This Order is issued under the Massachusetts Wetlands Protection Act,M.G.L. Chapter 131, Section 40 and the City of Salem Wetlands Protection and Conservation Ordinance,Salem Code Chapter 50. The order permits the demolition of an existing building per Notice of Intent submitted to the Conservation Commission on July 17,2012. I. To avoid working atop the site's contaminated materials, the applicant is seeking access to the area labeled "Truck Entrance and Loading Area" at 311 Bridge Street. If the applicant fails to obtain said access and must operate within 297 Bridge Street, a work plan must be submitted to the Conservation Agent prior to start of site activity. GENERAL CONDITIONS 1. This Order of Conditions must be recorded in its entirety (including these Special Conditions) at the Essex County Registry of Deeds or the Land Court for the district in which the land is located, after the expiration of the 10-day appeal period and within 30 days of the issuance. A copy of the recording information must be submitted to the Salem Conservation Commission before any work approved in this Order commences. 2. Approval of this application does not constitute compliance with any law or regulation other than M.G.L Chapter 131, Section 40, Wetlands Regulations 310 CMR 10.00 and the City of Salem Wetlands Protection and Conservation Ordinance, Salem Code Chapter 50. 3. All work shall be performed in accordance with this Order of Conditions and approved site plan(s). No alteration of wetland resource areas or associated buffer zones, other than that approved in this Order, shalt occur on this property without prior approval from the Commission. 4. Prior to any work commencing on site, a DEP Sign showing DEP File#64-541 must be installed at the entrance to the site and seen from the public way, but not placed on a living tree. 5. No work approved in this Order may commence until the ten (10)business day appeal period has lapsed from the date of the issuance of this Order. 6. With respect to this Order, the Commission designates the Conservation Agent as its agent with powers to act on its behalf in administering and enforcing this Order. The Commission or its Agent,officers,or employees shall have the right to enter and inspect the property at any time for compliance with the conditions of this Order, the Wetlands Protection Act MGL Chapter 131, Section 40,the Wetlands Regulations 310 CMR 10.00, and shall have the right to require any data or documentation that it deems necessary for that evaluation. 8. The term"Applicant"as used in this Order of Conditions shall refer to the owner, any successor in interest or successor in control of the property referenced in the Notice of intent, supporting documents and this Order of Conditions. The Commission shall be notified in writing within 30 days of all transfers of title of any portion of the property that takes place prior to issuance of the Certificate of Compliance. 9. It is the responsibility of the applicant to procure all other applicable federal, state and local permits and approvals associated with this project. These permits may include but are not necessarily limited to the following: (1) Section 404 of the Federal Water Pollution Control Act(P.L. 92-500, 86 stat. 816), U.S. Army Corps of Engineers. (2) Water Quality Certification in accordance with the Federal Water Pollution Control under authority of sec. 27(5)of Chapter 21 of the Massachusetts General Laws as codified in 314 CMR 9.00. (3) Sewer Extension Permit from the DEP Division of Water Pollution Control under G. L. Ch. 21 A ss7 and 314 CMR 7.00. Any Board of Health permit for septic system design for any portion of the septic system within 100 feet of wetlands shall be submitted to the Commission prior to construction initiation. (4) Design Requirements for Construction in Floodplains under the State Building Code (780 CMR 744.). 10. If there are conflicting conditions within this Order,the stricter condition(s) shall rule. IL All work shall be performed so as to ensure that there will be no sedimentation into wetlands and surface waters during construction or after completion of the project. 12. The Commission or its Agent shall have the discretion to modify the erosion/siltation control methods and boundary during construction if necessary. 13. The Commission reserves the right to impose additional conditions on portions of this project or this site to mitigate any actual or potential impacts resulting from the work herein permitted. 14. Any proposed changes in the approved plan(s) or any deviation in construction from the approved plan(s)shall require the applicant to file a Notice of Project Change with the Commission. The Notice shall be accompanied by a written inquiry prior to their implementation in the field, as to whether the change(s) is substantial enough to require filing a new Notice of Intent or a request to correct or amend this Order of Conditions. A copy of such request shall at the same time be sent to the Department of Environmental Protection. 16. In conjunction with the sale of this property or any portion thereof before a Certificate of Compliance has been issued, the applicant or current landowner shall submit to the Commission a statement signed ed b the g Y buyer that he/she is aware of an outstanding Order of Conditions on the property and has received a copy of the Order of Conditions. PRIOR TO CONSTRUCTION 17. Prior to the commencement of any activity on this site other than activities listed above,there must be a Pre-Construction Meeting on site between the project supervisor, the contractor responsible for the work, and the Conservation Agent and/or a member of the Conservation Commission to ensure that the requirements of the Order of Conditions are understood. The staked erosion control line shall be adjusted, if necessary,during the pre-construction meeting. Please contact the Conservation Agent at (978) 619-5685 at least forty-eight(48) hours prior to construction to arrange for the Pre- Construction Meeting. 18. Prior to the pre-construction meeting and commencement of any activity on this site,sedimentation and erosion control barriers shall be installed as shown on the approval plan(s)and detail drawings. The Commission and /or its Agent shall inspect and approve such installation at the pre-construction meeting. 