Dear Mr. Roberts,
This letter is regarding the beach operated by the Forest River Beach Club at the end of Riverway
road in Salem. This beach is determined to be a semi-public beach per 105 CMR 445.000:
Minimum Standards for Bathing Beaches (State Sanitary Code, chapter VII). 105 CMR
445.035:Sampling and Analysis at Semi-Public Beaches states that"The operators of semi-
public bathing beaches shall pay for the costs of testing, monitoring and analysis of
bathing beach waters adjacent to such semi-public bathing beaches."Water samples for
bacteriological analysis must be collected within five days immediately preceding the opening of
bathing season, and at least weekly during the bathing season.
We are reaching out to you in an attempt to find a person to be responsible for operation and
water sampling in order to facilitate operation of your beach for the 2011 season. Please contact
this office prior to June 13, 2011 to obtain a copy of the full regulations and speak with us about
sampling and signage requirements. If the Salem Board of Health is not provided with proof
that water sampling is being conducted,the Board of Health will post the beach closed
until such time as weekly sampling begins. Failure to comply may result in monetary
penalties as provided for in section 127A of Mass. General Laws, chapter 111.

Hi, Liz. I keep thinking to call you, then realizing it's after 4:00, and I'm out tomorrow, so...
email it is.
It's entirely up to the beach operator when he wants to operate. What frequently requires
emphasis, however, is that the operation dates must not include periods before testing starts, or
after testing ends. I think the term"dates of operation" can cause some confusion if the operator
is thinking in terms of(for example) the date they start maintaining the beach for the season, or
when they're.parking lot opens for the season, etc. For purposes of the permit—and the
permanent sign at the beach—dates of operation refer to the period the beach is being monitored
for bacteria. But it's entirely up to them when that is. Five different beaches might have five
different sets of dates; that's fine with us so long as they're monitoring throughout the period
they represent themselves as being in operation.
Once they have a permanent sign up, saying the dates of operation are from x to y and the beach
is not monitored for bacteria outside of those dates, then that addresses the posting issue. But if
the permanent sign is not ready yet, then, yeah, some form of posting would be best, until they
start monitoring.

Hi again,
I just met with the man from the neighborhood association that runs Mackey. He had a lot of questions
which I think I mostly answered for him. It came down to whether or not they want to test. I explained to
him that they could put a sign up designating it a no swimming area, which he was inclined to agree with,
but he said some of the members may want to have it tested. He's going to talk to them this week and get
back to me by next week about what they're going to do. I explained the permitting and signage
requirements to him, showed him the sample cups, gave him the lab's info if he had questions for them
etc., so he has all the info he needs to make a decision.
One question he had that I wasn't 100% sure about—their dates of operation. He wanted to know if the
state (or us) specifies dates he needs to operate between or if they need to operate between the dates
we sample the public beaches. I told him no and that he could mostly pick the dates to begin and end
• operating, but that if he decided to not start sampling until July, for example, he'd have to post the beach
until they start sampling. Is that right?And his permanent sign would have to state the dates.
I will let you and the lab know right away what he decides—he said he should be able to get back to me

RE: Contract Laboratory Support for 2011 Bathing Beach Season
• Dear Mr. Greenbaum,
The Massachusetts Department of Public Health (MDPH), Bureau of Environmental
Health (BEH), Environmental Toxicology Program (ETP) is pleased to announce the
availability of funding to continue to assist Salem with the cost of analyzing public
marine bathing water samples. As you know, all state and local agencies continue to
be impacted by the current fiscal crisis, however, MDPH Commissioner Auerbach has,
again this year, identified funds outside BEH to assist our ETP and local health with
analytical laboratory support related to marine beaches for the 2011 season.' These
funds will allow MDPH to continue to fund analytic laboratory costs at levels consistent
with previous years for the 2011 bathing season.
Based on information previously submitted to ETP, Salem has 10 marine beach
testing sites. Please review and let us know no later than May 20, 2010 if this
information is inconsistent with your records. Only routine samples collected between
June 13 and September 2, 2011 will be eligible for this funding (the laboratory will bill
MDPH directly for these services). If there is a need for additional samples because of
bacterial exceedances, the cost will need to be borne by your municipality.
The MDPH has contracted with Biomarine, Inc. to analyze the samples for your
community at their laboratory again this year. It is the responsibility of the municipality
to conduct the sampling in accordance with the required protocol and to preserve the
• sample until it is turned over to the laboratory (see Beach Sampling Field Data Form).
We would encourage you to contact Jim Groleau at Biomarine, Inc. at (978) 281-0222
in order to coordinate the delivery of the sterile sample bottles and for coordination
with regard to the pick up of the samples.
Like last year, the laboratories have been required in their contracts with MDPH to •
enter the monitoring data results and electronically report sample-specific results via
the bathing beaches website directly back to MDPH as well as to the local health
departments. The laboratory will.also enter information from the field data form, such
as field observations, rainfall data, and temperature, via the website. Therefore, the
field data form needs to be filled out in its entirety before delivery to the laboratory. As
noted above, these forms and other information are also available through the MDPH
website at www.mass.gov/dph/environmental health.
We continue to hope that funding may become available to help cover these costs for
the 2012 bathing season.- However, it is not possible to predict the amount of funding
available for the 2012 bathing season at this time. For this reason, MDPH strongly
encourages communities that have variance-eligible beaches to pursue sampling
variances. MDPH,Beaches Program staff can assist you in these efforts.
Chris Huskey, Bathing Beaches Coordinator, will continue to coordinate the efforts of
our two Bathing Beaches Inspectors, Irena Draksic and Michael Beattie. Our
inspectors have the responsibility of working with local municipalities to ensure that
this contract runs smoothly, to ensure that the sampling is conducted in accordance
with the required protocols, and to provide other types of technical assistance and
training to you in your efforts to comply with the requirements of the state and federal

quality report, which we°are required by statute to produce each year. This
. report,which is funded in part by the U.S. Environmental Protection Agency

(EPA), summarizes beach water quality data collected at marine and freshwater
bathing beaches throughout the Commonwealth. The latest.annual report, •
Marine and Freshwater Beach Testing in Massachusetts: 2010 Season, has
been completed. Due to upgrades to the MDPH website, the report is not
