Dear Ms. Duques and Commission Members:
As requested in your letter of May 7", we have consulted with the Applicant (Cassell
Builders) regarding grading work conducted at the subject property. Your letter
states that grading and filling and the construction of a masonry retaining wall at the
subject addresses are not as shown on the April 2005 plan approved by the
Commission. Your letter requests an explanation as to why the Commission`was
not notified prior to the work being completed and questions the necessity of a
building permit for the wall.
With regard to the latter request, a building permit was neither requested nor
necessary due to the small height of the wall (two to four feet; ref 780 CMR 11.03).
Our April 10, 2009, letter to the Commission noted the aforementioned masonry
retaining wall. We explained that the wall was constructed directly uphill of the
drainage swale to allow flatter grades in the area directly behind the residences and
that the flatter grades facilitated foot traffic behind the residences.
The April 2005 approved plan notes that the "building footprints, on-lot utilities and
grading are conceptual and for illustration purposes only". This note reflects the
fact that the specific wishes of future homeowners is unknown at the time of
permitting. Nonetheless, comparison of the April 2005 and April 2009 drawings
indicates that the as-built conditions closely approximate the approved plan.
Building footprints, driveway locations, drainage patterns, and contours are all
generally as proposed, with the only significant deviation being the masonry wall
along the drainage swale,
The masonry wall is a landscaping feature that was constructed as part of the '
approved'work. As noted above, the wall allows flatter grades behind the two
residences.. It also provided a convenient location for placement of spoil from
construction of the drainage swale, and thereby lessened the amount of soil that
would have otherwise been trucked from the site. The flatter grades also increase

the potential for stormwater infiltration and thereby increase the slow replenishment
of the wetlands downhill of the work and reduce the amount of runoff from the
properties. Flatter slopes are more stable and have lower potential for long-term
erosion. The wall also creates a permanent physical barrier that lessens the
possibility that future property owners will undertake activities near the bordering
vegetated wetlands.
The wall is small and of simple construction that did not require different equipment
than would have otherwise been used on the project. Its construction did not
increase the amount of ground disturbed for the project, nor did it require signficant
additional excavation. The wall construction work was protected by erosion controls
already in-place for the project.
As described above there are many benefits to the project that arise from
construction of the masonry wall. We did not include the wall in our April 2005
plans because there was no budget available at the time for such construction and it
was not necessary for the project to meet Wetland Protection Act performance
standards. Had our, or the Applicant's, foresight been better, we would have
included the wall on those plans.
The Applicant regrets not informing the Commission about the wall during its
construction. This was simply an inadvertent oversight. The fact that construction of
the project so closely followed the approved plan, and that there were no significant
construction-phase problems, demonstrates the Applicant's care in submitting his
plan for approval and his efforts to follow all of the Commission's requirements.

Dear Commission Members:
On behalf of the applicant, Cassell Builders, this letter requests that the
Commission issue a Certificate of Compliance for the subject project. Please find
enclosed eight (8) copies of our As-Built Plan for Certificate of Compliance
(Drawing CC-1) and Massachusetts Wetland Protection Act Form 8A.
We have reviewed the subject Order of Conditions and have inspected the site.
An As-Built Plan is enclosed showing the completed work. Based on the plan and
our post-construction inspection, we certify that the work has been completed in
substantial compliance with the approved plan with the following noted deviations.
1) A 2-ft to 4-ft tall masonry retaining wall was constructed directly uphill of the
drainage swale on Lots 1 & 2. The wall allows flatter grades in the area
directly behind the residences on Lots 1 and 2.
2) Wooden decks, each elevated approximately 8-ft over the finish grade,
were constructed at each single-family residence. Gravel was placed
under each deck.
3) The approved plans indicate that two 500-gallon dry-wells were to be
installed on each lot to capture and infiltrate roof runoff. iOnly'one dry-well."
was installed on'each lot. However, the crushed stone drainage swale
(approx. 1,100 s.f. bottom area) and the level spreader (approx. 350 s.f.
bottom area) as constructed appear to provide enough additional surface
area for infiltration of runoff to occur. The additional area provided by the
swale and level spreader is substantially larger than the three absent dry
wells (64 s.f. bottom area x 3 = 192 s.f.). During the design phase,
infiltration through the bottom of the crushed stone drainage swale and the

level spreader were ignored.

Dear Mr. Cassell:
After reviewing your request for a Certificate of Compliance at the Conservation
Commission's last meeting on April 23, 2009, the Commission noticed that the as-built
plans differed from the approved plan. As a result the Commission tabled your request
pending additional information. The Commission did not take issue with the change in
the number of dry wells installed on each lot, reduction from two to one as approved in
the Order of Conditions issued April 14, 2005. However, the Commission has requested
additional information regarding the grading and filling that was completed on lots 1 and
2 and the creation of the masonry retaining wall within the buffer zone. These changes
were not included in the approved plan "Cassell Builders Cedarcrest Ave. Extension
Salem, MA Plan to Accompany Notice of Intent" final revisions dated April 11, 2005.
Please submit a letter to the Commission explaining why the aforementioned changes
were made and why the Conservation Commission was not notified prior to the work
being completed. Also, please indicate if a building permit was necessary and obtained
for the masonry retaining wall constructed behind lots 1 and 2.
Upon receipt and review of your letter explaining the changes the Commission will
revisit your request for a Certificate of Compliance and determine if a full Certificate of
Compliance is warranted.

