Dear Mr. Gauthier:
Acomplaint was received by this Department alleging that a third floor, illegal apart-
ment had been rented at 6 Bristol Street, Salem,
The complainant also alleges that three dwelling units are rented in this dwelling while
the neighborhood is zoned R-2.
By coincidence, I met the owner of this rental property, Michael Levinson of 55 Prospect
Street in Marblehead, on site this morning. He told me that the third floor apartment
is currently occupied by two men and that the second means of egress from the apartment
is a trap door in the third floor above the second floor landing of the front staircase.
I could see that the first floor dwelling unit is currently vacant.
Enclosed please see the Building Department's report of May 3, 1978.\
Please advise on this matter.

Dear Mr. Levenson:
In response to a complaint an Inspector from this Department accompanied
by an Inspector from the Salem Health Department inspected the premises
located at 6 Bristol Street owned by you on May 3, 1978.
The inspection revealed the following violations .
1 . Third floor apartment occupied is in violation of the City of Salem
Zoning Ordinances.
2. No permit evident for the third floor apartment.
3. No legal second egress from the third floor apartment.
You are therefore ordered to take corrective action re : the third
floor apartment within seven (7) days of receipt of this notice.
Your failure to comply with this order will result in legal action
being taken against you by this Department and the City of Salem.

REGULATION FOR INSTALLATION OF AUTOMATIC FIRE WARNING UNITS, IN EXISTING THREE (3) ,
FOUR (4) , AND FIKE_ (5) , FAMILY OCCUPIED DWELLINGS.
Under Authority granted by-the C✓ner-al Laws of the Commonwealth of Massachusetts,
Chapter 148, Section 26E; aAPWdepted1by'the Salem City�Couhcil on June 12, 1980,
and effective June 12, 1981, this regulation shall stipulate the recorvendations
acceptable to the Head of the Salem Fire Department, which shall be enforced by
the Salem Fire Prevention Bureau.
1. Definitions:
A. Head of the Fire Department: Chief James F. Brennan
B. City Electrician: John A. Condon
C. Use Group R2: As defined in the Massachusetts State Building Code.
D. Approved Smoke Detector: An approved device which detects visible or in-
visible products of combustion. Such approved stroke detectors for use in
-EXISTING-three-i--four-and five family occupied dwellings, under provisions
of Chapter 148, Section 26D, M.G.L. may be activated by a battery power
source or may be activated by a permanently wired source of alternating
current electric power or connected to a source of alternating current
electric power by an underwriter's laboratory approved cord with a strain
relief and plug retainer. (The Salem Fire Department recomaends the use
of stroke detectors which are permanently connected to a source of alter-
nating current electric power, which could eliminate the human factor,
which often occurs when batteries are not replaced on an annual basis.)
E. Common Hallway: A comron corridor or space separately enclosed which prc-
vides common access to the required exitways of the residential building
or structure.
F. Separate-Sleeping=Area:- Shall_:mean:the area or areas of the dwelling unit
in which the bedrooms, or sleeping rooms are located. Bedrooms or sleeping
rooms, separated by other use areas, such as kitchens or living rooms, but
not bathrooms, shall be considered as separate sleeping areas.
2' Intent of Chapter 148, Section 26E:
A. It is the intent of the Massachusetts General Laws, Chapter 148 Section 26E,
to provide basic protection from products of combustion, which may occur
at any time, and would become a probable threat to life safety.
B. -It_is the intent of this regulation to prescribe a means of basic protection
consistent'with recognized good practice for the safeguarding to a reasonable
degree, of life and property, from said products of combustion. It is the
intent of the Salem Fire Department to permit such protection with the least
possible expense to the owners and occupants of EXISTING three, four and five
family occupied dwellings.
3. Level of Protection:
A. Fbr buildings or structures occupied in whole or in part for residential
purposes and containing a maximum of five dwelling units, the following shall
apply: (1) One approved smoke detector shall be installed on each level of
habitation and in the basement, with a minimum of one unit for
each twelve hundred square feet of floor space on each level.
(2) Locations:
a: An approved smoke detector shall be installed on the ceiling,
near the base of each stairway, but not within said stairway.
(2) S.F.P.R. #15F cont. .
b: An approved smoke detector shall be installed outside
of each separate sleeping area.
c. P7hen no stairway exists from the basement to the habitable
area, an approved smoke detector shall be installed on the
ceiling in the center of the basement area.
d. An approved smoke detector shall be installed within any .
comron hallway of the residential structure.
4. Equipment:
h.- -AIL-smoke detectors-shall_be_Underwriters Laboratories listed units.
B. Monitered battery powered smoke detectors may be used in this class of a ,
occupancy. _
C. Permanently wired stroke detectors connected to a source of alternating
current electric power, may be used as single station or multiple station '.
units,, for this class of occupancy. (The Salem Fire Department recommends
the use of this type unit.-) Power cord units are acceptable.
5. Application for Certificate of Installation and Inspection:
A. A required Certificate of Installation and Inspection shall be. on a Form #81B
as provided by the Salem Fire Department.
B. No fee is required for filing of Form #81B, for three, four and five
family EXISTING Dwelling Units.
C. The responsible person filing Form #8113, shall list the type of detector to
----be-used,—the-location-of-each unit, and shall sign the application which
states that said person is aware of the need for continued maintenance
of the units.
6. Final Inspection: % .
A. Upon completion of the installation, the responsible person who signed
the original Form #8113, shall make arrangements for an inspection and testing
of the smoke detectors, by appointment at a tire convenient to the
occupants and the Fire Department Inspectors. Appointments should be made
at least 48 hours in advance. The owner or agent must be present.
B. Upon satisfactory inspection, the Fire Department Inspector will sign
the Certificate of Inspection, which will be placed on file and a Certi-
ficate of Inspection will be issued to the owner of record.
