A public hearing on the above Petition was opened on April 19, 2017 pursuant to M.G.L Ch. 40A, 5 11 and continued to May 17, 2017 and closed on that date with the following Salem Board of Appeals members present: Rebecca Curran (Chau),Tom Watkins,Mike Duffy,Jimmy Tsitsinos, and Paul Viccica (alternate). The petitioner is seeking a Special Permit per Special Permit per Sec. 3.3.3 of the Salem Zoning Ordinance, Nonconforming Structures, to allow the petitioner to extend a nonconforming structure, and a Variance to Sec. 5.1.5 Parking Design, of the Salem Zoning Ordinance, to exceed the maximum width of entrance and exit drives. Statements of fact: 1. Attorney Joseph Correnti and Attorney Kristin Kolick,representing 295 Bridge Street Associates. The project team also includes: Andrew McBeth, Contractor, Greenleaf Construction; Mark McLeod, Project Engineer, H.L. Turner Group Inc.;Andrew Loverud, Project Architect, Design Science; Bob Matvichuk, F.W.WEBB Salem Store Manager. 2. The City of Salem is also a co-applicant as the City is the owner of 297 Bridge Street, which lot is under agreement with F.W. WEBB. 3. In the petition date-stamped March 29, 2017, the petitioner requested a Special Permit per Sec. 3.3.3 Nonconforming Structures, to allow the petitioner to extend an existing non-conforming structure and a Variance per Sec. 5.1.5 Parking Design, to exceed the maximum width of entrance and exit drives. 4. 293 Bridge Street and 297 Bridge Street were rezoned to the B-4 Zoning District. The parcels were previously within the NRCC zoning district. 5. The current use of the building is classified as Industrial wholesale,warehouse or distribution facility, and sale and storage of building supplies, and retail store, except department store, not elsewhere set forth. These uses are by right under the B-4 Zoning District. 6. The proposed project includes the use of two (2) separate lots, including the City of Salem municipal parking lot and existing F.W. WEBB site. The municipal parking lot is currently under agreement per a public auction conducted on November 14, 2016, at which F.W. Webb or nominee was the low bidder, as set forth in a Memorandum of Sale of even date. City of Salem Board of Appeals May 31,2017 Project:293-297 Bridge Street Page 2 of 7 7. The petitioner is requesting a Special Permit per Sec. 3.3.3 Nonconforming Structures, at the property of 293 Bridge Street, to allow the petitioner to extend a nonconforming structure. The petitioner is proposing a 7,600 +/- square foot single story addition and associated five-story stairway to the existing structure. 8. The existing F.W. WEBB building is non-conforming as to the height and rear yard setback. The proposed addition does not exceed the existing non-conforming dimensions. Five-story stairwell does not exceed the height of the existing non-conforming structure and the proposed one-story showroom does not exceed the existing rear yard setback non-conformity. 9. The petitioner was originally proposing a 40,000 +/- square foot freestanding structure on the municipal parking lot at 297 Bridge Street. This proposal was met with significant neighborhood opposition. The petitioner then proposed a 16,000 +/- square foot two (2) story showroom on the 293 Bridge Street lot,which was also met with significant opposition. The proposal before the Zoning Board of Appeals is a significant compromise consisting of a one-story 7,600 +/- square foot addition at 293 Bridge Street. 10. The proposed addition is a one-story brick structure that will be used as a showroom and retail space for F.W. WEBB. The front fagade has ribbon storefront windows and the brick is proposed to compliment the existing historic brick as much as possible. 11. F.W. WEBB has been located at the property for over a half century and would like to upgrade the business to include a bed and bath showroom in the proposed expansion. The proposal will keep F.W. WEBB in the City of Salem and increase employment and tax revenue to the City. 12. The petitioner is also requesting a Variance per Sec. 5.1.5 Parking Design, to exceed the maximum width of entrance and exit drives. 13. The Zoning Ordinance allows a maximum of 30' feet of width for curbcuts in business and industrial districts. 14. In the original petition, the applicant proposed a 35' foot wide curbcut at western most entrance, 67' wide cutbcut at the center entrance and 53'wide curbcut at the eastern most entrance. 15. At the request of the Board at the April 19,2017 meeting, the petitioner amended the plans to include safer pedestrian access across the proposed 67'wide curbcut. 16. The amended plans included a reduction of curbcut width such that the most eastern and western curbcuts comply with the zoning ordinance dimensional requirements. The curvature of the western most driveway was reconfigured to be 30' feet wide and also provide adequate access for tractor- trailers ractortrailers to exit the property. 17. The petitioner is now requesting a Variance per Sec. 5.1.5 Parking Design, only for the proposed 67' foot wide curbcut. 18. The plan for the 67' foot wide curbcut was amended to include a sidewalk setback onto the parking lot area such that the pedestrian crossing width was reduced from 67' feet to 57' feet. 19. There are many pedestrians who use the existing sidewalk in front the property to access the commuter rail train station. Concord, NH presents associated traffic circulation patterns. The existing loading docks for F.W. WEBB are on the east side of the building. Currently, when deliveries are made from the west, drivers pass the site and then cross over both traffic lanes on Bridge Street to back onto the site. 21. The existing F.W. WEBB parking lot is shared with visitor and employee parking, deliveries and exterior storage. The proposed plan will improve safety on Bridge Street and on-site circulation and safety. 22. The existing driveway opening at the F.W. WEBB property is approximately +/- 90 feet wide, which the petitioner is proposing to narrow to a 28' wide curbcut and provide two (2) parking spaces in front of the proposed showroom/retail space, as shown on the approved plans herein. 23. The existing driveway opening at the municipal parking lot (297 Bridge Street) has a single +/- 30' wide curbcut. The petitioner is proposing two (2) curbcuts including a 30' foot wide curbcut and a 67' wide curbcut. 24. At the April 17, 2017 meeting, Mr. McLeod presented plans with circulation patterns to demonstrate that the 67' wide curbcut opening is necessary to provide an adequate turning radius for tractor- trailers to access the parking lot from the east and west direction. The curbcut also allows drivers to maneuver the tractor-trailers on site in a safe circulation pattern. 25. At the April 17, 2017 meeting, the Board requested that the petitioner look at other curbcut arrangements, including two (2) driveways to allow tractor-trailer traffic onto the site in order to reduce the 67'wide curbcut width proposed. Mr. McLeod was concerned that the circulation pattern required by the tractor-trailers would require multiple turning movements to back into the loading dock. Having multiple turning movements on the site is difficult for truck drivers and creates hazardous circulation conditions in a shared lot with employee and customer parking. Further,two (2) driveways to allow tractor-trailer traffic would require one (1) 40' wide curbcut and one (1) 50' wide curbcut,which would require two (2) variances rather than the one (1) variance requested. 26. A single 67' wide entrance-point, closer to the F.W. WEBB building, makes it clearer to truck drivers to enter at this location. The width of the curbcut allows tractor trailers to enter the site from the east and west bound directions and the curvature of the opening allows for smooth tractor trailer circulation to back into the proposed loading docks without having to make multiple on-site turning movements. The 30' foot driveway to the west will be used by tractor-trailers to exit the site. 27. The literal enforcement to allow only 30' foot curbcut widths would prohibit tractor-trailer trucks from entering the site in a safe manner. A result of the literal enforcement of Sec. 5.1.5 Parking Design, would cause on street loading on Bridge Street 28. At the May 17, 2017 meeting, the Board requested that the petitioner consider additional measures to provide safer pedestrian access across the 67' wide curbcut. The Board requested that the petitioner install a rumble strip or raised pavers to visually narrow the opening such that tractor-trailers could drive over the material, cars could drive in-between, and pedestrians could feel safe crossing the driveway because the change in materials would visually shorten the perceived distance of the curbcut opening. The petitioner proposed cast concrete sidewalks on either end of the property, with a stretch of asphalt along the existing parking lot frontage. The Board requested that the sidewalk be concrete across the entire length of the property frontage. 