This order is issued under the Massachusetts Wetlands Protection Act,M.G.L. Chapter 131, Section 40 and the City of Salem Wetlands Protection and Conservation Ordinance,Salem Code Chapter 50. This order permits the constriction of a parking lot and associated drainage structures per Notice of Intent submitted to the Conservation Commission on September 4, 2012. Because it is located within an area mapped as Zone A on a July 3, 2012 FEMA Flood Insurance Rate Map and no base flood elevation has been established, the entire project is presumed to be within bordering land subject to flooding. The parking facility is to be constructed subsequent to the United States Environmental Protection Agency Removal Program's site remediation, which is not subject to the e Massachusetts Wetlands Protection tection Act r Chapter 50. the Salem p Because site grading Code g g resulting from the EPA's remediation is yet to be determined, the applicant is required to submit a final parking lot grading plan to the conservation commission prior to start of construction so that the commission can verify that no bordering land subject to flooding has been filled without providing compensatory flood storage. GENERAL CONDITIONS I• This Order of Conditions must be recorded in its entirety(including all 6 pages of Special Conditions) at the Essex County Registry of Deeds or the Land Court for the district in which the land is located, after the expiration of the 10-day appeal period and within 30 days of the issuance. A copy of the recording information must be submitted to the Salem Conservation Commission before any work approved in this Order commences. 2. Approval of this application does not constitute compliance with any law or regulation other than M.G.L Chapter 131, Section 40, Wetlands Regulations 310 CMR 10.00 and the City of Salem Wetlands Protection and Conservation Ordinance,Salem Code Chapter 50. 3. All work shall be performed in accordance with this Order of Conditions and approved site plan(s). No work approved in this Order may commence until the ten(10)business day appeal period has lapsed from the date of the issuance of this Order. 6. With respect to this Order, the Commission designates the Conservation Agent as its agent with powers to act on its behalf in administering and enforcing this Order. 7. The Commission or its Agent,officers, or employees shall have the right to enter and inspect the property at any time for compliance with the conditions of this Order,the Wetlands Protection Act MGL Chapter I31, Section 40,the Wetlands Regulations 310 CMR 10.00, and shall have the right to require any data or documentation that it deems necessary for that evaluation. 8. The term "Applicant"as used in this Order of Conditions shall refer to the owner, any successor in interest or successor in control of the property referenced in the Notice of intent, supporting documents and this Order of Conditions. The Commission shall be notified in writing within 30 days of all transfers of title of any portion of the property that takes place prior to issuance of the Certificate of Compliance. 9. It is the responsibility of the applicant to procure all other applicable federal, state and local permits and approvals associated with this project. These permits may include but are not necessarily limited to the following: (1) Section 404 of the Federal Water Pollution Control Act(P.L. 92-500, 86 stat. 816), U.S. Army Corps of Engineers. (2) Water Quality Certification in accordance with the Federal Water Pollution Control under authority of sec. 27(5)of Chapter 21 of the Massachusetts General Laws as codified in 314 CMR 9.00. (3) Sewer Extension Permit from the DEP Division of Water Pollution Control under G. L. Ch. 2IA ss7 and 314 CMR 7.00. Any Board of Health permit for septic system design for any portion of the septic system within 100 feet of wetlands shall be submitted to the Commission prior to construction initiation. (4) Design Requirements for Construction in Floodplains under the State Building Code (780 CMR 744.). 10. If there are conflicting conditions within this Order, the stricter condition(s) shall rule. if. All work shall be performed so as to ensure that there will be no sedimentation into wetlands and surface waters during construction or after completion of the project. 12. The Commission or its Agent shall have the discretion to modify the erosion/siltation control methods and boundary during construction if neces sary. 13. The Commission reserves the right to impose additional conditions on portions of this project or this site to mitigate any actual or potential impacts resulting from the work herein permitted. 14. Any proposed changes in the approved plan(s)or any deviation in construction from the approved plan(s)shall require the applicant to file a Notice of Proiect Change with the Commission. The Notice shall be accompanied by a written inquiry prior to their implementation in the field, as to whether the change(s) is substantial enough to require filing a new Notice of Intent or a request to correct or amend this Order of Conditions. A copy of such request shall at the same time be sent to the Department of Environmental Protection. 16. In conjunction with the sale of this property or any portion thereof before a Certificate of Compliance has been issued,the applicant or current landowner shall submit to the Commission a statement signed by the buyer that he/she is aware of an outstanding Order of Conditions on the property and has received a copy of the Order of Conditions. PRIOR TO CONSTRUCTION 17. Prior to the commencement of any activity on this site other than activities listed above, there must be a Pre-Construction Meeting on site between the project supervisor, the contractor responsible for the work, and the Conservation Agent and/or a member of the Conservation Commission to ensure that the requirements of the Order of Conditions are understood. The staked erosion control line shall be adjusted, if necessary, during the pre-construction meeting. Please contact the Conservation Agent at (978) 619.5685 at least forty-eight(48) hours prior to construction to arrange for the Pre- Construction Meeting. 