activities which directly relate to the applicability of the Massachusetts Wetlands Protection Act. 4.1 PROPOSED LANDSIDE AND MARINE ACTIVITIES The Salem Maritime National Historic Site Master Plan included the stabilization and reconstruction of portions of historic Derby, Central, and Hatch's wharves, the dredging ' between the wharves, placement of protective riprap along a 500 foot portion of the eastern face of the reconstructed Central Wharf, the construction of a new restroom and shower facility, a permanently moored floating exhibit and a early colonial period ' warehouse exhibit with enclosed and framed "ghosted" warehouses. The present construction which is the subject of this application is for the following work: 1. The construction of the permanently moored floating exhibit. 2. The construction of the period warehouse exhibit with enclosed and framed "ghosted" warehouses. Specific project descriptions follow and their locations are illustrated in Figure 7 of 21. ' 4.1.1 Floating Exhibit The permanently moored floating exhibit will include: The sailing vessel S/V Friendship Fore and aft fender piles Fore and aft boarding aprons and ramps Auxiliary mooring point bollards Mooring floats for visiting vessels The S/V Friendship is a working reproduction of a 1797 Salem merchantman and is under construction at a Hudson River shipyard in Albany, NY. She is 108 feet long from the taf frail to stem with a 171 foot sparred length (heel of spanker boom to tip of jib boom). Her beam is 29.75 feet at the wale, and draws approximately 11.5 feet at her full load of approximately 350 long tons. Her main mast rises 110 feet above the water and carries approximately 9,000 square feet of sail (17,000 square feet with stunsails and staysails set). The S/V Friendship is constructed of white oak and douglas fir. She has auxiliary ' power from a 300 hp Cummins diesel, a 30kw generator and a 4kw backup generator. The Friendship will be equipped with holding tanks with a total capacity of 1,380 gallons of wastewater. The holding tanks will be pumped out at approved disposal facilities offsite. The ship is scheduled to transit from Albany to Salem in mid-1997. Finishing carpentry, rigging and final outfitting will be conducted in Salem as part of the exhibit. Mooring floats for visiting vessels will also be constructed along Central Wharf. The S/V Friendship will be certified by the Coast Guard as a small passenger vessel carrying 149 passengers on day trips on a partially protected (coastwise) route. She will also carry a ticket as a sailing school vessel capable of carrying 49 students and ' instructors on domestic ocean voyages. ' 4-1 JASON M.CORTELL AND ' ASSOCIATES INC. The Friendship will be moored to fore and aft mooring floats with fenders which will rise , and fall with the tide on fore and aft steel pipe piles. Each pipe pile will be epoxy coated and jetted 18 to 22 feet into the bottom to bedrock. The fender piles will also be anchored to concrete deadmen on Derby Wharf. Subsurface steel beams and cross braces , will connect the pipe piles to the deadmen. Two wooden bollards will be driven into Derby Wharf for auxiliary mooring points. Fore and aft boarding aprons and ramps will also be constructed from Derby Wharf to the Friendship. The forward boarding apron will partially comply with American Disabilities Act requirements. Shorepower and fire hydrants will be provided at the aft boarding ramp. Plan and section views of the ramps and mooring system are shown on Figures 8 through 13 of 21. Figure 14 of 21 provides details of the shore power and fire hydrants. , 4.1.2 Warehouse Exhibit The warehouse exhibit will consist of two enclosed warehouses evoking the colonial period , structures, and three framed or "ghosted" warehouses. Buildings 1 and 2 (i.e. those closest to Derby Street) will be fully enclosed and will contain exhibits. Building 3 will have siding on the north and west sides of the west end. Buildings 4 and 5 will be framed, only. Exterior exhibits of typical commercial goods will be adjacent to Building 1. Granite building corners will also be constructed to mark the locations of other former warehouses. An at-grade granite compass rose will be constructed near the seaward end of Derby Wharf. Figures 15 and 16 of 21 illustrate the location of the exhibits and the compass rose. The stone dust walkway which presently traverses Derby Wharf down its center, will be widened to include the warehouses and fronting areas along the west side of the wharf. The sidewalk along