If this Order constitutes an Amended Order of Conditions, this Amended Order of Conditions does not extend the issuance date of the original Final Order of Conditions and the Order will expire on 3/29/2017 unless extended in writing by the Department. 7. General Conditions Under Massachusetts Wetlands Protection Act (cont.) 9. No work shall be undertaken until the Order has become final and then has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of the registered land, the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is done. The recording information shall be submitted to the Conservation Commission on the form at the end of this Order, which form must be stamped by the Registry of Deeds, prior to the commencement of work. 10. A sign shall be displayed at the site not less then two square feet or more than three square feet in size bearing the words, "Massachusetts Department of Environmental Protection"[or, "MassDEP"] "File Number 64-548 " 11. Where the Department of Environmental Protection is requested to issue a Superseding Order, the Conservation Commission shall be a party to all agency proceedings and hearings before MassDEP. 12. Upon completion of the work described herein, the applicant shall submit a Request for Certificate of Compliance(WPA Form 8A)to the Conservation Commission. 13. The work shall conform to the plans and special conditions referenced in this order. 14. Any change to the plans identified in Condition #13 above shall require the applicant to inquire of the Conservation Commission in writing whether the change is significant enough to require the filing of a new Notice of Intent. 15. The Agent or members of the Conservation Commission and the Department of Environmental Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours to evaluate compliance with the conditions stated in this Order, and may require the submittal of any data deemed necessary by the Conservation Commission or Department for that evaluation. 16. This Order of Conditions shall apply to any successor in interest or successor in control of the property subject to this Order and to any contractor or other person performing work conditioned by this Order. 17. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated Wetland, the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden stakes or flagging. General Conditions Under Massachusetts Wetlands Protection Act (cont.) 18. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or water body. During construction, the applicant or his/her designee shall inspect the erosion controls on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission, which reserves the right to require additional erosion and/or damage prevention controls it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of work line has been approved by this Order. NOTICE OF STORMWATER CONTROL AND MAINTENANCE REQUIREMENTS 19. The work associated with this Order(the"Project") is(1) ❑ is not(2)® subject to the Massachusetts Stormwater Standards. If the work Is subject to the Stormwater Standards,then the project Is subject to the following conditions: a) All work, including site preparation, land disturbance, construction and redevelopment, shall be implemented in accordance with the construction period pollution prevention and erosion and sedimentation control plan and, if applicable, the Stormwater Pollution Prevention Plan required by the National Pollution Discharge Elimination System Construction General Permit as required by Stormwater Condition 8. Construction period erosion, sedimentation and pollution control measures and best management practices (BMPs) shall remain in place until the site is fully stabilized. b) No stormwater runoff may be discharged to the post-construction stormwater BMPs unless and until a Registered Professional Engineer provides a Certification that: i. all construction period BMPs have been removed or will be removed by a date certain specified in the Certification. Prior to requesting a Certificate of Compliance, or Partial Certificate of Compliance, the responsible party(defined in General Condition 18(e)) shall execute and submit to the issuing authority an Operation and Maintenance Compliance Statement ("O&M Statement) for the Stormwater BMPs identifying the party responsible for implementing the stormwater BMP Operation and Maintenance Plan ("O&M Plan") and certifying the following: i.) the 0&M Plan is complete and will be implemented upon receipt of the Certificate of Compliance, and ii.) the future responsible parties shall be notified in writing of their ongoing legal responsibility to operate and maintain the stormwater management BMPs and implement the Stormwater Pollution Prevention Plan. d) Post-construction pollution prevention and source control shall be implemented in accordance with the long-term pollution prevention plan section of the approved Stormwater Report and, if applicable, the Stormwater Pollution Prevention Plan required by the National Pollution Discharge Elimination System Multi-Sector General Permit. e) Unless and until another party accepts responsibility, the landowner, or owner of any drainage easement, assumes responsibility for maintaining each BMP. To overcome this presumption, the landowner of the property must submit to the