Decision
Petition of Ed Burge requesting Variances from Side Yard setbacks and Lot
Coverage regulations to allow a construction of a single-story sun-room at
the property located at 95 Broadway, R-2 District
City of Salem Zoning Board of Appeals
A public hearing on the above petition was opened on June 21, 2006 pursuant to Mass
General Law Ch. 40A, Sec. 11, the following Zoning Board members present: Nina
Cohen, Richard Dionne, Stephen Pinto, Bonnie BeWr.
The petitioner Ed Burge is requesting a variance pursuant to section 9-5 to allow the
construction of a ten (10)foot by twelve (12) foot sunroom addition to the residence
located at 95 Broadway, Salem, in the Two-Family Residential (R-2) zoning district.
The petitioner is requesting a variance from the ten (10)foot side set back requirement of
the City of Salem Zoning Ordinance (Sec 6-4, Table 1)to four(4)feet, and from the
maximum lot coverage from thirty-five (35)percent to fifty-one (51)percent to allow the
low the construction of a ten (10) foot by twelve (12) foot sunroom addition in the rear of
the residence at 95 Broadway.
The Board of Appeals, after careful consideration of the evidence presented at the public
hearing, and after thorough review of the Plans and Petition submitted, makes the
following findings of fact:
1. The property at 95 Broadway is within the R-2 zoning district.
2. The petitioner,Ed Burge, represented the owners,John and Evelyn Walsh, at the
public hearing and submitted a signed letter authorizing him to speak on their
behalf.
3. The petitioner proposes to construct a ten (10) foot by twelve (12) foot sunroom
addition in the rear of their residence.
4. The existing structure currently is located four(4) feet from the side setbacks and
is a pre-existing non-conforming structure.
5. The construction of the addition will not extend further into the side setback than
the existing structure.
6. The current lot coverage of the parcel is forty-eight (48) percent and is pre-
existing. The increase in the lot coverage will be approximately three (3) percent
with the addition.
7. The petitioner has provided surveyed plans of the lot and conceptual plans of the
proposed addition.
8. There were no members of the public who wished to speak in favor or against the
petition.
On the basis of the above findings of fact, including all evidence presented at the public
hearing, including, but not limited to, the Petition and detailed plans, the Zoning Board of
Appeals concludes as follows:
1. The petitioner may construct the ten (10) foot by twelve (12) foot sunroom
addition in the rear of the residence according to the plans and conceptual
renderings submitted to the Board.
2. The petitioner's request for variances to allow a ten (10) foot by twelve (12)
foot sunroom addition in the rear of the residence does not constitute a
substantial detriment to the public good.
3. The proposed addition does not nullify or substantially derogate from the
intent or purpose of the zoning ordinance.
4. The petitioner's lot size and shape prohibit locating the addition in another
location.
5. The petitioner's lot size and coverage restrictions do not generally occur in the
district and are specific to their land.
6. A literal enforcement of the zoning ordinance would create a substantial
hardship to the petitioner.
7. In permitting such change, the Board of Appeals requires certain appropriate
conditions and safeguards as noted below.
In consideration of the above, the Salem Board of Appeals voted, four(4) in favor
(Cohen, Dionne, Pinto, Belair) and none (0) opposed, to grant the request for a variance,
subject to the following terms, conditions, and safeguards:
1. Petitioner shall comply with all city and state statutes, ordinances,codes and
regulations.
2. All construction shall be done as per the plans and dimensions submitted to and
approved by the Building Commissioner.
3. All requirements of the Salem Fire Department relative to smoke and fire safety
shall be strictly adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. Exterior finishes of the new construction shall be in harmony with the existing
structure.
6. A Certificate of Inspection is to be obtained.
7. Petitioner is to obtain approval from any City Board or Commission having
jurisdiction including, but not limited to, the Planning Board.

