Furthermore, if only one recepptacle is re- gired , it need only be fed with one 20-Ampere Branch Circuit . There are other circuits installed in the kitchen area which are on other 20-Ampere Branch Circuits thus satisfying the requirements of Article 120-4b-2. III . The action of the sprinklers at the grade floor protection was explained in our letter of yesterday on the Bridge Street project and will be the same at Broad Street. Regarding your interpretation of dwelling unit separation, we find code references which we believe take precedence over a concept of the complete perimeter of the dwelling unit being "dwelling unit separation." 1. If the intent of item7, "Dwelling unit separations" in Table 214, was to include all partitions surrounding a dwelling unit the Code would state "dwelling unit enclosures,"as in item 4 ".....enclosure of exitways, exitway hallways and stairways." 2. If all four walls are part of a one hour separation then the exterior wall windows would require opening protectives. Section 914.1 however exempts use group R-2 from this requirement. 3. With respect to the corridors, enclosure is emphasised in Section 610.4, "Enclosures: All corridors serving as exitway access shall be enclosed in fire separation walls having a fire resistance of at least one (1) hour when serving an occupancy load greater than thirty (30)". By Note j in Table 214, access corridors serving less than thirty are exempted from a one hour rating. From these items the Code seems consistant in considering exterior walls for certain requirements and exemptions and similarily corridor walls for certain requirements and exemptions, and that dwelling unit separations are yet another element considered independently of the exterior enclosure or corridor enclosures. We note that Section 437.1 states "Open wells ...shall be permitted in all buildings other than use group H. 437.1.2 The open well spaces may be used for any approved use when the individual space is provided with an approved fire suppression system. 437.1.3.1 An atrium (open well) connecting not more than three levels may contain an exitway as permitted by 616.10. 616.10 ...may be permitted without enclosure or protection between such areas provided all conditions described below are met: 1. the lowest level ...is a street floor. 2. the entire area...is sufficiently open to be assumed that a fire...in any part will be immediately obvious.. 3. egress capacity is simultaneously sufficient for all occupants of all levels... 4. each floor level...has at least 1/2 of its required egress capacity provided by an exitway leading out of that area without being exposed to the spread of fire or smoke therefrom. 437.3.1 An appropriate draft stop shall be installed at each story of the floor opening. Automatic sprinklers shall be provided around the perimeter of the opening... The distance between sprinklers shall not exceed six feet center to center. Rolf Jensen & Associates (Consultant ) has been asked by The Architects Collaborative to do research and provide an opinion regarding code requirements for the installation of automatic sprinklers in either of the buildings . According to the Client , because the Elderly Housing Units will be funded by the State, special requirements are incorporated in the design. The State specifies it will not incorporate into the design anything that the Massachusetts State Code would not require. Therefore, only the requirements of the Massachusetts State Code will apply. PERTINENT INFORMATION The Architects Collaborative has supplied the following information to Rolf Jensen & Associates . This information is assumed to be correct in the findings stated in this report. 1 . The applicable code : Massachusetts State Building Code, 4th Edition 2 . Area of each of the buildings 3. Construction types of each of the buildings 4 . Occupancy type of each of the buildings : R-2 Rolf Jensen & Associates has not been asked to address any other design feature of the building except for the requirements of automatic sprinkler protection. Therefore, it is assumed that all other features of the building comply with - 11. State and Local requirements . The Salem Elderly Housing Units Page 2 - W5554 Automatic Sprinkler Requirements June 23, 1987 OLIVER SCHOOL - BUILDING 667-7A DESCRIPTION Building 667-7A is an existing building which is two-stories in height . The building will be renovated, however, it will remain two stories in height with an unoccupied basement . The total area will be 11, 322 square feet with the area of the largest floor being 3,774 square feet . The building will be Type 4B ( unprotected frame) construction. This building ' s occupancy qualified as congregate housing as specified in Section 424, The Massachusetts State Code . There will be a maximum of 16 residents within the building . CODE REQUIREMENTS Article 3, Table 305 of the Code specifies the maximum area and height of all buildings and structures, between exterior walls, as governed by the type of construction and the use-group classification . However, because this building is an existing building and is not increased in height or area, this Table does not apply. Therefore, automatic sprinklers are not required within the existing building to obtain increases in area or height requirements for the structure. However , the existing building of Type 4B construction would meet the requirements for construction type of a new building with an R-2 Occupancy Type. Section 424 of the Massachusetts State Code, Section on Group Residences, specifies the requirements for this building. Section 424 .2 . 