19. No clearing of vegetation, includin g trees,or disturbance of soil shall occur prior to the pre-construction meeting. Minimal disturbance of shrubs and herbaceous plants shall be allowed prior to the pre- construction meeting if absolutely necessary in order to place erosion control stakes where required. 20. There shall be sufficient erosion control devices stored under cover on the site to be used for emergency erosion control purposes. EROSION CONTROL 21. Appropriate erosion control devices shall be in place l prior t p p o the beginning of any phase of construction, and shall be maintained during construction in any wetland resource area and/or buffer zones. The erosion control measures shown on the approval plan(s)and provisions in the Order will be the minimum standards for this project; the Commission or its Agent may require additional measures. 22. All debris, fill and excavated material shall be stockpiled a location far enough away from the wetland resource areas to prevent sediment from entering wetland resource areas. 23. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or replaced as necessary. Any accumulated silt adjacent to the barriers shall be removed. 24. The area of construction shall remain in a stable condition at the close of each construction day. 25. Any de-watering of trenches or other excavation required during construction shall be conducted so as to prevent siltation of wetland resource areas. Within thirty(30) days of completion of construction on any given portion of the project, all disturbed areas in the completed portion of the site shall be permanently stabilized with rapidly growing vegetative cover, using sufficient top soil to assure long-term stabilization of disturbed areas. 27. If soils are to be disturbed for longer than two(2) months, a temporary cover of rye or other grass should be established to prevent erosion and sedimentation. If the season is not appropriate for plant growth,exposed surface shall be stabilized by other appropriate erosion control measures, firmly anchored, to prevent soils from being washed by rain or Flooding. DURING CONSTRUCTION 28. A copy of this Order of Conditions and the plan(s)approved in this Order shall be available on site at all times when work is in progress. 29. No alteration or activity shall occur beyond the limit of work as defined by the siltation barriers shown on the approved plan(s). 30. All waste products,grubbed stumps,slash;construction materials,etc. shall be deposited at least 100 feet from wetland resource areas and 200 feet from river. 31. Cement trucks shall not be washed out in any wetland resource or buffer zone area,nor into any drainage system. Any deposit of cement or concrete products into a buffer zone or wetland resource area shall be immediately removed. 32. All exposed sub-soils shall be covered by a minimum of three(3) inches of quality screened loam topsoil prior to seeding and final stabilization. 33. Immediately following drainage structure installation all inlets shall be protected by silt fence, haybale barriers and/or silt bags to filter silt from stormwater before it enters the drainage system. 34. There shall be no pumping of water from wetland resource areas. 35. All equipment shall be inspected regularly for leaks. Any leaking hydraulic lines,cylinders or any other components shall be fixed immediately. 36. During construction,all drainage structures shall be inspected regularly and cleaned as necessary. 37. The applicant is herby notified that failure to comply with all requirements herein may result in the issuance of enforcement actions by the Conservation Commission including, but not limited to,civil administrative penalties under M.G.L Chapter 21A, section 16. AFTER CONSTRUCTION 38. Upon completion of construction and final soil stabilization, the applicant shall submit the following to the Conservation Commission to request a Certificate of Compliance (COC): (1) A Completed Request for a Certificate of Compliance form (WPA Form 8A or other form if required by the Conservation Commission at the time of request). (2) A letter from a Registered Professional Engineer certifying compliance of the property with this Order of Conditions. Attachment to Order of Conditions # 64-54I Page 5 of 5 -baa,mNRh (3) An "As-Built" plan signed and stamped by a Registered Professional Engineer or Land Surveyor showing post-construction conditions within all areas under the jurisdiction of the Massachusetts Wetlands Protection Act. This plan shall include at a minimum: (a) All wetland resource area boundaries with associated buffer zones and regulatory setback areas taken from the plan(s)approved in this Order of Conditions; (b) Locations and elevations of all stormwater management conveyances, structures and best management designs, including foundation drains,constructed under this Order within any wetland resource area or buffer zone; (c) Distances from any structures constructed under this Order to wetland resource areas- "structures"include,but are not limited to,all buildings,septic system components, wells, utility lines, fences, retaining walls,and roads/driveways; (d) A line delineating the limit of work-"work"includes any filling,excavating and/or disturbance of soils or vegetation approved under this Order; 39. When issued, the Certificate of Compliance must be recorded at the Southern Essex County Registry of Deeds and a copy of the recording submitted to the Salem Conservation Commission. 40. If the completed work differs from that in the original plans and conditions, the report must specify how the work differs; at which time the applicant shall first request a modification to the Order. Only upon review and approval by the Commission, may the applicant request in writing a Certificate of Compliance as described above. 