Dear Owners,
This department has received and investigated a complaint about a retaining wall at your
property. A Timber Wall was constructed along the edge of the driveway and it is failing. This is
causing the fence to collapse into the neighbors yard. Also a parking area was created in the rear
of the property. City of Salem Zoning Ordinance section 7-3 Addresses off street parking
regulations. Also Salem Ordinance 38-62 requires a plan be submitted to both the Building
Inspector and City Engineer before a permit is issued to create a parking area. This plan is
prepared by a Civil engineer to address runoff and other concerns..
You are Directed to contact this office to discuss your plans to bring this property into
compliance with City Ordinances. Failure to address this issue will result in Municipal Code
Tickets being issued.

Thank you for the copy of the letter dated July 30,1996 that you sent to the Managers/Owners of the subject property.
About 20 years ago, my property (61 Buffum St.)and the subject property at one time were on the same plane with a
gradual slope except for about 10 feet where my property meets 57 Buff nn St. (There it was perhaps a 20 degree slope). At that
time,the owner of 19 Bryant decided to(ill in and level his back yard so his tenants could park their cars.(At that time parking was
in front of 17 Bryant St.) The fill used was roof shingles, miscellaneous debris, rubbish and some dirt. Not only was this done
without the construction of a retaining w all to prevent the movement of earth from 19 Brvant destroying my fence, my garage and
my landscape. but also without my knowledge or permission. My existing chain-link fence fell down within a few short months.
Despite repeated attempts to contact the absentee landlord to replace my fence and construct a retaining wall. I decided to construct
somewhat of a wall with garden timbers and replace the fence with a 6 foot high stockade fence.
Since then, almost every year we replace/repair sections of fence hit by tenants. We are constantly picking up rubbish that
tenants toss over the fence on the way to getting in their cars. My garage wall is cracked and the fence and wall is bowed from the
constant traffic.
Presently there is a tenant that has been there for about 2 years. He has been parking commercial equipment under the
name of "Eastern Tree Service". This equipment ranges from very large"Cherry Pickers" and dump trucks loaded with tree logs
almost 3 feet in diameter to trailers that have motorized chippers that reduce tree limbs to shavings/sawdust. Even though the sides
of the trucks have a Lynn. MA phone number(617)593-4266,all of this equipment is registered in New Hampshire. (Perhaps to
avoid Mass taxes and pay lower insurance premiums.) The 2 Cherry Pickers have New Hampshire plates"AD0204"and"AD2557".
A"Dump Truck" has New Hampshire plate`BPY559" . Although I don't have the plate number the trailer is always parked at the
subject address. Parking of this equipment is dangerous as there is only an I 1 foot wide access.
Please tell me what course of action I must take and on what basis to:
I) Have the owner remove remove current fill and replace with clean fill and return to previous grading of 20 years
ago. Also prevent cars from parking there.
OR
Have the owner construct and maintain a cement wall and stockade fence at his expense to prevent earth movement
2) Have the owner repair damage to my garage from the traffic.

Thank you for the copy of the letter dated July 30,1996 that you sent to the Managers/Owners of the subject property.
About 20 years ago, my property(61 Buffum St.)and the subject property at one time were on the same plane with a
gradual slope except for about 10 feet where my property meets 57 Buffum St. (There it was perhaps a 20 degree slope). At that
time. the owner of 19 Bryant decided to fill in and level his back yard so his tenants could park their cars.(At that time parking was
in front of 17 Bryant St.) The fill used was roof shingles, miscellaneous debris, rubbish and some dirt. Not only was this done
without the construction of a retaining wall to prevent the movement of earth from 19 Bryant destroying my fence, my garage and
my landscape, but also without my knowledge or permission. My existing chain-link fence fell down within a few short months.
Despite repeated attempts to contact the absentee landlord to replace my fence and construct a retaining wall, I decided to construct
somewhat of a wall with garden timbers and replace the fence with a 6 foot high stockade fence.
Since then,almost every year we replace/repair sections of fence hit by tenants. We are constantly picking up rubbish that
tenants toss over the fence on the way to getting in their cars. My garage wall is cracked and the fence and wall is bowed from the
constant traffic.
Presently there is a tenant that has been there for about 2 years. He has been parking commercial equipment under the
name of `Eastern Tree Service". This equipment ranges from very large"Cherry Pickers' and dump trucks loaded with tree logs
almost 3 feet in diameter to trailers that have motorized chippers that reduce tree limbs to shavings/sawdust. Even though the sides
of the trucks have a Lynn, MA phone number(617)593-4266, all of this equipment is registered in New Hampshire. (Perhaps to
avoid Mass taxes and pay lower insurance premiums.) The 2 Cherry Pickers have New Hampshire plates"AD0204" and"AD255Y'.
A"Dump Truck" has New Hampshire plate *BPY559" . Although I don't have the plate number the trailer is always parked at the
subject address. Parking of this equipment is dangerous as there is only an 11 foot wide access.
Please tell me what course of action I must take and on what basis to:
I) Have the owner remove remove current fill and replace with clean fill and return to previous grading of 20 years
ago. Also prevent cars from parking there.
OR
Have the owner construct and maintain a cement wall and stockade fence at his expense to prevent earth movement
2) Have the owner repair damage to my garage from the traffic.

Thank you for your quick response to my recent letter regarding Safety Code
Violations at your property located at 19 Bryant Street.
As I advised you at our meeting of January 28, 1985, 1 have established the
following timetable for your compliance with my order.
Within Forty-Eight (48) hours of your receipt of this notice:
1. Repair or repalace the cracked boiler door and see to the removal of wood
.stored under the stairs and other combustibles presently stored within the boiler
rooms.
Within Seven (7) days:
1. Obtain the required permits from the Fire Prevention Bureau and Salem
Electrical Departments to put the detector system in working order, including final
inspections from these departments.
Within Sixty (60) days:
1. Repair the basement fire wall and install a one (1) hour rated, self closing
door.
2. Enclose the boilers in one (1) hour rated rooms as per Section 1105 of the
Massachusetts State Building Code (see attachment).
Please contact me at 744-4580 for re-inspections as you complete the various
phases of the work.

neighbors, and has cited the owner for violation of Article V See. 5 -1.
Your tenancy agreement prohibits the parking of commercial vehicles on the
property. Further you were given a " parking plan " indicating were you were permitted

My family and I lived in an apartment in the above referenced
building. We occupied the property for more that twenty years starting in
the 1960's.
The parking lot was always located in the large area on the side of the
building. The lot was accessible via a driveway that ran along the front
stairs.

Dear Mr. Inspector:
I am in receipt of your letter dated May 5, 2009 concerning the above referenced
property.
Enclosed please find a letter written to you by a former tenant Ms. Kate Ingalls with
regard to the longevity of the parking lot. I'm also in the process of tracking down several other
persons who would have first hand knowledge as to the age of the lot.
In addition, in keeping with our agreement I have caused the following to be completed:
a Install a guard rail along the driveway.
b. Contracted to have the low spot filled
c. Purchased and delivered garden timbers & contracted to have them installed.
It is our contention that our abutter is trying to get you to punish us for his failure to act.
- He erected a wall that was improperly engineered and didn't have a permit..-
If twenty some years ago he simply applied for a building permit for the wall all these
issues would have been addressed in a more timely fashion. We hope this ends this saga but if not
we'll continue to try to cooperate with your office.