I am writing to you at this time to request an extension of the order of conditions for the
Cedarcrest Ave. Extension project. Currently the last house is under construction and
should be complete by the middle of summer 2008.
The remaining landscape and paving should be complete by September 2008. I feel that a
six month extension should be all that I need. This would bring the project to completion
some time in mid October.

Dear Mr. Cassell:
After review of your file it appears that your Order of Conditions#64-392 will expire on
April 14, 2008. The Order of Conditions issued on April 14, 2005 indicates is was for the
construction of a roadway, three (3) single-family dwellings, associated site grading,
drainage improvements, utility installation, and stormwater management features at the
above mentioned site.
If this project is complete, you should Request a Certificate of Compliance (enclosed
form) from the Salem Conservation Commission. It is also highly recommended that you
confirm that all special conditions have been completed and fulfilled prior to requesting a
Certificate of Compliance. A full Certificate of Compliance will not be issued if special
conditions have not been completed and fulfilled.
If this project has not been completed, than you must submit a written request for an
extension of the existing Order of Conditions to the Commission at least 30-days prior to
the expiration of the order, as required in the Wetland Protection Act. If the project has
not been completed and your Order of Conditions expires, you will be required to file a
new Notice of Intent to complete this previously approved project.

developer at the back of sidewalk on the right side of the street, if heading down to the end of the street. Each of the water
services is to be offset about 10ft from each of the sewer services, with a straighter alignment to the new water main.
Water gate valves (shut-offs) are to be located in the sidewalk or driveway openings. The proposed Lot 1 water service is
directly under a proposed new tree. Either move the water service or move the tree. A 10 ft separation would be good
and that goes for both water and sewer services.
The driveway aprons are to be concrete, same as the sidewalks.
Concrete pads are to be installed around the light pole base and the hydrant. Although not a sidewalk, the appearance
would be the same for a 10 ft long stretch for each location.
The detention pond cannot be located in public space. Either move it entirely onto private property, to be privately
maintained or remove it entirely. Given the location of the project and the surrounding wetlands, it will be up to the
Conservation Commission to evaluate the usefulness of a proposed detention pond. The swale can stay but should be
realigned to be entirely private, terminating at roughly wetland flagging A8. Each property owner is responsible for
maintaining their respective piece of the swale. The drain pipe, stormceptor and new outfall with splash pad can be
aligned within the right of way provided the maintenance road is extended to reach the outfall area. The outfall should be
as near the wetland as possible and at the furthest extent of the public right of way. The design plans need to clearly
document that the swale is privately owned and maintained.
Easements for the roadway cul-de-sac that are private property need to be granted to the City by the project proponent
before granting Certificates of Occupancy for any of the new buildings. The project proponent is to bear all cost and
responsibility for completing the easement process, including completed filing with the Registry of Deeds and copies to the
City Engineer.
Sewer ball valves (shut-offs) are needed up stream of the clean-out at the end of the force main and where needed to
facilitate clean extensions of the main during construction.
A copy of the sewer capacity letter from Griffin Engineering needs to be incorporated into the file.

I received and reviewed plan sheets C3, C2, P1, D1 & D2, revised by Griffin Engineering Group on 4/7/05. Here are my
comments:
1. The hydrant detail needs to reflect that the hydrant location is to be approved by the DPW/Engineering, since DPW is
responsible for hydrants not the Fire Dept.
2. The hydrant detail needs to reflect, per City standards, it is to be an American Darling B62B hydrant, painted according
to Salem's standards.
3. All castings and structures (water, sewer&drain) are to be suitable for H-20 highway loading.
4. A detail of the sewer force main shut-off valve needs to be added.
5. Several of the details refer to bituminous concrete (asphalt) sidewalks. I was under the impression that there would be
only concrete sidewalks. There's no detail for a concrete sidewalk or driveway apron (sidewalks 4 inches thick and aprons
6 in thick WITH reinforcing wire mesh).
6. There must be a note on the plans clearly stating maintenance of the drainage swale is to be by each respective
property owner AND that the City is NOT responsible for the swale. Furthermore such a note should be required to be
place on the plot plan to be filed with the Registry of Deeds.
7. Although the water service connection detail does show that the curb-stop (valve) is to be on public property it is not
clearly indicated that it must be in a paved area. The preferable location is the sidewalk but if none exists then close to the
gutter-line of the road will also be acceptable. This is to ensure the valve will be locatable during winter months with snow
cover on the ground.

8. The applicant needs to provide and install a new water main valve at the end of the existing water main in order to
transition to a new main and isolate it for chlorination and testing.
9. So that there are no questions at the time construction begins, the plan needs to specify the configuration of E-One
sewage pumps suitable for this project.

