(R-3/R-2 ) A hearing on this petition was held February 16, 1994 with the following Board Members present: Stephen Touchette, Acting Chairman, George Ahmed, Stephen O'Grady, Albert Hill and Associate Member Nina Cohen. This hearing was continued until the March 16, 1994 meeting and the following Members were present: Stephen Touchette, Albert Hill, and Associate Members Labrecque and Cohen. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. The Board of Appeal at the request of petitioners Attorney, Francis T. Mayo, voted unanimously 5-0 to grant petitioners leave to withdraw this petition for Variances from lot size and setbacks to allow construction of a single family home with an in-law apartment. The lot in question (shown as lot 215, on Assessor ' s Plate 24 ) , is buildable as a matter of right since it is entitled to grandfather protection from the lot size and frontage increases adopted by the City. The lot is 9 ,000 square feet in area. According to the Assessor ' s Plate, it has 95 feet of frontage, though the current and past deeds indicate 100 feet exists. I understand that in your prior review of this matter, you determined that grandfather status did not apply, because you believed that lot was owned in common with abutting property. The following is an explanation, with more detail than you have had to date, of why your determination, in my opinion, should be reversed. For simplicity, I will use the lot numbers as they are de- picted on the Assessor' s Plate. The Brooks 'Street property, while referred to in the deeds as 2 parcels, is herein described as one parcel since that is what is depicted on the Assessor' s Plate, and the petitioner is treating them as one lot. Lots 182 and 7 on Ocean Avenue (referred to as lots 119 and 121 on the original plan) , were respectively acquired by Pietro and . Maria DiIsso in 1914 and 1920. Title to both parcels was acquired as tenants in common. It is believed that each parcel had on it a building, as it does today. In 1941 Pietro and Maria DiIsso acquired the locus, lot 215 Mr. Leo Tremblay -2- February 16 , 1994 ( lots 118 and 120 on the original plan) , as tenants by the entirety. The above parcels abut each other. The locus is, and apparently always has been, vacant. On December 24 , 1942 Pietro died, leaving no will. By op- eration of law, his property, including his one-half undivided interest in the Ocean Avenue lots, passed to his heirs at law ( 10 children) and his wife, Maria. However, unlike the Ocean Avenue properties which it abutted, the Brooks Street property did not pass to the wife- and 10 child- ren. Instead, because it was held in a tenancy by the entirety, complete title passed directly to Maria. Therefore, there was no unity of ownership of the Ocean Street parcels and the Brooks Street parcel in 1965 when, according to the City Solicitor, the zoning changed. This point is crucial. ( I am assuming here, without waiving the issue, that 1965 is in fact the date when the zoning changed) . Maria died on October 30, 1967. Thereafter, the Ocean Avenue properties were sold. In 1972, the petitioner ' s parents, Mike and Maria, purchased the Brooks Street locus from her estate and the heirs. In 1991 , they deeded the property to their daughter, Rosemary, the petitioner. Section 8. 2 of the ordinance entitled "Nonconforming lot" pro- vides in pertinent part as follows: "Where a lot or lots exist which could not be built upon for residential purposes under the terms of this ordinance by reason of restrictions on lot area or lot width, such lot or lots may be used, subject to the following provisions: ( 1 ) Any increase in area, frontage, width, yard or depth requirements of a zoning ordinance or by-law shall not apply to a lot for single- and two-family resi- dential use which, at the time of recording or endorsement, whichever occurs sooner, was not held in common ownership with any adjoining land, conformed to then-existing re- quirements and had less than the proposed requirement but at least five thousand ( 5,000) square feet of area and fifty ( 50 ) feet of frontage. The provisions of this sec- tion shall not be construed to prohibit a lot being built upon if, at the time of the building, building upon such lot is not prohibited by the Salem Zoning Ordinance. " Mr. Leo Tremblay -3- February 16 , 1994 It is clear from the foregoing that at the time the increases _ in the zoning requirements were put into effect, which the City claims to have been in 1965 , the lots were not held in common ownership. The Ocean Avenue parcels were held jointly by Maria and her 10 children. The Brooks Street property, for which a permit is now sought, was held by Maria alone. While I may be willing to proceed with the variance request in this case (reserving all rights to proceed on the grandfather issue herein discussed) , I believe it should not be necessary. DiIsso: The Conservation Commission is required by Massachusetts General Laws to