The petitioner Ed Burge is requesting a variance pursuant to section 9-5 to allow the construction of a ten (10)foot by twelve (12) foot sunroom addition to the residence located at 95 Broadway, Salem, in the Two-Family Residential (R-2) zoning district. The petitioner is requesting a variance from the ten (10)foot side set back requirement of the City of Salem Zoning Ordinance (Sec 6-4, Table 1)to four(4)feet, and from the maximum lot coverage from thirty-five (35)percent to fifty-one (51)percent to allow the low the construction of a ten (10) foot by twelve (12) foot sunroom addition in the rear of the residence at 95 Broadway. The Board of Appeals, after careful consideration of the evidence presented at the public hearing, and after thorough review of the Plans and Petition submitted, makes the following findings of fact: 1. The property at 95 Broadway is within the R-2 zoning district. 2. The petitioner,Ed Burge, represented the owners,John and Evelyn Walsh, at the public hearing and submitted a signed letter authorizing him to speak on their behalf. 3. The petitioner proposes to construct a ten (10) foot by twelve (12) foot sunroom addition in the rear of their residence. 4. The existing structure currently is located four(4) feet from the side setbacks and is a pre-existing non-conforming structure. 5. The construction of the addition will not extend further into the side setback than the existing structure. 6. The current lot coverage of the parcel is forty-eight (48) percent and is pre- existing. The increase in the lot coverage will be approximately three (3) percent with the addition. 7. The petitioner has provided surveyed plans of the lot and conceptual plans of the proposed addition. 8. There were no members of the public who wished to speak in favor or against the petition. On the basis of the above findings of fact, including all evidence presented at the public hearing, including, but not limited to, the Petition and detailed plans, the Zoning Board of Appeals concludes as follows: 1. The petitioner may construct the ten (10) foot by twelve (12) foot sunroom addition in the rear of the residence according to the plans and conceptual renderings submitted to the Board. 2. The petitioner's request for variances to allow a ten (10) foot by twelve (12) foot sunroom addition in the rear of the residence does not constitute a substantial detriment to the public good. 3. The proposed addition does not nullify or substantially derogate from the intent or purpose of the zoning ordinance. 4. The petitioner's lot size and shape prohibit locating the addition in another location. 5. The petitioner's lot size and coverage restrictions do not generally occur in the district and are specific to their land. 6. A literal enforcement of the zoning ordinance would create a substantial hardship to the petitioner. 7. In permitting such change, the Board of Appeals requires certain appropriate conditions and safeguards as noted below. In consideration of the above, the Salem Board of Appeals voted, four(4) in favor (Cohen, Dionne, Pinto, Belair) and none (0) opposed, to grant the request for a variance, subject to the following terms, conditions, and safeguards: 1. Petitioner shall comply with all city and state statutes, ordinances,codes and regulations. 2. All construction shall be done as per the plans and dimensions submitted to and approved by the Building Commissioner. 3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 4. Petitioner shall obtain a building permit prior to beginning any construction. 5. Exterior finishes of the new construction shall be in harmony with the existing structure. 6. A Certificate of Inspection is to be obtained. 7. Petitioner is to obtain approval from any City Board or Commission having jurisdiction including, but not limited to, the Planning Board. Dispite our protest and that of all our neighbors (signed petition by this group of people - protesting the moving of such a house - to this property on Broadway. ) Please check records on this; Mr. Boucher wanted a variance to the build- ing code, to put this (huge ) TWO family house on a lot barely large enough for a one family house. He was not given the variance, but, was allowed to move this monstrous°ty on the property, providing he housed ONE family. (Nothing has' been done to it since* ) Please find a little time in your busy schedule to come and inspect this (very dangerous) - (fire hazard) etc. , piece of property. We have time and time again called the Building Inspector and complained of this unsafe structure. (The windows were boarded and so were the doors, first floor only. ) notice the condition of the foundation - not half finished, ganina holes, certainly not meeting. the standard building codes of our city. Children have been able to get in anyway, only last Sunday a group of boys littered our yard with over fifty ceiling tiles. Mr. Mayor before some child is killed or mained please, do something to rid our part of the city of this very dancerous condition, one fire has already been set.