the south side of Derby Street will be widened and , paved with bricks. A series of paving and related design details are presented in Figure 17 of 21. Underground electric, telephone, and security lines will be installed. Water service will be installed to warehouse buildings i and 2 and the Friendship. Gas will be installed to warehouse building 1. The general layout of the site utilities are schematically shown on Figure 18 of 21. There will not be any sanitary services in the warehouses nor will the lavatory facilities on board the Friendship be for public use. As stated above, the Friendship will be equipped with wastewater holding tanks for clean out at approved facilities offsite. Elevation views of Exhibit Buildings 1, 2 and 5 are presented in Figures 19 through 21 of 21. 4.1.3 Other Site Improvements In addition to the above new construction, there will also be one additional site improvement in the form of repair to a failing bulkhead at the northeast edge of the site at the end of Kosciusko Street. This seawall was originally licensed for construction in 1888. At some time in the more recent past, the original granite bulkhead was covered with concrete. The concrete has now disintegrated, the footings have been undermined and the bulkhead is in need of repair. The NPS will repair the seawall and restore the granite blocks. As previously stated, the seawall was originally licensed under License No. 1095 which was issued in 1888. Because the seawall is already licensed, a Chapter 91 License or Permit is not required. 4-2 ' JASON M.CORTELL AND ASSOCIATES INC. 5.0 MITIGATION MEASURES ' As noted in Section II and illustrated on Figure 3 of 21, resources areas on the project site include: (1) Land Under the Ocean; (2) Coastal Beaches; (3) Coastal Banks; and (4) Land Containing Shellfish. Sections 5.1 through 5.5 discuss the project's conformance with ' performance standards identified under the Massachusetts Wetlands Protection Act, for each of these resource areas. Section 5.6 addresses interests of the U.S. Army Corps of Engineers under Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act. 5.1 CONFORMANCE WITH THE MASSACHUSETTS WETLANDS PROTECTION ACT ' 5.1.1 Conformance With Performance Standards For Land Under The Ocean Land under the ocean is considered to be significant to (1) the protection of marine fisheries; (2) the protection of land containing shellfish; and (3) storm damage prevention, flood control, and the protection of wildlife habitat. The following sections address measures and designs to meet the above-referenced performance standards. 5.1.1.1 Protection of Marine Fisheries Installation of the fender pipe pile mooring system will contribute to localized and ' temporary increases in turbidity. The pipe piles will be installed by jetting away the clay and till in advance of the pile. The result of the jetting will be a temporary increase of turbidity. Impacts to the chemical quality of water are expected to be minimal because ' former contaminated surface sediments were removed in 1993-1994. The materials being suspended in the water are naturally occurring sediments. Given the limited extent of the in-water construction, water quality disturbances are expected to be one day per pile. ' In order to restrict the dispersion of turbidity, a silt curtain will be deployed around the immediate area of the jetting. The silt curtain will extend the full depth of the water column and will have windows cut into it to allow the exchange of tidal water. This ' procedure successfully minimized sediment during the previous dredging. During land-side construction activities, a Sedimentation and Erosion Control Plan will be in use. The specifications for the sedimentation and erosion control system will include requirements for staked hay bales and silt fencing around the entire periphery of the landside construction area(s). 