As the result of complaints again received by this department, on June 20, 1994 Health Inspector
Virginia Moustakis met with Bruce Saunders, Plumbing Inspector John LeClerc and Building
Inspector John Jennings at Hawthorne Plaza Mall.
The following were noted:
Men's toilet room
No paper towels
No soap
Hole in door
Graffiti
No container to hold toilet tissue
Ladies'toilet room
No paper towels
Graffiti
No locking devices
No cover trash receptacle
Ceiling tiles not in place.
As discussed, these toilet rooms must be available to the public until all of the shops close for
the evening, including the bank, which is approximately 10:00 p.m.
In the past, we had been advised that the toilet rooms had to remain open 24 hours because of
the ATM machine at the bank. Mr. LeClerc explained that was not correct.
We were notified that there is no cleaning/maintenance person on site between the hours of 2:00
p.m. to 7:00 p.m. Mr. Saunders assured us that there is a person on site between 7:00 p.m.to
10:00 P.M.
To resolve this long-standing, on-going matter,the recommendation was made that these rooms
be monitored during the hours the mall is open.

As per your request, both Mr. O'Brien, the City Solicitor, and
I have reviewed the information you provided regarding Section 7 of
Chapter 40A of the Massachusetts General Laws.
It is the opinion of both the City Solicitor and myself that
the protection provided under this section pertains only to uses
protected by Variance or Special Permit issued by a Permit Granting
Authority.
In view of the fact that once again you apparently have an interest
in the above referenced property, (see enclosed letter from Attorney
Chris Drucas) I must insist that the trailer be removed from the
property within thirty (30) days or I will be forced to initiate the
appropriate legal action.

This letter will confirm our recent telephone conversation
wherein I advised you, in response to your September 16 , 1986 letter,
Mr. Maguire, prior to your sending the said letter, had no ownership
interest in the property. in fact, prior to the sale of whatever
interest he had, Mr. Maguire, individually, was not the record
owner of the property. we discussed where this matter should go
from here and you advised me that you would be checking with the
Citv Solicitor, Mr. Michael O'Brien, as verification of the present
owner could be easily obtained by checking the Registry of Deeds.
There was a transaction on this property some time in either August
or early September of this year.
If you have any questions or comments, do not hesitate to contact
me at your earliest possible convenience.

Section 7.
Enforcement
The inspector of buildings, building commissioner or local inspector, or if there are none, in a town, the
board of selectmen, or person of board designated by local ordinance or bylaw, shall be charged with
the enforcement of the zoning ordinance or bylaw and shall withhold a permit for the construction,
alteration or moving of any building or structure if the building or structure as constructed, altered or
moved would be in violation of any zoning ordinance or bylaw; and no permit or license shall be
granted for a new use of a building, structure or land which use would be in violation of any zoning
ordinance or bylaw. If the officer or board charged with enforcement of zoning ordinances or bylaws is
requested in writing to enforce such ordinances or bylaws against any person allegedly in violation of
the same and such officer or board declines to act, he shall notify, in writing, the party requesting such
enforcement of any action or refusal to act, and the reasons therefore, within fourteen days of receipt
of such request.
No local zoning law shall provide penalty of more than three hundred dollars per violation; provided
that nothing herein shall be construed to prohibit such laws from providing that each day such violation
continues shall constitute a separate offense. No action, suit or proceeding shall be maintained in any
court. nor any administrative or other action taken to recover a fine or damages or to compel the
removal, alteration, or relocation of any structure by reason of any violation of any zoning bylaw or
ordinance except in accordance with the provisions of this section, section eight and section seventeen.
provided, however, if real property has been improved and used in accordance with the terms of the
original building permit issued by a person duly authorized to issue such permits, no action, criminal or
civil. the effect or purpose of which is to compel the abandonment, limitation or modification of the use
allowed by said permit or the removal, alteration or relocation of any structure erected in reliance upon
said permit by reason of any alleged violation of the provisions of this chapter, or of any ordinance or
bylaw adopted thereunder, shall be maintained, unless such action, suit or proceeding is commenced
and notice thereof recorded in the registry of deeds for each county or district in which the land lies
within six years next after the commencement of the alleged violation of law; and provided, further, that
no action, criminal or civil, the effect or purpose of which is to compel the removal, alteration or
re-location of any structure by reason of any alleged violation of the provisions of this chapter, or any
ordinance and bylaw adopted thereunder or the conditions of any variance or special permit granted by
a permit granting authority, shall be maintained. unless such action, suit or proceeding is commenced
and notice thereof recorded in the registry of deeds for such county or district in which the land lies

A hearing on this petition was. held April 30, 98 wi th following Board
Members present: James Hacker, Chairman; Mes i�. ,Ch rik u nski, Strout and
Associate Member Dore. Notice of the hearing was sent. to abutters and others and
notices of the hearing were properly publish e8 r'the Salem Evening News in
accordance with Massachusetts General Laws Cher 40A:
Petitioners are requesting a Variance to allow an existing trailer to remain
on the premises and- to make said trailer a permanent structure by removing wheels
- _ and adding foundation. Property is located in an Industrial district.
The;;?ariance which has been requested may be granted upor a finding of the
Boad that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings or structures in the same district;
`. - - b. literal enforcement of the provisions of the Zoning Ordinance would in-
volve substantial hardship, financial or otherwise, to petitioner; and
W c. desirable relief may be granted without substantial detriment to the

ghe Board of Appeal, after careful consideration of the evidence presented at
w z he hearing, makes the following findings of fact:
Substantial opposition was raised to the plan;
2. -The Board felt it would be setting a precedent by allowing a
c. trailer to be used as permanent structure in the City as there
z: are _none .currently in use,
E -�)n the basis of the above findings of fact, and on the evidence presented at the
- _ = x �earing, the Board of Appeal concludes as follows:
- 1 . The relief requested cannot be granted without substantial detri-
mefit to the public good or without nullifying or substantially
derogating from the intent of the district or the purpose of the
Ordinance.
Therefore, -the Zoning Board of Appeal voted unanimously, 5-0, against granting
the Variance requested and to direct the Inspector of Buildings to take appro-
priate action to have the trailer removed from the premises.
