The work approved in the Order of Conditions dated luly 27, 2012 for the above referenced
project has been completed in accordance with the special conditions contained in said Order of
Conditions. In accordance with condition number 28 of said Order of Conditions,the proponent is
requesting the issuance of a Certificate of Completion.
I have attached the following information in accordance with Condition 28:
1. Request for Certificate of Completion Form (WPA Form 8a)
2. Letter from Vine/GZA dated September 18,2013 certifying that the work has been
- completed in substantial compliance with the Order of Conditions with no major
deviation.
3. Copy of Plans submitted with the Notice of Intent filing.
Because the work was done in compliance with the submitted plans the Proponent requests a
waiver from the requirement to prepare and submit an As Built Plan of the site as stipulated in
Special Condition 28 paragraph 3.

Following the l0-business-day appeal period (as of the postmazk or hand delivery of this
order), this document and the attached Special Conditions must be recorded at the South
Essex Counry Registry of Deeds (Shetland Park 45 Congress Street, Suite 4100 Salem,
' Massachusetts). Once recorded, please return a copy of Page 12 of the Order, which will
indicate to the Commission that the document has been recorded.
As indicated in the Order, prior to any wc�rk commencing:

Based on the Estimated Habitats ofRare Wildlife and Certified Vernal Pools Map (Oetober l, 2008) from Natural
Heritage & Endangered Species Proyam (NHESP) of the Massachusetts Division of Fisheries and Wildlife, it has
been deteimined thaY this project does not occur near any habitat of state-listed rare wildlife species nor contains any
vemal pools.
This Order is issued under the Massachusetts Wetlands Proteclion Act, M.G.L. Chapter ]31, Section 40 and die City
oESalem Wetlands Protection Ordinance, Salem Code Chapter 50.
This order permits the demolition of existing wharf;replacement ofexisting bulkiiead, removal oPexistinb piles,and
repair of existing seawlll.
GEIYERAL CONDITIONS
1. This Order of Conditions must be recorded in its entirety(including all 4 pages of Special Conditions)
at the Gssex County Registry of Deeds or the Land Court for the disCricC in which the land is located,
after the espiration of the ]0-day appeal period and within 30 days of the issuance. A copy of the
recording infbrmation must be submitted to the Salem Conservation Commission before any
work appruved in this Order commences.
2. Approval uf lhis application does not constitute compliance with any law or regulation other than
M.G.L Chapter I31, Section 40, Wetlunds Regulations 3 I0 CMR 10.00 and the City of Salem Wetlands
Protection Ordinance, Salern Code Chapter 50.
3. All work shall be pertorrned in accorJance with this Order of Conditions and approved site plan(s). No
alteration of wetland resource areas or associated buffer zones, other thai� that approved in this Order,
shall occur on this property without prior approval from the Comrnission.
4. Prior to any work wmmencing on si[e, a DEP Sign shocving DEP File#6�-540 must be installed at the
enhance Eo the site and seen from the public way, but not placed on a Iiving tree.
5. No work apprmed in Chis Order may commence until the ten-business-day appeal period has lapsed from
tlie date of the issuance of this Order.
6. With respect to this Order,the Commission designates the Conseivation Aoent as its agent witii�owers
to ac[on its hehalf in administering and enforcing this Order.
7. I�he Commission or its Agent,otfiicers,or employees shall have the righC to enter and inspect the property at
any time for complianee with tl�e conditions of this Order,the Wetlane�s Protection Aet MGL Chapter 13 I,
Seetion 40, the Wetlands Regidations 310 CMR 10.00,and shall have the ri�lrt to require any data�r

5. The term "ApplicanP'as used in this Order of Condifions shall refer to the owner. any successor in
ii�terest or successor in conUol of the peoperty referenced in t�he Notice of intent, supporcin�;documents
and this Order uf Condi6ons. The Commission shall be noti6ed in wriCina wiChin 30 days oY all
transfers of Yide of any portion of the property that takes place prior to issuance of t�he Certiiicate of
Compliance.
9. It is the responsibility of the applicant to procure all other applicable federal, st�te 3nd local permits and
approvafs associated with this proje�l. These permits ntay include but are not necesSarfly limit'ed to the
follo�ving:
(1) SecCion 404 of the Federal Wafer Pollution Control Act(P.L. 92-500, 86 stat. 8 L6), U.S. Army
Coips of Gngineers.
(2) Water Quality Certificaiion in accurdance with the Pederal Water Pollution Control �mdcr ssuthoriry
of sec. 27(5)of Chapter 31 of the Massachusetts General Laws as codified in 314 CMR 9.00.
(3) Sewer Extension Permit tiom the DEP Division of Water Pollution Control under G. I.. Ch. 21 A 557
and 314 CMR 7.00. My Board of Health permit for septic system design for any portion of the
septic system within ]00 feet of wet]ands shall be submitted fo the Commission prior fo
construction initiation.
(4) Design Requirements Eor Construction in F1oodplains under the State Building Cod�(780 CMR
744.).

