Owners of the 28-281 /2 Broad Street, Salem, Mass. Condominium (the "Condominium") created by
Master Deed dated October 1, 1999, and recorded with Essex South District Registry of Deeds, Book
15975,Page 126, as amended by Amendment of Master Deed dated July 23,2001 and recorded with
said Registry of Deeds at Book 17452, Page 1 (as amended, the "Master Deed"). Terms defined in or
by reference in said Master Deed shall have the same meanings herein as therein unless expressly
otherwise defined in this Amendment.
RECITALS
The undersigned Unit Owners represent all of the Unit owners in the Condominium and hold one
hundred (100%)percent of the Proportionate Interests under the Master Deed.
The owners desire to amend the square foot areas of Unit A-2 and Unit B.
The owners desire to eliminate the current right of the owner of Unit A-I to use the
washer/dryer hook ups in the basement of the Condominium.
The owners desire to re-designate certain areas from Unit B to Unit A2(specifically the
attic area as shown on Plan recorded in Plan Book 352 Plan 87.
The unit owners wish to correctly designate the percentage of ownership interests in the
Condominium.
6. Pursuant to Section 10 thereof,the Master Deed may be amended by an instrument in writing.
signed by the Unit Owners entitled to sixty-six and two-thirds(66.66%) percent or more of the
undivided interests in the Condominium, signed and acknowledged by a majority of the Trustees of
the Condominium Trust, and duly recorded with the Essex South District Registry of Deeds.
NOW TBEREFORE, in consideration of the mutual promises and covenants contained herein, the
undersigned hereby amend the Master Deed as follows:
A. The following language comprising the fourth sentence of the second paragraph of Section 4
entitled DESIGNATION OF CONDOMINIUM UNITS on page two of the AMENDED AND
RESTATED MASTER DEED shall be deleted:
Unit A-2 consists of approximately 792 square feet on the second floor, 758 square feet on the
third floor, and 196 square feet together with a 63 square foot loft in the attic,as well as
approximately 580 square feet of the basement."
And the following substituted in place thereof:
"Unit A-2 consists of approximately 27 square feet on the first floor, 792 square feet on the
second floor, 758 square feet on the third floor,and 196 square feet together with a 63 square foot
loft in the attic,an additional 283 feet of attic space noted as Unit B on Plan recorded in Plan
Book 352 Plan 87, as well as approximately 580 square feet of the basement."
B.)The following language comprising the fifth sentence of the second paragraph of Section 4
entitled DESIGNATION OF CONDOMINIUM UNITS on page two of the AMENDED AND
RESTATED MASTER DEED shall be deleted:
"Unit A-2 has approximately 580 square feet of basement, a living room, dining room, kitchen,half
bath, hall, office or walk in closet or vestibule on the second floor,three bedrooms and one full bath
on the third floor,and 259 square feet of area in the attic/loft space."
And the following substituted in place thereof.
"Unit A-2 has approximately 580 square feet of basement, hallways and stairways on the first
floor a living room, dining room,kitchen,half bath, hall, office or walk in closet or vestibule on
the second floor,three bedrooms and one full bath on the third floor, and 542 square feet of area
in the attic/loft space."
C.)The following language comprising the second sentence of the second paragraph of Section 4
entitled DESIGNATION OF CONDOMINIUM UNITS on page two of the AMENDED AND
RESTATED MASTER DEED shall be deleted:
"Unit B. extends from the basement through the first, second and third floors,through and including
the attic."
And the following substituted in place thereof.
"Unit B. extends from the basement through the first, second and third floors.
D.)The following language comprising the sixth sentence of the second paragraph of Section 4
entitled DESIGNATION OF CONDOMINIUM UNITS on page two of the AMENDED AND
RESTATED MASTER DEED shall be deleted:

DECISION ON THE PETITION OF PETER CONWAY FOR A SPECIAL PERMIT TO CONVERT
28 - 28-1/2 BROAD STREET INTO THREE CONDOMINIUM UNITS
A hearing on this Petition was held on September 9, 1981 with the
following Board Members present: Mr. Douglas Hopper, Chairman; and Messrs.
Hacker, Piemonte, LaBreque, and Feeherry. Notices of the hearing were sent
to abutters and others and notices of the hearing were properlypublished in
the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A.
The Petitioner has requested a Special Permit to convert the existing three-
family dwelling at this property into three condominium units. '
This proposed condominium conversion is coverdd by the terms of the City
of Salem's condominium conversion ordinance. The Special Permit that has been -requested
may therefore be granted only upon a finding by the Board of Appeals that (1) the
grant of the Special Permit will not adversely impact upon the City's existing stock
of rental units for low and moderate income families and elderly people on fixed incomes,
(2), that the grant of the Special Permit is not contrary to the City's Master Plan,
and (3) the. grant of the Special Permit will not have an adverse effect on the
neighborhood.
The Board of Appeals, after considering the evidence at .the hearing, and after
viewing the property makes the following findings of fact:
1. The conversion of this. property into condominiums was not opposed by
any neighbors and was supported by the existing tenants at the property.
2. The proposed conversion of this property to three condominium units in no
way conflicts with the Master Plan of the City of Salem.
3. The conversion of the property into condominiums will have negligible impact
on the existing stock of rental units in the City of Salem for the elderly and for
'families of low and moderate income.
4. One of these three units is vacant and no hardship is caused by the
proposed condominium conversion to the current tenants in the other two units.
On the basis of the above findings of fact and on the evidence presented at the
public hearing, the Board of Appeals by a 4 to 1 vote (Mr. Piemonte voted present)
concluded that the proposed condominium conversion is in harmony with the condominium
conversion ordinance of the City of Salem. Accordingly, the Board voted in favor of
granting the requested Special Permit in accordance with the following terms and
conditions:

1. The three parking spaces at the property shall be maintained.
2. The requirements set forth in the Salem Fire Marshall's Septem-
ber 9, 1981 letter to this Board are hereby incorporated into this decision.
3. Because the dwelling unit designated as Unit No. 3 on the Plan
submitted to the Board was vacant at the time this petition was filed, the
Petitioner will not be required to allow six months to elapse before commencing
any work in furtherance of the condominium conversion on this unit. The
Petitioner may commence such work 20 days after the date of the filing of
this decision. This waiver applies only to Unit No. 3.
4. There shall be no structural changes in the exterior of the
building in connection with this condominium conversion.
