The Commission has reviewed the above-referenced Notice of Intent and plans and has
held a public hearing on the project. Based on the information available to the Commission at this
time, the Commission has determined that the area on which the proposed work is to be done is
significant to the following interests in accordance with the Presumptions of Significance set forth in the -
regulations for each Area Subject to Protection under the Act (check as appropriate):

Therefore, the C'ommisaion hereby fi..ds that the fcllowing conditions
are necessary, in accordance with the Performance Standards set forth in the
regulaticns, -c. protect those interests checked above. The Commission
orders that all work shall be performed in accordance with said conditions and
with the Notice of In referenced above. To the extent that the following
conditions modify or differ from the plans, specifications or other proposals
submitted with the Notice of Intent, the conditions shall control.
General Conditions
1. Failure to comply with all conditions stated herein, and with all related
statutes and other regulatory measures, shall be deemed cause to revoke
or modify this Order.
2. The Order does not grant any property rights or any exclusive privileges;
it does not authorize any injury to private property or invasion of
private rights.
3. This Order does not relieve the permittee or any other person of the
necessity of complying with all other applicable federal, state or local
statutes, ordinances, by-laws or regulations.
a. The work authorized hereunder shall be completed within three years from
the date of this Order unless either of the following apply:
(a) the work is a maintenance dredging project as provided for in the
Act; or
(b) the time for completion has been extended to a specified date more
than three years, but less than five years, from the date of issuance
and both that date and the special circumstances warranting the
extended time period are set forth in this Order.
S. This Order may be extended by the issuing authority for one or more
periods of up to three years each upon application to the issuing
authority at least 30 days prior to the expiration date of the Order.
6. Any Yill used in connection with this project shall bt clean fill,
containing no crash, refuse, rubbish or debris, including but not limited
to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires,
ashes, refrigerators, motor vehicles or parts of any of the foregoing.
7. No work shall be undertaken until all administrative appeal periods from
this Order have elapsed or, if such an appeal has been filed, until all
proceedings before the Department have been completed.
B . No work shall be undertaken until the Final order has been recorded
in the Registry of Deeds or the Land Court for the district in which
the land is located, within the chain of title of the affected
property. In the case of recorded land, the Final Order shall also
be noted in the Registry's Grantor Index under the name of the owner
of the land upon which the proposed work is to be done. In the case
of registered land, the Final order shall also be noted on the Land
Court Certificate of Title of the owner of the land upon which the
proposed work is to be done. The recording informatin shall be
submitted to the Commission on the form at the end of this order
prior to commencement of the work.
9. A sign shall be displayed at the site not less than two square feet or
more than three square feet in size bearing the words,
"Massachusett6srtment of Environmental Protection,
File Number 4-256 1.
10. where the Department of Environmental Protection is requested to make a
determination and to issue a Superseding Order, the Conservation
Commission shall be a party to all agency proceedings and hearings before
the Department.

SPECIAL CONDITIONS 4-94
1 . All work shall conform to the above-referenced Notice of
Intent, site plan and supporting documents and those final
specifications which shall be filed with the Commission prior to
_ construction. Any change made or intended to be made to the
approved plans shall require the applicant to inquire of the
Commission in writing whether the change is substantial enough to
require the filing of a new Notice of Intent.
2. Members and agents of the Commission shall have the right to
enter and inspect the premises at all reasonable times to evaluate
compliance with the conditions in this Order. The Commission may
require the applicant to submit additional data or information
necessary for the Commission to conduct that evaluation.