30. The petitioner is proposing a 9,000 square foot fenced in outdoor product storage location along the rear of parking lot There is currently outdoor product storage where the one-story addition is proposed. 31. At the April 17,2017 meeting, the Board requested that the applicant provide a lighting plan. 32. At the May 17,2017 meeting, the petitioner presented a lighting plan and showed that there will be no light spill over onto adjacent properties. 33. The Board requested that the dumpster shown at the rear property line be moved to a more central location on site to be less obtrusive to the neighborhood. The Board requested that the dumpster be enclosed within the proposed outdoor storage area or a separate enclosure just outside of the outdoor storage area. 34. The Board recognized that the major concern of neighbors is that this project is not subject to Planning Board site plan review. The proposed addition is less than 10,000 gross square feet of new construction, which is the threshold for triggering Site Plan Review of non-residential structures by the Planning Board. 35. On May 17, 2017, the Building Commissioner provided a statement to confirm the interpretation that the 10,000 square foot threshold for triggering Site Plan Review is only triggered by the square footage of new building construction. 36. The Zoning Board, under the criteria of the requested special permit, has reviewed the typical site plan review items including a lighting, dumpster location, fencing, and landscaping to the extent that the Zoning Board could reasonably review these features. 37. This petition is under review by the Salem Conservation Commission and will also be reviewed by the Planning Board for a Floor Hazard Overlay District Special Permit only. 38. The requested relief,if granted,would allow the petitioner to extend a nonconforming structure,and exceed the maximum width of entrance and exit drives. 39. At the public hearing no members of the public spoke in favor of, and nine (9) in opposition to, the petition. The Salem Board of Appeals, after careful consideration of the evidence presented at the public hearing, and after thorough review of the petition, including the application narrative and plans, and the Petitioner's presentation and public testimony, makes the following findings that the proposed project meets the provisions of the City of Salem Zoning Ordinance: Findings for Special Permit: The Board finds that the proposed extension of the nonconforming structure is not substantially more detrimental than the existing non-conforming structure to the neighborhood. 1. Social, economic and community needs are served by the proposal. City of Salem Board of Appeals May 31,2017 Project:293-297 Bridge Street Page 5 of 7 2. Traffic flow and safety,including parking and loading are adequate. 3. Adequacy of utilities and other public services will not be negatively impacted. 4. Impacts on the natural environment, including drainage will be subject to review by the Conservation Commission. 5. The proposal fits with the character of the neighborhood. The F.W. WEBB industrial wholesale, warehouse and distribution and sale and storage of building supplies and associated parking lot are both existing uses. The proposed addition is located away from the Federal Street residences as much as possible. The proposed expansion fits with the architectural character of the existing historic structure. 6. Potential fiscal impact is positive. The proposed expansion will allow F.B. WEBB to continue to operate and expand employment in the City of Salem by modernizing the existing internal function of this historic building and provide a showroom and retail space for customers. Findings for Variance: 1. The lot shape and size are unique to the district, such that the literal enforcement to allow only a 30' foot curbcut width would prohibit tractor-trailer trucks from entering the site. 2. The hardship of literal enforcement of Sec. 5.1.5 Parking Design, is that a 30'wide curbcut width would cause on street loading on Bridge Street, which would create a traffic and unsafe public conditions. The petitioner demonstrated that the proposed 67' wide curbcut is necessary to create the turning radiuses for trucks to enter into the parking lot and safely maneuver on site to the loading docks rather than load and unload on Bridge Street. 3. Desirable relief can be granted without denigrating from the ordinance and without substantial detriment to the public good. The Board has taken care to consider and request traffic calming measures to mitigate pedestrian access and safety across the 67'wide curbcut. On the basis of the above statements of facts and findings,the Salem Board of Appeals voted five (5) in favor (Rebecca Curran (Chau), Tom Watkins, Mike Duffy,Jimmy Tsitsmos, and Paul Viccica (alternate)) and none (0) opposed, to grant a Special Permit to Sec. 3.3.3 of the Salem Zoning Ordinance,Nonconforming Structures,to allow the petitioner to extend a nonconforming structure, and a Variance to Sec. 5.1.5 Parking Design, of the Salem Zoning Ordinance, to exceed the maximum width of entrance and exit drives, subject to the following terms, conditions and safeguards: Standard Conditions: 1. Petitioner shall comply with all city and state statues, ordinances, codes and regulations. 2. All construction shall be done as per the plans and dimensions submitted to and approved by the Building Commissioner. 3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 4. Petitioner shall obtain a building permit prior to beginning any construction. 5. Exterior finished of the new construction shall be in harmony with the existing structure. 6. A Certificate of Occupancy is to be obtained. 7. A Certificate of Inspection is to be obtained. Petitioner is to obtain approval from any City Board or Commission having jurisdiction including,but not limited to the Planning Board. Special Conditions: Hours of Operation: 1. The hours of operation shall be Monday through Wednesday and Friday 6:30am to 5pm.Thursday 6:30am-8pm. Saturday 7am to 12pm. Sunday-Showroom only within the hours of 10am-3pm.,with no operation of loading and service counter on Sunday. Traffic and Pedestrian Access: 2. The petitioner has accepted a voluntary condition to install poured concrete sidewalks along the entire length of the properties. 3. The petitioner shall submit a revised site plan indicating proposed rumble strips and/or textured materials to provide a safe pedestrian crossing,while maintaining access for tractor-trailers and passenger vehicles.The plan shall be submitted to the Engineering Department for review and approval prior to the issuance of a building permit. Lighting: 1. The parking lot lighting shall be controlled such that lighting shall be reduced one hour after closing time. Full lighting shall be turned on no earlier than a half hour before opening time. 2. Elevation plans of the new addition showing lighting fixture locations and cut sheets of lighting fixtures shall be submitted to the Department of Planning and Community Development for review and approval prior to the issuance of a building permit. The applicant shall propose lighting fixtures that are in accordance with the submitted lighting plan. Landscaping and Maintenance: 3. The applicant shall submit a landscape plan to the Department of Planning and Community Development staff planner for review and approval prior to issuance of a building permit. 4. To the extent allowed under the existing AUL and applicable laws, the applicant shall install plantings and screening along the rear perimeter of the properties that abut the Federal Street residences to provide year round screening,including evergreens,between the Federal Street residences and 293- 297 Bridge Street properties. 