Please be advised that a finding of lack of probable
cause has been made in the matter referred to above.
This means that our investigation of the complaint filed
by you did not reveal sufficient evidence of an unlawful
act of discrimination. Therefore , your complaint has
been dismissed.
APPEAL PROVISION AND PROCEDURE
If you wish to appeal the dismissal of your complaint,
and believe that the finding of lack of probable cause
was incorrect, you may appeal to this Commission within
ten ( 10) days after receipt by you of this notice . Your
appeal of the dismissal must be made in writing by you
or your attorney to the General Counsel of this Commission
(Attention: Nancy L. Barnes) .
All employment complaints where applicable were filed
by us with the Equal Employment Opportunity Commission .

SUMMARY OF COMPLAINT:
On March 18 , 1987 , the Complainant a male filed a complaint
with this Commission alleging that on January 25, 1987 and March
16 , 1987 , he was discriminated against because of his Ancestry (Italian)
in violation of Massachusetts General Laws Chapter 151B, Section
4 (1) and Title VII of the Civil Rights Act of 1964 .
SUMMARY OF RESPONSE:
Respondent_ denies the Complainant was denied employment
because of his Ancestry. Respondent states that the Complainant
violated the State Building Code and despite repeated request,
the Complainant did not correct the alleged violation. Therefore,
Respondent felt it was inappropriate to hire the Complainant
to enforce Regulations which he personally had failed to comply
with.
INVESTIGATION COMPLETED: June 9 , 1987 .
SUMMARY OF FINDINGS OF FACT:
1 . Respondent, the City of Salem employs over fifteen (15)
employees and is an employer within the definition of Massachusetts
General Laws Chapter 151B, Section 4 (l) and the Title VII of
the Civil Rights Act of 1964 .

2 . The Complainant_ alleges that on January 25 , 1987 , he applied
for a position of Plumbing Inspector, and on January 28 , 1987
he applied for the position of Building Inspector . The Complainant
alleges that when he inquired about the status of his applications
he was told that he had not been selected and they already had
sufficient Italians working for the city. The Complainant alleges
he was discriminated against because of his ancestry.
3 . Investigation revealed that on January 25 , 1987, Respondent
advertised in the newspaper an opening for a position of Gas/Plumbing
Inspector . On January 28 , 1987, Respondent advertised an opening
for two positions, full-time or part-time for Building Inspectors.
Both advertisements (January 25th and January 28th) , indicated
resumes should be submitted to Respondent' s Director of Personnel .
The Complainant responded to both advertisements and submitted
his qualifications.
4 . Investigation revealed that Thomas S. Hogan, Respondent' s
Director of Personnel submitted all resumes he received, including
Complainant ' s to Mr. William Munroe , Respondent' s Superintendent
of Public Property and Inspector of Buildings. Mr. Munroe reviewed
the resumes and selected the applicants to be interviewed.
The selected applicants were interviewed sometime in the first
week of March 1987 , by Mr. Munroe and the Mayor of the City.
On March 16, 1987 , the Complainant was notified in writing by
Mr. Munroe, that the Complainant had not been selected to work
for Respondent ' s Property Department.
5 . Respondent states the Complainant was not selected for
interview for neither of the subject positions because his work
experience was personally known to Mr. Munroe and was unsatisfactory.
Investigation revealed that on May 24 , 1985 , the Complainant
was notified in writing, by Mr. Munroe that he had violated
Section 1308 . 1 of the State Building Code with respect to property
located at 411-431 Essex Street. The Complainant was requested
several times to correct the alleged violation, he did not reply,
and the city had to correct the violation. Therefore, Mr. Munore
decided it was inappropriate to hire the Complainant to enforce
regulations which he personally failed to comply with.
6 . Investigation revealed that James D. Santo was one of the
three candidates hired for the subject positions. Mr. Santo
was hired for Building Inspector, his ancestry is Italian.

CONCLUSION:
There is insufficient evidence to substantiate the Complainant' s
allegation that he was discriminated against because of his
ancestry in violation of Massachusetts General Laws, Chapter
151B, Section 4 ( 1) and Title VII of the 1964 Civil Rights Act.
Therefore , it is recommended this case be closed for Lack of
Probable Cause.

Therefore, pursuant to Section 5 of Chapter 151B of the
Massachusetts General Laws , and in conformity with the foregoing

Section 5 .

(1) The owner of any dwelling abutting a private passageway or right-of-way
owned or used in common with other dwellings or-which the owner or
occupants under his control have the right to use or are in fact using
shall be responsible for maintaining in a clean and sanitary condition
free from garbage, rubbish, other filth or causes of sickness that part of
the passageway or right-of-way which abuts his property and which he or
the occupants under his control have the right to use, or 1n fact using,
or which he owns.

CONTAINERS OR BUNDLES OF HOUSEHOLD AND ORDINARY COMMERCIAL WASTE GARDEN I LAWN
WASTE These shall be placed at the outer edge of the sidewalk appurtenant to the
premises of the owner not later than 7:00 a.m. on the day of collection and not
before 6:00 p.m, on the day preceding the day of collection, and shall be removed
fr6m the sidewalk on the same day as emptied. No commercial establishment shall
place or cause to be placed more than four barrels or other containers of ordinary
commercial wastes or any extraordinary commercial or industrial wastes or tree
waste upon any sidewalk or way for disposal. - -
Should you be aggrieved by this Order, you have a right to request a hearing before
the Board of Health. A request for a Hearing must be received in writing in the
Office of the Board of Health within seven (7) days of receipt of this Order. At
this Hearing, you will be given an opportunity to be heard and to present witness
and documentary evidence as to why this Order should be modified or withdrawn. You
may be represented by an Attorney. Please also be informed that you have the right
to inspect and obtain copies of all relevant inspection or investigation reports,
Orders, Notices or other documentary information in the possession of the Board
and that any adverse party has the right to be present at the Hearing,
Failure on your part to comply within the specified time can resuit in a complaint
being sought against you inSalem District Court.
One or more of the above violations constitutes a condition which may endanger or
materially impair the health or safety and well-being of the occepant(s).