tl�e Conservation Commissiun to request a Certil�icate of Gompliance(COC):
(1} A Cmnpleted Request for a Certificate of Compliauce form(W P�l Form SA or ofher form if
required by Ihe Conservation C:ommission at [he time of request).
(2) A letter fron�a Registered Professional Engineer certifying compliance of tlie piroperry with this
Order of Conditions.
(3) An "As-Built" plan signed and stampzd by a Registered ProFcssional Engineer or L�ind Surveyor
showing post-conshucticm conditions within all areas under the jurisdictiun of t'he Massaohusel'[s

(a) All wetland resource area boundaries with associated buffer zones and regulatory se[bacl<
areas taken from the plan(s)approved in this Order of Conditions;

authorize any injury to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of ihe necessity of complying
with all other applicable federal, state, or local statutes, ordinances, bylaws, or regulations.
4. The work authorized hereunder shall be completed within three years from the date of this
Order unless either of the following apply;
a. the work is a maintenance dredging project as provided for in the Act; or
b. the time for completion has been extended to a specified date more than three years,
but less than five years,from the date of issuance. If this Order is intended to be valid
for more than three years, the extension date and the special circumstances warranting
the extended time period are set forth as a special condition in this Order.
5. This Order may be e�ended by the issuing authority for one or more periods of up to three
years each upon application to the issuing authority at least 30 days prior to the expiration
date of the Order.
6. If this Order constitutes an Amended Order of Conditions, this Amended Order of
Conditions does not extend the issuance date of the original Final Order of Conditions and
the Order will expire on 7/26/2015 unless extended in writing by the Department,
7. Any fill used in connection with this project shall be clean fill. Any fill shall contain no trash,
, refuse, rubbish, or debris, including but not limited to lumber, bricks, plaster, wire, lath,

9. No work shall be undertaken until ihe Order has become final and then has been recorded
in the Registry of Deeds or the Land Court for the district in which the land is located, within
the chain of title of the affected property. In the case of recorded land,the Final Order shall
also be noted in the Registry's Grantor Index under the name of the owner of the land upon
which the proposed work is to be done. In the case ut the registered land, the Final Order
shall also be noted on the Land Court Certificate of Title of the owner of the land upon
which the proposed work is done.The recording information shall be submitted to the
Conservation Commission on the form at the end of this Order,which form must be
stamped by the Registry of Deeds, prior to the commencement of work.

15. The Agent or members of the Conservation Commission and the Department of
Environmental Protection shall have the right to enter and inspect the area subject to this
Order at reasonable hours to evaluate compliance with the conditions stated in this Order,
' and may require the submittal of any data deemed necessary by the Conservation
Commission or Department for that evaluation.
16. This Order of Conditions shall apply to any successor in interest or successor in control of
the property subject to this Order and to any contractor or other person pertorming work
conditioned by this Order.
17. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated
Wetland, the boundary of the wetland in the vicinity of the proposed work area shall be
marked by wooden stakes or flagging. Once in place, the wetland boundary markers shall
be maintained until a Certificate of Compliance has been issued by the Conservation
Commission.

18. All sedimentation barriers shall be maintained in good repaii until all disturbed areas have
been fully stabilized witfi vegetation or other means. At no time shall sediments be
deposited in a wetland or water body. During construction,the applicaN or his/her
designee shall inspect the erosion controls on a daily basis and shall remove accumulated
sediments as needed. The applicant shall immediately control any erosion problems that
occur at the site and shall also immediate�y notity the Conservation Commission, which
reserves the right to require additional erosion and/or damage p�evention controls it may
deem necessary. Sedimentation barriers shall serve as the limit of work unless another
limit of work line has been approved by this Order.
NOTICE OF STORMWATER CONTROL AND MAINTENANCE REQUIREMENTS
19. The work associated with this Order(the "ProjecP')is�i� 0 is not(2)�sub�ect to the
Massachusetts Stormwater Standards. If the work is subject to the Stormwater
Standards,then the project Is sub�ect to the following condltlons:
a) All work, including site preparation, land disturbance, construction and redevelopment,
shall be implemented in accordance with the construction period pollution prevention and
erosion and sedimentation control plan and, if applicable, the Stormwater Pollution
Prevention Plan required by the National Pollution Discharge Elimination System
Construction General Permit as required by Stormwater Condition 8. Construction period
erosion, sedimentation and pollution control measures and best management practices
(BMPs)shall remain in place until the site is fully stabilized.
b) No stormwater runoff may be discharged to the post-construction stormwater BMPs
unless and until a Registered Professional Engineer provides a Certification that:
i.all construction period BMPs have been removed or will be removed by a date certain
specified i�the Certification. For any construction period BMPs intended to be converted
to post construction operation for stormwater attenuation, recharge, and/or treatment,the
conversion is allowed by the MassDEP Stormwater Handbook BMP specifications and that
the BMP has been properly cleaned or prepared for post construction operation, including
removal of all construction period sediment trapped in inlet and outlet control structures;
ii. as-built final construction BMP plans are included, signed and stamped by a Registered
Professional Engineer, certifying the site is fully stabilized;
iii.any illicit discharges to the stormwater management system have been removed,as per
the requirements of Stormwater Standard 10;
iv. all post-construction stormwater BMPs are installed in accortlance with the plans
(including all planting plans)approved by the issuing authoriry, and have been inspected to
ensure that they are not damaged and that they are in proper working condition;
v.any vegetation associated with post-construction BMPs is suitably established to
withstand erosion.