issuing authority a legally binding agreement of record, acceptable to the issuing authority, evidencing that another entity has accepted responsibility for maintaining the BMP, and that the proposed responsible party shall be treated as a permittee for purposes of implementing the requirements of Conditions 18(f)through 18(k) with respect to that BMP. Any failure of the proposed responsible party to implement the requirements of Conditions 18(f) through 18(k)with respect to that BMP shall be a violation of the Order of Conditions or Certificate of Compliance. In the case of stormwater BMPs that are serving more than one lot, the legally binding agreement shall also identify the lots that will be serviced by the stormwater BMPs. I have attached an excerpt from the appendix to the wetlands protection act which will provide insight into the history of the riverfront portion of the wetlands protection act and the history behind how the current system for determining river status was developed. As mentioned in the first paragraph of the introduction it became apparent that the 'original regulatory criteria do not clearly distinguish perennial rivers that flow throughout the year from intermittent streams'. This inaccuracy in determining the status of a stream in the original regulation was what most likely caused the labeling of the stream at 6 Champlain Ave. as a perennial stream when it should have been classified as being intermittent. Also attached to this letter is a two page printout that was generated using the USGS Massachusetts Streamstats website. The streamstats printout provides information which can be compared to the definitions of a River as listed in the current regulations 310 CMR 10.58(2)(a)l a through c. The comparison of the stream at 6 Champlain Ave to the requirements for classification of a River is as follows a. A stream shown as perennial on the USGS map is-perennial. • The stream at 6 Champlain Ave. is shown as an intermittent stream on the USGS maps. b. The watershed size of the stream, whether shown as perennial or intermittent on the USGS map, is greater than 1 square mile. • The streamstats printout lists the drainage area of the stream at 6 Champlain Ave. as 0.29 square miles which is highlighted in pink on page 1 of the printout and shown shaded in red on page 2 of the printout. c. To explore other options, the Department contracted with the USGS to research watershed chtaracteistics that might be rueful In classifying streams,such its drainage area,mean basin slope, length of stream,urbanized land cover,and the percentage ofsands and gravels in the watershed. lUis research revealed that the most important characteristics for predictingwimethera river flows throughout the year arc watershed size(drainage area)and surficial geology(the percentage of sands and grovel in the watershed). As a result of this research,as well as independent analysis and field-testing by the Department,the Depamant and its technical advisory committee agreed that watershed size and surficial(subsuTace)geology could reliably be used to predict whether a stream will flow year-round. There is a strong correlation between watersheds greater than or equal to ate square mile and streams that are predicted to flow 99%of the time. There is also a strongcoarc4aion between watersheds with a high percentage of stratified drift(sands and gravels) aril streams that flow 99%oftle time. These two factors,as well its a fail-safe field observation provision,have been incorporated Into the new regulations. USGS cavinues to refire its statistical methodology to better predicttle probabilityofa sucam flowing year-round Once completed, the Department plans to use this infamaion to produce surcann raps that will eliminate roliance on the USGS topographic maps. Unfotuately,proving that a stream isperennial by direct observation requires multiple observations trade in the late summer and early fall months over many years,and the Department could not craft a workable provision to accommodate those timefnanes. B. Extended DroutJnt. The definition of`extended drought"has been amended to coincide with an"Advisory'or more severe drought as declared bythe Massachusetts Drought ManeigementTask force in accordance with a statewide drought narnagement plan. This change was made on an emergency basis, effective December 21, 2001, and is now incorporated into the penTanew regulations. The plan has five drought action levels based upon nudtiple indicators such as stream flow, groundwater elevations, precipitation,snow pack,wild the danger,crop moisture availability,reservoir levels,and the Palter Drought Severity Index. The'rask force will issue written statements when a drought develops,when drought levels change,and whenthe drought ends. Monthly naps will be prepared by DL'M detailing the geographic extent of the drought and the corespond ng drought level. The site originally consisted of a greatly sloping buffer zone area with very large outcroppings of bedrock. The original construction of the dwellings was allowed under DEP File #64-262 and included the construction of two dwellings on two separate lots with no work proposed within 100 feet of the intermittent stream. During the permitting process the intermittent stream was considered a River