41. Erosion control devices shall remain in place and properly functioning until all exposed soils have been stabilized with final vegetative cover and the Conservation Commission and/or its Agent has authorized their removal. No work shall be undertaken until the Order has become final and then has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or water body. During construction, the applicant or his/her designee shall inspect the erosion controls on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission, which reserves the right to require additional erosion and/or damage prevention controls it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of work line has been approved by this Order. NOTICE OF STORMWATER CONTROL AND MAINTENANCE REQUIREMENTS 19. Prior to requesting a Certificate of Compliance, or Partial Certificate of Compliance, the responsible party(defined in General Condition 18(e)) shall execute and submit to the issuing authority an Operation and Maintenance Compliance Statement ("O&M Statement) for the Stormwater BMPs identifying the party responsible for implementing the stormwater BMP Operation and Maintenance Plan ("O&M Plan") and certifying the following: i.) the O&M Plan is complete and will be implemented upon receipt of the Certificate of Compliance, and if.) the future responsible parties shall be notified in writing of their ongoing legal responsibility to operate and maintain the stormwater management BMPs and implement the Stormwater Pollution Prevention Plan. d) Post-construction pollution prevention and source control shall be implemented in accordance with the long-term pollution prevention plan section of the approved Stormwater Report and, if applicable, the Stormwater Pollution Prevention Plan required by the National Pollution Discharge Elimination System Multi-Sector General Permit. e) Unless and until another party accepts responsibility, the landowner, or owner of any drainage easement, assumes responsibility for maintaining each BMP. To overcome this presumption, the landowner of the property must submit to the issuing authority a legally binding agreement of record, acceptable to the issuing authority, evidencing that another entity has accepted responsibility for maintaining the BMP, and that the proposed responsible party shall be treated as a permittee for purposes of implementing the requirements of Conditions 18(f) through 18(k)with respect to that BMP. Any failure of the proposed responsible party to implement the requirements of Conditions 18(f)through 18(k)with respect to that BMP shall be a violation of the Order of Conditions or Certificate of Compliance. In the case of stormwater BMPs that are serving more than one lot, the legally binding agreement shall also identify the lots that will be serviced by the stormwater BMPs. The property is fenced and is improved with a vacant two-story warehouse building, two large concrete pads, and several ancillary features (i.e., truck scale, loading dock and paved areas). The Site was historically used for metal recycling and reclamation activities, ' including processing and sorting of scrap metals and demolition debris, dismantling and processing of transformers, and stockpiling of automotive batteries. The City of Salem is proposing to demolish the existing vacant two-story warehouse building. ' Work Description t Prior to building demolition, silt fences, straw bales, catch basin protection and wind suppression fabric will be placed as noted in the site plans. ' Environmental protection measures will include dust control to ensure that generation of on-site dust during demolition activities will be minimized. Dust control activities will not add to any additional stormwater runoff at the site since dust control will not be used during storm events. ' Dust control will be used under windy and/or hot conditions, which will lead to the evaporation of much of the dust control product. Wet suppression shall be used to provide temporary control of dust. Several applications per day may be necessary to control dust depending upon ' meteorological conditions and work activity. At a minimum, wet suppression shall be applied to demolition debris, excavated material, aggregate piles, and exposed soils and dirt. Dust suppression wetting agents shall be water soluble, non-toxic, non-reactive, non-volatile, and non- foaming. Dust suppression measures will not result in ponding of water. Covers shall be 20 mil polyethylene sheeting or 10 mil nylon reinforced polyethylene sheeting. The stockpiles shall be placed on 40 mil polyethylene sheeting. Only after the environmental protection measures are in place will remediation and demolition efforts commence. Any hazardous materials abatement will occur before any demolition activities commence. All asbestos-containing and hazardous materials shall be removed and disposed of at approved facilities. Demolition, abatement and bulk loading activities will be ' conducted in accordance with applicable federal, state and City of Salem regulations and ordinances. A work plan will be prepared by the engineer and approved by the Massachusetts Department of Environmental Protection. Water used during the abatement shall be collected ' and filtered through a system with at least a 5-micron particle size collection capability. Both erosion and sedimentation controls and non-stormwater best management measures will be used to minimize site disturbance and ensure compliance with the performance standards of the Wetlands Protection Act (WPA) and Stormwater Standards. Measures will be taken to minimize the area disturbed by debris removal activities to reduce the 1 potential for soil erosion and stormwater pollution problems. Straw bales and silt fences will be installed at the perimeter of the work areas to divert, store, or limit runoff. In addition, good housekeeping measures will be followed during the day-to-day site operations under the control of the contractor to minimize the impact of debris removal activities. This section describes the control practices that will be in place during debris removal activities. All recommended control practices will comply with the standards set in the MassDEP Stormwater Policy Handbook. ' 2.1 Minimize Disturbed Area and Protect Natural Features and Soil In order to minimize disturbed areas, all work will be completed within well-defined work limits. These work limits are shown on the site plan (Appendix D). The Contractor will be responsible to make sure that all workers know the proper work limits and do not extend their work into the undisturbed areas. The protective measures are described in more detail in the following ' sections. 