5. The applicant,owner,or assigns shall maintain the landscaping along the rear perimeter of the properties in perpetuity. Dumpster and Outdoor Storage Area: 6. The petitioner shall move the dumpster location to be adjacent to the outdoor storage location within an enclosure as to screen the dumpster in accordance with the dumpster ordinance. The chain link fence surrounding the outdoor storage area shall include slats or screening as reviewed and approved by the Department of Planning and Community Development prior to the issuance of a building permit. I also met with Dan Tammaro of IMECA Masonry. We toured the work area to observe the progress of the work. B. The staging was set and enclosed on the first section (i.e. south section) of building. Masons were demolishing the existing brick. Work had progressed from the roof down to a point approximately 2 to 3 feet above the fifth floor level. The demo'd brick was placed in plywood boxes approximately 4' x 4' x 3' high set on the fifth floor. When the boxes were full they were taken by pallet truck to the elevator. Prior to the meeting, Dave made case to reconsider the removal of the brick on the north third of the building and instead consider repointing and local repairs as needed. He said the wood showed no sign of rot except for one location where the roof drain had let go and that there was no obvious bulging in the brick like is observed on the south half of the building. Both Mark and I said it would have to be discussed with persons at our respective offices. D. A meeting followed that included all of the parties above and the scaffolding subcontractor. A few safety concerns were discussed with respect to bracing, tiebacks, fasteners used for the enclosure around the staging and the debris chute. Also dust issues were discussed but because the dust issue is minor, respirators are voluntary and dust is controlled by water and fans. E. The mason mentions that he will be using the open bottom knock out style bond beams. There will be four bond beams installed. One will be used for the starter course, and then there will be one under the former roof beam, one under the fifth floor beam and one under the new roof beam. They will use back- to-back 4 x 3-1/2 x '/4 angle for lintels over the fifth floor windows only(since the first bond beam will be over the fourth floor window). They will provide 6-inches of bearing per side. F. The vertical rebar alongside the window jamb(i.e. two #4's) cannot run continuous because of the steel lintels on the fifth floor. They will try to get one bar continuous. G. The mason will use all pre-mixed mortars and grout. (Spec-Mix) The grout will be 3000 psi; apparently 2000-psi grout is no longer used. Mortar will be type "S". H. Mark left the meeting at 11:45 AM. After Mark left there was a discussion about using the existing brick for the fagade. Dan said he would like to use a color matched new brick. His price was quoted FIELD OBSERVATION REPORT Ldoc using new brick. He mentioned a$10,000 adder to use the old brick and Dan felt the look would not be what the Owner expects. This is a non-structural issue but an aesthetics and cost issue. I. The mason will clean down to the top of the fourth floor window to sound brick. If there is loose of damaged brick at this level it will be replaced. With a solid base to build on he will install a first course consisting of a open bottom bond beam and it will be bedded in an epoxy mortar as called for on the plans. The bond beam will then be fully grouted. J. I promised Dave that I would revise the sketches SK-1 and—2 to show the actual field conditions that were found at the top of the wall and roof intersection. K. We discussed the clip angles that tie the existing wood beams t the new CMU. The design now call for the clip angles between the roof beams and CMU and the clip angles between the 5`h floor beams and CMU to be 6 x 6 x %z x 1'-8" long. There will be three 1/2"anchors (8"cc) into the CMU and two 1/4" Simpson SDS screws (3"cc) up into the timber. For the old roof beam just below the 5`h floor beam,the clip angle will a 6 x 6 xl/2 x 1'-0" long. For this clip angle there will be two-%s°'anchors into the CMU and one SDS Simpson '/4" screw up into the timber. L. I left the site at 12:15. Also on site was the foreman for the roofing contractor. We toured the work area to observe the progress of the work and to discuss some issues. B. The masons had demolished the existing brickwork in Section"A"down to the top of the fourth floor windows. (Section"A" is the southernmost third of the east wall) Pallets of masonry block were being brought up to the fifth floor via the elevator and was being stacked and moved out onto the staging. The masons were scheduled to start laying block on Tuesday. C. The roofing crew was in the process of installing a 36"x 36"Bilco roof hatch adjacent to and inboard of the elevator shaft. D. The staging contractor was on site erecting the staging for Section`B" . COMMENTS: E. We discussed the detail at the top of the wall/roof interface. The roofer stated that the ISO filler would not work and that he needs solid wood blocking at the outside edge of the roof. We also learned that the detail for the brick corbel at the top was a series of four 1/2" steps and three flush courses of brick at the top. (See attached sketch SK-1R). It was decided that the wood beam and existing roof decking would be cut back flush with the inside face of the masonry. A stretcher course of block would be installed on top of the continuous bond beam, which will be just below the wood beams. A 12"long by 5/8" diameter threaded rod, with a nut on both ends, would be installed into the stretcher course. (6-inches embedment.) The roofer can use the rod to attach the solid wood blocking and then cut the rod flush with the wood. See detail on SK-1R. F. It was decided that the roofer would relocate the existing scupper outside the masonry. G. We discussed adding some control joints in the veneer layer of brick. It was decided to add a control joint around the corner on the south side of the building approximately 2-feet back from the corner. There will also be a control joint in each of the three sections of wall("A", `B:", and"C")along the east side. The control joint will be located alongside one of the windows. H. Since the existing wood beams have varying degrees of rot and deterioration in the ends, we discussed cutting back the existing wood beams flush with the inside face of the masonry wall. It was decided to cut the beams back but that there should be at least 4 inches of bearing on the steel clip angles that will be added at the fifth floor beams and the roof support beams and at least 2 to 2/l/2 inches of bearing for the old roof beams just below the fifth floor beams. Since there was considerable rot in the beams adjacent to the elevator shaft we discussed leaving the plywood support wall in place below the fifth floor beam,provided it was acceptable to the Owner. We decidied to fill in with wood framing between FIELD OBSERVATION REPORT 2.doc the old roof beam and the fifth floor beam approximately 4-feet back from the inside face of the masonry wall. The fifth floor beam and old roof beam would then be supported on a continuous wood framed wall. I. We discussed new brick versus using the existing brick for the outside veneer course. Since the interior brick was judged to be non-usable the mason said that there will not be enough usable brick from the original veneer course to complete the job. The mason felt the using the original brick would produce an inferior end product. After some discussion it was decided to go with the new brick for the veneer. We looked at the samples of new brick and selected the Bradford—"Watsontown" as the best match to the existing brick. J. We discussed the issue that Dave had brought up at the previous meeting concerning repairing rather than dismantling the brick wall at section"C" (the northern-most section of the wall). Bill said it was discussed internally and as Engineer of Record, H.L. Turner wants the brick taken down as planned. K. Upon examination of the existing brick course where the new block will be installed, it appeared sound and was judged to be in reasonably good condition. With some minor patching here and there it was judged to be acceptable to start the new masonry. Once again we discussed the procedure for the starter course using the specified Sika product. The interface will be cleaned of all dust and debris and a bonding agent will be brushed on as prescribed in the manufacturer's literature. The product will then be mixed with mortar to form the epoxy bedding mortar for the first course. L. We discussed the brickwork below the fourth floor window header. The exterior joints were deteriorated and need repointing. As EOR it is our opinion that if F W Webb plans to hold onto the building for the foreseeable future then repointing of the remaining existing brickwork should be seriously considered. The recommended procedure would be to rake out approximately 1/2" of the old mortar, down to sound mortar and repoint the joint with a standard concave tooled joint. We left the site at 1:15. The staging was nearing completion for section"A". Staging now extends across sections "A" and"B". C. The carpenters were installing pressure treated blocking around some window openings on the fourth level. D. Masons