with the request for a Certification of Compliance, an affidavit,
prepared by a professional engineer or land surveyor registered in
the Commonwealth of Massachusetts , stating that the site has been
developed in accordance with the requirements of this order of
Conditions, the referenced site plan and supporting documents.
4. This order shall apply to every successor in control or
successor in interest of the property described in the Notice of
Intent and accompanying plans or part thereof. In the event this
land or any part thereof changes ownership before or during
construction, the current owner shall notify the new owner, by
registered mail , of this order prior to the transfer of ownership
and shall forward proof of this notification to the Commission.
5 . Prior to commencement of construction activity, a haybale
barrier shall be placed downgradient of construction to prevent
siltation of the adjacent wetland. Haybales shall be anchored with
stakes and entrenched 4 to 6 inches in depth. Trench material
shall be. deposited on the upgradient side of the haybale barrier.
Haybales shall be inspected daily; those showing signs of
deterioration shall be replaced immediately. The haybale barrier
shall remain in proper functioning condition until all disturbed
areas have been stabilized.
6. Additional erosion and sedimentation control measures deemed
necessary by the Commission shall be instituted by the applicant.
Any siltation caused. onto. any wetland or waterway area shall be
promptly reported. to the. Commission. Such areas shall be restored
to the satisfaction of the Commission.
7. During construction, no debris , fill, or excavated material
shall be stockpiled within 100 feet of designated wetlands: Any
other stockpile location will be protected sufficient to- prevent
sediment from surface runoff entering wetlands.
S. A paved berm shall- be installed_ around the parking lot perimeter
to contain and direct,the flow of water to catch basins.

for Conservation Commission approval .
10 . * A letter confirmina the implementation of the cleaning and

December 15 , annually.
11. Any proposed headwalls with pipes shall be fitted with a
protective barrier, approved by the Commission , sufficient to
assure the free flow of water.
12. Equipment servicing and overnight equipment storage must be
conducted outside the buffer zone. Equipment must be maintained to
prevent leakage or discharge of pollutants.
13 . * No spill or discharge of petroleum products or other
ooilutants will occur within 100 feet of anv wetland resource area.
4 . _ Use or storage or rock salt ( sodium chlo
ride ) or other toxic
de-icina chemicals is prohibited within 100 feet of the resource
area. Anv arrangement for snow removal shall stipulate the ban.
15. Notice shall be given this Commission no more than 2 weeks nor
less than 2 days prior to the commencement of construction
activities. Said notice shall include, in writing, the name(s) ,
address(es I , and business and home telephone numbers of the project
supervisors ) responsible for insuring that operations are
conducted in compliance with this order.
16 . * Minimal prunina and no removal of anv buffer zone or wetland
vegetation will occur downgradient of the staked havbale line.

19. A plan for landscaping and maintenance of vegetation for the
buffer zone shall be developed and submitted for Conservation
Commission approval prior- to commencement of work.
20. . No project activities will. be conducted between December 1 and
March 15. Projects shutting down for the winter-will , by December
1 complete slope stabilization sufficient to� prevent
erosion or

discussed,Hasbro is planting to perform some limited investigatory activities during June of this
year. These activities will consist of the installation of several soil borings and groundwater
monitoring wells. In accordance with the requirements of the Massachusetts Contingency Plan,soil
and groundwater samples collected from the borings and the wells will be analyzed to assist in
furtber characterizing the site. I will continue to keep you informed about die on-going site
investigation and will be glad to alert you in advance of the sampling activities.

LAND SUBJECT TO COASTAL STORM FLOWAGE
The site is located within the 100 year floodplain (elevation 10.00 C-1,N-1
NGVD) of a coastal area designated by the Office of Coastal Zone
Management. The site is presumed not significant to protection of the
' Interests of the Act due to the following reasons: a) Historic filling of
the site and the adjacent area in the late 1800's;b) The site surface is
largely paved and impervious; c) Extensive site improvements and
structures have long existed on the site; d) The MBTA rail line
separates the site from the North River; and e) There is an existing
seawall serving as the COASTAL BANK of the North River.
The proposed demolition project is designed to preserve, to the extent
' possible, existing subsurface conditions, to minimize changes to
surficial topography of the site, and to facilitate redevelopment of the
site.

To minimize and mitigate the transport of sediment toward the North C-1,N-1
River, the following control measures will be implemented as shown
' on the plan prior to initiation of work: Siltation fence will be installed
around the site perimeter along the existing chainlink fence and
haybales will be installed around each stormwater intake structure.
These measures will be maintained and replaced as necessary for the
duration of construction and until such time as disturbed areas are
stabilized to prevent erosion.
It should be noted, however, that none of the structures scheduled for
demolition are located within the buffer zone. In addition, potential
impact to the COASTAL BANK is further reduced due to the
existing elevated MBTA Right-of Way located between the site and
the North River.