1 allows existing buildings of Type 4B Construction to be converted to group residences regardless of height . This Section does require "fire warning systems" , but not automatic sprinklers. The final section pertaining to the conversion of an existing building is Article 22 of the Massachusetts State Building Code. The provisions of that Article apply to repair , Iteration and/or addition to : :icting buildings . The i)cen assumed : The Salem Elderly Housing Units Page 3 - W5554 Automatic Sprinkler Requirements June 23, 1987 2 . There are no outstanding notices of violation or other order of the building official which will not be corrected with the proposed work . The alteration of the Oliver School is classified in Article 22 as a changing of use group to a use-group of lesser hazard index number . This applies because the hazard index is reduced by changing from the current A-4 Occupancy ( hazard index = 4 ) to congregate housing (hazard index = 2 ) . Section 2203 of Article 22 contains the requirements for the change to a use-group of equal or lesser hazard. This Section does require the installation of fire alarm systems and several other emergency systems . However , it does not specifically require the installation of automatic sprinklers . Section 2203 . 2 of Article 22 states that requirements exceeding those required for new construction may be reduced or removed, in part or completely, if not required by this Code for new construction. Therefore, the partially sprinklered portions of the building may have the sprinklers removed provided they are not within storage and workshop areas of the building or within the cellar or basement . Storage and workshop areas or sprinklered cellars or basements are required to remain sprinklered if they are currently sprinklered, because these areas in new buildings are required to be sprinklered by Section 1202 . 12 and 1202 . 13 . However , individual storage or workshop areas located entirely within the dwelling unit are not required to remain sprinklered. BUILDING 667-7B DESCRIPTION Building 667-7B is three stories in height with an unoccupied basement . The total area of the building is 31, 245 square feet with an area of 7, 811 square feet per floor. The Salem Elderly Housing Units Page 4 - W5554 Automatic Sprinkler Requirements June 23, 1987 CODE REQUIREMENTS Table 305 of the Massachusetts State Code specifies the maximum area and height of all buildings and structures as governed by the type of construction and the use-group classification. For an R-2 Occupancy of Type 4A construction the height of the building is limited to three stories and 40 feet, and the area of the building is limited to 10,200 square feet per floor . Because the building is greater than one story in height, this area must be reduced by 20 percent . Therefore, the maximum area per floor for a three-story R-2 Occupancy of Type 4A Construction is 8, 160 square feet per floor . Because Building 667-7B is only 7, 811 square feet per floor and is not greater than three stories in height , automatic sprinklers are not required to obtain the allowable area and height increases due to automatic fire suppression installation. Article 12 of the Massachusetts State Building Code details the requirements for Fire Protection Systems . Section 1202 of this Article states where fire protection systems are required . No requirements are specified for complete automatic sprinkler installation of R-2 (Residential ) occupancies . However, requirements are stated for storage and workshop areas within these buildings which are not entirely located within a dwelling unit . Also, requirements are stated for the installation of automatic sprinklers in cellars or basements which exceed 2 ,500 square feet in area. CONCLUSION The Massachusetts State Building Code contains no requirements for the installation of automatic sprinklers throughout R-2 Occupancies. Certain areas within these structures may require the installation of automatic sprinklers, however , the entire structure is not required to be sprinklered by the Massachusetts State Building Code. Dee &, Assoc. ) Joe Carroll (TAC) I. 667-7A Oliver School Renovation After a presentation of the drawings, the following comments were made: 1. Mr. Turner stated that he was unsure if "Congregate Housing" should be classified under Section 424 - Group Residence or under Institutional I-2. He requested that Mr. Santry of the Building Department review the drawings and the code and advise the Fire Department as to which classification was appropriate. 