were finishing up the work on section"B" and preparing for the demo work to begin on section "XI E. The roofers were installing the blocking and sloped filler board along the edge of section`B". Metal edging had not yet been installed along the new roof edge. COMMENTS: F. We looked at the front corner of the building— Section"A" near Bridge St. The discussion centered on where the control joint should be and how to finish off the brickwork at the front. The emphasis was on aesthetics and how the finished construction would look from Bridge Street. We discussed three options: Option 1-Repeat the same construction technique as was used on the rear of the building with all new brick and a control joint on the front(Bridge st. side) approximately 2-feet in from the corner. Option 2- Locate the control joint 2-feet back from the front on the east wall within Section"A". New brick would then be installed from the control joint and wrapped around the comer and toothed into the sound existing brick. All deteriorated or broken existing brick would be replaced with new brick. Option 3 - Install a control joint 2-feet back from the front corner on the east wall within Section"A". New brick would continue to the comer but any brick or brick face exposed on the front face(Bridge St. face)of the building would utilize the existing old brick. The mason may have to clean two to three dozen existing bricks to complete the corner and tooth in around the front. Cracked and broken bricks would be replaced with sound existing brick. Any brick showing on the front face(i.e. Bridge St. side) would be existing brick. TTG said they would discuss the options wit Mark Moschella of J M Coull and reach a consensus. Post Meeting Note: On a follow up call with Mark on Wednesday morning June 13th it was decided to go with Option 3. G. The installation of the steel angle clips under the floor and roof beams was discussed. It was agreed that any beam at the end of the building or any beam adjacent to an internal cross wall between section"A" and"B" and "B" and"C"could be supported with a shorter 12-inch clip. All clips supporting the sloped FIELD OBSERVATION REPORT 3.doc roof beams were shimmed with composite shims. It was determined that the plywood shear walls could be removed at any location where the steel clip was installed and shimmed and all bolts and screws were in place and nuts tightened. There is one exception on wall removal, see the next item. H. The plywood shear wall on Level 4 in section"C"adjacent to the elevator shaft will remain in place. In addition a"pony"wall will be constructed between the old roof beam and the fifth level floor beam. Since there is a slight misalignment between the two beams the"pony"wall will be constructed from 2 x 10's and will extend from the face of the masonry back approximately 4 to 5 feet. It was decided that the"pony"wall would not have to be sheathed with plywood. L All of the beams were cut flush with the inside face of the new CMU wall. There are a few beams that still show signs of rot in the wood. These beams shall be covered plated with Y4" CDX plywood. Two layers of plywood shall be added to each side of the existing wood beams. The plywood shall extend out from the wall 4-feet. The width of the plywood strips shall match the depth of the beam. The plywood shall be secured with three rows of SDS screws spaced 16-inches apart. J. At one location near the elevator a steel beam was bearing on a newly installed steel bearing plate anchored into the new CMU. It was decided to have the welder weld the bottom flange of the beam to the plate with a 1"to 1-1/2" long fillet weld and then to weld along the underside of the beam to the bearing plate with a minimum 3/16" fillet weld. We left the site at 2:00. The color of the edging, scuppers and downspouts will be bronze to match the trim of the windows. E. The masons had done an excellent job thus far on the front corner of the building, matching new brick in with the old brick. F. We walked the fourth and fifth floor and reviewed the work completed to date. The following is a list of punch list items to be completed. Note,this is not a complete list as work was still ongoing. The final walk-through/punch list will be completed during the week of July 91'. 1. In general, overall clean-up is required. With regard to sections"C"and`B"the outside face of the east wall needs to be cleaned. The areas to be cleaned include those areas where the staging was up against the building and left powered residue and dried mortar on the existing brickwork. 2. The windows shall be cleaned. 3. Cleaning and regrading of the area in the rear of the building is required. 4. Section "C",Fifth Floor, Southeast corner—repoint joint on inside face of south wall at corner 5. Section`B"—any granite sills that are cracked should be caulked to prevent moisture intrusion (Note, this item is outside the job scope) 6. CHAPTER 40A, SECTION 17 APPEALING THE JULY 24,2017 FLOOD HAZARD OVERLAY DISTRICT SPECIAL PERMIT DECISION OF THE SALEM PLANNING BOARD CONCERNING 293 AND 297 BRIDGE STREET, SALEM, MASSACHUSETTS (SALEM ASSESSOR'S MAP 26, LOTS 634 and 635) This is an appeal from a Decision of the City of Salem, Massachusetts Planning Board (hereinafter "Salem Planning Board"or"Planning Board"), dated July 24, 2017 (hereinafter "Decision"or"Special Permit Decision"), and filed with the Salem, Massachusetts City Clerk on July 24, 2017, granting Mark McLeod a Flood Hazard Overlay District Special Permit pursuant to Section 8.1 of the Salem Zoning Ordinance to construct a 7,600 square foot free-standing 1 addition to the existing 5-story grandfathered structure located at 293 Bridge Street, Salem, Massachusetts (Assessor's Map 26, Lot 634), which lot is owned by 295 Bridge Street Associates, a wholly-owned subsidiary or affiliate of F. W. Webb, Inc., and also involving the adjacent lot at 297 Bridge Street, Salem, Massachusetts (Assessor's Map 26, Lot 635), currently a municipal parking lot owned and operated by the City of Salem, which two lots are currently located in a B-4 Zoning District, on the grounds that said Decision was arbitrary, capricious, unreasonable, violated due process, exceeded the Planning Board's authority, was based on legally and factually untenable grounds, and was wrong as a matter of law. A certified copy of said July 24, 2017 Special Permit Decision is attached hereto as Exhibit A. PARTIES Plaintiffs 1. Plaintiff Federal Street Neighborhood Association (hereinafter"FSNA") is a 501(c)(3) corporation whose corporate address is c/o 20 Beckford Street, Salem, Massachusetts and which is dedicated to the improvement,preservation, and protection of the Federal Street Neighborhood (defined as the roughly rectangular area bounded by Essex Street to the south, Bridge Street to the north, North Street to the east, and Boston Street to the west, specifically including Federal Court, Beckford Street, Andover Street, River Street, Lynn Street, Monroe Street, Carpenter Street, Flint Street, and Harrington Court). 2. Plaintiff Victoria Alla owns and resides at 78 Federal Street, Salem, Massachusetts, which property is an abutter to an abutter to one or both of the Webb and Universal Lots. 3. Plaintiff James McAllister resides at 86 Federal Street, Salem, Massachusetts, which property is a direct abutter to the Webb Lot. 4. Plaintiffs, Jonathan L. Felt and Suzanne R. Felt, reside at 31 Flint Street, Salem, Massachusetts and own 86 Federal Street, Salem, Massachusetts, which property is a direct abutter to the Webb Lot. 5. Plaintiff, T. Jane Graham-Dwyer, owns and resides at 89 Federal Street, Salem, Massachusetts, which property is an abutter to an abutter to one or both of the Webb and Universal Lots. 6. Plaintiffs, Eric Olson and Marie Olson, own and reside at 3 Federal Street Court, Salem, Massachusetts, which property is located within 300 feet(approximately) of one or both of the Webb and Universal Lots. 7. Plaintiff, Constance Arlander, owns and resides at 91 Federal Street, Salem, Massachusetts, which property is an abutter to an abutter to one or both of the Webb and Universal Lots. 2 8. Plaintiffs, Steven Sass and Ellen Golub, own 92 Federal Street, Salem, Massachusetts, which property directly abuts one or both of the Webb and Universal Lots. 9. Plaintiff, Jane Curtis Arlander, owns and resides at 93 Federal Street, Salem, Massachusetts, which property is an abutter to an abutter to one or both of the Webb and Universal Lots. 10. Plaintiff, Jean Colby Arlander, owns and resides at 93 Federal Street, Salem, Massachusetts, which property is an abutter to an abutter to one or both of the Webb and Universal Lots. 11. Plaintiff, James E. Gaull, owns 94 Federal Street, Salem, Massachusetts, which