C. General Conditions Under Massachusetts Wetlands Protection Act
(only applicable to approved projects)
1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory
measures, shall be deemed cause to revoke or modify this Order.
2. The Order does not grant any property rights or any exclusive privileges; it does not authorize any
injury to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying with all
other applicable federal, state, or local statutes, ordinances, bylaws, or regulations.
4. The work authorized hereunder shall be completed within three years from the date of this Order
unless either of the following apply:
a. the work is a maintenance dredging project as provided for in the Act; or
b. the time for completion has been extended to a specified date more than three years, but less
than five years, from the date of issuance. If this Order is intended to be valid for more than three
years, the extension date and the special circumstances warranting the extended time period are
set forth as a special condition in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill.Any fill shall contain no trash, refuse,
rubbish, or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard,
pipe, tires, ashes, refrigerators, motor vehicles, or parts of any of the foregoing.
7. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such
an appeal has been taken, until all proceedings before the Department have been completed.
8. No work shall be undertaken until the Order has become final and then has been recorded in the
Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title
of the affected property. In the case of recorded land, the Final Order shall also be noted in the
Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to
be done. In the case of the registered land, the Final Order shall also be noted on the Land Court
Certificate of Title of the owner of the land upon which the proposed work is done. The recording
information shall be submitted to this Conservation Commission on the form at the end of this Order,
which form must be stamped by the Registry of Deeds, prior to the commencement of work.
9. A sign shall be displayed at the site not less then two square feet or more than three square feet in
size bearing the words,

C. General Conditions Under Massachusetts Wetlands Protection Act
10. Where the Department of Environmental Protection is requested to issue a Superseding Order, the
Conservation Commission shall be a party to all agency proceedings and hearings before DEP.
11. Upon completion of the work described herein, the applicant shall submit a Request for Certificate of
Compliance (WPA Form 8A)to the Conservation Commission.
12. The work shall conform to the plans and special conditions referenced in this order.
13. Any change to the plans identified in Condition#12 above shall require the applicant to inquire of the
Conservation Commission in writing whether the change is significant enough to require the filing of a
new Notice of Intent.
14. The Agent or members of the Conservation Commission and the Department of Environmental
Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours
to evaluate compliance with the conditions stated in this Order, and may require the submittal of any
data deemed necessary by the Conservation Commission or Department for that evaluation.
15. This Order of Conditions shall apply to any successor in interest or successor in control of the
property subject to this Order and to any contractor or other person performing work conditioned by
this Order.
16. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated Wetland,
the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden
stakes or flagging. Once in place, the wetland boundary markers shall be maintained until a Certificate
of Compliance has been issued by the Conservation Commission.
17. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully
stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or
water body. During construction, the applicant or his/her designee shall inspect the erosion controls
on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately
control any erosion problems that occur at the site and shall also immediately notify the Conservation
Commission, which reserves the right to require additional erosion and/or damage prevention controls
it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of
work line has been approved by this Order.
18. All work associated with this Order is required to comply with the Massachusetts Stormwater Policy
Standards.

F. Appeals
The applicant, the owner, any person aggrieved by this Order, any owner of land abutting the land subject
to this Order, or any ten residents of the city or town in which such land is located, are hereby notified of
their right to request the appropriate DEP Regional Office to issue a Superseding Order of Conditions.
The request must be made by certified mail or hand delivery to the Department, with the appropriate filing
fee and a completed Request of Departmental Action Fee Transmittal Form, as provided in 310 CMR
10.03(7)within ten business days from the date of issuance of this Order. A copy of the request shall at
the same time be sent by certified mail or hand delivery to the Conservation Commission and to the
applicant, if he/she is not the appellant. Any appellants seeking to appeal the Department's Superseding
Order associated with this appeal will be required to demonstrate prior participation in the review of this project.
Previous participation in the permit proceeding means the submission of written information to the
Conservation Commission prior to the close of the public hearing, requesting a Superseding Order or
Determination, or providing written information to the Department prior to issuance of a Superseding Order
or Determination.
The request shall state clearly and concisely the objections to the Order which is being appealed and how
the Order does not contribute to the protection of the interests identified in the Massachusetts Wetlands
Protection Act, (M.G.L. c. 131, §40)and is inconsistent with the wetlands regulations (310 CMR 10.00).

ADDITIONAL FINDINGS
Based on a letter from the Natural Heritage & Endangered Species Program (NHESP) of the Massachusetts
Division of Fisheries and Wildlife, it has been determined that this project occurs near the actual habitat of state-
listed rare wildlife species but it is the opinion of NHESP that the project will not adversely affect habitat of state-
listed wildlife species.
This Order is issued under the Massachusetts Wetlands Protection Act,M.G.L.Chapter 131,Section 40 and the City
of Salem Wetlands Protection Ordinance, Salem Code Chapter 34,Section 34-1 —34-13.
This Order permits the construction of a roadway, three (3) single-family dwellings, associated site grading,
drainage improvements,utility installation, and stromwater management features.
SPECIAL CONDITIONS
1. This Order of Conditions must be recorded in its entirety (all 5 pages) at the Essex Registry of Deeds
or the Land Court for the district in which the land is located, within the chain of title of the affected
property; and recording information must be submitted to the Salem Conservation Commission in
writing, before any work approved in this Order commences.
2. Approval of this application does not constitute compliance with any law or regulation other than
M.G.L Chapter 131, Section 40, Wetlands Regulations 310 CMR 10.00.
3. All work shall be performed in accordance with this Order of Conditions and approved site plan(s). No
alteration of wetland resource areas or associated buffer zones, other than that approved in this Order,
shall occur on this property without prior approval from the Commission.
4. Prior to any work commencing, a sign shall be displayed showing DEP File#64-392, and not placed on
a living tree.
5. No work approved in this Order may commence until the ten(10)day appeal period has lapsed from the
date of the issuance of this Order.
6. The term"Applicant"as used in this Order of Conditions shall refer to the owner,any successor in
interest or successor in control of the property referenced in the Notice of intent, supporting documents
and this Order of Conditions. The Commission shall be notified in writing within 30 days of all
transfers of title of any portion of the property that takes place prior to issuance of the Certificate of
Compliance.
7. It is the responsibility of the applicant to procure all other applicable federal, state and local permits and
approvals associated with this project. These permits may include but are not necessarily limited to the
following:

