Dear Mr. Townsend, Jr. :
The Metropolitan Boston/Northeast Regional Office, Division of Water Pollution
Control, of the Department of Environmental Quality Engineering is in receipt of a
copy of your variance request, submitted to the Salem Board of Health and dated
July 11, 1986 requesting approval by the Board of Health of three variances to the
provisions of 310 CMR 15.00 (Title 5) of the State Environmental Code. The
variances pertain to the installation of a "Grey Water" leaching area to dispose of
the wastewater emanating from the kitchen sink. The Board of Health has not acted
on these variances but has requested, orally, comments by the Department.
In accordance with the provisions of 310 CMR 15.20: - Variance of Title 5, the
Department does not formally act on variances prior to the granting of the
variances by the Board of Health.
However, in order to provide assistance to the Salem Board of Health, an
engineer has reviewed the plan and data as submitted and comments as follows:
1. The subject site pertains to new construction.
2. The Board of Health has approved, on July 8, 1986,
the construction and use of a privy as a means of
sanitary waste disposal.
3. Due to existing constraints, such as known soil
characteristics, no percolation testing nor deep
observation hole excavations have been conducted.
4. Due to site constraints, no reserve area has been
designated.
5. There apparently is no area on the site that can meet
the requirements of 310 CMR 15.03:(6) which states in
part "Subsurface Sewage Disposal Systems shall be
located in an area where there is at least a 4 foot
depth of naturally occuring pervious soil below the
entire area of the leaching facility.

In addition, be advised that by definition of Title 5, grey water is defined
as sanitary waste and the disposal of such waste must comply with the provisions of
Title 5.

On behalf of Mr. Russell , we hereby request that the Board,
at their meeting on August 12, 1986, grant waivers from the
requirements of Title 5 of the Massachusetts Environmental
Code as follows :
1 . Regulation 3 , Deep Observation Holes and Percolation Test
requirments .
Due to the location, on an Island, and the general soil
classifications (see attached copy of U.S.D.A. Soil Survey)
it is our opinion that such testing will not provide any
new or pertenant information.
2 . Regulation 3 - 3 , 4e Leaching Area Requirements .
It is requested that leaching, for "gray water" only (sink
waste :eater) up to a maximum of fifty (50) gallons per
day be allowed to be disposed of as shown on the attached
plan. (Toilet wastes will be in accordance with the Boards
vote of July 8, 1986, by privy)
3 . Regulation 14, Leaching Trenches
It is requested that the leaching area be allowed to be
constructed as shown, with a depth less than four (4) feet
below the system to impervious strata and that no specified
Reserve Area be designated.
It is Mr. Russells" intention to use the new structure in
the same manor as the present one is being used, (i.e. )
1 . Weekends and vacation periods only.
2 . Water supply by five gallon containers from the Islands
"ddep well ' .
3 . Toilet facilities to consist of privey.

range from 100 to 1,200 feet long. The areas of exposed
bedrock are 10 to 100 feet apart. The surface of the unit
has stones and boulders 1 to 4 feet in diameter that are
10 to 100 feet apart. The unit consists of about 40
percent Chatfield soils, 25 percent Hollis soils, 20
percent exposed bedrock, and 15 percent other soils.

was not practical to map them separately. ^" ^ k • `
Typically, the Chatfield soils have a surface layer of -r.", ., x
very dark grayish brown very fine sandy loam about 1
inch thick. The subsoil is 16 inches thick. It is dark brown
very fine sandy loam in the upper 5 inches and dark
yellowish brown gravelly very fine sandy loam in the 110
lower 11 inches. The substratum is very firm, light olive cm
brown gravelly very fine sandy loam 17 inches thick. ti� { , Bakers
Granite bedrock is at a deoth of ^-' inches. ,o • `Island' A
Typically, the Hollis soils have a surface laver of darks
brown fine sandy loam about 3 inches thick. The subsoil c,°
is dark yellowish brown fine sandy loam about 15 inches \ DD cc
thick. Hard granite bedrock is at a depth of about 18 �
inches. t '
Included with this complex in mapping are small areas y e err
of Canton, Freetown, Montauk, Paxton, Ridgebury,
Swansea, Whitman, and Woodbridge soils.
The permeability of these Chatfield and Hollis soils is
moderate or moderately rapid. Available water capacity
is low or moderate in the Chatfield soils and very low in
the Hollis soils. Reaction in both soils is very strongly
acid to medium acid.
Most areas of this unit are wooded. A few areas are
used for homesites.
The areas of exposed bedrock, the stones and
boulders on the surface, and the slope make this unit
poorly suited to farming. The Chatfield soils are suited to
trees, but the Hollis soils are poorly suited. The stones
and boulders on the surface, the shallow depth to
bedrock in the Hollis soils, the outcroppings of bedrock,
and slope limit the unit for recreational development.
Slope and depth to rock limit the use of these soils as
a site for dwellings, small commercial buildings, septic
tank absorption fields, or shallow excavations.
This unit is in capability subclass Vlls.