property directly abuts one or both of the Webb and Universal Lots. 12. Plaintiff, Frederick S. Koopman, owns and resides at 102 Federal Street, unit#3, Salem, Massachusetts, which property directly abuts one or both of the Webb and Universal Lots. 13. Plaintiffs, James Gwin and Jennifer Lucht, own and reside at 103 Federal Street, Salem, Massachusetts, which property is an abutter to an abutter to one or both of the Webb and Universal Lots. 14. Plaintiffs, Barbara Cleary and David Hart, own and reside at 104 Federal Street, Salem, Massachusetts, which property is an abutter to an abutter to one or both of the Webb and Universal Lots. 15. Plaintiffs, Thomas Frary and Susan Weldon, own and reside at 106 Federal Street, Salem, Massachusetts, which property is within 300 feet of one or both of the Webb and Universal Lots. 16. Plaintiff, Jane Stauffer, owns and resides at 28 Beckford Street, Salem, Massachusetts, which property is an abutter to an abutter of one or both of the Webb and Universal Lots. 17. Plaintiffs, Ann Whittier and Stephen Whittier, own and reside at 10 River Street, Salem, Massachusetts, which property is located within 300 feet(approximately) of one or both of the Webb and Universal Lots. 18. Plaintiffs, Mary E. Nugent and Peter Nugent, own 12 River Street, Salem, Massachusetts, which property is located within 300 feet (approximately) of one or both of the Webb and Universal Lots. 19. Plaintiff, Daniel Madigan, owns and resides at 14 River Street, Salem, Massachusetts, which property is located within 300 feet (approximately)of one or both of the Webb and Universal Lots. 3 20. Plaintiff, Charles von Bruns, owns and resides at 3 River Street, Salem, Massachusetts, which property is located within approximately 300 feet of one or both of the Webb and Universal Lots. 21. Plaintiffs, Frederick C. Biebesheimer, owns, and he and his wife, Lisa A. Spence,reside at 17'/2 River Street, Salem, Massachusetts, which property is located within approximately 300 feet of one or both of the Webb and Universal Lots. Mr. Biebesheimer is also President of FSNA. 22. Plaintiffs, Jeremiah Jennings and Deborah Jennings, own and reside at 18 River Street, Salem, Massachusetts, which property is located within approximately 300 feet of one or both of the Webb and Universal Lots. 23. Plaintiffs, Margaret K. S. Twohey and Darrow A. Lebovici, own and reside at 122 Federal Street, Salem, Massachusetts, and also own 120 Federal Street, Salem, Massachusetts, which properties are directly affected by the traffic and flooding issues hereinafter described. Defendants 24. Defendant, Mark McLeod (hereinafter"McLeod" or"Applicant"or"Defendant McLeod"), is the Applicant and beneficiary of the July 24, 2017 Flood Hazard Overlay District Special Permit Decision herewith being appealed, and is believed to be an agent of 295 Bridge Street Associates or of F. W. Webb, Inc. On information and belief, Mr. McLeod's business address is c/o The H. L. Turner Group Inc., 27 Locke Road, Concord,New Hampshire 03301. 25. Defendant, 295 Bridge Street Associates (hereinafter"BSA") is believed to be a wholly- owned real estate subsidiary or affiliate of F. W. Webb, Inc. which owns Webb's local Salem retail/wholesale outlet at 293 Bridge Street. On information and belief, BSA shares the same corporate headquarters at 160 Middlesex Turnpike, Bedford, Massachusetts 01730, as does F. W. Webb, Inc. 26. Defendant, Defendant, F. W. Webb Company, Inc. (hereinafter"Webb") is believed to be a family-owned Massachusetts corporation whose headquarters is located at 160 Middlesex Turnpike, Bedford, Massachusetts 01730 which owns, directly or indirectly, its local Salem retail/wholesale outlet located at 291-295 Bridge Street, Salem, Massachusetts ("Webb Lot"). Webb is believed to do business at approximately 80 retail or wholesale locations from Maine to Pennsylvania which are believed to generate gross annual sales in excess of one billion ($1,000,000,000.00) dollars. 27. Defendant, Matt Veno, a/k/a Matthew Veno, who resides at 20 Forest Avenue 43, Salem, Massachusetts 01970, is a regular member and the Vice Chair of the Salem Planning Board who on July 20, 2017 voted in favor of what became the July 24, 2017 Flood Hazard Overlay District Special Permit Decision of the Salem Planning Board being appealed. 4 28. Defendant, Helen Sides, who resides at 35 Broad Street, Salem, Massachusetts 01970, is a regular member of the Salem Planning Board who on July 20, 2017 voted in favor of what became the July 24, 2017 Flood Hazard Overlay District Special Permit Decision of the Salem Planning Board being appealed. 29. Defendant, Kirt Rieder, who resides at 15 Warren Street, Salem, Massachusetts 01970, is a regular member of the Salem Planning Board who on July 20, 2017 voted in favor of what became the July 24, 2017 Flood Hazard Overlay District Special Permit Decision of the Salem Planning Board being appealed. 30. Defendant, Carole Hamilton, who resides at 4 Willow Avenue, Salem, Massachusetts 01970, is a regular member of the Salem Planning Board who was absent on July 20, 2017 and thus, did not vote on Defendant McLeod's Application for a Flood Hazard Overlay District Special Permit. 31. Defendant, Dale Yale, who resides at 7 Mayflower Lane, Salem, Massachusetts 01970, is a regular member of the Salem Planning Board who on July 20, 2017 voted in favor of what became the July 24, 2017 Flood Hazard Overlay District Special Permit Decision of the Salem Planning Board being appealed. 32. Defendant, Bill Griset, who resides at 153 Fort Avenue, Salem, Massachusetts 01970, is a regular member of the Salem Planning Board who on July 20, 2017 voted in favor of what became the July 24, 2017 Flood Hazard Overlay District Special Permit Decision of the Salem Planning Board being appealed. 33. Defendant,Noah Koretz, who resides at 10 Woodside Street, Salem, Massachusetts 01970, is a regular member of the Salem Planning Board who left the July 20, 2017 Salem Planning Board hearing early and thus, did not vote on Defendant McLeod's Application for a Flood Hazard Overlay District Special Permit. 34. Defendant, Ben Anderson, who resides at 10 Adams Street, Salem, Massachusetts 01970, is a regular member and the Chair of the Salem Planning Board who on July 20, 2017 voted in favor of what became the July 24, 2017 Flood Hazard Overlay District Special Permit Decision of the Salem Planning Board being appealed. 35. Defendant,Antonio Mataragas, who resides at 19 Pickman Road, Salem, Massachusetts 01970, is a regular member of the Salem Planning Board who was absent on July 20, 2017 and thus, did not vote on Defendant McLeod's Application for a Flood Hazard Overlay District Special Permit. 36. The Plaintiffs have standing to bring this action, as they are substantially aggrieved by the July 24, 2017 Decision of the Salem Planning Board being appealed. JURISDICTION 5 37. This Court has jurisdiction over this matter pursuant to Section 17 of Chapter 40A of the Massachusetts General Laws. 38. This case is timely, as it has been filed within twenty(20) days from July 24, 2017, which is when the July 24, 2017 Decision of the Salem Planning Board was filed with the Salem City Clerk. PROCEDURAL HISTORY AND FACTUAL ALLEGATIONS 39. On Wednesday, May 24, 2017 Defendant McLeod filed an Application with the Salem Department of Planning& Community Development seeking from the Salem Planning Board a Flood Hazard Overlay District Special Permit pursuant to Section 8.1 of the Salem Zoning Ordinance. 40. At 3:25 p.m. that same day a duplicate of said Application was filed with the Salem City Clerk's office. 41. Said Application listed as the "Applicant: Mark McLeod c/o The H.L. Turner Group Inc." of 27 Locke Road, Concord,NH 03301 and "295 Bridge Street Associates c/o FW Webb Co."as the "Owner"of both"293 & 297 Bridge St (Map& Lot: 26-634 & 26-635)," whereas the City of Salem is in fact the owner of 297 Bridge Street (Map 26-Lot 635). 42. According to the "Project Description" in Section I of said Application: "The FW Webb Co. is proposing to construct a 7,600 sf addition to their existing facility at 293 Bridge St. Additionally, the adjacent lot, currently a municipal parking lot, will be used for employee and customer parking, tractor trailer access to the loading docks, and exterior storage for products (such as plastic and cast iron piping.)" 43. Both the Universal Lot and the Webb Lot are currently located in a B-4 Zoning District. 44. Prior to the rezoning of both 293 Bridge Street (the existing Webb Lot) and the adjacent so- called Universal Lot at 297 Bridge Street, both in late November of 2016, the Webb Lot was located in the so-called North River Canal Corridor("NRCC")Zoning District and the Universal Lot was located in a Two-Family Residential ("R-2") Zoning District. 