2.2 Phased Debris Removal ' Weston & Sampson has proposed a three phase approach to complete the work. Phase 1: Placement of Erosion and Sedimentation Controls Erosion and sedimentation controls will be located at the limit of work, except where vehicle access is located. Details and locations of all controls can be found in Appendix D. 1 Phase 2: Asbestos Abatement All asbestos-containing and hazardous materials shall be removed and disposed. Demolition, abatement and bulk loading activities will be conducted in accordance with applicable federal, state and City of Salem regulations and ordinances. A work plan will be prepared by the ' engineer and approved by the Massachusetts Department of Environmental Protection. Water used during the abatement shall be collected and filtered through a system with at least a 5- micron particle size collection capability. Filtered water shall be pumped to a frac tank to be re- used for dust control or discharged to the ground. Phase 3: Building Demolition, Debris Removal and Site Restoration ' The proposed areas for building demolition and debris removal are shown on the attached plans (Appendix D). Work will include the demolition of a vacant two-story warehouse building. All material will be handled according to the appropriate specifications and removed from the site. All care will be taken to prevent escape of materials from the proposed Limit-of-work during demolition activities. Only a concrete pad (floor of the demolished building) will remain after project completion. ' 2.3 Stabilize Soils The Contractor shall limit the area of land, which is exposed and free from vegetation during debris removal. Although not anticipated, in areas where the period of exposure will be greater than two (2) months, mulching, the use of erosion control mats, or other protective measures shall be provided as specified. ' 2.4 Proper storage and cover The location of the Contractor's storage areas for equipment and/or materials shall be upon cleared portions of the job site or areas to be cleared as a part of this project, and shall require written approval of the Engineer. Adequate measures for erosion and sediment control such as the placement of baled straw around the entire perimeter shall be employed to protect any downstream areas from siltation. ' 2.5 Perimeter Controls and Sediment Barriers Erosion control lines as described in Section 5.0 and shown on the plans (Appendix D) will be ' utilized to ensure that no sedimentation occurs outside the perimeter of the work area. 2.6 Storm Drain Inlet Protection Storm drains will be protected within work limits at the Site. Filter fabric will be placed on top of the storm drains and straw bales will be around storm drain perimeter to protect sediment migration into storm drains. ' 2.7 Retain Sediment On-Site The Contractor will be responsible for monitoring all erosion control measures. When ' necessary, the Contractor will clear all sediment from the straw bales or silt fence that have been silted up during demolition. ' Sections 2.8 through 2.11 include the good housekeeping practices that will be followed on-site during the debris removal project. ' 2.8 Material Handling and Waste Management All materials stored on-site will be stored in a neat, orderly manner. All materials will be kept in their original containers with the original manufacturer's label. Substances will not be mixed with one another unless recommended by the manufacturer. Debris will be disposed of or recycled in accordance with local, state and federal requirements. The contractor will be responsible for all waste removal. Sanitary waste will be collected from the portable units a minimum of once a week, by a licensed sanitary waste management contractor. ' 2.9 Designated Washout Areas The Contractor shall use washout facilities at their own facilities, unless otherwise directed by the Engineer. 2.10 Proper EquipmentNehicle Fueling and Maintenance Practices On-site vehicles will be monitored for leaks and receive regular preventative maintenance to reduce the risk of leakage. To ensure that leaks on stored equipment do not contaminate the site, oil-absorbing mats will be placed under all equipment during storage. Regular fueling and service of the equipment may be performed using approved methods and with care taken to ' minimize chance of spills. Any petroleum products will be stored in tightly sealed containers that are clearly labeled. ' 2.11 EquipmentNehicle Washing The Contractor will be responsible to ensure that no equipment is washed on-site except to remove sediments prior to transport from the site. 3.0 Spill Prevention and Control Plan The Contractor will be responsible for preventing spills in accordance with the project specifications and applicable federal, state and local regulations. The Contractor will identify a properly trained site employee, involved with the day-to-day site operations to be the spill prevention and cleanup coordinator. The name(s) of the responsible spill personnel will be posted on-site. Each employee will be instructed that all spills are to be reported to the spill ' prevention and cleanup coordinator. 3.1 Spill Control Equipment Spill control/containment equipment will be kept in the Work Area. Materials and equipment necessary for spill cleanup will be kept either in the Work Area or in an otherwise accessible on- site location. Equipment and materials will include, but not be limited to, absorbent booms/mats, brooms, dust pans, mops, rags, gloves, goggles, sand, plastic and metal containers specifically for this purpose. It is the responsibility of the Contractor to ensure the inventory will be readily accessible and maintained. 3.2 Notification ' All workers will be directed to inform the on-site supervisor of a spill event. The supervisor will assess the incident and initiate proper containment and response procedures immediately upon notification. Workers should avoid direct contact with spilled materials during the containment procedures. Primary notification of a spill should be made to the Salem Fire and Police Departments. Secondary notification will be to the certified cleanup contractor, if deemed necessary by Fire and/or Police personnel. The third level of notification is to MassDEP. The ' specific cleanup contractor to be used will be identified by the Contractor prior to commencement of debris removal activities. 