Notice of hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner, owner of the property, is requesting an extension of a Variance granted December 7, 1988 and recorded January 20, 1989 allowing construction of a single family dwelling in this R-2 district. The Board of Appeal , after careful consideration of the evidence presented, makes the following findings of fact: 1 . Petitioner was unable to start construction in a timely manner due to unforeseen personal problems. 2. No changes in the plans are proposed. 3. Councillor O'Leary spoke in favor of the extension. 4. There was no opposition to the request. The Zoning Board of Appeal voted unanimously 5-0 to grant a six (6) month extension of the variances to allow construction of the single family dwelling. All conditions of the December 7, 1988 decision remain unchanged. Petitioners, owners of the property, are requesting variances from lot area, width and side setbacks to allow construction of a single family dwelling in this R-2 district. The Variances which have been requested may be granted upon a finding of the Board that: a. special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures in the same district; b. literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner; c. desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district of the purpose of the Ordinance. Douglas Hopper, John Nutting, Joseph Piemonte and Chairman James Boulger. Notices were sent to abutters and others in accordance with Massachusetts General Laws,, Chapter 40A. .:. The Petitioners are requesting a Special Permit_ to erect a single 'family dwelling house on a parcel, of.land containing 50 feet of frontage and 4,500 square feet of land. Attorney George P. Vallis represented the Petitioners before the Board who explained that the Petitioners acquired the parcel on January 25, 1974, and are prevented from obtaining a building permit because their lot does not contain the minimum area of 5,000 square feet as required by Section VIII {B} "(2) of the Zoning By-Laws. However, the lot is identical in size to most of the other lots in the neighborhood on which houses have been previously built. Councillor Steven Lovely appeared in favor of granting the Special Permit. No one appeared in opposition. The Board voted unanimously to grant the Special Permit. It found that the lot is identical to many other lots in the immediate neighborhood and the construction of a single family dwelling would in no way change the character of the neighborhood and therefore relief could be granted without substantial detriment to the surrounding neighborhood and would in no way nullify or sub- stantially derogate from the intent and purpose of the Zoning Ordinance. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. The Petitioner requests a variance to combine lots 187 and 179 Brooks Street which total 24,750 square feet and then divide the parcel into four lots. A variance is required because the four lots to be created will all be non- conforming because of their area and frontage. The property is in an R-2 district. The Board of Appeals, after consideration of the evidence presented at the public hearing and after viewing the property makes the following fiddings of fact: 1. The Petitioner's request involves a substantial variance from the provisions of the City's Zoning by-laws and amounts to a miniature subdivision. 2.