2. Mr. Turner questioned the report prepared by Rolf Jensen & Associates (Code Consultants to TAC) with regard to the decrease in the hazard index. Mr. Turner stated that the most recent use of the building was for offices for the Recreation Department rather than as a school (assembly occupancy) as stated in the report. TAC to review this question and respond. 3. Mr. Turner asked why it was necessary to remove the existing sprinklers from the building. I responded due to the near complete gutting of the building required for this conversion, saving the sprinklers would be nearly impossible. Mr. Zisson also remarked that the existing system is probably beyond repair given its age and length of inactivity. 4. I reviewed for those present the position of the State regarding the sprinkler issue. The position simply stated is that EOCD has an agreement with the City of Salem to provide funds for the construction of elderly housing and in return for that funding the city has agreed to both waive permit fees and not require any construction which is above and beyond the State of Massachusetts Building Code. Salem Elderly Housing 3 December 1987 Page 2 5. Mr. Turner responded that first of all he felt permit fees could not be waived. He also stated that the primary responsibility of those involved in the project was to promote the safety of the occupants and that the cost of the sprinklers as a percentage of the overall construction cost was justified given the substantial improvements in safety that would be realized. A short discussion then took place regarding either a meeting with EOCD officials to discuss the issue or the possibility of proceeding with the bidding of the job and including the sprinklers as an add alternative to the bid. All parties present agreed to try to resolve the issue quickly in order to allow the project to move ahead into the bidding phase. 6. Mr. Dee reviewed the location of standpipes, heat and smoke detectors, the location of the siamese connection, type of heating system, removal of existing oil tanks, and connection of the fire alarm system into the city loop. Additional comments by the Building and/or Fire Departments will be made following the determination of building classification by Mr. Santry. 7. A short discussion was held concerning the interstitial space which will be approximately 2'-0" high between the existing ceilings and the new hung ceilings. These spaces are not currently shown having either sprinklers or smoke detectors. 8. The site plan was reviewed for clearances for fire fighting equipment. Although it appears that entrance drive off Broad Street is acceptable, there may be tight clearances in the rear due to the parking layout of 1 Broad Street. Mr. Turner to review and comment. Mr. Turner also stated that this building was not within the Central Fire District. 9. A complete set of drawings and a copy of the Rolf Jensen Code Review will be sent to both the Building and Fire Departments along with meeting notes. Salem Elderly Housing 3 December 1987 Page 3 II 667-7B - Bridge and Ash After a presentation of the drawings, the following comments were made: 1. Mr. Turner stated that this parcel was within the Central Fire District of the city. He said that he believed Type 4A construction was not permitted within the fire limits. We review Mass. State Building Code Section 302.2 and determined that Type 4A construction is permitted provided that the building is in compliance with Tables 214 and 305 and located in accordance with the requirements of Table 302. 2. Having determined that 4A construction was permitted on the site, it was agreed that sprinklers are not required for this building according to the Code. 3. Michael Dee reviewed the siamese connection location And the location of the standpipes with Mr. Turner. Mr. Turner stated that he would like both 2 1/2" and 1 1/2" valves on the standpipes but no hose need be provided. II 667-7B - Bridge and Ash (cont.) 4. Michael Dee reviewed the fire alarm risers including the location of the pull stations. The system will be wired into the city loop. Also reviewed were the type of heating system and the location of heat and smoke detectors. Because the existing drawings currently show sprinklers, the Fire Protection Drawings need to be revised to locate additional detectors. 5. A complete set of drawings will be forwarded to both the Building and Fire Departments for review along with the meeting notes. The anticipated occupancy of this building is comprised of elderly residents incapable of evacuation equivalent to the capability of the general population. 3. The building is of Type III Construction (Exterior Protected Combustible). 