' PROJECT NARRATIVE
' SITE DESCRIPTION
The subject site, 190 Bridge Street in Salem, Massachusetts, has been most recently occupied by
the former Parker Brothers manufacturing facility. The facility is situated adjacent to the MBTA
Salem Station just easterly of the North River. The parcel consists of approximately 15 acres
improved with 300,000 sf of industrial/manufacturing space in a total of thirteen buildings, eleven
of which are attached. Existing site improvements also include associated parking areas and utility
installations. The buildings vary significantly in age and type of construction ranging from the
original wood frame structure built sometime in the mid 1800's to the 92,340 sf modem steel-
frame warehouse constructed in 1968.
According to plans on file at the Salem City Offices, prior to being filled in the 1800's, the
property was once a tidal mudflat of the North River. The entire area, including the project site and
much of Salem was filled sometime in the mid to late 1800's. An MBTA rail line and a seawall
' separate the site from the North River.
The site is almost entirely paved and impervious. With the exception of a small growth of sparse
scrub brush at the far northeast comer of the site,the parcel is mostly devoid of vegetation.
The site is located in an area designated as within the 100 year floodplain of a coastal area
designated by the Office of Coastal Zone Management. The elevation of the 100 year flood is
shown as 10.00 NGVD in the area of the site on the FEMA Flood Insurance Rate Map (FIRM)

The existing site topography is fairly flat, ranging in elevation of 10±at Bridge Street to 8± along
the northerly property line adjacent to the MBTA tracks.
The existing buildings have been vacant for approximately two years. Hasbro, Inc. and the City of
Salem are currently seeking proposals for the redevelopment of this property. Hasbro is
undertaking this demolition project in preparation for site redevelopment.
PROJECT DESCRIPTION
The project entails the demolition of all existing above-ground structures on the subject 15 acre
parcel. These structures are constructed on different types of subsurface support systems that will
be retained in place wherever possible for potential reuse in connection with redevelopment of the
' site. Utilities will be abandoned in-place after termination in accordance with all applicable
regulations. Existing bituminous concrete pavement will remain in place to serve as stabilization of
the ground surface prior to redevelopment.
Existing building slabs and miscellaneous concrete will be crushed and compacted in layers to
provide a stable site surface. All other interior building furnishings and construction materials will
' be removed and properly disposed of off-site. Existing site storm drainage systems will be
maintained in good working order during and after completion of the demolition project.
MITIGATION OF PROJECT IMPACTS
The area within which the demolition project will take place will be surrounded by a silt fence
proposed to be installed along the existing chainlink security fence located on the perimeter of the
property. This barrier together with demolition protocols will be designed to minimize and mitigate
sediment transport. In addition, haybales will be installed around each stormwater intake structure
(i.e. all catch basin grates). All haybales/siltation fencing will be maintained and/or replaced as
necessary for the duration of the demolition project.
The proposed demolition project is designed to preserve, to the extent possible, existing subsurface
conditions, to minimize changes to surficial topography of the site, and to facilitate redevelopment
of the site.