18. Prior to the pre-construction meeting and commencement of any activity on this site,sedimentation and erosion control barriers shall be installed as shown on the approval plan(s)and detail drawings. The Commission and/or its Agent shall inspect and approve such installation at the pre-construction meeting. 19. No clearing of vegetation, including trees,or disturbance of soil shall occur prior to the pre-construction meeting. Minimal disturbance of shrubs and herbaceous plants shall be allowed prior to the pre- construction meeting if absolutely necessary in order to place erosion control stakes where required. 20. There shall be sufficient erosion control devices stored under cover on the site to be used for emergency erosion control purposes. Appropriate erosion control devices shall be in place prior to the beginning of any phase of construction, and shall be maintained during construction in any wetland resource area and/or buffer zones. The erosion control measures shown on the approval plan(s)and provisions in the Order will be the minimum standards for this project; the Commission or its Agent may require additional measures. 22. All debris, fill and excavated material shall be stockpiled a location far enough away from the wetland resource areas to prevent sediment from entering wetland resource areas. 23. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or replaced as necessary. Any accumulated silt adjacent to the barriers shall be removed. 24, The area of construction shall remain in a stable condition at the close of each construction day. 25. Any de-watering of trenches or other excavation required during construction shall be conducted so as to prevent siltation of wetland resource areas. All discharge from de-watering activities shall be filtered through hay bale sediment traps, silt filter bags or other means approved by the Commission or its Administrator. 26. Within thirty(30) days of completion of construction on any given portion of the project, all disturbed areas in the completed portion of the site shall be permanently stabilized with rapidly growin g vegetative cover, using sufficient top soil to assure long-term stabilization of disturbed areas. 27. If soils are to be disturbed for longer than two(2) months, a temporary cover of rye or other grass should be established to prevent erosion and sedimentation. If the season is not appropriate for plant growth, exposed surface shall be stabilized by other appropriate erosion control measures, firmly anchored, to prevent soils from being washed by rain or flooding. DURING CONSTRUCTION 28. A copy of this Order of Conditions and the plan(s)approved in this Order shall be available on site at all times when work is in progress. 29. No alteration or activity shall occur beyond the limit of work as defined by the siltation barriers shown on the approved plan(s). 30. All waste products,grubbed stumps, slash;construction materials,etc. shall be deposited at least 100 feet from wetland resource areas and 200 feet from river. 31. Cement trucks shall not be washed out in any wetland resource or buffer zone area,nor into any drainage system. Any deposit of cement or concrete products into a buffer zone or wetland resource area shall be immediately removed. 32. All exposed sub-soils shall be covered by a minimum of three(3) inches of quality screened loam topsoil prior to seeding and final stabilization. 33. Immediately following drainage structure installation all inlets shall be protected by silt fence, haybale barriers and/or silt bags to filter silt from stormwater before it enters the drainage system. 34. There shall be no pumping of water from wetland resource areas. 35. All equipment shall be inspected regularly for leaks. Any leaking hydraulic lines,cylinders or any other components shall be fixed immediately. 36. During construction,all drainage structures shall be inspected regularly and cleaned as necessary. s - " Attachment to Order of Conditions # 64-544 J° Page 5 of 6 37. The applicant is herby notified that failure to comply with all requirements herein may result in the issuance of enforcement actions by the Conservation Commission including, but not limited to,civil administrative penalties under M.G.L Chapter 21 A, section 16. AFTER CONSTRUCTION 38. Upon completion of construction and final soil stabilization, the applicant shall submit the following to the Conservation Commission to request a Certificate of Compliance(COC): (1) A Completed Request for a Certificate of Compliance form(WPA Form 8A or other form if required by the Conservation Commission at the time of request). (2) A letter from a Registered Professional Engineer certifying compliance of the property with this Order of Conditions. (3) An "As-Built" plan signed and stamped by a Registered Professional Engineer or Land Surveyor showing post-construction conditions within all areas under the jurisdiction of the Massachusetts Wetlands Protection Act. This plan shall include at a minimum: (a) All wetland resource area boundaries with associated buffer zones and regulatory setback areas taken from the plan(s)approved in this Order of Conditions; (b) Locations and elevations of all stormwater management conveyances,structures and best management designs, including foundation drains,constructed under this Order within any wetland resource area or buffer zone; (c) Distances from any structures constructed under this Order to wetland resource areas- "structures"include, but are not limited to,all buildings, septic system components, wells, utility lines, fences, retaining walls, and roads/driveways; (d) A line delineating the limit of work-"work"includes any filling,excavating and/or disturbance of soils or vegetation approved under this Order; 39. When issued, the Certificate of Compliance must be recorded at the Southern Essex County Registry of Deeds and a copy of the recording submitted to the Salem Conservation Commission. 