enforce the Wetlands Protection Act . Under the regulations anyone altering a resource area or land within 100 feet of the resource area ( also referred to as a Buffer Zone) is required to file either a Request for Determination of Applicability or a Notice of intent to the Commission to determine if the proposed action will adversely effect the wetland. The City of Salem Conservation Commission has received information which states that a work permit has been issued to clear the parcel of vegetation at One Brook Street . According to the City of Salem Wetlands Maps a portion of your property at One Brook Street is within the Buffer Zone of a resource area. On Monday, August 29 , 1994 , a preliminary investigation was done on One Brook Street to see the extent of activity occuring on this parcel . It was noted that some clearing of vegetation, primarily small trees , had occurred which sloped downward toward the resource area. There appears to be no large equipment utilized. On Tuesday, August 30 , 1994 , a more thorough investigation was completed and it appears that the activity which is occurring is approximately 75 feet from the top of the bank of the brook . A review of a case issued by the Appeals Court of Massachusetts in May of 1986, indicates that if the ownership of the two lots in question was not the same, that no merger results. As I understand it, one of these lots was owned by a group of people as devisees under the will of a deceased person. I understand that the other lot was owned by a husband and wife as tenants by the entirety. Accordingly, it would appear to me that based on the facts as presented, no variance would be required. (c) Any such fixture, structure, or property referred to in this section which has been erected, placed or left illegally in any street, highway or sidewalk may be moved by or under the direction of an officer and at the owner's expense. The board of officers issuing permits for such use of side- walks, streets or highways as are described in section 26-7 Supp.No.14 1670 §26-8 STREETS AND SIDEWALKS §26-12 may in its discretion when occasion justifies demand a suit- able cash deposit, surety bond or insurance indemnity policy to save the city or the commonwealth harmless from all lia- bility of any nature whatsoever caused directly or indirectly by such use of the sidewalk, street or highway. Obstructing sidewalks with lumber, iron, coal, etc. No person shall place, or cause to be placed, upon any side- walk any lumber, iron, coal, trunk, bale, box, crate, cask, package, article or anything whatsoever, so as to obstruct passage for travelers for more than fifteen (15) minutes. No tenant, occupant, or owner having the care of any build- ing or lot of land bordering on any street, lane, court, square, or public place within the city shall allow any bushes, shrub- bery, or any other form of plant growth to obstruct the safe passage of any pedestrian on any such street, lane, court, square, or public place within the city. Lots 182 and 7 on Ocean Avenue (referred to as lots 119 and 121 on the original plan) , were respectively acquired by Pietro and Maria DiIsso in 1914 and 1920. Title to both parcels was acquired as tenants in common. It is believed that each parcel had on it a building, as it does today. In 1941 Pietro and Maria DiIsso acquired the locus, lot 215 Mr. Leo Tremblay -2- February 16 , 1994 ( lots 118 and 120 on the original plan) , as tenants by the entirety. The above parcels abut each other. The locus is, and apparently always has been, vacant. On December 24 , 1942 Pietro died, leaving no will. By op- eration of law, his property, including his one-half undivided interest in the Ocean Avenue lots , passed to his heirs at law ( 10 children) and his wife, Maria. However, unlike the Ocean Avenue properties which it abutted, the Brooks Street property did not pass to the wife and 10 child- ren. Instead, because it was held in a tenancy by the entirety, complete title passed directly to Maria. Section 8 . 2 of the ordinance entitled "Nonconforming lot" pro- vides in pertinent part as follows: "Where a lot or lots exist which could not be built upon for residential purposes under the terms of this ordinance by reason of restrictions on lot area or lot width, such lot or lots may be used, subject to the following provisions: ( 1) Any increase in area, frontage, width, yard or depth requirements of a zoning ordinance or by-law shall not apply to a lot for single- and two-family resi- dential use which, at the time of recording or endorsement, whichever occurs sooner, was not held in common ownership with any adjoining land, conformed to then-existing re- quirements and had less than the proposed requirement but at least five thousand ( 5,000) square feet of area and fifty ( 50 ) feet of frontage. The provisions of this sec- tion shall not be construed to prohibit a lot being built upon if, at the time of the building, building upon such lot is not prohibited by the Salem Zoning Ordinance. Site Visit/Verification Form prepared by a Vivint Solar representative identifying specific site information including size and spacing of rafters for the existing roof structure. 