Dear Mr. Santo:
Please be advised that I have examined various
documentation relative to the use of the above described
premises as a two-family dwelling. I have examined numerous
Affidavits from abutters, a letter from the City Assessors'
Office, Census Documentation and a history of the premises
from a Mrs. Ernest L. Daly.
Based on my review of the documentation, it is my
opinion that this dwelling was a lawful two-family residence
prior to the adoption of the City's Zoning Ordinance in 1965.
It is my opinion that this dwelling should be afforded the
protection of Section VIII (E) of the aforementioned ordinance
relative to non-conforming uses and this dwelling's current
use as a two-family unit is permissible.
The owner of 37 Broad Street whose name appears to be
Daly is unknown to me and of no relation whatsoever.

TO WHOM IT MAY CONCERN
The house at 37 Broad Street was built in 1927 by Charles Johnston as
a two family house with separate front and rear doors and separate
utilities. In 1929 he sold it to Eugenio Ansaloni who purchased it for
Luigi Diozzi as both families were being displaced by the coming of the
new Post Office . The Ansaloni family moved into the first floor and
the Diozzi family moved into the second floor. Mrs. Ansaloni was a
daughter of Luigi Diozzi. Some of the unmarried Diozzi Daughters lived
elsewhere with the exception of Marina and Clarice who always stayed at
home with their parents. As the Ansaloni children grew up they moved to
wherever life took them. Eventually the Elder Diozzi' s passed away
and by the mid 1960 ' s the Ansaloni had passed away also . Rachele Diozzi
who had lived elsewhere returned to Salem and moved into the first floor .
Upon her death another daughter Mrs. Catherine Diozzi Mulkern moved on
the first floor with Marina and Clarice on the second floor. Eventually
Marina and Clarice passed away and Malvina Diozzi returned to her
fathers house . Upon the death of Mrs Mulkern, Malvina Diozzi then moved
to the first floor and Mr and Mrs Ernest Daly moved into the second
floor to take care of her aunt who was then in her late eighty' s. Mrs.
Daly is an Ansaloni who grew up on the first floor. Several months ago
the last Diozzi member , Malvina, passed away.
Even though it was always a blood relative who lived in both apartments
it is obvious the house is a two family dwelling. The house has always
been kept as a 2 Family house . There are 2 front doors , 2 back doors ,
2 electric meters, 2 gas meters , 2 rear porches , 2 sets of cellar steps
The only way to get from one floor to the other is by going outside
by the front from one door to the other or by the outside through one
back door to the other.
The house has always been assesed and taxes paid for a two family house ,
from away back to 1929. It has always been maintained as a two dwelling
unit. Enclosed are 3 notarized statements attesting to neighbors knowing
this house as a two family home.
It is my urgent request that you come and inspect the property at
37 Broad Street. I am sure that there could be no doubt that this
is definitely a two family house . You may call 745-5493 to inspect.
Enclosed also is my check to the City of Salem for $30 .00.

The current exemption of"Homeownem"was extended to includeowner-occupied
dwellings of two Units or less and to allow such homeowners to engage an individual for
hire who does not possess a license,provided that the ownef acts as supervisor.

DEFINITION OF HOMEOWNER.
Person(s)who owns a parcel of land on which he/she resides or intends to reside, on
which there is, or is intended to be, a one or two family dwelling, attached or detached
structures accessory to such use and/or farm structures. A person who constructs more
than one home in a two year period shall not be considered a homeowner. Such
"homeowner"shall submit to the Building Official,on a form acceptable to the Building
Official, that he/she be responsible for all such work performed under the Building
Permit.
The undersigned "homeowner"assumes responsibility for compliance with the State
Building Code and other applicable by and regulations.
The undersigned"homeowner"certifies that he/she understands the City of Salem
Building Department minimum inspection procedures and requirements and that he/she
will comply with said procedures and requirements.