(1) Section 404 of the Federal Water Pollution Control Act(P.L. 92-500, 86 stat. 816), U.S. Army
Corps of Engineers.
(2) Water Quality Certification in accordance with the Federal Water Pollution Control under authority
of sec. 27(5) of Chapter 21 of the Massachusetts General Laws as codified in 314 CMR 9.00.
(3) The City of Salem Wetlands Protection Ordinance and its Regulations
8. If there are conflicting conditions within this Order, the stricter condition(s) shall rule.
9. All work shall be performed so as to ensure that there will be no sedimentation into wetlands and
surface waters during construction or after completion of the project.
10. The Commission and its Administrator shall have the discretion to modify the erosion/siltation control
methods and boundary during construction if necessary.
11. The Commission or its Administrator,officers,or employees shall have the right to enter and inspect the
property at any time for compliance with the conditions of this Order,the Wetlands Protection Act MGL
Chapter 131,Section 40, the Wetlands Regulations 310 CMR 10.00,and shall have the right to require any
data or documentation that it deems necessary for that evaluation.
12. The Commission or its Administrator shall have the discretion to modify the erosion/siltation control
methods and boundary during construction if necessary.
13. The Commission reserves the right to impose additional conditions on portions of this project or this site
to mitigate any actual or potential impacts resulting from the work herein permitted.

15. Any proposed changes in the approved plan(s)or any deviation in construction from the approved
plan(s) shall require the applicant to file a Notice of Project Change with the Commission. The Notice
shall be accompanied by a written inquiry prior to their implementation in the field, as to whether the
change(s) is substantial enough to require filing a new Notice of Intent or a request to correct or amend
this Order of Conditions. A copy of such request shall at the same time be sent to the Department of
Environmental Protection.
16. In conjunction with the sale of this property or any portion thereof before a Certificate of Compliance has
been issued,the applicant or current landowner shall submit to the Commission a statement signed by the
buyer that he/she is aware of an outstanding Order of Conditions on the property and has received a copy of
the Order of Conditions.

17. Condition Number #43 as indicated below shall continue in force beyond the Certificate of
Compliance,in perpetuity,and shall be referenced to in all future deeds to this property.
PRIOR TO CONSTRUCTION
18. Prior to the commencement of any activity on this site other than activities listed above, there shall be a
PRE-CONSTRUCTION MEETING between the project supervisor, the contractor responsible for the
work, and a member of the Conservation Commission or its Administrator to ensure that the
requirements of the Order of Conditions are understood. The staked erosion control line shall be
adjusted,if necessary,during the pre-construction meeting. Please contact the Conservation Commission
Agent at(978) 745-9595 ext 311 at least forty-eight(48)hours prior to any activity to arrange for the
pre-construction meeting.
19. Prior to the pre-construction meeting and commencement of any activity on this site, sedimentation and
erosion control barriers shall be installed as shown on the approval plan(s)and detail drawings. The
Commission and/or its Administrator shall inspect and approve such installation at the pre-construction
meeting.
20. No clearing of vegetation, including trees, or disturbance of soil shall occur prior to the pre-construction
meeting. Minimal disturbance of shrubs and herbaceous plants shall be allowed prior to the pre-
construction meeting if absolutely necessary in order to place erosion control stakes where required.
21. There shall be 20 hay bales and wooden stakes under cover on the site to be used only for emergency
erosion control.
EROSION CONTROL
22. Appropriate erosion control devices shall be in place prior to the beginning of any phase of construction,
and shall be maintained during construction in the wetland areas and buffer zones. The erosion control
specifications provided in the Notice of Intent and the erosion control provision in the Order will be the
minimum standards for this project; the Commission may require additional measures.
23. All debris, fill and excavated material shall be stockpiled a location far enough away from the wetland
resource areas to prevent sediment form entering wetland resource areas.
24. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or
replaced as necessary. Any accumulated silt adjacent to the barriers shall be removed.
25. The area of construction shall remain in a stable condition at the close of each construction day.
26. Any de-watering of trenches or other excavation required during construction shall be conducted so as
to prevent siltation of wetland resource areas. All discharge from de-watering activities shall be filtered
through hay bale sediment traps, silt filter bags or other means approved by the Commission or its
Administrator.
27. Within thirty(30)days of completion of construction on any given portion of the project, all disturbed
areas in the completed portion of the site shall be permanently stabilized with rapidly growing
vegetative cover, using sufficient top soil to assure long-term stabilization of disturbed areas.
28. If soils are to be disturbed for longer that two months, a temporary cover of rye or other grass should be
established to prevent erosion and sedimentation. If the season is not appropriate for plant growth,
exposed surface shall be stabilized by other appropriate erosion control measures, firmly anchored, to
prevent soils from being washed by rain or flooding.