4. The use group for the proposal falls under Group I-2. (This use group shall include all buildings used for housing people suffering from physical limitations because of health or age, including among others day nurseries, hospitals, sanitariums, clinics, infirmaries, orphanages, and homes for the aged and infirm.) 5. The plans submitted for approval lack provision for a system of automatic sprinklers. 6. Site access: The proposed building cannot be accessed from all sides by fire department apparatus. Inadequate attention to site details can place this building in an unnecessarily vulnerable position. If the building's fire defenses are compromised by preventing adequate fire department access, the loss should be compensated by a more adequate system of internal building protection. It should be noted that this building was formerly used as a school and is currently protected by a complete system of automatic sprinklers. The proposed use represents a change in existing use as defined by the Massachusetts State Building Code Section 105.0 and shall comply with the provisions of Article 22 of the Code. Adequate life safety design for a building is often related only to compliance with the minimum requirements of local building regulations. This may or may not provide sufficient occupant protection, depending upon the particular building function and occupant activities. Conscious incorporation of fire safety into buildings is too frequently given minimal attention by the designer, and building designers are content, as are their clients, to meet the minimum safety standards of the building code. It is often incorrectly assumed that the codes provide completely adequate measures rather than the minimum. The approach to building design requires a familiarity with the reaction of people in fire emergencies. These reactions can differ widely depending upon the physical and mental capabilities and conditions of building occupants. Sufficient means of egress cannot provide adequate protection in occupancies where occupants are confined or are physically or mentally unable to escape without effective and immediate assistance. If the economic cost of fire safety is judged to be prohibitive, the occupancy or the structure should be changed or prohibited because there is no justification for subjecting building occupants to an unreasonable level of peril from a fire. It is my professional opinion that the building design as presented fails to provide the necessary level of protection to the occupants and represents a step backwards in providing safe, quality housing for the elderly in Salem. The plans submitted for approval lack provision for a system of automatic sprinklers. 6. Site access: The proposed building cannot be accessed from all sides by fire department apparatus. Inadequate attention to site details can place this building in an unnecessarily vulnerable position. If the building's fire defenses are compromised by preventing adequate fire department access, the loss should be compensated by a more adequate system of internal building protection. • ,r aJ . It should be noted that this building was formerly used as a school and is currently protected by a complete system of automatic sprinklers. The proposed use represents a change in existing use as defined by the Massachusetts State Building Code Section 105.0 and shall comply with the provisions of Article 22 of the Code. Adequate life safety design for a building is often related only to compliance with the minimum requirements of local building regulations. This may or may not provide sufficient occupant protection, depending upon the particular building function and occupant :.activities. Conscious incorporation of fire safety into buildings is too frequently given minimal attention by the designer, and building designers are content, as are their clients, to meet the minimum safety standards of the building code. It is often incorrectly assumed that the codes provide completely adequate measures rather than the minimum. The approach to building design requires a familiarity with the reaction of people in fire emergencies. These reactions can differ widely depending upon the physical and mental capabilities and conditions of building occupants. Sufficient means of egress cannot provide adequate protection in occupancies where occupants are confined or are physically or mentally unable to escape without effecLive and immediate assistance. If the economic cost of fire safety is judged to be prohibitive, the occupancy or the structure should be changed or prohibited because there is no justification for subjecting building occupants to an unreasonable level of peril from a fire. It is my professional opinion that the building design as presented fails to provide the necessary level of protection to the occupants and represents a step backwards in providing safe, quality housing for the elderly in Salem. The system included sprinklers in the basement, and at each occupied floor (including sprinkler heads in the interstitial spaces between existing ceilings and new hung ceilings.) In addition, a dry sprinkler system was designed for the attic spaces. A copy of the estimate is attached. 