3.3 Spill Containment and Clean-Up Measures Spills will be contained with granular sorbent material, sand, sorbent pads, booms or all of the above to prevent spreading. Certified cleanup contractors should complete spill cleanup. The ' material manufacturer's recommended methods for spill cleanup will be clearly posted and on- site personnel will be made aware of the procedures and the location of the information and cleanup supplies. ' 3.4 Hazardous Materials Spill Report The Contractor will report and record any spill. The spill report will present a description of the ' release, including the quantity and type of material, date of the spill, circumstances leading to the release, location of spill, response actions and personnel, documentation of notifications and corrective measures implemented to prevent reoccurrence. This document does not relieve the Contractor of the Federal reporting requirements of 40 CFR Part 110, 40 CFR Part 117, 40 CFR Part 302 and the State requirements specified under the Massachusetts Contingency Plan ' (MCP)re lating to spills or other releases of oils or hazardous substances. Where a release containing a hazardous substance or oil in an amount equal to or in excess of a reportable quantity established under either 40 CFR Part 110, 40 CFR Part 117 or 40 CFR Part 302, occurs during a twenty-four(24) hour period, the Contractor is required to comply with the response requirements of the above mentioned regulations. This Section specifies requirements for controlling dust generated during work of this ' Contract. Work activities requiring special attention to dust control include building demolition, asphalt/concrete demolition, stockpiling, loading and removal of material from the site, and earthwork. As used in this Section, the word `site' refers to the area encompassed by the Contract Limits of Work (Facemate Demolition Project). Dust generated during the course of the Work must be controlled and kept on-site. B. The Contractor is responsible for control of dust at all times during work of this Contract, 24 hours per day, 7 days per week, including non-working hours, weekends, and holidays. C. During the progress of the work, the Contractor shall conduct his operations and maintain the area of his activities, including sweeping and sprinkling of streets as ' necessary, to minimize creation and dispersion of dust. The Engineer may perform air/dust monitoring for confirmation purposes. If dust exceeds action levels described in this Section, or determined to be a nuisance by the Engineer, the Contractor shall be ' responsible for implementing additional engineering controls (e.g. additional dust suppression agents, wind screens), as directed by the Engineer, and described in this Section at no additional cost to the Owner. D. The Contractor shall conform to air monitoring action levels specified in Section 13282 - Lead-Based Coatings Removal during the demolition of structures involving lead paint where lead exposure to workers may be in excess of the permissible exposure limit(PEL) as described in Section 13282 - Lead-Based Coatings Removal. E. The Contractor is responsible for daily clean-up of public roadways, adjacent driveways/parking lots, and walkways affected by work of this Contract. The Contractor shall perform all work specified under this Section in compliance with the Massachusetts Department of Environmental Protection, Code of Massachusetts Regulations (CMR) 310 CMR 7.00, "Air Pollution Control Regulations", specifically 310 CMR 7.09, "Dust, Odor, Construction and Demolition". B. Work of this Contract shall be conducted in a manner that will not result in excessive particulate matter emissions, nuisance dust conditions, PMio (particulate matter with an aerodynamic diameter less than or equal to 10 microns) emissions, or PMio concentrations exceeding the Massachusetts and National Ambient Air Quality Standard of 150 ug/m3 on 24-hour average basis. 1.04 SUBMITTALS: A. Contractor shall submit a Dust Control Plan that outlines in detail the measures that he ' will implement to comply with this Section, including suppression, wind screens and barriers (if necessary), prevention, cleanup, and other measures. Plan shall be submitted to the Engineer within fifteen calendar days following the date of the Notice ' to Proceed. B. Contractor shall submit to the Engineer product literature and Material Safety Data Sheets for any dust suppression wetting agents and stabilizers that the Contractor proposes to use. ' 1.05 QUALITY CONTROL: A. The Engineer may conduct air monitoring with a Mini RAM monitor, or equivalent, to ensure dust is being controlled at the site. During the course of the Work, the Contractor shall be responsible for implementing engineering controls (e.g., wetting, ' calcium chloride) to minimize or eliminate fugitive dust emissions. If dust exceeds action levels described below, or determined to be a nuisance by the Engineer, the Contractor shall be responsible for implementing additional engineering controls (e.g. additional dust suppression agents, wind screens), as directed by the Engineer. If additional wet suppression (water) and/or wind screens, barriers, or covers are required per the Engineer based on air/dust monitoring results, they shall be at no additional cost to the Owner. 01562-2 PART 2 - PRODUCTS 2.01 DUST SUPPRESSION AGENTS: A. Dust suppression wetting agents shall be water soluble, non-toxic, non-reactive, non- volatile, and non foaming. ' B. Soil stabilizer shall be a sprayable organic or inorganic tackifier. 2.02 BARRIERS, SCREENS, AND COVERS: A. Mesh Fabric/Wind screens shall be a durable fabric mesh of 50 percent porosity, attached to the temporary chain link fence to be installed as shown on the Contract Drawings and specified in Section 02821 —Temporary Chain Link Fence. B. Wind barriers, if required, shall be solid wood fences or solid durable fabric, attached to Site's temporary chain link fence, or other solid barriers intended to block the passage of wind. C. Covers for stockpiles, if required, shall be plastic tarps. Covers shall be 20-mil. polyethylene sheeting or 10-mil. nylon reinforced polyethylene sheeting. The stockpiles shall be placed on 40 mil. polyethylene sheeting. 2.03 CALCIUM CHLORIDE: A. Calcium chloride shall conform to the requirements of AASHTO-M 144, Type I or Type II and Specification for Calcium Chloride, ASTM D98. The calcium chloride shall be packaged in moisture proof bags or in airtight drums with the manufacturer, name of product, net weight, and percentage of calcium chloride guaranteed by the manufacturer legibly marked on each container. ' B. Calcium chloride failing to meet the requirements of the aforementioned specifications or that which has become caked or sticky in shipment, may be rejected by the Engineer. r2.04 WATER: A. Water shall not be brackish and shall be free from oil, acid, and injurious alkali or vegetable matter. PART 3 - EXECUTION 3.01 CONSTRUCTION SITE DUST CONTROL—GENERAL: ' A. Wet suppression shall be used to provide temporary control of dust. Several applications per day may be necessary to control dust depending upon meteorological 01562-3 1 conditions and work activity. The Contractor shall apply wet suppression on a routine basis as necessary or directed by the Engineer, to control dust. At a minimum, wet suppression shall be applied to demolition debris, excavated material, aggregate piles, and exposed soils and dirt. 1. Wet suppression consists of the application of water or a wetting agent in solution with water. Ensure wetting agent is not used on plantable soils. 