Dear Ms. Lam,
I am rejecting your May , 2010 application to finish the basement at 109 Broadway for the
following reasons; 780 CMR refers to the State Building Code, the number following is the
section in the code that spells out the requirements
• The ceiling height is insufficient. See 780 CMR 5305
• There is insufficient Light and ventilation. See 780 CMR 5303
• There are insufficient Emergency Escape and Rescue openings. See 780 CMR
5310
• The door providing access to the basement does not conform to 780 CMR 5311
Further, when I inspected the property I observed a toilet that had been recently installed in the
basement. No permits were granted or inspections done by the Plumbing and Gas Inspector as
required by the State Plumbing Code. You are hereby directed to have a licensed Plumber
remove that toilet.
You have the right to appeal this decision to the Massachusetts Board of Building Regulations
and Standards at 1 Ashburton Place Boston, Ma.

Ward Councillor Kimberly Driscoll dated December 22, 2000.

Dear Peter:
I am writing to follow up with you on the property located at 109 Broadway, currently being
used by a business enterprise, Chimney Sweeping by Brownie.
As you know, I have received complaints regarding the excessive amount of business vehicles,
ladders and stock stored at the premises. I am aware of the fact that you contacted the owners of
the premises and informed them that the property could not be used as business in this manner.
In addition, I also spoke with a representative from Chimney Sweeping by Brownie, who
informed me that the business has grown faster than they anticipated and that they have a
Purchase and Sale Agreement for property located at the other end of Broadway (behind
McDonalds) and plan to relocate to that site by March 1, 2001, the closing date for the new
property. I informed the representative that it is imperative that they relocate the business
enterprise as soon as possible, and in the event that the acquisition of this other parcel did not
take place, that they need to have a back-up plan. The representative informed me that they were
aware of the need to move as soon as possible and were attempting to make arrangements to
relocate to the site prior to the March 1 closing date, if possible.
Lastly, I informed the representative that while I am understanding and supportive of their
business growth in the City, their operation within a residential zone on Broadway beyond
March 1 could subject them to daily fines for violation of the City's zoning ordinance.
As the Building Inspector and Zoning Enforcement Officer for the City, I am writing to request
that you follow-up with Chimney Sweeping by Brownie to insure that they fully understand the
circumstances involved in this matter.
As always, thank you for your efforts in regard to this constituent concern.

A home occupation is allowed as of right provided that it is conducted solely within a
dwelling and solely by the person (s) occupying the dwelling as a primary residence, is
clearly incidental and secondary to the use of the premises for residential purposes, does
not produce offensive noise, vibration, smoke, dust, odors, heat, lighting, electrical
interference, radioactive emission or exterior storage of material or equipment (including
the parking of commercial vehicles over 10,000 gvw), does not exhibit any exterior
indication, including signs of its presence or any variation from residential appearance,
does not produce any customer pupil or client vehicles types to the occupation site and
has no nonresident employees is registered as a business with the City Clerk.
It should be clear by reading the ordinance that you are in violation of the Salem Zoning
Ordinance. Although we do not discourage business in Salem, we expect the business to
operate in a legal fashion.