2. Design drawings of the proposed system including a site plan, roof plan and connection details for the solar panels. This information was prepared by Vivint Solar and will be utilized for approval and construction of the proposed system. 3. Photovoltaic Rooftop Solar System Permit Submittal prepared by Vivint Solar identifying design parameters for the solar system. 4. Photographs of the interior and exterior of the roof system identifying existing structural members and their conditions. Based on the above information we have evaluated the structural capacity of the existing roof system to support the additional loads imposed by the solar panels and have the following comments related to our review and evaluation: Description of Residence: The existing residence is typical wood framing construction with the roof system consisting of 2 x 6 dimensional lumber at 16" on center with a 2 x 4 knee wall supporting the ridge beam. The attic space is unfinished and photos indicate that there was free access to visually inspect the size and condition of the roof rafters. All wood material utilized for the roof system is assumed to be Spruce-Pine-Fir#2 or better with standard construction components. Our review of the photos of the exterior roof does not indicate any signs of settlement or misalignment caused by overstressed underlying members. Stability Evaluation: A. Wind Uplift Loading 1. Refer to attached ZEP calculations sheet for ASCE/SEI 7-10 Minimum Design Loads for Buildings and other Structures, wind speed of 100 mph based on Exposure Category "B" and 22 degree roof slopes on the dwelling areas. Ground snow load is 40 PSF for Exposure"B", Zone 2 per(ASCE(SEI 7-10). 2. Total area subject to wind uplift is calculated for the Interior, Edge and Corner Zones of the dwelling. } Page 2 of 2 B. Loading Criteria • 10 PSF= Dead Load roofing/framing • 40 PSF= Live Load (ground snow load) • 5 PSF=Dead Load solar panels/mounting hardware Total Dead Load=15 PSF The above values are within acceptable limits of recognized industry standards for similar structures. Analysis performed of the existing roof structure utilizing the above loading criteria indicates that the existing rafters will support the additional panel loading without damage, if installed correctly. C. Roof Structure Capacity 1. The photographs provided of the attic space and roof rafters show that the framing is in good condition with no visible signs of damage caused by prior overstressing. 2. The dwelling owners shall be made aware that long term build-up of heavy snow conditions may produce deflections in the roof. If any deflection is noticed, then it is recommended that the solar panels be cleared of accumulated snow more than one (1) foot deep over a period of one week. If no deflections are visible under any snow loading over a period of time, then there is no need to clear the solar panels. D. Solar Panel Anchorage 1. The solar panels shall be mounted in accordance with the most recent "ZEP Code Compliant Installation Manual", which can be found on the ZEP website (zepsolar.com). If during solar panel installation, the roof framing members appear unstable, deteriorated, structurally compromised or deflect non-uniformly, our office should be notified before proceeding with the installation. 2. Maximum allowable pullout per lag screw is 235 lbs/inch of penetration as identified in the National Design Standards (NDS) of timber construction specifications for Hem-Fir(North Lumber) assumed. Based on our evaluation, the pullout value, utilizing a penetration depth of 2 '/z', is less than what is allowable per connection and therefore is adequate. Based on the variable factors for the existing roof framing and installation tolerances, using a thread depth of 2 '/" with a minimum size of 5/16" lag screw per attachment point for panel anchor mounts should be adequate with a sufficient factor of safety. 3. Considering the roof slopes, the size, spacing, condition of roof, the panel supports shall be placed at and attached to no greater than every fourth roof rafter as panels are installed perpendicular across rafters and no greater than the panel length when installed parallel to the rafters (portrait). No panel supports spacing shall be greater than four(4) rafter spaces or 64" o/c, whichever is less. 4. Panel supports connections shall be staggered to distribute load to adjacent rafters. Based on the above evaluation, it is the opinion of this office that with appropriate panel anchors being utilized the roof system will adequately support the additional loading imposed by the solar panels. This evaluation is based on information supplied to us at the time of this report and current industry standards and practices.
