DECISION ON THE PETITION OF RICHARD L. POHL (Petitioner)
REQUESTING A VARIANCE FOR 10 BROAD STREET
A public hearing on this Petition was held on March 10, 1982 and thereafter the
matter was considered by this Board at a Special MeefQoon March 17, 1982. The
following Board Members were present: Douglas Hoppe JIT,Chairman, - easy. Hacker,
Piemonte and Feeherry, and Associate Member Luzinsli. Notice of th hearing was
sent to abutters and others and notices of the hearing were properly published 'in
the Salem Evening News in accordance with Massachusetts General Laws Chapter 40a..
The Petitioner has requested a variance to allow him to maintain an office
for the, practice of psychiatry in a portion of the property in question. The remainder
of the property will be used as a single rental dwelling unit. A variance is required
because the property is in an R-2 district where the proposed use is prohibited.
The Board of Appeal,, after consideration of the evidence presented at the public
hearing and after viewing the property makes the following findings of fact:
1) The property has for many years been used as a single-family dwelling.
2) There was both substantial oppo ;iti.on to the proposed use from certain
persons in the neighborhood.as well as support ,from others.
3) The proposed use would be the first commercial use of this kind
on this street which has o strong residential character.
4) The proposed use may have a negative impact on pre-existing parking and
traffic problems in the area.
On the basis of the move findings of fact, and other evidence presented at the
public 'r.earig, the Board of Appeal conciudes as follows:
A. The Petitioner failed to establish circumstances relating to the land or
structure which affect that property but do not generally affect the coning district
in which the property is located. The property is an attractive single-family
dwelling and can be sold as such, the neighborhood is a residential one.
B. The Petitioner failed to establish that a literal enforcement of the provi-
sions of the Salem Zoning Ordinance as applied to this property would involve substan-
tial hardship to the Petitioner. There is a substantial amount of vacant professional
office space in the City.
C. The Petitioner failed to establish that the requested variance could be
granted without substantial detriment to the public good and without nullifying or
substantially derogating from the intent and purposes of the Salem Ordinance.

Therefore, the Board of Zoning Appeal denied a variance to the Petitioner.
The vote was as follows: Messrs. Hopper, Hacker and Luzinski voted in opposition
to the variance. Mr. Piemonte voted in favor of the grant of a variance
and filed a detailed statement of reasons for his vote with the Board. Mr.
Feeher.ry voted "present,"

i-:y analysis in favor of. the motion to provide a variance at 10 Broad Street,
Salem, is based on the following points.
First, there is a hardship associated ir;_th the continued use of this build-
i;;-- as a single residential d:-relli;ig by virtue of its size; eleven rooms and
armee levels.
Second, there is also a limited lot size that could, with use change, create
paz_:ing problems.
^,lthough it ray be possible:. to retain the single duelling character at 10
Broad Street, this could entail an economic hardship; the expense of maintenance
and in energy costs The economic hardship is further aggravated because of the
age of the strnctrre.
'conomic necessity would suggest a conversion to apart...ent complexes. To
allow this is to create those very parking problemsthat. should be avoided as well
as to violate density problems.
This variance would more closely appro=mate the zoning requirements of this
historic district because the use outlined by the petitio_7'er would maintain the
res_dential atmosphere of the building. Its intended use is to maintain a home
environment that utilizes all levels of the huildirg thereby eliminating the threat
cf creating a cor,ercial atmosphere. Indeed, the commercial element would destroy
the very nature of the petitioners aspirations, and because .o£ the unique nature of
the socialservice provided, the potential difficulties attending the small lot
size are minimized; that is, the availability for par?-�Lng. Parking, as a probleri,
has been alleviated.
Cn another point, granting the variagce does not acd an additional burden to
retal stock, nor to. increased professional use in this residential zone by virtue of
eli?a nating the Esse.. Street office of the petitioner.
Given the condit-ions and reEtrictions that -;ould be imposed on the variance,
it would be virtually iLTossible to compromise the residential malities in this
area.
ConseT.tently, a successful rennovation and continued maintenance can be assumed
for this residence because of the earlier successful care that is identified 1-ith
the Essex Street property owned by the petititioner as--ell as the petitioners
financial stability.
To deny this variance could have a negative ia.tact and intensify a hardship on use.
Although irrelevant to reasons of hardship, the petitioner would provide a desirable
human service that this community mould be ill—advised to discourage.