45. On November 28, 2016 one institutional and seventy-seven(77) individual plaintiffs filed suit in this Court in a 41-page, 8-Count, 377-paragraph Complaint challenging the validity of said rezoning. See Federal Street Neighborhood Association, et al. v. Mayor Kimberley Driscoll, et al., dated November 28, 2016, Essex Superior Court Civil Action No. 16- 1537D. 46. Notwithstanding said rezoning, Webb still needed major zoning relief to pursue its proposed development of the Webb and Universal Lots. 47. At 11:40 a.m. on Wednesday, March 29, 2017 295 Bridge Street Associates ("BSA"), a wholly-owned real estate subsidiary or affiliate of Webb, filed a Petition with the Salem 6 Zoning Board of Appeals ("ZBA") seeking a Variance from Section 5.1.5 of the Salem Zoning Ordinance to create 3 entrance and exit drives of 67 feet, 35 feet, and 53 feet at the Universal Lot, in each case more than the 30 foot maximum allowed in a B-4 Zoning District, and a Special Permit pursuant to Section 3.3.3 of the Salem Zoning Ordinance "to extend a non-conforming structure (7,600+/- s.f. addition)"relative to its existing Webb Lot and grandfathered non-conforming 5-story structure. 48. On May 17, 2017 the Salem Zoning Board of Appeals voted to grant a Variance and Special Permit to permit BSA to construct a 7,600 square foot, free-standing addition to its existing 5-story, grandfathered structure located at 293 Bridge Street, and to increase by more than double the 30-foot wide maximum curb cut permitted in a B-4 Zoning District pursuant to the Salem Zoning Ordinance in connection with the Universal Lot. 49. On Friday, June 16, 2017 one institutional and thirty-two (32) individual plaintiffs filed suit in this Court challenging the validity of said Variance and Special Permit. See Federal Street Neighborhood Association, et al. v. 295 Bridge Street Associates, et al., dated June 16, 2017, Essex Superior Court Civil Action No. 17-889B. 50. Both the Webb Lot and the immediately adjacent Universal Lot(to the west)are bounded on the south, east, and west by the so-called McIntire Historic District established pursuant to Chapter 40C of the Massachusetts General Laws, which District basically extends from Bridge Street to the North,North Street to the east, Broad Street to the south, and Boston Street to the west, and includes Federal Street, Essex Street, Chestnut Street,parts of Broad Street, parts of Summer Street, Federal Court, Beckford Street, River Street,Andover Street, Lynn Street, Munroe Street, Gifford Court, Flint Street, Harrington Court, Cambridge Street, Botts Court, Hamilton Street, North Pine Street, South Pine Street, Pickering Street, and Warren Street. 51. Said District is also separately listed on the National Register of Historic Places designated by the United States Department of the Interior. 52. Aside from Chestnut Street, which is zoned single-family ("R-1") residential, the rest of the McIntire Historic District is uniformly zoned two-family ("R-2")residential. 53. The Webb and Universal Lots are also bounded on the north by a 4,003-acre linear park known as Leslie's Retreat Park, stretching 2,236 feet along the northern side of Bridge Street from the North Street Overpass in the east to Flint Street in the west, which was completed in 1999 at a cost to taxpayers of approximately Four Million($4,000,000.00) Dollars as part of the so-called Salem Beverly Transportation Project, 90% of which was underwritten by the United States Federal Highway Administration. 54. As a result of the former use of the so-called Universal Lot at 297 Bridge Street by the now defunct Universal Steel & Trading Company (hereinafter"Universal"), which operated a scrap metal and junk yard at that location for over 60 years,the Universal Lot is one of, if not the, most polluted lots in the City. The City of Salem acquired title to the property pursuant to a tax taking dated October 7, 2005. 7 55. The Universal Lot was cleaned up by the United States Environmental Protection Agency ("EPA") in 2012 (to the limited standard required for a parking lot) at a total cost to federal and state taxpayers of Three and One Half Million ($3,500,000.00) Dollars. 56. The Universal Lot is still heavily contaminated below a depth of approximately four feet. 57. Since the completion of the EPA clean-up,the City has been using the Universal Lot as a 112-space municipal parking lot. 58. In the 5 weekends leading up to Halloween, the Universal Lot tends to be full on both Saturdays and Sundays. In recent weeks the Universal Lot averages 35 to 60 cars during weekdays. 59. Both the Webb Lot and the Universal Lot are located entirely within a FEMA (National) Hazardous Flood Zone. 60. On an average of approximately once every four to six weeks, Bridge Street between the intersection of River and Lynn Streets in the west, and the Webb Lot in the east, seriously floods twice a day. 61. Such serious and frequent flooding, which periodically occurs irrespective of whether the sun is shining or whether it is raining, is the product of tidal surges that back up through the storm drains along that portion of Bridge Street that connect to the present North River Canal, exacerbated by the fact that Bridge Street at that location is low-lying within said Flood Plain. 62. During periods of severe flooding occurring during flood tides, it is not uncommon that Commercial Street to the north of the present North River Canal is completely under water, as is that portion of the Leslie's Retreat Park, and Bridge Street between the intersection of River and Lynn Streets in the west, and the Webb Lot in the east, often to a depth of approximately one foot. 63. The northerly side of Bridge Street between Lynn Street and the Webb Lot has signs on three utility poles warning westbound motorists to use "Caution"because of"Flood Zone During Unusually High Tides," and the southerly side of Bridge Street between Lynn Street and the Webb Lot has signs on two utility poles warning eastbound motorists to use "Caution"because of"Flood Zone During Unusually High Tides." 64. On July 10, 2017 a 10 Citizen Appeal was filed with the Massachusetts Department of Environmental Protection ("Mass DEP")pursuant to the Massachusetts Wetlands Protection Act. 65. Basically, said 10 Citizen Appeal challenged an Order of Conditions issued by the Salem Conservation Commission as being inadequate to meet the safeguards mandated by the Massachusetts Wetlands Protection Act. 8 66. The Mass. DEP has accepted said appeal and a site visit has been scheduled for August 17, 2017 in preparation for writing a Superseding Order Of Conditions by the Mass. DEP. 67. On November 14, 2016, the City conducted a public auction for the sale of the Universal Lot. 68. Webb is a family-owned business with 80 retail/wholesale or distribution locations between Maine and Pennsylvania(26 in Massachusetts). On information and belief, Webb had over One Billion($1,000,000,000.00) Dollars of gross annual sales in 2015 alone. 69. BSA, a wholly-owned real estate subsidiary or affiliate of Webb, was the sole bidder at the public auction of the Universal Lot. Its bid of$498,550.00 represented approximately one seventh of the $3,500,000.00 cost that federal and state taxpayers paid in 2012 to partially clean up the site and create the parking lot. 70. BSA has a conditional purchase and sales agreement with the City of Salem to purchase the Universal Lot once all appeals are resolved to BSA's satisfaction. 71. An initial hearing on Defendant McLeod's May 24, 2017 Application for a Flood Hazard Overlay District Special Permit was held by the Salem Planning Board on Thursday, July 6, 2017. 72. According to the official Minutes of said July 6, 2017 initial hearing, "Chair Ben Anderson, Kirt Rieder, Dale Yale, Bill Griset [sic], Matt Veno, and Carole Hamilton were present." Absent were "Bill Griset [sic] and Noah Koretz." Emphasis added. 73. At the second of the two Salem Planning Board hearings on Thursday, July 20, 2017 Chair Ben Anderson, Kirt Rieder, Dale Yale, Bill Griset, Matt Veno, and Helen Sides voted to approve Defendant McLeod's May 24, 2017 Application for a Flood Hazard Overlay District Special Permit. 74. At both the first and second Planning Board hearings on July 6, 2017 and July 20, 2017 respectively, no one from the public spoke in support of McLeod's May 24, 2017 Application. 75. At the conclusion of the second of the two Planning Board hearings on July 20, 2017, approximately 15 people appeared in opposition, of whom multiple people spoke in opposition. 