DURING CONSTRUCTION
29. A copy of this Order of Conditions and the plan(s)approved in this Order shall be available on site at all
times when work is in progress.
30. No alteration or activity shall occur beyond the limit of work as defined by the siltation barriers shown on
the approved plan(s).
31. All waste products, grubbed stumps, slash;construction materials,etc. shall be deposited at least 100 feet
from wetland resource areas and 200 feet from river.
32. Cement trucks shall not be washed out in any wetland resource or buffer zone area,nor into any drainage
system Any deposit of cement or concrete products into a buffer zone or wetland resource area shall be
immediately removed.
33. All exposed sub-soils shall be covered by a minimum of three(3)inches of quality screened loam topsoil
prior to seeding and final stabilization.
34. Immediately following drainage structure installation all inlets shall be protected by silt fence,haybale
barriers and/or silt bags to filter silt from stormwater before it enters the drainage system.
35. There shall be no pumping of water from wetland resource areas.
36. All equipment shall be inspected regularly for leaks. Any leaking hydraulic lines,cylinders or any other
components shall be fixed immediately.
37. During construction, all drainage structures shall be inspected regularly and cleaned as necessary.
38. The applicant is herby notified that failure to comply with all requirements herein may result in the issuance
of enforcement actions by the Conservation Commission including,but not limited to,civil administrative
penalties under M.G.L Chapter 21A, section 16.
AFTER CONSTRUCTION
39. Upon completion of construction and final soil stabilization, the applicant shall submit the following to
the Conservation Commission to request a Certificate of Compliance (COC):
(1) A Completed Request for a Certificate of Compliance form(WPA Form 8A or other form if
required by the Conservation Commission at the time of request).
(2) A letter from a Registered Professional Engineer certifying compliance of the property with this
Order of Conditions.
(3) An "As-Built" plan signed and stamped by a Registered Professional Engineer or Land Surveyor
showing post-construction conditions within all areas under the jurisdiction of the Massachusetts
Wetlands Protection Act. This plan shall include at a minimum:
(a) All wetland resource area boundaries with associated buffer zones and regulatory setback
areas taken from the plan(s)approved in this Order of Conditions;
(b) Locations and elevations of all stormwater management conveyances, structures and best
management designs,including foundation drains,constructed under this Order within any
wetland resource area or buffer zone;

(c) Distances from any structures constructed under this Order to wetland resource areas-
"structures"include,but are not limited to,all buildings, septic system components, wells,
utility lines, fences,retaining walls, and roads/driveways;
(d) A line delineating the limit of work-"work"includes any filling,excavating and/or
disturbance of soils or vegetation approved under this Order;
40, When issued, the Certificate of Compliance must be recorded at the Essex County Registry of Deeds
and a copy of the recording submitted to the Salem Conservation Commission.
41. If the completed work differs from that in the original plans and conditions, the report must specify how
the work differs; at which time the applicant shall first request a modification to the Order. Only upon
review and approval by the Commission, may the applicant request in writing a Certificate of
Compliance as described above.
42. Erosion control devices shall remain in place and properly functioning until all exposed soils have been
stabilized with final vegetative cover and the Conservation Commission and/or its Administrator has
authorized their removal.
ADDITIONAL CONDITIONS
43. The property owners of Lots 1, 2, &3 as shown on the approved plans referenced in this Order shall be
responsible for maintaining the drainage Swale on his/her property in perpetuity.
44. Herbicides or any other pesticides are not be used to maintain lawns.
45. Prior to site construction, the applicant shall receive approval for the specifications and location of the
level spreader shown within the City right-of-way (paper street portion of Cedarcrest Avenue). The
applicant is required to submit written approval and or written comments from the City Engineer to the
Salem Conservation Commission.

' PROJECT DESCRIPTION
1.0 Introduction
' The project site includes approximately 2 acres of undeveloped land located at the existing
terminus of Cedarcrest Ave. in Salem, MA. The project site includes two lots (Map 21, Lots
0038 & 0081) located at 31 & 33 Cedarcrest Ave and an existing 40-foot wide un-built portion of
Cedarcrest Ave. to the north of the vacant lots. Figure 1 - United States Geological Survey
(USGS) Locus Map depicts the general location of the proposed project.
' The site is bounded to the north and west by the Forest River Conservation Area, to the south
by the Vinnin Square Condominiums, and to the east by residential lots. A inland bank
' (intermittent stream) and bordering vegetated wetland (BVW) has been identified on the south
and west perimeter of the site.
The Notice of Intent is for the construction of a 125-foot extension of Cedarcrest Ave. with a
cul-de-sac and for the development of three single-family residences including the associated
utility installation, site grading, drainage improvements and stormwater management features.
Such work will take place within the Buffer Zone to the wetland resource areas identified above.
No alterations of the resource areas are proposed, and no impacts to the resource areas are
anticipated. The reader is referred to Attachment B for a site plan showing the proposed work.
Mitigation of potential adverse impacts associated with the proposed work is described below in
' Section 4.0.
2.0 Wetland Resource Areas
Griffin Engineering Group conducted an assessment of the subject property to determine
resource areas regulated under the Massachusetts Wetland Protection Act (310 CMR 10.00)
and the Salem Wetland Protection Ordinance present on the property and in the vicinity of the
proposed work. The investigation included an on-site inspection and wetland delineation
performed by Rimmer Environmental Consultants in October of 2001, see Attachment C. In
' addition, the review of pertinent published information regarding the site area was performed
and included:

' present on the property, and/or within 100 feet of the work area. These include:

2.1 Inland Bank (intermittent Stream)
' There is an intermittent stream that flows in a northwesterly direction along and outside the
south-property line. The stream is a well defined channel but there was no flow observed on
the day of the on-site inspection by the wetland scientist. Furthermore, the stream is not
' indicated on the USGS Lynn Quadrangle and therefore is presumed under 310 CMR 10.58 not
to contain perennial flow and is not subject to riverfront regulations. It is noted that alterations
of the stream and the inland banks are not proposed.
2.2 Bordering Vegetated Wetland (310 CMR 10.55)
A wooded swamp, qualifying as a Bordering Vegetated Wetland (BVW), borders the
' intermittent stream described above. The wetland delineation, conducted by the wetland
scientist, was well defined by topography, hydrophytic vegetation and hydric (wetland) soils.
The limit of the BVW, located on the south and west perimeter of the site, was marked by flags
A-1 through A-33. Flag locations were mapped by a instrument survey, as shown on the Site
Plan (Attachment B). Attachment C, prepared by Rimmer Environmental Consulting, further
describes the delineated wetlands on site.
' No alterations of the BVW are proposed. However, land within 100-feet of the inland bank and
the BVW are subject to the jurisdiction of the MA WPA and the Salem Wetlands Ordinance to
ensure that resource areas are not impacted. Work is proposed to occur within the Buffer
' Zone.
2.3 Additional Information
The Flood Insurance Rate Map for the City of Salem indicates that the proposed
buildings appear to be in Zone C - area of minimal flooding. The wetlands appear to be
in or near Zone B -the area between the 500 and 100-year flood zone or where flooding
' is less than 1' or less than 1 sq. mile tributary area.
The Massachusetts Natural Heritage Atlas, July 2003 Edition, indicates a portion of the
j ' site as being near or within the Estimated Habitat for Rare Species and a Priority Habitat
for Rare Species (PH 424/WH6015). A request for information has been mailed to the
Natural Heritage and Endangered Species Program (NHESP). At the time of filing there
' has not been a response from the NHESP. A copy of the NO] along with a set of plans
and supporting calculations are separately transmitted to the NHESP. See Attachment
G for proof of mailing.
III ' The National Wetlands Inventory Map identified the subject wetland as a seasonally
flooded, broad-leaved forested, palustrine wetland. There are two other wetlands
identified of a similar type in the general area.
Soil Survey Field Sheet for the Souther Part of Essex County (Sheet 14) indicates that
the site is underlain by soils of the Chatfield-Hollis Outcrop complex (CrC). These soils
' are described as well drained, moderately deep Chatfield soils; somewhat excessively
drained, shallow Hollis soils, and some exposed bedrock.

3.0 Proposed Project
' This Notice of Intent addresses roadway and building construction for a 3-lot residential
subdivision; including the associated site grading, utility installation, drainage improvements,
and stormwater management features. The applicant will extend Cedarcrest Ave.
' approximately 125 feet and provide a 90-foot diameter cul-de-sac turning area. Specific
elements of the project include:
' extending Cedarcrest Ave. 125-feet within the existing 40 foot public way;
constructing a cul-de-sac turn area at the end of the proposed extension;
extending existing water and sewer mains within the public way;
' routing underground electrical, telephone, and cable to the site.
providing a 5-foot wide sidewalk along the south edge of the roadway;
constructing three single-family residences and the associated utility instillation;
constructing a drainage swale and detention pond along the perimeter of the of
the site; and
grading and re-vegetating the site.
The proposed development will disturb approximately 1.25 acres of the 2-acre site. The reader
is referred to Attachment B for a site plan showing the proposed work.
As required by the city, stormwater will be managed in conformance with MA DEP's Stormwater
Management Guidelines. Post-development runoff will be dampened by the means of a
detention pond. Roof runoff will be recharged and managed through the use of six 500-gallon
' dry wells (2 per building). The complete Stormwater Management Form (W PA Appendix B) is
provided in Attachment D.
' All disturbed areas will be re-seeded, re-vegetated, or restored. Significant soil and aggregate
stockpiles are generally not expected to be needed. Should equipment logistics require
temporary stockpile creation, the stockpile will be protected from erosion for as long as it
exists. Erosion control measures are specified in Attachment E.
' 4.0 Mitigation of Potential Adverse Impacts
' Proposed mitigation measures include construction mitigation, stormwater management plan,
and best management practices are described below. These elements will minimize the
potential of impacting the adjacent wetland resource areas.
' 4.1 Construction Mitigation
Short-term impacts to the resource areas may occur during construction activities. To minimize
' these impacts, several construction mitigation steps are proposed as described below.
Prior to work commencing on the site, there will be a preconstruction conference with the
' contractor. The purpose of this meeting will be to coordinate the best methods for erosion and
sedimentation control, protection of adjacent wetland resource areas, and other construction-
related issued. The implementation of a comprehensive soil and erosion control plan will occur
' prior to any project construction activities within the project area. Attachment E provides the
construction specifications for the erosion control work. In general, the following sequence of
events will occur.
' Erosion and sedimentation control devices will be installed along the edge of

Erosion and sedimentation control devices will be inspected daily during periods
1 of active construction and bi-weekly during the remainder of the construction
period. Sediments will be removed from the barriers as soon as they reach a
depth of 6 inches.
1 Runoff from the site will be directed through sedimentation control barriers.
1 All brush will be chipped, removed from the site, and disposed of in accordance
with applicable local, state and federal requirements.
1 During construction, disturbed areas will be kept to a minimum and vegetative
stabilization of these areas will occur as soon as possible.
Temporary seeding, mulching, or other suitable stabilization measures will be
1 used to protect exposed critical areas should unprotected soils remain exposed
for prolonged periods.
1 Construction activities shall be monitored on-site by the construction supervisor to ensure that
the soil erosion and sediment control features are installed properly and maintained and to
evaluate the need for additional erosion control and/or stabilization measures. The inspector
1 will perform the following tasks:

Evaluate the need for additional soil erosion and sediment control features.
1 Scheduled inspections of erosion control features, including construction
entrance, haybales, check dams, and dust control.
1 Supervise and monitor temporary and permanent stabilization activities.
4.2 Stormwater Management
1 The proposed drainage design includes a detention basin designed for the 2-, 10-, 25-and
100-year storm events. The detention basin provides water quality treatment by allowing the
settling of particulates and associated pollutants. Riprap located at the pond inlets will reduce
1 stormwater velocity and promote efficient settling of suspended solids. The multi-stage outlet
design used in the basin will extend detention times to allow for water quantity and quality
control. The outlet is located to maximize flow lengths and minimize potential short-circuiting of
1 flows. In addition to sediment trapping, the detention basin will attenuate and transform
excessive nutrients/toxicants originating from the impervious surfaces of the proposed project.
II ' Attachment D, MA DEP Stormwater Management Form, provides details on the hydrologic
analyses and stormwater treatment based on the MA DEP Stormwater Management Standards.
Based on this analysis the post-development run-off rates from the site are the same, or lower,
' than the pre-development runoff rates for storm frequencies of 2, 10, 25, and 100 years.

4.3 Best Management Practices
' The following Best Management Practices (BMPs)will be implemented to protect the
environmental surroundings of the site.
• Catchbasins at the site will be equipped with hooded outlets and deep sumps to trap
debris, sediment, and to separate oil. The catchbasins will be inspected at least twice
per year and cleaned as needed to remove trapped sediment and litter.
' Once constructed, the detention basins and pretreatment structures will be inspected
after several storm events to confirm drainage system functions, bank stability, and
' vegetation growth.
The detention basin and drainage structures will be inspected initially on a quarterly
' basis for the first year, and at least once per year thereafter, to ensure that they are
operating as designed. The outlet structure will be inspected for evidence of clogging or
too rapid an outflow release. Potential problem areas that will also be inspected include:
subsidence, erosion, sediment accumulation around the outlet, adequacy of the
inlettoutlet erosion control measures, and erosion within the basin and banks.
• At least twice during the growing season, side slopes and embankment will be mowed,
and accumulated trash and debris will be removed.
Sediment will be removed from the detention basin as necessary, and at least once
' every 10 years.
• The streets will be swept at appropriate intervals to remove debris and road sand
' applied during the winter months.
' 5.0 Conclusions
' The proposed development has been designed to avoid work in the wetland resource area
associated with the project area to the maximum extent possible. The work proposed within
Buffer Zone to the BVW fully complies with the required performance standards of the WPA,
' and meets the performance standards of the Salem Wetland Protection Ordinance. The
proposed project includes comprehensive construction mitigation, stormwater management
plan, and best management practice. These mitigation measures will ensure that the interests
' of the Massachusetts Wetlands Protection Act and the Salem Wetlands Protection Ordinance
are protected and performance standards are met.

1 The following is a summary.of wetland investigations conducted on an approximately 4-acre
parcel on Cedar Crest Avenue in Salem.Massachusetts..The purpose of these investigations was
to determine the location and extent of wetland resources subject to the Massachusetts Wetlands
1 Protection Act (MGL Ch. 13.1 S. 40pand the City of Salem Wetlands Ordinance within and
adjacent.to the project site.
1 A site inspection was conducted on September 20, 2001. At that time, a numbered sequence of
flags (A 1-A33) was tied in the field to delineate the boundaries of Inland Bank and Bordering
Vegetated Wetland in accordance with the procedures established within the Massachusetts
1 Wetlands Protection Act Regulations (310 CMR i10.00)and the Department of Environmental
Protection, Delineating Bordering Vegetated Wetlands handbook(March, 1995). The following
wetland resources are present:
1 Inland Bank
The project site contains an intermittent stream that flows in a northwesterly direction
along and just outside of the southern property boundary. While there is a well-defined .
channel,there was no flow at the time of observation. This stream is not indicated on the
US Geologic Survey Lynn Quadrangle, and is therefore presumed under 310 CMR 10.58
1 not to contain perennial flow and therefore not subject to the riverfront regulations.
Bordering Vegetated Weiland
1 A wooded swamp,determined to qualify as Bordering Vegetated Wetland(BVW)subject
to 310 CMR 10.55, borders the stream described above. The wetland was well defined
by topography and hydrophytic vegetation as well as hydric(wetland) soils. It extends
1 along the southern portion of the property as well as along the western boundary. The
dominant plant species in the wetland include red maple(Acer rubrum)in the

overstory, and sweet popperbush(Clethro olnifnlia), northern arrow-wood (Viburnum
recognitum),jewelweed (Impatiens capenris), poison ivy (Tozicodendron radicans), and
cinnamon fern (Osmunda cinnamomea) in the understory. Dominant plant species in the
upland include American beech(Fagus grandifolia) in the overstory, and black cherry
' (Prunus serotina), multiflora rose(Rosa mrdti%lord), and Asiatic bittersweet(Celastnis
orbiculate) in the understory.
Other Resources
' There are no certified vernal pools. estimated habitat of rare wetlands wildlife, or priority
habitats of rue species within the project area, as determined by reference to the
Massachusetts Natural Heritage and Endangered Species Program,Natural Heritage Atlas
(2000-2001 edition).
' Any work or activity proposed within 100 feet of inland Bank or Bordering Vegetated Wetland
will require authorization from the Salem Conservation Commission.