40. If the completed work differs from that in the original plans and conditions, the report must specify how the work differs; at which time the applicant shall first request a modification to the Order. Only upon review and approval by the Commission, may the applicant request in writing a Certificate of Compliance as described above. 41. Erosion control devices shall remain in place and properly functioning until all exposed soils have been stabilized with final vegetative cover and the Conservation Commission and/or its Agent has authorized their removal. ADDITIONAL CONDITIONS 42. Prior to start of constriction, a final grading plan must be submitted to the commission in order to verify that no bordering land subject to flooding will be filled. 43. Prior to start of constriction, a certificate of compliance must be obtained for the outstanding order of conditions for this property, DEP#64-541. 44. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or water body. During construction, the applicant or his/her designee shall inspect the erosion controls on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission, which reserves the right to require additional erosion and/or damage prevention controls it may deem necessary. Prior to requesting a Certificate of Compliance, or Partial Certificate of Compliance, the responsible party(defined in General Condition 18(e)) shall execute and submit to the issuing authority an Operation and Maintenance Compliance Statement("O&M Statement) for the Stormwater BMPs identifying the party responsible for implementing the stormwater BMP Operation and Maintenance Plan ("O&M Plan")and certifying the following: i.)the 0&M Plan is complete and will be implemented upon receipt of the Certificate of Compliance, and ii.) the future responsible parties shall be notified in writing of their ongoing legal responsibility to operate and maintain the stormwater management BMPs and implement the Stormwater Pollution Prevention Plan. d) Post-construction pollution prevention and source control shall be implemented in accordance with the long-term pollution prevention plan section of the approved Stormwater Report and, if applicable, the Stormwater Pollution Prevention Plan required by the National Pollution Discharge Elimination System Multi-Sector General Permit. e) Unless and until another party accepts responsibility, the landowner, or owner of any drainage easement, assumes responsibility for maintaining each BMP. To overcome this presumption, the landowner of the property must submit to the issuing authority a legally binding agreement of record, acceptable to the issuing authority, evidencing that another entity has accepted responsibility for maintaining the BMP, and that the proposed responsible party shall be treated as a permittee for purposes of implementing the requirements of Conditions 18(f) through 18(k) with respect to that BMP. Any failure of the proposed responsible party to implement the requirements of Conditions 18(f)through 18(k)with respect to that BMP shall be a violation of the Order of Conditions or Certificate of Compliance. In the case of stormwater BMPs that are serving more than one lot, the legally binding agreement shall also identify the lots that will be serviced by the stormwater BMPs. As part of the remediation process, a cap is required. The City of Salem will use 4" of pavement to cap this Site. Because the Site requires paving (as a cap to the remediation site), the City is proposing to use the Site as a parking lot. The proposed plan calls for virtually the entire 1.2-acre parcel to be paved, with the exception of vegetated plantings and stormwater structures. The City of Salem is in the process of constructing a parking garage to accommodate the need for additional parking associated with the Bridge Street MBTA station. As a short-term accommodation while the parking garage is under construction, the City of Salem is proposing to turn the Site into a temporary parking lot. Before work for this paving project begins, the USEPA will prepare the site for the paving effort, including the removal of all vegetation and debris from the site, re-grading site, and excavating site in preparation for infiltration trenches and deep sump catch basins. The Site currently has no stormwater management devices on site. The proposed parking lot will incorporate infiltration trenches, deep sump catch basins, and vegetation to improve stormwater quality and reduce storm water flow on the site. These measures will improve stormwater conditions on site. The site is located within the 100 year flood plain associated with the North River. With the exception of the flood plain, no other resources will be impacted. Work Description Before the start of this paving project, the remediation work will have been completed by the USEPA. The EPA will prepare the site for paving, including removal of vegetation and debris (concrete pads, various materials), grading the site, and earthwork associated with the preparation of infiltration trenches and catch basins at the site. Prior to the paving effort, silt fences and straw bales will be placed as noted in the site plans (see Appendix D). Environmental protection measures will include dust control to ensure that generation of on-site dust during site preparation and paving effort will be minimized. Wet suppression shall be used to provide temporary control of dust. At a minimum, wet suppression shall be applied to any debris, excavated material, aggregate piles, and exposed soils and dirt, if on site. Dust suppression wetting agents shall be water soluble, non-toxic, non-reactive, non-volatile, and non- foaming. See Specification 01562 — DUST CONTROL, in Appendix E, for additional information on dust control. Only after the environmental protection measures are in place will the paving efforts commence. Erosion control measures, including the use of silt fences, straw bales and catch basin protection, will be implemented to mitigate sediment migration outside the limits of work. Infiltration