1 2. Wet suppression equipment shall consist of sprinkler pipelines, tanks, tank trucks, or other devices capable of providing regulated flow, uniform spray, and positive shut-off. 3. Water may be sprinkler applied with equipment including a tank with gauge- equipped pressure pump and a nozzle-equipped spray bar. 4. Water shall be dispersed through the nozzle under a minimum pressure of 20 pounds per square inch, gauge pressure. 5. Dust control will be used under windy and/or hot conditions, which will lead to the evaporation of much of the dust control product. Wet suppression shall be used to provide temporary control of dust. Several applications per day may be necessary to control dust depending upon meteorological conditions and work activity. At a minimum, wet suppression shall be applied to demolition debris, excavated material, aggregate piles, and exposed soils and dirt. Calcium chloride shall be used to control dust instead of wet suppression when freezing conditions exist. Calcium chloride shall be uniformly applied by a mechanical spreader at 1-%2 pounds per square yard, unless otherwise directed by the Engineer. Ensure vegetation or soil to be used for vegetation is not treated. C. The use of petroleum products for dust suppression is prohibited in this Contract. D. Provide wind screens and wind barriers, if required, in locations where they would be effective in minimizing wind erosion and spread of dust. The Contractor shall keep wind screens and barriers in good repair for the life of the Contract. 3.02 PUBLIC ROADWAY DUST CONTROL: 01562-4 iA. Vehicles leaving the demolition site shall have no mud and dirt on the vehicle body or wheels. Any foreign matter on the vehicle body or wheels shall be physically removed prior to vehicle's entering of a public roadway. Contractor shall not permit any truck to leave the site with exterior mud or dirt that has the potential to be deposited on public roadways. Refer also to Section 01570 — Environmental Protection for equipment and vehicle decontamination requirements. ' B. Haul truck cargo areas shall be securely and completely covered during material transport on public roadways. C. Vehicle mud and dirt carryout, material spills, and soil wash-out onto public roadways and walkways and other paved areas shall be cleaned up immediately. D. The Contractor is responsible for daily clean-up of public roadways and walkways affected by work of this Contract. A wet spray power vacuum street sweeper shall be used on paved roadway. Dry power sweeping is prohibited. 3.03 CONTROL OF EARTHWORK DUST: A. During batch drop operations (i.e., earthwork with front-end loader, clamshell bucket, or backhoe) the free drop height of excavated or aggregate material shall be reduced as much as practical to minimize the generation of dust. B. To prevent spills during transport, freeboard space shall be maintained between the 1 material load and the top of the truck cargo bed rail. 3.04 CONTROL OF STOCKPILE DUST: A. The Contractor shall use the following methods to control dust and wind erosion of active and inactive stockpiles: 1. Wet suppression without wetting agent during active stockpile load-in, load-out, and maintenance activities. 2. Soil stabilizers applied to the surface of inactive stockpiles. 3. Polyethylene tarps on stockpiles shall be placed both below and on top of stockpiles, and secured with sandbags or an equivalent method to prevent the cover from being dislodged by the wind. The Contractor shall repair or replace covers whenever damaged or dislodged, at no additional cost to the Owner. 4. The tarps shall be bermed 12" high at all edges to prevent any infiltration of storm water or exfiltration of leachate. 01562-5 B. The methods to be used shall be submitted to the Engineer as part of the Dust Control Plan. 3.05 DEBRIS AND DEMOLITION DUST CONTROL MEASURES: A. The Contractor shall use water sprinkling, temporary enclosures, and other suitable methods to limit dust and dirt rising and scattering in the air to the lowest practical level. Sufficient water shall be supplied for the building, demolition-related debris, and site compacting to meet Federal, State, and local air-quality regulations and to minimize dust during demolition and debris handling. B. Closed chutes shall be used for the handling of debris. Dropping or throwing of debris is prohibited. C. Debris may be stockpiled but must be done in accordance with Section 02220 — Demolition. D. During transport of debris,the truck cargo area shall be securely covered. ' E. Description The work covered by this Section of the Specifications consists of furnishing all labor, ' materials, tools and equipment and performing all work required for the prevention of environmental pollution during and as a result of demolition operations under this Contract.As used in this Section, the word `site' refers to the area encompassed by the Contract Limits of Work (Facemate Demolition Project). 2. Notification IThe Engineer will notify the Contractor in writing of any non-compliance with the foregoing provisions. The Contractor shall, after receipt of such notice, immediately take corrective action. Such notice, when delivered to the Contractor or his authorized representative at the site of the work, shall be deemed sufficient for the purpose. If the Contractor fails to act promptly, the Engineer may order stoppage of all or part of the work until satisfactory corrective action has been taken. No claim for an extension of time or for excess costs or damage incurred by the Contractor as a result of time lost due to any stop work orders shall be made unless it was later determined that the Contractor was in compliance. 3. Implementation A. Prior to commencement of work, the Contractor shall meet with representatives of the Engineer to develop mutual understandings relative to compliance of the environmental protection program. 08/05/2002 01570-1 1 B. The Contractor shall submit for approval six sets of details and literature fully describing environmental protection methods to be employed in carrying out construction activities. 