76. At the second of the two Salem Planning Board hearings on Thursday, July 20, 2017, Chair Ben Anderson, Kirt Rieder, Dale Yale, Bill Griset, Matt Veno, and Helen Sides voted to approve Defendant McLeod's May 24, 2017 Application for a Flood Hazard Overlay District Special Permit. 77. Said six votes constituted the bare minimum required for passage of said Application. 9 78. The resulting July 24, 2017 Planning Board Decision was filed in the office of the Salem City Clerk at 11:38 a.m. on Monday, July 24, 2017. 79. As to each of the following Counts, the Plaintiffs reaffirm, re-allege, and incorporate all of the prior allegations contained in paragraphs 1-78 above. ARGUMENT COUNTI THE SALEM PLANNING BOARD'S JULY 24,2017 DECISION VIOLATES THE EXPLICIT PURPOSES OF THE SALEM ZONING ORDINANCE AND CHAPTER 40A 80. Section 1.1 of the Salem Zoning Ordinance, entitled "Purpose,"provides following in relevant part: For the purpose of promoting the health, safety, convenience, morals or welfare of the inhabitants of Salem, the zoning regulations and restrictions of this ordinance, ordained in accordance with the provisions of Chapter 40A of the General Laws and, in the case of signs, ordained in addition in accord with the provisions of Section 29 of Chapter 93 of the General Laws. are designed among other purposes to lessen congestion in the streets; to preserve health; to secure safety from fire, panic and other dangers; to provide adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; to facilitate the adequate provision of transportation. water, sewerage, schools, parks and other public requirements; to conserve the value of land and buildings; to encourage the most appropriate use of land throughout the City; and to preserve and increase its amenities. to preserve and protect the water supply, open space and conservation of natural resources, to prevent the pollution of the environment and community blight, to ensure housing for all income levels and compliance with the master plan of the City of Salem; all as authorized by, but not limited to, the provisions of the Zoning Act, G.L. c. 40A. as amended, Section 2A of 1975 Mass. Acts 808, and by Article 89 of the Amendments to the Constitution of the Commonwealth of Massachusetts. Emphasis added. 81. In particular, the Planning Board's July 24, 2017 Flood Hazard Overlay District Special Permit Decision does not preserve and protect the water supply...and conservation of natural resources and it does not prevent the pollution of the environment. 82. Nor does said Decision comply with other express provisions of the Salem Zoning Ordinance, including lessening congestion in the streets: preserving health. securing 10 safety from...other dangers; conserving the value of land and buildings; encouraging the most appropriate use of land throughout the City; and preserving and increasing its amenities. 83. Accordingly, said Decision does not comply with the Master Plan of the City of Salem. 84. For the foregoing reasons alone,the Planning Board exceeded its authority in granting said Special Permit and the July 24, 2017 Flood Hazard Overlay District Special Permit Decision must be annulled in its entirety. COUNT II THE SALEM PLANNING BOARD'S JULY 24,2017 SPECIAL PERMIT DECISION DOES NOT COMPLY WITH SECTION 8.1.4 OF THE SALEM ZONING ORDINANCE BECAUSE IT DOES NOT COMPLY IN ALL RESPECTS WITH THE USES AND PROVISIONS OF THE UNDERLYING B-4 ZONING DISTRICT IN WHICH THE LAND IS LOCATED WITH RESPECT TO CURB CUTS ALONE 85. Section 8.1.4 of the Salem Zoning Ordinance provides in relevant part that"No structure or building including pipes shall be constructed, erected, improved, enlarged, moved unless the following conditions are found to exist: 1. The proposed use will comply in all respects to the uses and provisions of the underlying district in which the land is located. Emphasis added. 86. Pursuant to the Salem Zoning Ordinance, the maximum width of a curb cut in a B-4 Zoning District is 30 feet. 87. Webb's project calls for a new 67-foot curb cut at the Universal Lot pursuant to the Variance granted by the Salem ZBA in its May 31, 2017 Variance and Special Permit Decision now under appeal in this Court. See Federal Street Neighborhood Association, et al. v. 295 Bridge Street Associates, et al., dated June 16, 2017, Essex Superior Court Civil Action No. 17-889B. 88. Said new 67-foot curb cut is more than double the maximum curb cut permitted by the Salem Zoning Ordinance in a B-4 Zoning District. 89. The Salem City Solicitor failed to address this legal defect in her July 20, 2017 legal opinion letter to the Salem Planning Board. 90. Nowhere in the Salem Zoning Ordinance is there any language to the effect that the requirement that the proposed project must comply in all respects with the provisions of the underlying district in which the land is located is superseded or modified by any Variance or Special Permit that may be granted modifying said provisions. 11 91. And yet, Finding No. 1 in said July 24, 2017 Special Permit Decision is a masterpiece in self-serving, circular, and factually untrue reasoning, when it simply states in unsupported conclusionary terms that "The proposed use will comply in all respects to the uses and provisions of the underlying district in which the land is located." 92. Simply regurgitating the requirement of the Zoning Ordinance is NOT a legally competent factual finding. 93. The same defect is also true with respect to Finding No. 2 as well. 94. For the foregoing reasons alone,the Planning Board exceeded its authority in granting said Special Permit and the July 24, 2017 Flood Hazard Overlay District Special Permit Decision must be annulled in its entirety. COUNT III THE SALEM PLANNING BOARD'S JULY 24,2017 DECISION ALSO DOES NOT COMPLY WITH SECTION 8.1.4 OF THE SALEM ZONING ORDINANCE BECAUSE IT DOES NOT MAKE ADEQUATE PROVISIONS FOR THE CONVENIENCE AND SAFETY OF VEHICLES AND PEDESTRIAN MOVEMENT WITHIN THE SITE AND IN RELATION TO ADJACENT STREETS AND PROPERTY, PARTICULARLY IN THE EVENT OF FLOODING OF THE LOT OR ADJACENT LOTS BY EITHER OVERSPILL FROM WATERBODIES OR HIGH RUNNOFF. 95. As correctly noted in the first paragraph of the City Solicitor's July 20, 2017 legal opinion letter to the Salem Planning Board, Section 8.1.4 of the Salem Zoning Ordinance requires that four conditions must be met before the Planning Board can issue a Flood Hazard Overlay District Special Permit, including that the project has "adequate convenience and safety of vehicular and pedestrian movement within the site and in relation to adjacent streets and property, particularly in the event of flooding of the lot(s) or adjacent lot(s) caused by either overspill from waterbodies or high runoff." Emphasis added. 96. In her July 20, 2017 legal opinion letter to the Salem Planning Board, the City Solicitor assured the Planning Board that it could find that Webb/McLeod's Application met the requirements of Section 8.1.4 of the Salem Zoning Ordinance because the project(in her stated opinion)makes adequate provision for the convenience and safety of vehicular and pedestrian movement within the site and in relation to adjacent streets and property because: "1) When flooding takes place on the public street, it is closed to traffic; 2) flooding moves from the street onto the FW Webb lot over time which affords ample time for customers or employees to move their cars and 3) pedestrians can use the ancient [Beckford pedestrian] way up to Beckford Street to avoid any flooding." 12 Emphasis added. 97. With respect to pedestrian movement in reason no. 3 alone, the so-called "ancient way" is a narrow, steep, unpaved, and rock-strewn pedestrian way that is certainly not handicap accessible and which basically connects the grade of Bridge Street with the grade of Beckford and River Streets approximately thirty (30) feet above. 98. The Bridge Street grade of the pedestrian way is subject to the very same flooding as is Bridge Street and the Universal Lot, thus absolutely precluding it from serving as a safe pedestrian egress solution. 99. Among the City Solicitor's recommended Special Permit conditions that the Planning Board should adopt relative to her reason no. 3, perhaps the most fatuous is that Webb should "implement a policy/practice...to make employees aware of the ancient path to Beckford Street." 100.As such, reason no. 3 does not represent any provision, let alone adequate provision, for pedestrian movement within the site and in relation to adjacent streets and property. 101.With respect to vehicular movement within the site and in relation to adjacent streets and property during periods of severe flooding on Bridge Street, east-bound traffic (including large tractor trailer trucks and other commercial vehicles)tends to react to the flooding by turning south onto Lynn Street, and west-bound traffic (also including large tractor trailer trucks and other commercial vehicles) tends to detour by turning south up the North Street Overpass ramp to Federal Street. 