trenches and deep sump catch basins will be constructed on site to help with improve stormwater quality and reduce stormwater flow at the Site (see Appendix D for location and detail). These have been designed to capture sheet flow and provide infiltration for stormwater runoff. Once the infiltration trenches are in place, the site will be paved. A gravel sub-base will be placed on the Site, followed by four (4) inches of bituminous pavement. An in-depth paving specification is located in Appendix E. Timber railings will be installed around all infiltration trenches. Environmental Impacts There is a small, isolated wetland outside the southern border of the site. Because this is an isolated wetland, it does not fall under the protection of the Wetlands Protection Act or local City �. of Salem bylaws. The site is located outside the 200-foot Riverfront Protection Area associated with the North River, which is situated to the north of the site. The site is located within the 100- year flood zone. The project will not introduce new fill in the 100-year flood zone. The new infiltration trenches and catch basins will improve flooding conditions in the 100-year flood zone as amount of flow coming from the site will decrease after project completion when compared to existing conditions. As noted in the Stormwater Report (Appendix B), existing flow from a 100-year storm is 8.90 cfs. When paving the entire property, the flow is 8.37 cfs. However, when the infiltration trenches and deep sump catch basins are added to the parking lot, the estimated flow is 8.35 cfs, which is less than existing conditions. An additional benefit to this project is that the infiltration trenches and catch basins will also treat the first flush stormwater and meet all of the standards presented in the Massachusetts Stormwater Handbook. (See Appendix B for an in-depth discussion of this project meeting the Stormwater Management Standards). Of particular note is that the infiltration trenches and catch basins will decrease TSS by 80%. As there is currently no stormwater treatment on the site, this new treatment will improve stormwater quality. As part of the remediation process, a cap is required. The City of Salem will use 4" of pavement to cap this Site. Because the Site requires paving (as a cap to the remediation site), the City is proposing to use the Site as a parking lot. The proposed plan calls for virtually the entire 1.2-acre parcel to be paved, with the exception of vegetated plantings and stormwater structures. ' The City of Salem is in the process of constructing a parking garage to accommodate the need for additional parking associated with the Bridge Street MBTA station. As a short-term accommodation while the parking garage is under construction, the City of Salem is proposing to ' turn the Site into a temporary parking lot. Before work for this paving project begins, the USEPA will prepare the site for the paving effort, ' including the removal of all vegetation and debris from the site, re-grading site, and excavating site in preparation for infiltration trenches and deep sump catch basins. The Site currently has no stormwater management devices on site. The proposed parking lot will incorporate infiltration ' trenches, deep sump catch basins, and vegetation to improve stormwater quality and reduce storm water flow on the site. These measures will improve stormwater conditions on site. ' The site is located within the 100 year flood plain associated with the North River. With the exception of the flood plain, no other resources will be impacted. Work Description Before the start of this paving project, the remediation work will have been completed by the ' USEPA. The EPA will prepare the site for paving, including removal of vegetation and debris (concrete pads, various materials), grading the site, and earthwork associated with the preparation of infiltration trenches and catch basins at the site. Prior to the paving effort, silt fences and straw bales will be placed as noted in the site plans (see Appendix D). ' Environmental protection measures will include dust control to ensure that generation of on-site dust during site preparation and paving effort will be minimized. Wet suppression shall be used t to provide temporary control of dust. At a minimum, wet suppression shall be applied to any debris, excavated material, aggregate piles, and exposed soils and dirt, if on site. Dust suppression wetting agents shall be water soluble, non-toxic, non-reactive, non-volatile, and non- foaming. See Specification 01562 — DUST CONTROL, in Appendix E, for additional information on dust control. ' Only after the environmental protection measures are in place will the paving efforts commence. Erosion control measures, including the use of silt fences, straw bales and catch basin protection, will be implemented to mitigate sediment migration outside the limits of work. ' Infiltration trenches and deep sump catch basins will be constructed on site to help with improve stormwater quality and reduce stormwater flow at the Site (see Appendix D for location and ' detail). These have been designed to capture sheet flow and provide infiltration for stormwater runoff. ' Once the infiltration trenches are in place, the site will be paved. Section 02745 - Paving 1.03 REGULATORY REQUIREMENTS: A. The Contractor shall perform all work specified under this Section in compliance with ' the Massachusetts Department of Environmental Protection, Code of Massachusetts Regulations (CMR) 310 CMR 7.00, "Air Pollution Control Regulations", specifically 310 CMR 7.09, "Dust, Odor, Construction and Demolition". 1 t01562-1 1 ' B. Work of this Contract shall be conducted in a manner that will not result in excessive ' particulate matter emissions, nuisance dust conditions, PMio (particulate matter with an aerodynamic diameter less than or equal to 10 microns) emissions, or PMio concentrations exceeding the Massachusetts and National Ambient Air Quality ' Standard of 150 ug/m3 on 24-hour average basis. 