4. Area of Construction Activity Insofar as possible, the Contractor shall confine his construction activities to those areas defined by the Contract Drawings and Specifications. All land resources within the project boundaries and outside the limits of permanent work performed under this contract shall be preserved in their present condition or be restored to a condition after completion of demolition at least equal to that which existed prior to work under this contract.The Contractor shall keep the streets clear of debris, equipment and vehicles at all times for Chicopee Fire Department access, as shown on the Contract Drawings. 5. Protection of Water Resources A. The Contractor shall not pollute streams, lakes or reservoirs with fuels, oils, bitumens, calcium chloride,acids or other harmful materials. The Contractor shall also prevent the transport of soil, dirt,and salt to surface streams,wetlands,and/or catch basins. It is the Contractor's responsibility to comply with all applicable Federal, State, County and Municipal laws regarding pollution of rivers and streams. B. Special measures should be taken to insure against spillage of any pollutants into public waters, and run-off of demolition site sediments into stormwater collection systems. Measures shall include placement of strawbales and silt traps around catchbasins and along temporary construction fencing, as indicated on the Contract Drawings. C. Catchbasins shall be protected as specified in Section 01110 — Control of Work and Materials and as shown on the Contract Documents with a nonwoven geotextile filter fabric trap, or strawbales, as described in this Section and shown on the Contract Drawings,and as approved by the Engineer. The Contractor,Engineer,and Owner shall conduct a pre-demolition inspection of the catch basins to assess sediment accumulation and shall coordinate with the Chicopee Department of Public Works (DPW) to clean catch basins, as required, prior to demolition activities. ' D. The Contractor is responsible for maintaining flow into each catch basin shown to be protected on the Contract Documents to prevent ponding/flooding. The Contractor shall clean filter fabric by removing accumulated material,as needed.Removed material shall be disposed of per applicable local, State,and Federal requirements at no extra cost to the Owner. E. The filter drainage fabric shall be composed of continuous-filament fibers bonded together to form a sheet. The fabric shall be an average of 20 mils thick and possess the characteristic of Mirafi 140 N. 08/05/2002 01570-2 6. Protecting and Minimizing Exposed Areas A. The Contractor shall limit the area of land which is exposed and free from vegetation during demolition. In areas where the period of exposure will be greater than two (2) months,temporary vegetation,mulching or other protective measures shall be provided as specified. B. The Contractor shall take account of the conditions of the soil where temporary cover crop will be used to insure that materials used for temporary vegetation are adaptive to the sediment control. Materials to be used for temporary vegetation shall be approved by the Engineer. 7. Location of Storage Areas A. The location of the Contractor's storage areas for equipment and/or materials shall be upon cleared portions of the job site or areas to be cleared associated with the phase of work being done as a part of this project, and shall require written approval of the Engineer. Plans showing storage facilities for equipment and materials shall be submitted for approval of the Engineer. B. No excavated materials or materials used in backfill operations shall be deposited within a minimum distance of one hundred (100) feet of any watercourse or any drainage facility. Adequate measures for erosion and sediment control(polyethylene sheeting on stockpiles,the placement of baled straw around the downstream perimeter of stockpiles, etc.) shall be employed to protect any downstream areas from siltation. �. C. The Engineer may designate a particular area or areas where the Contractor may store materials used in his operations. 8. Protection of Landscape A. The Contractor shall not deface,injure,or destroy trees or shrubs nor remove or cut them within the Limit of Work, unless shown on the Contract Drawings, and described in Section 02230—Clearing and Grubbing,without written authority from the Owner. No ropes, cables, or guys shall be fastened to or attached to any existing nearby trees for anchorages unless specifically authorized by the Engineer. Excavating machinery and cranes shall be of suitable type and be operated with care to prevent injury to trees which are not to be removed, particularly overhanging branches and limbs. The Contractor shall, in any event, be responsible for any damage resulting from such use. If the Contractor damages trees not designated for removal, the Contractor shall remove damaged trees,including stump removal,per Section 02230—Clearing and Grubbing,at no additional cost to the Owner. B. Branches, limbs, and roots shall not be cut except by permission of the Engineer. All cutting shall be smoothly and neatly done without splitting or crushing. C. Where,in the opinion of the Engineer,trees may possibly be defaced,bruised,injured,or otherwise damaged by the Contractor's equipment or other operations,the Engineer may direct the Contractor to adequately protect such trees by placing boards,planks,poles or ' fencing around them. Any trees or landscape feature scarred or damaged by the Contractor's equipment or operations shall be removed, including stump removal, per Section 02230—Clearing and Grubbing, at the expense of the Contractor. Dust Control A. During the progress of the Work, the Contractor shall conduct his operations and maintain the area of his activities, including sweeping and sprinkling of streets as necessary,to minimize creation and dispersion of dust in accordance with Section 01562 ' - Dust Control. The Engineer may conduct air monitoring to ensure dust is being controlled at the Site. If dust exceeds action levels provided in Section 01562- Dust Control, the Contractor shall be responsible for implementing additional engineering controls (e.g. additional dust suppression agent, etc.) as described in Section 01562 - Dust Control, at no additional cost to the Owner. 