as defined under the wetland protection act and therefore a 100 foot buffer zone restriction was placed on the two properties. Subsequent to the construction of the dwelling on the property at 6 Champlain the property was sold to a residential owner who proceeded to make improvements to the property within the 100 foot restricted zone defined in the original order of conditions. The owner obtained a building permit to construct a 24' x 37 garage, but proceeded to make other improvements to the property including the installation of chain-link fences, retaining walls, walkways, gardens, and steps located in the buffer zone of the bordering vegetated wetland associated with the intermittent stream. In 1996 when the lots at 6 Champlain Road and 19 Arthur Street were created, the stream at the rear of the lots was classified as a River under the wetland protection act. As a result a "No Disturbance Restriction' was placed on the properties, the limits of which are shown on the approved development plans as a Restriction Line located approximately 100 feet from the edge of the stream. Since the original filing of the Notice of intent the Massachusetts DEP regulations as to how a River is defined has changed. Under the new regulations a Stream Stats program is used to define the watershed size and expected low flows during certain environmental conditions. Under the new regulations the stream is not perennial and is not a River with an Inner or Outer Riparian Zone. The Stream Slats outpu�as well as a letter explaining this output, are attached in this appendix. Because the stream is not considered a River we are asking for the Restriction Line to be removed. REMEDIATION As part of this Notice of Intent the 8' high chain-link fence along the northerly side of the property line will be removed as well as the 4' high fence around the existing garden area. The closest end of the 4' fence to be removed is about 8 feet from the wetland and the closest point of the 8' fence is 14 feet from the wetland. The 8' chain-link fence along the rear of the property which parallels the edge of the wetland will remain in place as a protective barrier and to prohibit trespassing through the wetland resource area from the adjacent playing field located immediately on the opposite side of the stream. Removal of this fence could also disturb the resource area to a greater extent than leaving it in place. Wetland resource area markers will be attached at 50 foot intervals along the fence. The balance of the improvements previously made such as the garage, lawn areas, retaining walls, and stairs are proposed to remain. With the exception of the existing stairs to the garden area which are 40 feet from the BVW line and the fence on the north side of the property, all of the other improvements are further than 50 feet from the wetland line. RESOURCE AREA PROTECTION The resource area consists of a Bordering Vegetated Wetland which borders an intermittent stream. The proposed mitigation work proposed with this notice of intent does not include any excavation activities and therefore no erosion control devices are required. WILDLIFE HABITAT The property is not located near any mapped priority habitat as delineated by the Massachusetts Natural Heritage Endangered Species program. As the property currently exists the house is surrounded by a lawn area which transitions through a semi landscaped buffer into thick underbrush along the resource area. WETLAND DELINEATION The bordering vegetated wetlands and intermittent stream were delineated by Sommer Environmental Technologies, Inc. in 1996 as part of the original NOI filing and was copied from existing plans of record. I have attached an excerpt from the appendix to the wetlands protection act which will provide insight into the history of the riverfront portion of the wetlands protection act and the history behind how the current system for determining river status was developed. As mentioned in the first paragraph of the introduction it became apparent that the `original regulatory criteria do not clearly distinguish perennial rivers that flow throughout the year from intermittent streams'. This inaccuracy in determining the status of a stream in the original regulation was what most likely caused the labeling of the stream at 6 Champlain Ave. as a perennial stream when it should have been classified as being intermittent. Also attached to this letter is a two page printout that was generated using the USGS Massachusetts Streamstats website. The streamstats printout provides information which can be compared to the definitions of a River as listed in the current regulations 310 CMR 10.58(2)(a)l a through c. The comparison of the stream at 6 Champlain Ave to the requirements for classification of a River is as follows a. A stream shown as perennial on the USGS map is perennial. • The stream at 6 Champlain Ave. is shown as an intermittent stream on the USGS maps. b. The watershed size of the stream, whether shown as perennial or intermittent on the USGS map, is greater than 1 square mile. • The streamstats printout lists the drainage area of the stream at 6 Champlain Ave. as 0.29 square miles which is highlighted in pink on page 1 of the printout and shown shaded in red on page 2 of the printout. c.