c) The landowner is responsible for BMP maintenance until the issuing authority is
notified that another party has legally assumed responsibility for BMP maintenance. Prior
to requesting a Certificate of Compliance, or Partial Certificate of Compliance, the
responsible party(defined in General Condition 18(ep shall execute and submit to the
issuing authority an Operation and Maintenance Cornpliance Statement("O&M Statement)
for the Stormwater BMPs identifying the party responsible for implementing the stormwater
BMP Operation and Maintenance Plan ("O&M Plan")and certifying the following: i.)the
08M Plan is complete and will be implemented upon receipt of the Certificate of
Compliance, and ii.) the future responsible parties shall be notified in writing of their
ongoing legal responsibility to operate and maintain the stormwater management BMPs
and implement the Stormwater Pollution Prevention Plan.
d) Post-construction pollution prevention and source control shall be implemented in
accordance with the long-tertn pollution prevention plan section of the approved
Stormwater Report and, if applicable,the Stormwater Pollution Prevention Plan required by
the National Pollution Discharge Elimination System Multi-Sector General Permit
e) Unless and until another party accepts responsibility,the landowner, or owner of any
drainage easement,assumes responsibility for maintaining each BMP. To overcome this
presumption, the landowner of the property must submit to the issuing authority a legally
binding agreement of record,acceptable to the issuing authority, evidencing that another
entity has accepted responsibility for maintaining the BMP, and that the proposed
responsible party shali be treated as a permittee for purposes of imptementing the
requirements of Conditions 18(f)through 18(k) with respect to that BMP. Any failure of the
proposed responsible party to implement the requirements of Conditions 18(f) through
18(k)with respect to that BMP shali be a violation of the Order of Conditions or Certificate
of Compliance. In the case of stormwater BMPs that are serving more than one lot,the
legally binding agreement shall also identify the lots that will be serviced by the stormwater
� BMPs. A plan and easement deed that grants the responsible party access to perform the
required operation and maintenance must be submitted along with the legally binding
agreement
f) The responsible party shall operate and maintain all stormwater BMPs in accordance
with the design plans,the 08M Plan, and the requirements of ihe Massachusetts
Stormwater Handbook.

g) The responsible party shalL
1. Maintain an operation and maintenance log for the last three (3)consecutive
calendar years of inspections, repairs, maintenance and/or replacement of the
' stormwater management system or any part thereof,and disposal(for disposal the
log shall indicate the type of material and the disposal location);
2. Make the maintenance log available to MassDEP and the Conservation
Commission ("Commission") upon request and "
3. Allow members and agents of the MassDEP and the Commission to enter and
inspect the site to evaluate and ensure that the responsible party is in compliance
with the requirements for each BMP established in the O&M Plan approved by the
issuing authority.
h) All sediment or other contaminants removed from stortnwater BMPs shall be disposed
of in accordance with all applicable federal, state, and local laws and regulations.
i) Illicit discharges to the stormwater management system as defined in 310 CMR 10.04
are prohibited.
j) The stormwater management system approved in the O�der of Conditions shall not be
changed without the prior written approval of the issuing authoriry.
k) Areas designated as qualifying pervious areas for the purpose of the Low Impact Site
Design Credit (as defined in the MassDEP Stormwater Handbook, Volume 3, Chapter 1,
Low Impact Development Site Design Credits) shall not be altered without the prior written
approval of the issuing authority.
1) Access for maimenance, repair,and/or replacement of BMPs shall not be withheld.
Any fencing constructed around stormwater BMPs shall include access gates and shall be
at least six inches above grade to allow for wildlife passage.

� � Attachment 2 Project Description
� 1. Project Description
I � 24 Congress Street and 281 Derby Street are abutting properties located along the north side of
�, . the South Riverjust west of the Congress Street Bridge in Salem, MA (see Locus and Property Maps
in Attachment 3). The proposed activities involve demolition of an existing wharf, replacement of
� a bulkhead, replacement /removal of piles and minor seawall repairs. The activities proposed on
each parcel are described below.

