Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. The petitioner is requesting Variances from minimum lot area, minimum lot area per dwelling Bt depth of front yard to construct a single family dwelling for the property located at 12 Brooks Street in an R-2 zone. The Variances,which have been requested,may be granted upon a finding by this Board that: a. Special conditions and circumstances exist which especially affect the land, building or structure involved and which aro not generally affecting other lands, buildings and structures involve. b. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship,financial or otherwise,to the petitioners. c. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district of the purpose of the Ordinance. The Board of Appeal,after careful consideration of the evidence presented at the hearing, and after viewing the plane, makes the following findings of fact: I. Attorney Stephen Lovely of 14 Story Road appeared and represented the petitioners. 2. Mr.&Mrs. Kapnis had previously received a Variance for the lot sometime around 1999 but did not pursue building because of family circumstances. 3. A majority of the house lots wens all 4500squane fat or less which is the size of the lot at 12 Books Street. 4. Mrs. Doherty of 17 Lawrence Street appeared at the hearing in opposition to this Petition because it would restrict her view looking out the back of her}rouse. 1 DECISION OF THE PETITION OF MICHAEL dt MAUREEN KAPNIS REQUESTING A VARIANCE FOR THE PROPERTY LOCATED AT 12 BROOKS STREET R-2 page two S. It was suggested through Mr. Moriarty,a member of the Board that Mr. tit Mrs. Kapnis plant trees and shrubs along the back of the property and it would improve the view of the back of their property and help Mrs. Doherty's view. On the basis of the above findings of fact,and on,the evidence presented the Board of Appeals finds as follows; 1. Spacial conditions exist when especially affect the subject property but not be District 2. Literal enfomemeot of the provisions of the Zoning Ordinance would involve substantial hardship to the petitioner. 3. Petitioner shall obtain a Certificate of Occupancy. 6. Exterior finishes of the new construction shall be in harmony with the existing structtues. 7. Petitioner shall obtain approval from any City Boards or Commissions having jurisdiction, but not limited to the Conservation Comadssian. g. Petitioner shall obtain proper shed numbering from the City's Assessors Office and shall display numbers as to be visible fiom the stmt 9.