1.04 SUBMITTALS: ' A. Contractor shall submit a Dust Control Plan that outlines in detail the measures that he will implement to comply with this Section, including suppression, wind screens and ' barriers (if necessary), prevention, cleanup, and other measures. Plan shall be submitted to the Engineer within fifteen calendar days following the date of the Notice to Proceed. ' B. Contractor shall submit to the Engineer product literature and Material Safety Data Sheets for any dust suppression wetting agents and stabilizers that the Contractor ' proposes to use. ' 1.05 QUALITY CONTROL: A. The Engineer may conduct air monitoring with a Mini RAM monitor, or equivalent, to ' ensure dust is being controlled at the site. During the course of the Work, the Contractor shall be responsible for implementing engineering controls (e.g., wetting, calcium chloride) to minimize or eliminate fugitive dust emissions. If dust exceeds ' action levels described below, or determined to be a nuisance by the Engineer, the Contractor shall be responsible for implementing additional engineering controls (e.g. additional dust suppression agents, wind screens), as directed by the Engineer. If ' additional wet suppression (water) and/or wind screens, barriers, or covers are required per the Engineer based on air/dust monitoring results, they shall be at no additional cost to the Owner. PART2 - PRODUCTS ' 2.01 DUST SUPPRESSION AGENTS: ' A. Dust suppression wetting agents shall be water soluble, non-toxic, non-reactive, non- volatile, and non foaming. ' B. Soil stabilizer shall be a sprayable organic or inorganic tackifier. 1 t01562-2 ' 2.02 BARRIERS, SCREENS, AND COVERS: A. Mesh Fabric/Wind screens shall be a durable fabric mesh of 50 percent porosity, ' attached to the temporary chain link fence to be installed as shown on the Contract Drawings. ' B. Wind barriers, if required, shall be solid wood fences or solid durable fabric, attached to Site's temporary chain link fence, or other solid barriers intended to block the passage of wind. 1 C. Covers for stockpiles, if required, shall be plastic tarps. Covers shall be 20-mil. polyethylene sheeting or 10-mil. nylon reinforced polyethylene sheeting. The stockpiles ' shall be placed on 40 mil. polyethylene sheeting. 2.03 CALCIUM CHLORIDE: ' A. Calcium chloride shall conform to the requirements of AASHTO-M 144, Type I or ' Type II and Specification for Calcium Chloride, ASTM D98. The calcium chloride shall be packaged in moisture proof bags or in airtight drums with the manufacturer, name of product, net weight, and percentage of calcium chloride guaranteed by the ' manufacturer legibly marked on each container. B. Calcium chloride failing to meet the requirements of the aforementioned specifications tor that which has become caked or sticky in shipment, may be rejected by the Engineer. 2.04 WATER: ' A. Water shall not be brackish and shall be free from oil, acid, and injurious alkali or vegetable matter. ' PART 3 - EXECUTION ' 3.01 SITE/PUBLIC ROADWAY DUST CONTROL: ' A. Vehicles leaving the site shall have no mud and dirt on the vehicle body or wheels. Any foreign matter on the vehicle body or wheels shall be physically removed prior to vehicle's entering of a public roadway. Contractor shall not permit any truck to leave the site with exterior mud or dirt that has the potential to be deposited on public roadways. Refer also to Section 01570 — Environmental Protection for equipment and vehicle decontamination requirements. ' B. Haul truck cargo areas shall be securely and completely covered during material transport on public roadways. ' 01562-3 ' C. Vehicle mud and dirt carryout, material spills, and soil wash-out onto public roadways ' and walkways and other paved areas shall be cleaned up immediately. D. The Contractor is responsible for daily clean-up of public roadways and walkways ' affected by work of this Contract. A wet spray power vacuum street sweeper shall be used on paved roadway. Dry power sweeping is prohibited. ' 3.03 CONTROL OF EARTHWORK DUST: A. During batch drop operations (i.e., earthwork with front-end loader, clamshell bucket, ' or backhoe) the free drop height of excavated or aggregate material shall be reduced as much as practical to minimize the generation of dust. ' B. To prevent spills during transport, freeboard space shall be maintained between the material load and the top of the truck cargo bed rail. ' 3.04 CONTROL OF STOCKPILE DUST: A. The Contractor shall use the following methods to control dust and wind erosion of active and inactive stockpiles: ' 1. Wet suppression without wetting agent during active stockpile load-in, load-out, and maintenance activities. 2. Soil stabilizers applied to the surface of inactive stockpiles. 3. Polyethylene tarps on stockpiles shall be placed both below and on top of stockpiles, and secured with sandbags or an equivalent method to prevent the cover from being dislodged by the wind. The Contractor shall repair or replace covers whenever damaged or dislodged, at no additional cost to the Owner. 4. The tarps shall be bermed 12" high at all edges to prevent any infiltration of storm water or exfiltration of leachate. ' B. The methods to be used shall be submitted to the Engineer as part of the Dust Control Plan. t3.05 DEBRIS AND DEMOLITION DUST CONTROL MEASURES: ' A. The Contractor shall use water sprinkling, temporary enclosures, and other suitable methods to limit dust and dirt rising and scattering in the air to the lowest practical ' level. Sufficient water shall be supplied for the building, demolition-related debris, and site compacting to meet Federal, State, and local air-quality regulations and to minimize dust during demolition and debris handling. If the Contractor fails to act promptly, the Engineer may order stoppage of all or part of the work until satisfactory ' corrective action has been taken. No claim for an extension of time or for excess costs or damage incurred by the Contractor as a result of time lost due to any stop work orders shall be made unless it was later determined that the Contractor was in compliance. 