5.1.1.2 Protection of Land Containing Shellfish ' Intertidal flats are present around Derby and Hatch's Wharf (see Figure 3 of 21). Historical data from the MA Division of Fisheries, however, indicate a 2.7 acre intertidal flat was located at the northeast corner of Derby Wharf to support legal-sized clams. During screening studies conducted by Cortell in 1990 for this project, no soft shell clams were found (Jason M. Cortell and Associates Inc.: October, 1990). Blue mussel beds were found from approximately the mid-point of Derby Wharf to its southern end, growing on cobble and pebble substrates and on the bulkheads. There will be minimal disturbance to marine life during construction. The existing fine ' sediment bottom biota will tolerate the temporary increases in turbidity and disturbed areas will recolonize. During construction, a sedimentation and erosion controls will be in place, and during pile jetting a full depth silt curtain will be employed in the immediate area of work. ' 5-1 JASON M.CORTELL AND ' ASSOCIATES INC. 5.1.1.3 Storm Damage Prevention and Flood Control Reconstruction/replacement of the bulkheads will not affect the location or function of ' the wharves' storm damage prevention or flood control capacity. As the result of earlier reconstruction work on Derby and Central wharves, the ability of the structures to withstand storm energy has been substantially increased. The proposed fender pile mooring system is designed to withstand the energy from a 100 year storm. , 5.1.1.4 Protection of Wildlife Habitat Project activities will meet the performance standard to minimize adverse effects on ' wildlife habitat, pursuant to 310 CMR 10.25(6). The projected increases of turbidity are expected to be temporary and limited in area. No destruction of eelgrass and widgeon grass will occur, since these species are no found onsite. , 5.1.2 Conformance With Performance Standards For Coastal Beaches Coastal beaches are presumed to be significant to: (1) storm damage prevention; (2) flood ' control, and (3) the protection of wildlife habitat. In addition, they are likely to be significant to the protection of marine fisheries and land containing shellfish. At the Salem Maritime National Historic Site, coastal beaches are found along the northeastern ' shoreline of the property and in intertidal areas within the slip between Central and Derby Wharves. 5.1.2.1 Storm Damage Prevention ' No modification of the coastal beach area located along the northeastern shoreline of the property is proposed as part of this project. A minor regrading (less than one foot ' change) of grassed areas landward of the beach is proposed. However, this small change in topography will not alter the degree of storm damage prevention as the coastal beach presently provides. The balance of the proposed construction will not affect the ability ' of the Derby, Hatches and Central wharf area in providing the critical function of storm damage prevention. 5.1.2.2 Flood Control ' The entire portion of the site seaward of Derby Street is situated within the 100 year flood plain. The proposed construction will not affect the site's capacity for flood ' control attenuation. 5.1.2.3 Protection of Marine Fisheries and Land Containing Shellfish ' Coastal beach areas adjacent to the proposed construction include the tidal flats at the northeastern corner of Derby Wharf and in the slip between the Wharves. During construction, there will be temporary increases in turbidity associated with pile installation and other construction activities. During construction, a Sedimentation and Erosion Control Plan will be in place, and ' during pile jetting a full depth silt curtain will be installed. 5.1.2.4 Protection of Wildlife Habitat ' The proposed construction will not impact wildlife habitat. ' II 5-2 ' ' JASON M.CORTELL AND ASSOCIATES INC. 5.1.3 Conformance With Performance Standards For Coastal Banks Coastal banks are presumed to be significant to (1) storm damage prevention; and (2) flood control. At the Salem Maritime National Historic Site, the wharf bulkheads serve as the only coastal banks. The bulkheads provide significant storm damage and flood ' control. Phase one of the project, which has been completed, was directed at stabilization and repair of failing bulkheads. The repair of the failing seawall at the end of Kosciusko Street will improve the stability of the bulkhead, and, hence, its ability to provide storm damage prevention and flood control. ' 5.1.4 Conformance With Performance Standards For Land Containing Shellfish Land containing shellfish is considered both as a resource area under jurisdiction of the Massachusetts Wetlands Protection Act and is also one of the interests of the Act. Several areas of land containing shellfish are present on the property. These include a shellfish flat of approximately 2.7 acres at the northeast corner of Derby Wharf, and areas of sporadic blue mussel beds along the bulkheads. The proposed construction activities will temporarily affect any blue mussels found along the bulkhead at the end of Kosciusko Street. These blue mussels are expected to recolonize the area once ' construction is complete. During