102.In both instances, such traffic then has to thread its way through the relatively narrow and historic streets of the National Register and local Historic District, which is uniformly R-2 residential. 103.Said historic residential neighborhood contains many families with young children whose safety is threatened by said vehicular incursions onto their narrow streets. 104.The City Solicitor recommended to the Planning Board that "perhaps the Board should consider conditions requiring FW Webb to monitor the tidal flow into the street, block access to their site when flooding is imminent or beginning in the street, implement a policy/practice to insure employees' vehicles are offsite when flooding is imminent..." 105.The City Solicitor's recommended conditions are woefully inadequate and make a mockery of the content and purposes of Section 8.1.4 of the Salem Zoning Ordinance. 106. For the foregoing reasons alone, the Planning Board exceeded its authority in granting said Special Permit and the July 24, 2017 Flood Hazard Overlay District Special Permit Decision must be annulled in its entirety. COUNT IV 13 THE SALEM CITY SOLICITOR' JULY 20,2017 OPINION LETTER TO THE SALEM PLANNING BOARD ALLUDES TO UNSPECIFIED FLOODING IMPROVEMENTS THAT APPARENTLY HAVE NO BASIS IN FACT,AND EVEN IF TRUE, SHOULD HAVE BEEN FULLY AND SPECIFICALLY DISCLOSED TO THE SALEM PLANNING BOARD PRIOR TO ITS JULY 20,2017 VOTE. 107.In her July 20, 2017 legal opinion letter to the Salem Planning Board, the City Solicitor wrote: "The most important fact I learned from the [Salem City] Engineer today, though, is that within two weeks, tide gates will be installed in the drain lines leading into the North River adjacent to the FW Webb site. This installation is part of the City's ongoing flood mitigation efforts and when installed will reduce the occasional flooding on bridge Street. As a result, in my opinion, the Board could find that based on all of these factors there is adequate convenience and safety for vehicles and pedestrians." Emphasis added. 108.The details of said purported tide gates, their installation and what is hoped they will accomplish, were immediately requested orally, and subsequently requested in writing, by representatives of the Plaintiffs. 109.Twenty-one days after the July 20, 2017 Planning Board hearing they still have not been forthcoming. 110.Even if said purported tide gates are in fact genuine elements of the City's "ongoing flood mitigation efforts,"the City Solicitor's self-serving and conclusionary statement is hardly a satisfactory or legitimate substitute for the Planning Board's legal responsibility to make competent decisions based on empirical facts. 111.After all, had only one Planning Board Member voted differently on July 20, 2017, Webb/Mcleod's Application would have failed. 112.At a minimum, the Planning Board should have insisted on getting the details of what the City Solicitor was referring to as "the most important fact" she learned from the Salem City Engineer earlier in the day of the Planning Board vote on the evening of Thursday, July 20, 2017, even assuming said assertions were true. 113.For the foregoing reasons alone, the Planning Board exceeded its authority in granting said Special Permit and the July 24, 2017 Flood Hazard Overlay District Special Permit Decision must be annulled in its entirety. COUNT V THERE ARE NO LEGALLY COMPETANT FINDINGS IN SUPPORT OF THE PLANNING BOARD'S JULY 24, 2017 FLOOD HAZARD OVERLAY 14 DISTRICT SPECIAL PERMIT DECISION ON THE KEY ISSUES OF ZONING COMPLIANCE AND VEHICULAR AND PEDESTRIAN MOVEMENT 114.Finding No. 1 in said July 24, 2017 Special Permit Decision is a masterpiece in self- serving, circular, and factually untrue reasoning, when it simply states in unsupported conclusionary terms that "The proposed use will comply in all respects to the uses and provisions of the underlying district in which the land is located. 115.Simply regurgitating the requirement of the Zoning Ordinance is NOT a legally competent factual finding. 116.The same defect is also true with respect to Finding No. 2 as well 117.For the foregoing reasons alone, the Planning Board exceeded its authority in granting said Special Permit and the July 24, 2017 Flood Hazard Overlay District Special Permit Decision must be annulled in its entirety. COUNT VI THE PLAINTIFFS ARE SUBSTANTIALLY AGGRIEVED BY THE PLANNING BOARD'S JULY 24, 2017 FLOOD HAZARD OVERLAY DISTRICT SPECIAL PERMIT DECISION 118.The Plaintiffs have relied on the Salem Zoning Ordinance to protect their property values, their safety, and the enjoyment of their respective properties and their neighborhood. 119.The July 24, 2017 ZBA Decision adversely undermines their property values, their safety, their enjoyment of their properties, and the zoning integrity of their neighborhood. 120.For the foregoing reasons alone, the Planning Board exceeded its authority in granting said Special Permit and the July 24, 2017 Flood Hazard Overlay District Special Permit Decision must be annulled in its entirety. The adjacent lot, 297 Bridge Street, currently a municipal parking lot, will be used for employee and customer parking, tractor trailer access, and exterior storage for products. The Scope of Work is limited to what is stated in the 6 Proposal and Sales Agreement. Furnish and install temporary rooftop chute assembly for debris removal. (Back Roof Only.) Furnish and install proper safety equipment in accordance with Centimark's written safety program. 9 Safety Related Furnish and install warning lines to identified areas associated with ground related roofing activities. Store roofing materials in accordance with good roofing practices. Material placement will be to distribute weight loads throughout the entire roof area. Surface Preparation: Remove and dispose of the existing EPDM and fiberboard insulation down to the original B.U.R. The primary layer of roof will be spot cored for deteriorated/wet insulation. If any is found, it will be removed and replaced at a unit price of $1.25 per square foot per inch of thickness. Areas of removal will be approved by an Owner's representative. (Back Roof Only.) Removal of existing roof will be limited to an amount that can be replaced the same day. (Back Roof Only.) Identify and remove structural deck not capable of providing an acceptable substrate for the installation of the new roof. Furnish and install new deck at a unit cost of$8.75 per square foot per inch of thickness. Areas of removal will be approved by an Owner's representative. Remove and dispose of existing pitch pan(s) as needed. (Back Roof Only.) Remove the existing perimeter termination bar and dispose of debris. (Back Roof Only.) Remove existing wall flashings to a workable surface and dispose of debris. (Back Roof Only.) Insulation Attachment: Furnish and install a layer of V polyisocyanurate insulation, (R-Value = 5.6). This layer of insulation will be mechanically attached to the prepared substrate utilizing FM Global (FM) approved 3" plates and fasteners. Furnish and install a new nailer along the outside perimeter as needed. Furnish and install tapered insulation at the roof drains creating a sump. (Back Roof Only.) System Application: Furnish a CentiMark 60 mil,non-reinforced, EPDM roofing membrane. CentiMark Confidential ® : view instnictional Position the EPDM membrane over the newly prepared substrate and allow the membrane sufficient time to "relax" prior to installation. Fully adhere EPDM membrane to the prepared surface. The seam shall overlap by no less than 4" and be treated with an application of primer wash and sealed with a 4" butyl-based seam tape. 9 Encapsulate the face and top of the parapet wall with the 60 mil EPDM membrane. HVAC,Curbed Penetrations and other Air Handling Unit Details Furnish and install a 6" wide laminated reinforcement perimeter strip at the base of the curb. Fully adhere the EPDM membrane tip the curb using a bonding adhesive. All comers will then be completed with uncured EPDM tubber flashing. Pipes Less Than 6" In Diameter Fumish and install new prefabricated rubber pipe boot secured at the top with a stainless steel screw type clamp fully adhered to the field sheet. 9 Stacks Greater Than 6" In Diameter Furnish and install 60 mil EPDM uncured flashing. Miscellaneous Projections Fumish and install 60 mil EPDM uncured flashing at roof projections. Fumish and install new pitch pan(s)and/or ChemCurb(s) as needed. (Back Roof Only.) New pitch pan(s) and/or ChennCurb(s) shall be installed utilizing mechanical fasteners and/or adhesives and topped with sealant. (Back Roof Only.)