Erosion Control, Sedimentation and
' Containment of Construction Materials
Part 1 - General
' 1.1 Provide all work and undertake all measures necessary to control soil erosion
from the work site throughout the Construction Phase and continuing until
' removal of siltation controls are authorized by the Engineer or Local Authority.
This work shall be continuous throughout the project, regardless of the
construction schedule undertaken by the Contractor. The contractor must ensure
' that controls perform as specified even when he is not present at the work site.
1.2 Prevent soil and construction materials from the work area from reaching
' wetlands or waterways at all times.
1.3 Install and maintain erosion controls as shown on the drawings and as specified.
' Should additional controls or measures be necessary to control erosion, as
determined by the Owner or Engineer, then provide and maintain same.
' 1.4 Controls installed and maintained must prevent movement of soil and
construction materials from the work areas at all times. Controls must be capable
of performing adequately during normal and severe storm events.
1.5 Controls are to be installed prior to disturbing earth or vegetation at the project.
1.6 Compliance with all requirements of the Order of Conditions issued by the Local
Authority is the responsibility of the Contractor, with the following exceptions:
' Filing of the Order on the property deed.
Requirements for actions at the property after the authorized removal of erosion
controls.
' Part 2 - Quality Assurance
2.1 All erosion controls to be constructed of new materials approved by the Engineer
and consistent with these specifications. Replace inadequate or worn controls
with new materials.
' 2.2 Inspect and maintain as necessary erosion controls within 24 hours following
every storm event.
2.3 Disturbance of soils or vegetation and construction activities of any type beyond
the limits of work shown on the drawings are prohibited. Do not disturb adjacent
' vegetation.
' 2.4 The Contractor is solely responsible, at no additional cost to Owner, for repairs,
replanting, remediation, or reconstruction or other any actions ordered by the

' Local Authority resulting from non-compliance with these requirements. Non-
compliance includes, but is not limited to, failure to prevent soil and construction
' materials from reaching a wetlands or waterbody.
2.5 The Contractor is required to keep on-site, throughout the project, 12 additional
' haybales and 50 feet additional silt fence. These additional erosion control
materials are to be available for use solely at the project site and are to be
installed immediately upon direction of the Engineer or the Local Authority.
2.6 Follow preventative erosion control practices established by the United States Soil
Conservation Service.
' 2.7 Do not allow litter or construction materials to blow from the work area and enter
wetlands. Immediately remove by hand any such materials entering wetlands.
Part 3 - Submittals
' 3.1 Two weeks prior to disturbing soil at the project site, submit to Engineer for review
and approval, catalog cuts showing the proposed materials to be used during
construction.
Part 4 - Materials
' 4.1 Haybales shall be made of straw or hay, tightly bound with string, and measure
approximately 18" x 18"' x 3' or larger.
4.2 Silt Fence - shall be made of a woven geotextile with a metal reinforcing mesh
fully integrated during the manufacturing process into the geotextile.
4.3 Stakes - Stakes for securing haybales and silt fence shall be made of oak, and
shall have nominal dimensions of 2" x 2" x 4'. Metal fence posts for silt fence
acceptable.
I ' Part 5 - Dewatering Discharges
' 5.1 Water discharged from the construction area must be completely free of
petroleum products.
' 5.2 The maximum rate of pumping, without special approval of the Engineer, shall be
150 gallons per minute.
t 5.3 Dewatering waters shall pass through a silt removal chamber having an overflow
rate less than 3,500 gallons per square foot per day and a depth of at least three
feet, and then be filtered through haybales prior to being allowed to flow to a
1 wetlands or waterbody. Effluent shall have turbidity less than 10 NTU.

Dear Mr. Griffin,
Thank you for contacting the Natural Heritage and Endangered Species Program ("NHESP") of the MA
Division of Fisheries & Wildlife for information regarding state-protected rare species in the vicinity of
the above referenced site. We have reviewed the site and would like to offer the following comments.
This project site is located near, and possibly within Priority Habitat 420(PH 420) and Estimated
Habitat 6015(WH 6015) as indicated in the 11°i Edition of the Massachusetts Natural Heritage Atlas.
Our database indicates that the following state-listed rare species have been found in the vicinity of the
site:

Botaurus lentiginosus American Bittern Bird Endangered
Jxobrychus exilis Least Bittern Bird Endangered
These species are protected under the Massachusetts Endangered Species Act(MESA) (M.G.L. c. 131 A)
and its implementing regulations(321 CMR 10.00). State-listed wildlife are also protected under the
state's Wetlands Protection Act(`x1PA)(M.G.L. a. 131, s. 40)and its implementing regulations (310
CMR 10.37 and 10.59). Fact sheets for these species can be found on our website http://www.nhesp.ora.
At this time we do not have any rare species concerns with the work proposed in the vicinity of this site.
This evaluation is based on the most recent information available in the NHESP database, which is
constantly being expanded and updated through ongoing research and inventory. Should your site plans
change, or new rare species information become available, this evaluation may be reconsidered.
Please note that this determination addresses only the matter of rare wildlife habitat and does not pertain
to other wildlife habitat issues that may be pertinent to the proposed project.