construction, a Sedimentation and Erosion Control Plan will be in effect and during pile jetting a full depth silt curtain will be installed around the work area. ' 5.1.5 Conformance With Performance Standards For Work Within The Buffer Zone At the Salem Maritime National Historic Site, a buffer zone is associated with both the ' coastal bank and the coastal beach. Work within the buffer zone is primarily associated with construction of the warehouse exhibit and regrading of the grassed area along Derby Street. Clean granular fill will be used in the grading and the area will be quickly mulched and hydroseeded. The entire area of disturbance will be enclosed with staked ' hay bales and/or silt fencing to minimize sediment laden runoff into Harbor waters. During construction, all efforts will be made to temporarily or permanently cover ' exposed material to limit erosion and/or dust. 5.2 CONFORMANCE WITH CHAPTER 91 LICENSE STANDARDS FOR WATER DEPENDENT PROJECTS As stated in Section 1.0, the proposed mooring facilities and maritime exhibits meet the criterion under 310 CMR 9.12(2)(a) for designation as a water-dependent activity. The ' following section describes the project compliance with DEP requirements for water-dependent projects outlined at 310 CMR 9.36. ' The Salem Maritime National Historic Site was established by the National Park Service with the purpose of preserving for the public what is considered to be the best remaining representation of early maritime commerce activities in the United States. Presently, the site provides full access to the waterfront along the recently refurbished Derby, Hatches and Central Wharves. A new Central Wharf Warehouse/Visitors Center was completed in 1995. Along the landward side of Derby Street are several Park building with exhibits depicting historical Salem seafaring activities and associated waterfront facilities. The proposed activities will significantly enhance the park and public waterfront experience through construction of five historic maritime exhibit structures and by accommodating a working reproduction of the S/V Friendship. 5-3 JASON M.CORTELL AND ' ASSOCIATES INC. The warehouse exhibits will be constructed on or about the location of actual warehouses i during the early 1800's. At one time, up to 22 warehouses lined Derby Wharf out to its seaward-most point. Insofar as sufficient historical data does not exist to accurately ' reproduce the historic warehouses, the new exhibits will be constructed of modern materials. The exhibit buildings will, however, recreate the generally massing of the former warehouses. As illustrated on Figure 2 of 21, the new exhibits will be positioned towards the landward end of the wharf to minimize disruption of harbor views from , adjacent properties. In addition, the fourth and fifth (seaward most), structures will be "ghosted" or consist only of structural framework. In this manner, the essence of the former warehouses will be outlined without obstructing views. ' Installation of the mooring and floating exhibit access structures will allow for the permanent mooring of the S/V Friendship. Additional floating dock space will be available for transient sailing vessels. As described elsewhere in this document, S/V ' Friendship will able capable of carrying up to 149 passengers on day trips and will also serve as a sailing school vessel capable of carrying 49 students and instructors on domestic ocean voyages. ' Each of these park components is fully consistent with goals of water dependent uses. The park improvements will not disrupt any water-dependent use in operation or existing within the past five years. ' 5.3 CONFORMANCE WITH SECTION 10 OF THE RIVERS AND HARBORS ACT OF 1899 AND SECTION 404 OF THE CLEAN WATER ACT ' The only activities proposed herein which are subject to U.S. Army Corps of Engineers jurisdiction are the installation of two steel pipe mooring piles for the S/V Friendship and ' repair of the failing seawall within the intertidal zone at the seaward end of Kosciusko Street. The mooring piles will be jetted into place in an area temporarily isolated from the ' Harbor during construction by a full depth silt curtain. This technique was successfully implemented during the initial stages of the project when dredging was underway. Rehabilitation of the failed seawall will involve limited excavation of the native beach ' sands in the immediate area of the seawall. Once a new footing has been installed, the block seawall will be replaced. 1 1 5-4 ' JASON M.CORTELL AND ASSOCIATES INC.