, . Z4 CONGRE55$TREET
�� � Wharf Removal
■ The existing wharf located along the shoreline at 24 Congress Street is approximately 12 feet wide
by 110 feet long. The wharf is in poor condition with many rotted and failed timber structural
I � members. The wharf is comprised of 3x8 timber decking, 4x10 stringers, 10x12 timber pile caps,
miscellaneous timber bracing and timber piles with bent spacing at approximately 5-6 foot on
� center. In addition, timber fender piles exist along the outer face and timber batter piles along the
I . inner portion of the pier are located on every other bent. These timber batter piles along with the
vertical plumb piles along the landward edge of the wharf support the existing timber bulkhead
� � wall discussed below. Chain link and wood stockade fences prevent public access to the wharf.
� The project involves demolition of the wharf.
�
Bulkhead Reolacement
� The existing timber bulkhead located along the shoreline extends easterly from the shared
■ property line with 281 Derby Street to the Congress Street Bridge. The wall is behind the timber
wharf and comprised of 3x8 tongue and groove vertical members, fronted by lOx8 timber
� horizontal wales supported laterally by the plumb and batter piles along the landward portion of
■ the pier. The bulkhead is in fair to poor condition with many holes observed and deterioration of
the vertical timber members.
�
The project proposes to replace the timber bulkhead with a new steel sheetpile wall with raker
� supports similar to the sheetpile wall installed at the south end of the river as part of the South
� River Harborwalk Project.
� Floatin¢ Dock Pile Reqlacement
The existing line of main floating docks in front of the timber bulkhead are held with four, 4 inch
� diameter pipe piles, four 4 inch diameter disconnected pipe piles and two 3x3 steel angles. The pipe
� piles will be removed and replaced with six, 12 inch diameter timber piles similar to those
installed as part of the pile supported section of the South River Harborwalk fronting the National
� Grid substation on the south side of the river.

� 281 DERBY STREET
� Seawall Repairs
■ The seawall at 281 Derby Street is comprised of granite block and stones of various sizes with non-
uniform joints and medium sized gaps (6 to 18 inches) between the stones. There are some gaps
� that are missing blocks and stones. There are also deteriorated timber guide piles of varying
■ diameters spaced at approximately 3 to 6 feet on center located along the wall face. Some of the
piles are attached to the wall by steel pile hoops located at the base of the concrete wall section
� and others are no longer connected to the wall. The wall measures approximately 50 feet in
length and approximately 9 feet in height.
�
■ The project includes removal of the existing timber guide piles, replacement of missing granite
blocks and stone and chinking with smaller stones. In addition, the height of the wall will be
� increased approximately 21 inches to match the height of the adjacent concrete cap located on
■ the seawall at 283 Derby Street. The height increase will be accomplished through the placement
of new granite blocks atop the existing seawall.
�
� 2. Wetland Resource Areas and Impacts
■
Wetland Resource Areas
� Wetland resource areas on the project sites include Land Under Ocean (extending from mea n low
. water seaward), Coastal Beach (extending from mean low water to coastal bank), Coastol eank
(timber bulkhead/granite seawall), Land Subject to Coastal Storm Flowage (100 year flood zone)
� and Riverfront Area. There is also a 100 foot Buffer Zone that extends from the top of the
■ seawall/bulkhead wall 100 feet inland.
� It should be noted that the Riverfront provisions of the wetland regulations do not apply as the
project requires authorization under the state Chapter 91 program (see 310 CMR 10.58(6)�i).
�
■ Wetland Resource Area Impacts
Work is proposed within resource areas and the 100 foot Buffer Zone. Impacts to wetland
� resource areas are primarily temporary construction impacts related to wharf demolition,
■ bulkhead and pile removal, and seawall repairs.
. 24 CONGRE55$TREET
Permanent impacts to resource areas at 24 Congress Street result from:
� a. Land UnderOcean—project impacts result from replacing the existing pipe guide piles at
■ the floating docks with timber piles for a net impact of+2.7 square feet (sf). Removal of
existing piles that support the timber wharf will create 7.9 sf of Land Under Ocean so there
� is a net positive impact of -5.2 sf in Lond Under Oceon.

sf), which will be constructed as close as possible (within 12 inches) of the existing timber

■ coostol storm flowage and Riverfront Areas; however no adverse impacts will result from this
activity. Timber guide piles/fenders will be removed from about 13.4 sf of coastal beach resource
� area.
� 3. Construction Methods and Schedule
■
The owner hopes to begin construction this fall with project completion by the Spring of 2013. All
� work will be undertaken from the landside to the greatest extent practical. The demolition debris
. will be removed from the site and property disposed of. The landside will be restored upon
completion of construction.