3. Implementation tA. Prior to commencement of work, the Contractor shall meet with representatives of the Engineer to develop mutual understandings relative to compliance of the environmental ' protection program. 08/05/2002 01570-1 B. The Contractor shall submit for approval six sets of details and literature fully describing environmental protection methods to be employed in carrying out construction activities. 4. Area of Construction Activity ' Insofar as possible, the Contractor shall confine his work activities to those areas defined by the Contract Drawings and Specifications. All land resources within the project boundaries and outside the limits of permanent work performed under this contract shall be preserved in their present condition or be restored to a condition after completion of paving at least equal to that which existed prior to work under this contract.The Contractor shall keep the streets clear of debris, equipment and vehicles at all times for Fire Department access, as shown on the Contract Drawings. ' 5. Protection of Water Resources A. The Contractor shall not pollute streams, lakes or reservoirs with fuels, oils, bitumens, ' calcium chloride,acids or other harmful materials. The Contractor shall also prevent the transport of soil, dirt, and salt to surface streams,wetlands,and/or catch basins. It is the Contractor's responsibility to comply with all applicable Federal, State, County and Municipal laws regarding pollution of rivers and streams. ' B. Special measures should be taken to insure against spillage of any pollutants into public waters, and run-off of demolition site sediments into stormwater collection systems. Measures shall include placement of strawbales and silt traps around catchbasins and ' along temporary construction fencing, as indicated on the Contract Drawings. C. Catchbasins shall be protected as shown on the Contract Documents with a nonwoven geotextile filter fabric trap,or strawbales, as described in this Section and shown on the Contract Drawings, and as approved by the Engineer. The Contractor, Engineer, and Owner shall conduct a pre-work inspection of the catch basins to assess sediment accumulation and shall coordinate with the Department of Public Works(DPW)to clean catch basins, as required, prior to work activities. ' D. The Contractor is responsible for maintaining flow into each catch basin shown to be protected on the Contract Documents to prevent ponding/flooding. The Contractor shall clean filter fabric by removing accumulated material,as needed. Removed material shall be disposed of per applicable local,State,and Federal requirements at no extra cost to the Owner. ' E. The filter drainage fabric shall be composed of continuous-filament fibers bonded together to form a sheet. The fabric shall be an average of 20 mils thick and possess the ' characteristic of Miraf. 140 N. 1 08/05/2002 01570-2 6. Protecting and Minimizing Exposed Areas A. The Contractor shall limit the area of land which is exposed and free from vegetation ' during work. In areas where the period of exposure will be greater than two(2)months, temporary vegetation, mulching or other protective measures shall be provided as specified. tB. The Contractor shall take account of the conditions of the soil where temporary cover crop will be used to insure that materials used for temporary vegetation are adaptive to the sediment control. Materials to be used for temporary vegetation shall be approved by the Engineer. ' 7. Location of Storage Areas A. The location of the Contractor's storage areas for equipment and/or materials shall be upon cleared portions of the job site or areas to be cleared associated with the phase of work being done as a part of this project, and shall require written approval of the Engineer. Plans showing storage facilities for equipment and materials shall be submitted for approval of the Engineer. ' B. No excavated materials or materials used in backfill operations shall be deposited within a minimum distance of one hundred (100) feet of any watercourse or any drainage facility. Adequate measures for erosion and sediment control(polyethylene sheeting on stockpiles,the placement of baled straw around the downstream perimeter of stockpiles, etc.) shall be employed to protect any downstream areas from siltation. C. The Engineer may designate a particular area or areas where the Contractor may store materials used in his operations. 8. Protection of Landscape A. The Contractor shall not deface,injure,or destroy trees or shrubs nor remove or cut them ' within the Limit of Work, unless shown on the Contract Drawings without written authority from the Owner. No ropes, cables, or guys shall be fastened to or attached to any existing nearby trees for anchorages unless specifically authorized by the Engineer. Excavating machinery and cranes shall be of suitable type and be operated with care to prevent injury to trees which are not to be removed, particularly overhanging branches and limbs. The Contractor shall, in any event, be responsible for any damage resulting ' from such use.If the Contractor damages trees not designated for removal,the Contractor shall remove damaged trees,including stump removal at no additional cost to the Owner. ' B. Branches, limbs, and roots shall not be cut except by permission of the Engineer. All cutting shall be smoothly and neatly done without splitting or crushing. When there is unavoidable injury to branches, limbs and trunks of trees, the injured portions shall be 08/05/2002 01570-3 ' neatly trimmed and covered with an application of grafting wax or tree healing paint as directed by the Engineer. C. Where,in the opinion of the Engineer,trees may possibly be defaced,bruised,injured,or otherwise damaged by the Contractor's equipment or other operations,the Engineer may direct the Contractor to adequately protect such trees by placing boards,planks,poles or fencing around them. Any trees or landscape feature scarred or damaged by the ' Contractor's equipment or operations shall be removed, including stump removal at the expense of the Contractor. 