HALEY October 21, 1969 Mr. Daniel J. O' Brien, Building Inspector City of Salem City Hall Salem, Massachusetts 01970 Dear Mr. O' Brien: Re: 59 Broad Street, Salem, Massachusetts Enclosed are photostatic copies of the real estate notes kept by Bruce Jordan for his property at 59 Broad Street, Salem, Massachusetts from the time that he acquired ownership of the premises, June 1, 1966 through December of 1966. These notes indicate that Robert Ellison paid $25 .00 a month for the use of the garage. You already have received the signed statement of Paul A. LaPointe, in which he certifies that from at least February of 1965 to the time he sold it to Jordan on June 1, 1966 the garage was then rented by Ellison. You also have seen the rent receipts books and record books for 1967 and 1968, so that there certainly is no question now as to Mr. Jordan having abandoned the use always made of the garage. After you confer again with the particular city councilor involved in this situation and the parties who are complaining, we would appreciate from you a letter indicating the final disposition of this matter by the Office of the Building Inspector. Thank you very much for your cooperation. Yours very truly, HILL & BLAKE e By: J dhh/ms ' ; September 29, 1969 i TO: Mr. Daniel J. O'Brien,. Building Inspector City of Salem City Hall Salem, Massachusetts I, Paul A. LaPointe, of 23 Stone Place, Lynn, Massachusetts, hereby certify and state that I formerly owned property in Salem at 59 Broad Street, a three family dwelling with a separate garage, and that while I owned this property from at least February of 1965 to the time that I sold it on June 1, 1966 to Bruce Jordan, I rented the garage at that address to Robert Ellison, who used this space for the storage of his and another "racer" . The work that was done on these racers was of the mechanical type and to my knowledge the engines of these vehicles were never started in my garage . This statement was prepared for me by Attorney Douglas H. Haley of 70 Washington Street on behalf of Bruce Jordan . I have read it completely and certify that to the best of my knowledge and belief all the facts contained therein are true . Paul A. O'Brien, Jr. , Building Inspector e y . of Salem City Hall Salem, Massachusetts 01970 Dear Mr. O' Brien; . Re: 59 Broad Street Salem We have made an extensive investigation of the facts concerning the use of the garage at 59 Broad Street, Salem, owned by Bruce Jordan of 25 Chester Street, Danvers, and have the following informa- tion for you. In February of 1965 Robert Ellison, now of 12 Elm Street, Peabody, rented garage space at 59 Broad Street from Paul A. LaPointe for . storage of his and another "racer" automobile. Some work was done on these two motor vehicles as will be described later. in June of 1966 Bruce I . Jordan and his wife, Sandra, purchased the real estate; Ellison continued his use of the garage and rented from the Jordans. Ellison left in January of 1968 and a friend of his, Robert Kondon, of 183 Winona Street, West Peabody, also a "racer" owner took over the rental of the garage. There was no break in the monthly rental pay- ments., Kondon' s use of the garage for two racers was the same as Ellison ' s and continues to the present. The "racers" stored in the garage at present are valuable and unique motor vehiclest. Their engines cannot be started except by "jumping" the vehicle, which usually requires a one-half mile run. They are carried on a trailer to whatever track they are going to run on and when returned to the garage their engines are cleaned and rebuilt. Because the above described use of the, garage at 59 Broad Street has cctinued from at least February, of 1965 it is our belief that it is nonconforming in nature and must, by the terms of the City' s Zoning Ordinance adopted in August of 1965, be allowed to continue in the same form. we would appreciate hearing from your office when your investiga- tion has been completed.