This letter is an attempt to clear up the file your office has kept on the
property located at 95 Broadway, Salem,' Massachusetts.
As you read this clarification, please note that the exhibits attached are
directed to a Mr. Boucher, who did not at the time, and has never, owned the
property at 95 Broadway. Any reference to either number 95 or number 96 Broadway
is incorrect.
The properties discussed in the following exhibits are located at 11 Pacific
Street and 17 Broadway, Salem, Massachusetts. It appears that the number 96 was
picked up from the Quitclaim Deed (Exhibit #15) .
Exhibit #1
This document refers to a dwelling located behind 212 Canal Street, and in no
way concerns the property at 95 Broadway.
Exhibit #2
This document does not refer to 95 Broadway, rather to 96 Broadway. In
addition, please note that 96 Broadway is located on the Northwest side of
Canal Street.

This document is in reference to a house located on 11 Pacific Street, and

of these two structures , complaints received in this department with
regard to children playing in and around them, and advised you that, the

valuation of same because of the appearance of these buildings .
We are enclosing copies of applicable sections from the City of
Salem Building Code for your study.
With regard to the building on Broadway, y.ou shall have a founda-
tion installed under this structure by the sixth of April , and the dwel
ling shall be made habitable by the first of May, 1970.
Please make immediate emergency repairs to this fire damnrred struc
ture on Pacific Street in the nature of boarding up and securing the
building to eliminate this serious hazard and nuisance in the neighbor-
hood. This structure also , 'shall be made habitable by the first of May
1970.
If these remedial operations are not taken rare of exactly as or-
dered, you leave me no alternative but to comply with Section 9 of the
Building Code, a copy of which and Sections 8, 10, and 11 , are enclosed
as mentioned above .

We are abutters to the property owned by Mr. Boucher,
who was allowed to move an old delapidated, (now nearly
completely destroyed by vandals ) house, which was originally
located on Forest Avenue, land which was acquired by Salem
State College.
Dispite our protest and that of all our neighbors (signed
petition by this group of people - protesting the moving of
such a house - to this property on Broadway. ) Please check
records on this; Mr. Boucher wanted a variance to the build-
ing code, to put this (huge ) TWO family house on a lot barely
large enough for a one family house. He was not given the
variance, but, was allowed to move this monstrous°ty on the
property, providing he housed ONE family. (Nothing has' been
done to it since* )
Please find a little time in your busy schedule to come
and inspect this (very dangerous) - (fire hazard) etc. , piece
of property. We have time and time again called the Building
Inspector and complained of this unsafe structure. (The
windows were boarded and so were the doors, first floor only. )
notice the condition of the foundation - not half finished,
ganina holes, certainly not meeting. the standard building codes
of our city. Children have been able to get in anyway, only
last Sunday a group of boys littered our yard with over fifty
ceiling tiles. Mr. Mayor before some child is killed or mained
please, do something to rid our part of the city of this very
dancerous condition, one fire has already been set.
We have spoken to our lawyer, he suggested we contact the
i State Inspector, if, no action is being taken by our local
authority. We cannot understand how such a situation can go
unchecked for such a lenghtly time.

Dear Sir:
As you know, for some time we have been working with Henry Boucher and
yourself as his attorney to have corrective action taken on the condemned
property at 95 Broadway in Salem. At the Board of Health meeting on
January 25, 1972, Mr. Boucher informed the Board of Health that the property
had been sold to Laurien L'Italien, who was taking steps to demolish this
unsafe property.
In talking to Mr. Laurien L'Italien, he has indicated that he did not
purchase this property. We have searched the title (on.January 26) and
it is found that you are the owner of this condemned property. We bring
to your attention that this property is a hazard and could cause injury
(by wind blown debris, children entering, potential for another fire, etc.)
to the public.
This condemned structure is ordered razed within 10 days after receipt of
this order for a multitude of violations of Article Two of the Sanitary
Code (roof in poor repair and in hazardous condition; ceilings, walls,
floors in poor repair; wiring and plumbing in structure in poor repair;
siding in poor repair; roof on porch and porch in poor repaii). Under
the authority of Article One of the Sanitary Code this is considered an
emergency condition.
Upon compliance (razing the structure) you have a right to appeal by filing
a written petition within seven days after receipt of this order.

on Broadway in Salem, which is described on attached deed (Book 5826 and
page 25).
Upon completion of the razing of the structure and filling in the cellar hole
(including compacting), submit your invoice to the Board of Health.
In the interest of expediting the razing of this dangerous property, we have
taken steps to exterminate this property for rodents.