9. Clearing and Grubbin¢ A. The Contractor shall clear and grub shrubs and trees within 10-feet of all buildings,or as ' shown on the Contract Drawings or as approved by the Engineer. The Contractor shall maintain as much of the existing vegetation as possible beyond 10-feet from the buildings. 10. Discharge of Dewatering Operations A. No dewatering is expected for the paving project. 11. Dust Control A. During the progress of the Work, the Contractor shall conduct his operations and maintain the area of his activities, including sweeping and sprinkling of streets as necessary,to minimize creation and dispersion of dust in accordance with Section 01562 - Dust Control. Baled Straw To trap sediment and to prevent sediment from clogging drainage systems,baled straw shall be used where shown on the Contract Drawings. Care shall be taken to keep the bales from breaking apart. The bales should be securely staked to prevent overturning, flotation, or displacement. Where indicated on the drawings or where directed by the Engineer,the Contractor shall ' erect and maintain a temporary silt fence. In areas designated as wetlands,the Contractor shall line the limits of the construction easement with a silt fence. The silt fence shall be used specifically to contain sediment from runoff water and to minimize environmental ' damage caused by construction. B. The silt fence shall consist of a 3-foot wide continuous length sediment control fabric, stitched to a 22-foot wide,continuous length support netting,and stapled to preweathered oak posts installed as shown on the drawings. The Contractor shall make special provisions to prevent excessive noise during demolition ' and construction.No heavy demolition and construction equipment or large engine vehicle shall be allowed to operate on the site between the hours of 7 PM and 7 AM,unless special permission is granted by the Owner. Temporary noise barriers shall be erected by the Contractor at the direction of the Owner if the noise level at the perimeter of the site is determined as excessive. B. When available,make the maximum use of"low-noise-emission products" as certified by EPA. No blasting or use of explosives is permitted. C. Protect employees against noise exposure in accordance with the requirements of the ' Occupational Safety and Health Act of 1972. D. Compliance with the requirements of this Section will not offer any relief from responsibility for compliance with local ordinances, regulations, and other Sections. E. Noise Level Restrictions in All Areas: In no case expose the public to demolition and construction noise levels exceeding 85 dBA(slow)or to impulsive noise levels with a peak sound pressure level exceeding 125 dBA (fast). If work is specifically approved by Engineer during nighttime, restrict noise levels to not more than 50 dBA (slow). Intermittent Noise: Prevent noises from nonstationary mobile equipment operated by a driver or from any source of nonscheduled intermittent,nonrepetitive,short-term noises not ' lasting more than a few hours from exceeding 75 dBA daytime and 60 dBA nighttime. ' 15. Waste A. All rubbish and surplus material shall be handled and disposed of in accordance with all local, State, and Federal requirements. B. Provide rubbish and garbage containers at several locations throughout the site. Empty containers at regular intervals to avoid overfilling. ' C. Provide temporary chemical toilets and periodically empty wastes according to all Federal, State, and local regulations. C. Conduct fueling and lubricating of equipment and motor vehicles in a manner that affords the maximum protection against spills and evaporation. Dispose of lubricants to be discarded and excess oil in accordance with approved procedures meeting Federal, State and local regulations. 16. Equipment and Vehicle Decontamination A. Vehicles leaving the Site shall not carry out mud or dirt from the site on the vehicle body or wheels. Any foreign matter on the vehicle body or wheels shall be physically removed prior to vehicle's entering of a public roadway. Contractor shall not permit any truck to leave the site with exterior mud or dirt that has the potential to be deposited on public roadways. Contractor shall be responsible for assuring that each vehicle is properly cleaned and/or decontaminated prior to exiting the site. The Contractor shall prevent carry- out or spillage of material from his/her vehicles onto public ways. The Contractor shall promptly clean up and dispose of all material and debris deposited on public ways to the Owner's satisfaction. If vehicles track mud and dirt off-site, the Contractor shall be responsible for additional engineering controls such as wheel washing at no extra cost to the Owner. If a pavement course thickness exceeds 2-1/2 compacted inches, the course shall be installed in multiple lifts with each lift not exceeding 2-1/2 compacted inches in ' thickness. 3.02 GRAVEL SUBBASE: A. The gravel subbase to be placed under pavement shall consist of 12-inches of gravel evenly spread and thoroughly compacted. ' B. The gravel shall be spread in layers not more than 4-inches thick, compacted measure. All layers shall be compacted to not less than 95 percent of the maximum dry density of tthe material as determined by ASTM D1557 Method C at optimum moisture content. 3.03 PERMANENT BITUMINOUS PAVEMENT: L ' A. The bituminous paving mixture, equipment, methods of mixing and placing, and the precautions to be observed as to weather, condition of base, etc., shall be in accordance ' with MassDOT 460. 