When I entered the building I was confronted by a homeless individual. Fortunately, the Salem Police . Officer detail was able to take care of the situation. An inspection of the building revealed several openings to the exterior that are not sealed. The masonry deck over the garage area is deteriorated. Most serious is the opening for the circular stairway. The stairs have been removed and the opening is unprotected .The building has no perimeter alarm and/or fire alarm. Per Massachusetts State Building Code 780 CMR, Section 121, 1 am declaring this an unsafe structure. Per 780 CMR, Section 121.3 you have until 12:00 noon tomorrow to begin to remove the building or make it safe. There is no appeal for this order. If you feel you are aggrieved by this order you may seek the remedy prescribed by Mass General Law 139, Section 2 as defined in the State Building Code CMR, Section 121.6. A hearing was held on this appeal on Wednesday , October 2'7 , 19'71, pursuant to rnrices mailed postpaid to the petitioner, abutters , board members , and others , and advertisements published in the Salem Evening News . Members present at this hearing included John M. Gray, William F. Abbott , Arthur Labrecque , and Norman Welch. Petitioner appeared with Mr. ' Hilwig who had prepared the plans ; the case was stated the same as in the original appeal on file ; additional space* is necessary to provide adequate storage facilities ; present business activities would not be substantially increased; the site in question is unused and is presently .of no use to anyone . No one appeared in opposition. The Board members studied the facts presented and found that the location is an ideal site for the business conducted there ; it is in an Industrial zone where density requirements of the Ordinance are substantially greater . clan those required in the business districts ; the Board further found that a hardship could be relieved by granting the variance as requested without derogating from the intent and purpose of the Ordinance and without causing detriment to the public good, and for these reasons voted unanimously to grant this appeal .
