Dear Attorney Keenan:
Please be advised that I have been contacted by abutting neighbors of the above-
captioned property. These neighbors are concerned about a fence that has been erected
across what appears to be at the end of Ocean Avenue, thereby blocking the MBTA's
access to the railroad tracks at this location. I contacted the Building Inspector regarding
same, and it is his opinion that this fence is erected properly on the property of 8-10
Broadway and is thereby allowed. I communicated this to the neighbors, however, doubt
remains as to the legality of the fence.
Therefore, would you kindly research and issue your opinion as to the legality of
the fence being erected in this location.
Your assistance in this regard is greatly appreciated. Should you require any
further information, please do not hesitate to contact me.

Decision
Petition of Patricia LeBrun requesting a Special Permit
for the property at 8-10 Broadway
City of Salem Zoning Board of Appeals
A public hearing on the above petition was opened on October 18, 2006 pursuant to
Massachusetts General Law Ch.40A, Sec. 11. The following Zoning Board members
were present: Nina Cohen, Steven Pinto, Richard Dionne, Elizabeth Debski and Robin
Stein.
The petitioner, Patricia L.eBrun, sought a special permit to allow a pet grooming business
for the property located at 8-10 Broadway, Salem, in the Industrial (1)zoning district.
The Board of Appeals, after careful consideration of the evidence presented at the public
hearing, and after thorough review of the Petition submitted, makes the following
findings of fact:
I. The property at 8-10 Broadway is within the Industrial zoning district.
2. The propose business will be a pet grooming business with hours of operation
primarily from 8:30 am until 5 pm,Tuesday through Saturday.
3. Ward Three City Councilor Jean Pelletienspoke in favor of the petition, and
spoke on behalf of Ward Five Councilor Matthew Veno, who is also in favor
of the petition.
On the basis of the above findings of fact, including all evidence presented at the public `
hearing, including, but not limited to, the Petition the Zoning Board of Appeals concludes
as follows:
1. The petitioner's request for a Special Permit does not constitute a substantial
detriment to the public good.
2. The requested Special Permit does not nullify or substantially derogate from
the intent or purpose of the zoning ordinance.
3. A literal enforcement of the zoning ordinance would create a substantial
hardship to the petitioner.

4. In permitting such change, the Board of Appeals requires certain appropriate
conditions and safeguards as noted below.
In consideration of the above, the Salem Board of Appeals voted, five (5) in favor
(Cohen, Pinto, Dionne, Debski, Stein) and none (0) opposed, to grant the request for a
Special Permit, subject to the following terms, conditions, and safeguards:
1. Petitioner shall comply with all city and state statutes, ordinances, codes and
regulations.
2. All requirements of the Salem Fire Department relative to smoke and fire
safety shall be strictly adhered to.
3. Petitioner shall obtain a building permit prior to beginning any construction.
4. A Certificate of Occupancy is to be obtained.
5. A Certificate of Inspection is to be obtained.
6. Petitioner is to obtain approval from any City Board or Commission having
jurisdiction including, but not limited to, the Planning Board.