09/30/2011 02745-4 1 ' B. BASE COURSE AND BINDER COURSE PAVEMENT: ' 1. Immediately prior to installing the base and/or binder course, the trimmed edges shall be made stable and unyielding, free of loose or broken pieces and all edges ' shall be thoroughly broomed clean. Contact surfaces of curbings, manholes, catch basins, or other appurtenant structures in the pavement shall be painted thoroughly with a uniform coating of asphalt emulsion (tack coat),just before any ' mixture is placed against them. 2. The binder course shall be repaired as necessary to maintain the surface of the ' pavement until placement of the permanent overlay. If required, the Contractor shall place a leveling course before placing the permanent overlay. ' C. TOP COURSE OR SURFACE TREATMENT PAVEMENT (PERMANENT OVERLAY): 1. Top course or surface treatment shall be placed over the full width of the parking area as shown on the drawings or as specified. t 2. Prior to placement of the top course or surface treatment, the entire surface over which the top course or surface treatment is to be placed shall be broom cleaned and tack coated. 3. Prior to placing full width top course or surface treatment pavements, keyways shall be cut in all intersecting streets, if applicable. 3.04 PAVEMENT PLACEMENT: ' A. Unless otherwise permitted by the Engineer for particular conditions, only machine methods of placing the pavement shall be used. The equipment for spreading and finishing shall be mechanical, self-powered pavers, capable of spreading and finishing the mixture true to line, grade, width and crown. The mixtures shall be placed and compacted only at such times as to permit proper inspection and checking by the Engineer. B. After the paving mixtures have been properly spread, initial and intermediate compaction shall be obtained by the use of steel wheel rollers having a weight of not less than 240 pounds per inch width of tread. ' C. Final rolling of the top course or surface treatment pavement shall be performed by a steel wheel roller weighing not less than 285 pounds per inch width of tread at a mix temperature and time sufficient to allow for final smoothing of the surface and thorough compaction. D. Immediately after placement of top course or surface treatment pavement, all joints between the existing and new top course or surface treatment pavements shall be sealed with hot poured rubberized asphalt joint sealant. ' 09/30/2011 02745-5 ' E. Where there is no backing for the edges of the curb-to-curb pavement, the Contractor shall provide a gravel transition. The gravel transition shall be installed immediately after the pavement is placed, shall be feathered and extend a minimum of 18-inches, and ' shall be compacted using the same equipment as for pavement compaction. The gravel shall be uniformly graded material with a maximum size of 3/8-to '/z-inch. ' F. When required by the Engineer, the Contractor shall furnish and install additional paving to provide satisfactory transition for driveways and walkways impacted by a new curb-to-curb pavement installation. The transition installation will be considered ' incidental to the curb-to-curb pavement installation. 3.05 PARKING LOTS AND DRIVEWAYS: ' A. Pavement shall consist of a 2 1/2-inch binder course and a 1-1/2-inch top course on a 12-inch gravel sub-base. All thicknesses are compacted thicknesses. B. Adjacent concrete work, slate work, sidewalks, structures, etc., shall be protected from stain and damage during the entire operation. Damaged or stained areas shall be ' replaced or repaired to equal their original condition. C. All joints between binder and top course shall be staggered a minimum of 6-inches. ' D. After final rolling, no vehicular traffic of any kind shall be permitted on the pavement until it has cooled and hardened sufficiently to prevent distortion and loss of fines, and ' in no case in less than 6 hours. E. Smoothness of all areas of the finished surface shall not vary more than 1/4-inch when tested with a 16 foot straight-edge, applied both parallel to and at right angles to the centerline of the paved area. At building entrances, curbs, and other locations where an essentially flush transition is required, pavement elevation tolerance shall not exceed plus or minus 1/8-inch. Irregularities exceeding these amounts, or which retain water on the surface, shall be corrected by removing the defective work and replacing or repairing it to the satisfaction of the Engineer. tF. The Contractor shall prepare the pavement surface for painting lines according to the recommendations of the paint manufacturer. Applied markings shall have clean-cut edges, true and smooth alignment and uniform film thickness of 15 mils, +/- 1.0. The Contractor shall be responsible for removing, to the satisfaction of the Engineer, tracing ' marks, and spilled paint applied in an unauthorized area. 3.06 RAISING AND ADJUSTING CASTINGS: ' A. In areas of permanent top course paving, existing catch basin and manhole castings and valve boxes shall be raised to the proper grade where required by the Engineer. t09/30/2011 02745-6 1 ' B. Castings owned by private utilities shall be raised by their own forces, if applicable. ' The Contractor shall be responsible for coordinating this work. C. The method of adjusting these castings shall be as follows: Cut around catch basin or manhole castings a minimum of 8-inches from casting. Excavate and if required rebuild up to 12-inches of masonry below the bottom of the casting. Backfill with suitable material and compact to bottom of casting. Place high, early strength cement or ' bituminous concrete collar, as directed, to approximately 1%-inches below the raised casting grade. Masonry work shall conform to Section 02631, PRECAST MANHOLES AND CATCH BASINS. ' D. In some areas, raising of castings may not be required. Where required by the Engineer, castings not to be raised shall have at least 12-inches of bituminous concrete pavement ' chipped and removed around the casting. New bituminous concrete pavement shall be placed and compacted around such castings to approximately 1-1/2-inches below the top of the casting. The overlay course shall then be sloped down to the level of the ' casting. E. The method of raising valve boxes shall be as follows: Cut around valve box a ' minimum of 8-inches from valve box. Excavate as required and raise the valve box. Pour high early strength cement or bituminous concrete collar, as directed, to approximately 1-1/2-inches below the top of the valve box. ' F.