1 WORKSHEET FOR NOTICE OF INTENT FEES
The filing fee is the sum of the fees for each of the proposed activities in the notice. Circle the letter of each
activity that is proposed within a resource area or buffer zone, as defined in the Wetlands Protection Act and
Regulations. If more than one of a given activity is proposed,write down the number of occurrences of the activ-
ity(e.g.,four single-family houses).Add up the total fee on the last page of this worksheet.
Category 1: ($55 each activity)
_ a. Any work on a single-family residential lot including a house addition,deck,garage,garden, pool,shed,
or driveway.Activities excluded from Category 1 include driveways reviewable under 310 CMR 10.53
1 (3)(a) (see Category 2g);construction of an unattached single-family house (see Category 2a);and
construction of a dock,pier,or other coastal engineering structure (see Category 5a).
_ b. Site preparation of each single-family house lot, including removal of vegetation,excavation, and grad-
ing, where actual construction of the house is not proposed under the Notice of Intent.
c. Control of nuisance vegetation by removal, herbicide treatment,or other means,from a resource area,
on each single-family lot,as allowable under 310 CMR 10.53(4)
_ d. Resource improvement allowed under 310 CMR 10.53(4),other than removal of aquatic nuisance veg-
etation, as allowable under said section.
' e. Construction, repair, replacement, or upgrading of a subsurface septic system or any part of such a
system.
f. Activities associated with installation of a monitoring well,other than construction of an access road-
way thereto.
Category 2: ($250 each activity)
I _ a Construction of each single-family house (including single-family houses in a subdivision),any part of
which is in a buffer zone or resource area. Any activities associated with the construction of said
house(s), including associated site preparation and construction of retention/detention basins, utili-
ties, septic systems, roadways and driveways other than those roadways or driveways reviewable
under 310 CMR 10.53(3) (a) (see Category 2g),shall not be subject to additional fees if all said activi-
ties are reviewed under a single Notice of Intent. (For apartmenticondominium type buildings see
Category 3).
b. Parking lot of any size.
c. The placement of sand for purposes of beach nourishment.
L ' d. Any activities reviewable under 310 CMR 10.24(7)(a)through(c) (coastal activities).
e. Any activities reviewable under 310 CMR 10.53(3)(a)through(d)and 310 CMR 10.53(f)through (1)
(limited projects other than driveways and roadways crossing wetlands, including:public utilities;
forestry; improvement or maintenance of public roads;ponds;maintenance of pre-existing structures;
construction of boardwalks,decks, and boathouses;maintenance of road drainage.)Where more than
1 one activity is proposed within an identical footprint (e.g., construction of a sewer within the footprint of
a new roadway)only one fee shall be payable.

1 — f. New agricultural or aquacultural projects.
g. Construction of each crossing for a driveway or roadway associated with an unattached single-family
house, reviewable under 310 CMR 10.53(3)(e) (limited project crossing).
i = h. Any point source discharge (except from a package treatment plant—see Category 4k).
i. Any other activity not described in Categories 1,3,4,or 5.
Category 3: ($525 each activity)
a. Site preparation for any development other than an unattached single-family house or houses, includ-
ing the removal of vegetation, excavation, and grading,where actual construction is not proposed
under the Notice of Intent.
— b. Construction of each building for any commercial, industrial, institutional or multifamily apartment/
condominium/townhouse type development,when any part of the building is in a buffer zone or
resource area.Any activities associated with the construction of said building, including associated
site preparation and construction of retention/detention basins, parking lots, utilities, point source dis-
charges,sewage package treatment plants, and roadways and driveways other than those roadways
or driveways reviewable under 310 CMR 10.53(3)(a)(limited project crossings)(see Category 4a)shall
not be subject to additional fees if all said activities are reviewed under a single Notice of Intent.
— c. Construction of each roadway or driveway, not reviewable under 310 CMR 10.53(3)(a), not associated
with the construction of an unattached single-family house,and not included on the same Notice of
— Intent with building construction (see Category 3b).
d. Any activity associated with the cleanup of hazardous waste, except as otherwise noted in Category 4
below, including excavation,destruction of vegetation, change in subsurface hydrology, placement of
collection wells or other structures for collection and treatment of contaminated solid and/or water.
1 Category 4: ($725 per activity)
— a. Construction of each crossing for a limited project access roadway or driveway reviewable under 310
CMR 10.53(3)(a)associated with a commercial, industrial,or institutional development or with any resi-
dential construction (other than a roadway or driveway crossing associated with the construction of an
unattached single-family house--see Category 2g)
' b. Construction, modification,or repair of a flood-control structure such as a dam, sluiceway,tidegate,
etc.
L c. Construction of each roadway or driveway,not reviewable under 310 CMR 10.53(3)(a)and not asso-
ciated with the construction of an unattached single family house.
— d. Creation,operation, maintenance,or expansion of a public or private sand and/or gravel operation
including but not limited to excavation,filling, and stockpiling.
e. Construction of new railroad lines or extensions of existing lines, including ballast area,placement of
track, signals and switches, and other related structures.