Health had, on September 30, 1986 granted variances to the above noted provisions

designated reserve area.

The plan proposes to utilize the existing septic tank, abandon an existing
leaching pit and install a shallow leaching pit for effluent disposal. Due to the
topography of the site, it is physically impossible to install the leaching pit in
compliance with the slope and reserve area requirements. In order to compensate
for the slope requirements, it is proposed to install two clay barriers each of
which is to be faced with a layer of 10 mil. polyethylene sheeting. Additionally,
the new leaching must be placed in an area previously designated as a reserve area.
An engineer of the Department has reviewed the plan and it is the opinion of
the Department that strict enforcement of the provisions of Title 5 would do
manifest injustice to' the applicant and the applicant has proved that the same
degree of environmental protection required under Title 5 can be achieved.
The Department, hereby approves the variances to the provisions of 310 CMR
15.11: Figure 1 and 15.11:8 of Title 5 of the State Environmental Code which have
previously granted by the Salem Board of Health for the subject site:

Basing the decision upon the reviews conducted by an engineer of the DeparnTent,
it is the opinion of the Department that the same degree of Fnviror7-ental Protection
required under Title 5 has neither been provided nor achieved. Therefore, the
Department disapproves the variances granted by the Salem Board of Health for the
subject site.
However, since the Board of Health has previously approved the installation of
a privy to dispose the "Black [-later" emanating from the site, the applicant should
address the feasibility of disposing of the grey water to the privy with the Board
of Health's approval.

the issue concerning the granting of a variance to Keith Russell , Ocean Avenue
on Baker' s Island in Salem.
Our letter of August 13, 1986 (see enclosed) stated that the Board of Health
granted a variance at its monthly meeting on August 12, 1986 and requested
comments from the Mass. D.E.Q.E.
Also, Mr. Townsend of T & M Engineering states in his letter of September 8, 1986
(see enclosed) that he received a letter from you concerning this issue. At this
time the Board of Health respectfully requests that a copy of this letter be sent
to this office.

the variance for the installation of the subsurface disposal system for
Keith Russell, Ocean Avenue on Baker's Island in Salem, MA.
This letter along with the enclosed letter and plan from T & M Engineering
Associates, Inc. is being sent to the department of Environmental Quality
Engineering, Attention Mr. Tom Clougherity, for approval and/or modification.
The variance applies to the State Environmental Code Title 5, Regulation 15.03
Deep observation holes, percolation test requirements, and leaching area re-
quirements, and regulation 15.14- leaching trenches .
We would also like to point out of Mr. Russell that the firm installing the
system must be licensed by the Board of Health prior to start-up. If you
have any questions please call this office at 741-1800.

Dear Board Members ;
On behalf of Mr. Russell , we hereby request that the Board,
at their meeting on August 12, 1986, grant waivers from the
requirements of Title 5 of the Massachusetts Environmental
Code as follows :
1 . Regulation 3 , Deep Observation Holes and Percolation Test
requirments .
Due to the location, on an Island, and the general soil
classifications (see attached copy of U. S . D.A. Soil Survey)
it is our opinion that such testing will not provide any
new or pertenant information.
2 . Regulation 3 - 3 , 4e Leaching Area Requirements.
It is requested that leaching, for "gray water" only (sink
waste water) up to a maximum of fifty (50) gallons per
day be allowed to be disposed of as shown on the attached
plan. (Toilet wastes will be in accordance with the Boards
vote of July 8`, 1986, by privy)
3 . Regulation 14 , Leaching Trenches
It is requested that the leaching area be allowed to be
constructed as shown, with a depth less than four (4) feet
below the system to impervious strata and that no specified p�

• SOIL MAP AND DESCRIPTION
CrD—Chatfield-Hollis-Rock outcrop complex, 15 to from
35 percent slopes. This unit is on ridges and hills. It "SOIL SURVEY OF ESSEX COUNTY
consists of well drained, moderately deep Chatfield soils; '
somewhat excessively drained, shallow Hollis soils; and MASSACHUSETTS-SOUTHERN PART"

range from 15 to 1,250 acres. Slopes are complex and U. S. DEP.OF AGRICULTURE
range from 100 to 1,200 feet long. The areas of exposed
bedrock are 10 to 100 feet apart. The surface of the unit
has stones and boulders 1 to 4 feet in diameter that are
10 to 100 feet apart. The unit consists of about 40
percent Chatfield soils, 25 percent Hollis soils, 20
percent exposed bedrock, and 15 percent other soils.
The soils anc exposed rock are so intermingled that it \
was not practical to map them separately. f
Typically, the Chatfield soils have a surface layer of
very dark grayish brown very fine sandy loam about 1 fit
inch thick. The subsoil is 16 inches thick. It is dark brown + ,
very fine sandy loam in the upper 5 inches and dark 0' a
yellowish brown gravelly very fine sandy loam in the
lower 11 inches. The substratum is very firm, light olive ` , V ac u
brown gravelly very fine sandy loam 17 inches thick.• ' w <q Bakers;-
Granite bedrock is at a depth of 34 inches. `_ tie ' Island`¢�
Typically, the Hollis soils have a surface layer of dark. ea
brown fine sandy loam about 3 inches thick. The subsoil Yak .`w CrD
is dark yellowish brown fine sandy loam about 15 inches c D CIC -
thick. Hard granite bedrock is at a depth of about 18
inches.
Included with this complex in mapping are small areas
of Canton, Freetown, Montauk, Paxton, Ridgebury, p`� t ,.;.�* x"
Swansea, Whitman, and Woodbridge soils. '"'r ,