2. We have requested our mechanical engineer to survey the existing sprinkler system to determine its suitability for reuse/alteration. This survey will be conducted on Tuesday, March 15. Based upon that survey, we will estimate the cost of system alteration and review alternatives for partial sprinkler coverage. 3. We have notified the apparent low-bidder for the project, Rene C. Lamarre Co., Inc., that no award of contract will occur until this matter is resolved. In addition, we have reviewed your letter to Mr. Munroe and would like to make the following comments: 1. Reference Item 6 - Site Access: Please note the attached drawing. In the early stages of feasibility study for this project, we had proposed schemes which would have increased the site access over what is now available. As you can see from the attached drawing, we proposed 12 parking spaces for 1 Broad Street and objected to the 18 spaces approved by the City during public hearings. At this point•in time, the lawyer for the Salem Housing Authority, Mr. William Lundregan, is prepared to go to the appropriate City agency and request that we increase the access easement within our property lines. However, in real terms only a removal of a number of previously approved parking spaces would enhance site access. 2. Reference Item 4: We have received from E.O.C.D. a copy of the proposed change to the State Building Code and have discussed the proposed change with Mr. Steve Demos, Chief Architect for that agency. Please reference the proposed Code Revision attached. As you can see from the cover sheet, the proposal to add a definition of Congregate Dwelling Unit was made by E.O.C.D. The wording contained on the second page is not the original wording proposed by E.O.C.D. but rather wording resulting from negotiations between E.O.C.D. and the State Building Code Commission. According to E.O.C.D. , the wording in the first paragraph relating to no more than six not necessarily related persons, is not for the building as a whole but for each individual Dwelling Unit as the definition is titled. This paragraph was inserted because of other restrictions governing the number of unrelated people who can live together. The final paragraph clarifies the Congregate Dwelling Units (plural) "shall be considered as Multi-Family Dwellings (R-2) not be considered boarding, lodging, dormitory, hotel, motel or institutional use." We shall contact Mr. David McCartney at the State Building Code Commission to verify that this is the proper reading of the definition. In summary, it is this offices' intention to fully comply with all provisions of the State Building Code and even exceed those standards if another source of funding can be found to provide the level of safety you feel is necessary. To that end, we will move quickly to determine the condition of the existing sprinkler system and produce documentation and an estimate for its potential reuse/alteration. If the building's fire defenses are compromised by preventing adequate fire department access, the loss should be compensated by a more adequate system of internal building protection. It should be noted that this building was formerly used as a school and is currently protected by a complete system of automatic sprinklers. The proposed use represents a change in existing use as defined by the Massachusetts State Building Code Section 105.0 and shall comply with the provisions of Article 22 of the Code. Adequate life safety design for a building is often related only to compliance with the minimum requirements of local building regulations. This may or may not provide sufficient occupant protection, depending upon the particular building function acid occupant activities. Conscious incorporation of fire safety into building's is too frequently given minimal attention by the designer, and building designers are., content, as are their clients, to meet the minimum safety standards of the building code. It is often incorrectly assumed that the codes provide completely adequate measures rather than the minimum. The approach to building design requires a familiarity with the reaction of people in fire emergencies. These reactions can differ widely depending upon the physical and mental capabilities and conditions of building occupants. Sufficient means of egress cannot provide adequate protection in occupancies where occupants are confined or are physically or mentally unable to escape without effective and immediate assistance. If the economic cost of fire safety is judged to be prohibitive, the occupancy or the structure should be changed or prohibited because there is no justification for subjecting building occupants to an unreasonable level of peril from a fire. It is my professional opinion that the building design as presented fails to provide the necessary level of protection to the occupants and represents a step backwards in providing safe, quality housing for the elderly in Salem.