12. Baled Straw To trap sediment and to prevent sediment from clogging drainage systems,baled straw shall be used where shown on the Contract Drawings. Care shall be taken to keep the bales from breaking apart. The bales should be securely staked to prevent overturning, flotation, or displacement. All deposited sediment shall be removed periodically. 08/05/2002 01570-4 13. Silt Fence A. Where indicated on the drawings or where directed by the Engineer,the Contractor shall erect and maintain a temporary silt fence. In areas designated as wetlands,the Contractor shall line the limits of the construction easement with a silt fence. The silt fence shall be used specifically to contain sediment from runoff water and to minimize environmental damage caused by construction. B. The silt fence shall consist of a 3-foot wide continuous length sediment control fabric, 1 stitched to a 22-foot wide,continuous length support netting,and stapled to preweathered oak posts installed as shown on the drawings. The oak posts shall be 1%-inches by 1%- inches (Minimum Dimension) by 48 inches and shall be tapered. The support netting shall be industrial strength polypropylene. The Contractor shall make special provisions to prevent excessive noise during demolition and construction.No heavy demolition and construction equipment or large engine vehicle shall be allowed to operate on the site between the hours of 7 PM and 7 AM,unless special permission is granted by the Owner. Temporary noise barriers shall be erected by the Contractor at the direction of the Owner if the noise level at the perimeter of the site is determined as excessive. B. When available,make the maximum use of"low-noise-emission products"as certified by EPA. No blasting or use of explosives is permitted. C. Protect employees against noise exposure in accordance with the requirements of the Occupational Safety and Health Act of 1972. D. Compliance with the requirements of this Section will not offer any relief from responsibility for compliance with local ordinances, regulations, and other Sections. iE. Compliance with the requirements of this Section will require the use of machines with 08/05/2002 01570-5 effective mufflers or enclosures and selection of quieter alternative procedures. F. Unless otherwise indicated,all noise level limits are measured 50 feet from the equipment producing said noise. G. Noise Level Restrictions in All Areas: In no case expose the public to demolition and construction noise levels exceeding 85 dBA(slow)or to impulsive noise levels with a peak sound pressure level exceeding 125 dBA (fast). If work is specifically approved by Engineer during nighttime, restrict noise levels to not more than 50 dBA (slow). ' Intermittent Noise: Prevent noises from nonstationary mobile equipment operated by a driver or from any source of nonscheduled intermittent,nonrepetitive,short-term noises not lasting more than a few hours from exceeding 75 dBA daytime and 60 dBA nighttime. ' 15. Waste A. All rubbish and surplus material shall be handled and disposed of in accordance with all local, State, and Federal requirements. iB. Provide rubbish and garbage containers at several locations throughout the site. Empty containers at regular intervals to avoid overfilling. 1 C. Provide temporary chemical toilets and periodically empty wastes according to all Federal, State, and local regulations. ' C. Conduct fueling and lubricating of equipment and motor vehicles in a manner that affords the maximum protection against spills and evaporation. Dispose of lubricants to be discarded and excess oil in accordance with approved procedures meeting Federal, State and local regulations. 16. Equipment and Vehicle Decontamination A. Vehicles leaving the Site shall not carry out mud or dirt from the site on the vehicle body or wheels. Any foreign matter on the vehicle body or wheels shall be physically removed prior to vehicle's entering of a public roadway. Contractor shall not permit any truck to leave the site with exterior mud or dirt that has the potential to be deposited on public roadways. Contractor shall be responsible for assuring that each vehicle is properly cleaned and/or decontaminated prior to exiting the site.The Contractor shall prevent carry- out or spillage of material from his/her vehicles onto public ways. The Contractor shall promptly clean up and dispose of all material and debris deposited on public ways to the Owner's satisfaction. If vehicles track mud and dirt off-site, the Contractor shall be responsible for additional engineering controls such as wheel washing at no extra cost to the Owner. The Contractor shall be responsible for collecting all wash water and sediment, as required, at no additional cost to the Owner. The Contractor shall ensure that material hauling vehicles remain on paved surfaces as much as possible. ' B. Vehicle mud and dirt carryout,material spills,and soil wash-out onto public roadways and walkways and other paved areas shall be cleaned up immediately by the Contractor at no additional expense to the Owner. The Contractor also shall not create conditions that allow silt laden runoff to run onto public ways. A wet spray power vacuum street sweeper shall be used on paved roadway, as required. Dry power sweeping is prohibited. Costs associated with cleaning/sweeping of public roadways is considered incidental to the Project. E. Construction equipment,tools and appliances used during the Work shall also be cleaned and/or decontaminated. Mud, dirt, and any other foreign matter shall be physically removed from equipment and tools prior to being removed from the site and stockpiled with excavated material identified for off-site disposal. F. All vehicle containers shall be carefully loaded to avoid contamination of exterior surfaces. No wetland resource areas were noted at the site. An isolated wetland area was noted just south of the property boundary(see attached figure). The bank ' of the North River, located to the North of the site, was flagged to determine if the site is within the 200-foot Riverfront Protection Area. The isolated wetland boundary was marked using pink flagging with the code "WF" and numbered WF-1 through WF-9(see attached field map). A 10' x 10' sample plot and investigation, with soil boring,was conducted on the wetland side of the ' wetland boundary at WF-3. The results of this sample plot investigation are presented below. Soils— All values and chromas were taken from the Mansell Color Chart. A-horizon=0-6"bgs were dark black soils(l0Y 2/1).