The permeability of these Chatfield and Hollis soils is
moderate or moderately I'apid. Available water capacity
is low or moderate in the Chatfield soils and very low in
the Hollis soils. Reaction in both soils is very strongly
acid to medium acid.
Most areas of this unit are wooded. A few areas are
used for homesites.
The areas of exposed bedrock, the stones and
boulders on the surface, and the slope make this unit
poorly suited to fafming. The Chatfield soils are suited to
trees, but the Hollis soils are poorly suited. The stones
and boulders on the surface, the shallow depth to .
bedrock in the Hollis soils, the outcroppings of bedrock,
and slope limit the unit for recreational development.
Slope and depth to rock limit the use of these soils as
a site for dwellings, small commercial buildings, septic
tank absorption fields, or shallow excavations.
This unit is in capability subclass Vlls.

Dear Sir:
The Metropolitan Boston/Northeast Regional Office, Division of Water Pollution
Control , of the Department of Environmental Quality Engineering is in receipt of
your letter, dated April 10, 1986 with enclosures , requesting comments *by the
Department relative to the use of a "Humus 80" toilet as a means of sanitary waste
disposal for a reconstructed dwelling at the subject site.
An engineer of the Department has reviewed the data and it is the opinion of
the Department that the "Humus 80". system should be classified as a Humus toilet as
defined under the provisions of '310 CMR 15.01 of Title 5 of the State Environmerta'
Code. This Regulation defines a Humus toilet as "A self-contained toilet from
which no liquid or solid waste materials are regularly discharged and from which a
Humus-Like end product is discharged.
Based upon the above, it is the further opinion of the Department that in
accordance with the provisions of 310 CMR 15.17:1, approval for construction anc/or
installation of the "Humus 80" system is remanded to the Salem Board of Health and
no action by the Department is required.

the Department shall approve innovative disposal systems if it can be
demonstrated that their impact on the environment and hazard to
public health is not greater than that of other approved systems. No 7
variances to this regulation shall be granted.
(2) Drains. No rain water leader, cooling water drain, cellar drain,
or OtH—er—Trami other than one for sanitary sewage shall discharge into
or be connected with any sewage disposal system.

expire at the end of the year in which they are issued unless earlier
revoked for cause by the Board of Health.
(3) Seotage Handlers Permit. No person or firm shall engage in the
pumping or transport or the contents of any part of an individual
sewage disposal system without first obtaining a Septage Handler's
Permit from the Board of Health, in accordance with G. L. c. lii, s.
31A. The application for such permit shall state the site of he dis-
posal, and such site and method of disposal must have been approved
by the Department of Environmental Quality Engineering, regardless of
the stated volume of material disposed of at that site. Such permits
shall be contingent upon compliance with 310 CNIR 15.ig(1) arta shall
expire at the end of the year in which :.he; are issued uniess earlier
revoked for cause. 1 list of permits issued shall be submitted to the
appropriate regional office of the Department of Environmental Quality
- Engineering at the beginning of each calendar year.
(4) M licaton for Disposal '.forks Construction Permit. An applica-

Board of Health and must be accompanied by a plan of the proposed
sawage disposal faciiites. Such permit shall be invalidated if condi-
tons different than those set forth iR ".he application are found prior
to or during actual construction of the individual sewage disposal
system. In any event, a permit so granted shall expire two years
from the date of issue unless construction of the system of individual
sewage disposal is begun before the expiration date or unless this
Title has been revised.
(5� Plan of Sewage Disposal Svstem. The submitted plan must show
as a minimum: the tot to be served, location and dimensions of the
system (including reserve area), design calculations, existing and
" proposed contours, location and log of deep observation hoies, location
and results of percolation tests, location of any streams, surface and
subsurface drains and wetlands within 100 feet of the sewage disposal
system, known sources of water supply within 200 feet of the sewage
disposal system, location of any proposed well to serve the lot, loca-
tion of water lines on the property, maximum ground water elevation in
the area of he sewage disposal system, and a profile of the system.
The plan must be prepare by a Professional Engineer or other oro-
fessionai authorized by law to prepare such pians.
(6) Use. The use of an individual sewage disposal system shall be in

Please note that at the time of sampling, sample 119" was the
p only sample meeting drinking water standards. Most samples
show gross bacteriological contamination and should not be
used for drinking or cooking.
